The victim should have got a B rating...just because you CAN do what he did, doesn't mean you SHOULD do what he did. He did escalate things instead of co-operating like most eyewitnesses or victims. Again his legal right, but it serves no positive purpose. For such an upstanding member of his community, he should have done better and could have avoided all this. He was looking for an excuse to sue hoping the cops would mess up which is easy for cops to do with poor training in combination with confusing, vague and contradictory laws

Often we hear supervisors or higher-ranking officers directly tell the cops "CYA" (=Cover Your As..hley) when they KNOW they have violated someone's rights, etc. AND they realize the person is not likely to stay silent and forget it happened!

Even if "complicance" MIGHT be the best way to resolve the situation in your favor for now, that system has your rights and existence placed at the behest of the police and government, NOT the other way around.
Standing up for your rights is the only way to make sure you have them in the long run, and videos like this prove time and again that law enforcement doesn't have a proper attitude, nor proper training, about respecting and protecting your rights.

@@zaksmith1035 You can see it's the supervisor that was the actual driving force behind this too. Although it was one of the beat cops that nicked him first, his supervisor took it to 100 real fast, and was clearly encouraging his officers to follow this kind of behaviour, even if they weren't like that before (which is why forces are soo messed up sometimes).
You notice how one pulls him and cuffs him, then the other arrests him when not being there originally. This is for plausible deniability later. First one can say "I didn't arrest him, I just detained him", and second one can say "well I arrested him as I was under the impression x happened, but wasn't there, I was told" etc. This makes it more difficult to find either officer guilty of an actual crime, as the two actions that combined to make this a 100% illegal arrest happened each by a different officer, one not present at the time of the first action. This is why body camera's are SO important, as you get to see them collude without saying much (although in this they say just enough to get some real trouble in court I think).

They tried to say it's obstruction because he didn't give it to them voluntarily before being handcuffed, even though they handcuffed him after about 5 seconds and he literally told them which pocket his wallet was in, implying consent to take his ID. They get paid to just make shit up and it's so infuriating.
He didn't identify himself with his mouth, so that "doesn't count". 🙄 (What if he was deaf/mute/autistic/maimed/etc? 🤨) He also asked if he handed him the wallet or the cop took it. The cop took it, so that "doesn't count" (the guy was cuffed, so he COULDN'T hand it to the cop 😒).
The fact that they can detain you and put you in handcuffs and force you to talk to them is mindboggling to me.

@Enrique Perezarce Whatever the laws are for that region, in regard to giving ID, is irrelevant. He was searching through her wallet, and that is in clear violation of her 4th Amendment rights. Those rights supersede any local ordinance or law.

They put him in cuffs and render his ability to hand over identification impossible, he voluntarily told them where to find it and gets arrested for obstruction. Cops need to carry liability insurance so the taxpayers won't have to pay the settlements. Make having liability insurance a condition for employment. If a particular cop racks up too many payouts. He can't get a policy

I'm not sure this actually saves anyone money. Cops salary would increase significantly to compensate for this and they would be so worried about losing that insurance they would not arrest actual criminals.

As a retired LEO this makes me sick. He’s initially identified as a potential victim not a suspect. I can’t remember ever handcuffing a suspected victim in my whole career.

@@germanythroughlens7274 it's unfortunately qualified immunity which is federal law and these gang members all suck each other off so they do in house investigations (which should be illegal) and will deem most actions to not violate constitutional rights. And if they do and immunity is stripped away, the cop usually will appeal the judgment and will sent the case to another court room. It's our shitty system at work and they are all buddies

These days its that much more easier to have a successful lawsuit against a cop, and a small portion of the compensation owed to you will be paid by the cop if you involve the cop in the lawsuit personally (and not just his department or his city). But don't quote me on that, the part about cops paying is what I have been reading on from recent cases.
Eligible voters are ultimately responsible for our governments. As a group, we haven't cared enough to demand positive policing reform. A lot of people don't care at all, and a disturbing number of people actually support this kind of behavior because they think it's limited to people they don't like or they think it will mainly be experienced by people they don't like. People can also become law enforcement officers and run for political offices themselves. Not taking responsibility for our governments isn't going to improve anything.
This gentleman will have to wait for a full year to deal with a bogus charge! There will hopefully be pain and suffering damaged paid to him in a civil suit. Any kid can see through what they did.

He was handcuffed before being asked for his ID, so the officer later stating that not voluntarily showing his ID was obstruction, is just making up charges as they go.

Judge should also get an 'F' for keeping case under advisement, rather than throwing it out. Sounds like the judge, police and prosecutor are trying to set up Mr. James for a future arrest so they can re-open this case.
Absolutely. I've seen far too many cases where the prosecutors and judges are just as corrupt as the cops. I've seen some where they're _friends._ 😒 The constitution specifically says a SPEEDY TRIAL. (They'll try to waive it off as not their fault because they're just swamped with too many cases, which is NOT a defense, if anything that just