      The victim should have got a B rating...just because you CAN do what he did, doesn't mean you SHOULD do what he did. He did escalate things instead of co-operating like most eyewitnesses or victims. Again his legal right, but it serves no positive purpose. For such an upstanding member of his community, he should have done better and could have avoided all this. He was looking for an excuse to sue hoping the cops would mess up which is easy for cops to do with poor training in combination with confusing, vague and contradictory laws

    Cops need to carry liability insurance so the taxpayers won't have to pay the settlements. Make having liability insurance a condition for employment. If a particular cop racks up too many payouts. He can't get a policy

      I'm not sure this actually saves anyone money. Cops salary would increase significantly to compensate for this and they would be so worried about losing that insurance they would not arrest actual criminals.

      @Enrique Perezarce Whatever the laws are for that region, in regard to giving ID, is irrelevant. He was searching through her wallet, and that is in clear violation of her 4th Amendment rights. Those rights supersede any local ordinance or law.

    As a retired LEO this makes me sick. He’s initially identified as a potential victim not a suspect. I can’t remember ever handcuffing a suspected victim in my whole career.

      Well, sort of? That's the problem right? This happens everywhere. Everyone knows about. Everyone turns a blind eye. Then they say that you can't hold me responsible. But you were part of the system. You knew bad things happened and innocent people jailed or imprisoned... or just the simple racial profiling at traffic stops. So it's hard, right?
      Like, from perspective, you could jail me for nothing, lie to my face about the evidence you had, lose the recording of the encounter, and send me in front of a judge months later on very serious and fake charges. Nothing bad would happen to you. My life would be ruined. Now did you do that? No. But I guarantee people you worked with did. And that seriously sucks because it does tarnish your work.

      Yes, LEO's, courts, politicians and media all collude to protect one another. There's just as much a percentage of dirty judges as there are dirty cops.       Often we hear supervisors or higher-ranking officers directly tell the cops "CYA" (=Cover Your As..hley) when they KNOW they have violated someone's rights, etc. AND they realize the person is not likely to stay silent and forget it happened!
      CYA doesn't mean: Make it right, apologize, or own your mistakes? HELL NO!
      It's the direct opposite. NEVER EVER ADMIT ANY WRONGDOING!
      When they even dare to say "CYA", loud and clear, when their bodycam+audio is on, tells us how little they care people will see and hear the recordings and they open display of their corruption, as they have a high degree of "QI"
      No, not a high IQ, but QI = Qualified Immunity! = 99,9 5 above the law!

      He had no warrants , then they look for another reason. These cops act like any person in public is supposed to run up to the police with identification in hand. They put him in cuffs and render his ability to hand over identification impossible, he voluntarily told them where to find it and gets arrested for obstruction. These cops need to be fired and sued for violation of the fourth amendment.

They tried to say it's obstruction because he didn't give it to them voluntarily before being handcuffed, even though they handcuffed him after about 5 seconds and he literally told them which pocket his wallet was in, implying consent to take his ID. They get paid to just make shit up and it's so infuriating.

      He didn't identify himself with his mouth, so that "doesn't count". 🙄 (What if he was deaf/mute/autistic/maimed/etc? 🤨) He also asked if he handed him the wallet or the cop took it. The cop took it, so that "doesn't count" (the guy was cuffed, so he COULDN'T hand it to the cop 😒).

      Even if "complicance" MIGHT be the best way to resolve the situation in your favor for now, that system has your rights and existence placed at the behest of the police and government, NOT the other way around.
      Standing up for your rights is the only way to make sure you have them in the long run, and videos like this prove time and again that law enforcement doesn't have a proper attitude, nor proper training, about respecting and protecting your rights.

      @@zaksmith1035 You can see it's the supervisor that was the actual driving force behind this too. Although it was one of the beat cops that nicked him first, his supervisor took it to 100 real fast, and was clearly encouraging his officers to follow this kind of behaviour, even if they weren't like that before (which is why forces are soo messed up sometimes).
      You notice how one pulls him and cuffs him, then the other arrests him when not being there originally. This is for plausible deniability later. First one can say "I didn't arrest him, I just detained him", and second one can say "well I arrested him as I was under the impression x happened, but wasn't there, I was told" etc. This makes it more difficult to find either officer guilty of an actual crime, as the two actions that combined to make this a 100% illegal arrest happened each by a different officer, one not present at the time of the first action. This is why body camera's are SO important, as you get to see them collude without saying much (although in this they say just enough to get some real trouble in court I think).

      @@germanythroughlens7274 it's unfortunately qualified immunity which is federal law and these gang members all suck each other off so they do in house investigations (which should be illegal) and will deem most actions to not violate constitutional rights. And if they do and immunity is stripped away, the cop usually will appeal the judgment and will sent the case to another court room. It's our shitty system at work and they are all buddies

    They never asked him to identify himself. They said, do you have an ID in your pocket and he said yes. They took his wallet. There's no charge here. Only failure to be good officers.

    Judge should also get an 'F' for keeping case under advisement, rather than throwing it out. Sounds like the judge, police and prosecutor are trying to set up Mr. James for a future arrest so they can re-open this case.

I've seen some where they're _friends._ 😒 The constitution specifically says a SPEEDY TRIAL. (They'll try to waive it off as not their fault because they're just swamped with too many cases, which is NOT a defense, if anything that just shows HOW MANY people they harass and harm with so many cases. 🤦)

    “Under advisement for a year”….that means it’s an open case on his record. Any time someone runs a background check, it will be there for them to see…and JUDGE him.       It's not even legal because that's a secondary-charge, you can't apply that without a primary charge, which there isn't. This is tantamount to arresting someone for no reason, then when they ask why they're being arrested, saying for "resisting arrest" by asking, or for charging someone for escaping prison after they've been exonerated and proven that they never should have been in prison in the first place. 😠

These days its that much more easier to have a successful lawsuit against a cop, and a small portion of the compensation owed to you will be paid by the cop if you involve the cop in the lawsuit personally (and not just his department or his city). A lot of people don't care at all, and a disturbing number of people actually support this kind of behavior because they think it's limited to people they don't like or they think it will mainly be experienced by people they don't like.     When a cop says that they're using something to "justify" an arrest, you know those cops should be fired. I had a very similar situation. I was the victim, yet my attacker, who attacked me in my own house, where she was not welcomed, was not arrested and I was arrested for defending my life. In my own house. This woman also broke in my door to get to me, and that was recorded on the 911 call. In fact, all the evidence supported her being the attacker. Including witnesses. This was in Canada. My charges were just dropped in November, after I said no to every deal they offered. I should have never been arrested. Due to the stress of being arrested, as well as them forcing me to move, I had severe health issues. I had been fighting chronic kidney disease for 15 to 20 years. After the attack in the rest my kidneys tanked, and I am now on dialysis. Not only that, I could not do the more beneficial form of dialysis at home, because I was kicked out of my residence.

      A few years ago a lawyer was arrested for obstruction for not answering the cops questions about why she was pulled over. He arrests her for not answering questions, only to read her her right to remain silent.

      It's called Pissing Off the Police. They always tell you that you might beat the charge but you will take the right. The arrest itself and detaining at jail, that makes people lose their jobs and shit IS the punishment for not cooperating. Because cops know that their bosses won't discipline them for false arrests and DA's often look the other way.

      This is one of my biggest issues. When cops show up they split everyone up to get the right story but cops never get arrested before they get questioned so they have all the time in the world to get their stories straight. I'm so sick of this feeling I get when I think about all the injustice people have faced when body cams couldn't be used to get to the truth, and that's only a fraction of the way innocent people are wronged my government officials.
      A cop's testimony should be as valuable as any one else's or even less valuable because they're less likely to be charged with perjury if they're caught lying.

      I feel unions are vital though. In any industry.
      Idk I'm thinking about joining law enforcement and I see why there needs to be a union. We only see them in the big cases where someone dies, but mostly it's the internal things they help with. Problems with hours, wrongfully fired (like firing people before they qualify for pension).
      Idk if anyone wants to form a union at there work they should be allowed.
      It's more the extent some of these unions go to save the city money, rather than having the officer take blame for there mistakes. It's sick that happens

      If you watch alot of these videos... Obstruction is litterly the number 1 turn to for false arrest.
      You don't have idenitify or answer questions acording to your laws and rights? OBSTRUCTION.
      Didn't get out of the car during a Terry stop when asked though it's not lawfully required? OBSTRUCTION.
      Refusing to take a test to see if you are drunk and asking to go to the hosptial for testing? OBSTRUCTION.
      Not being polite to an officer? OBSTRUCTION.
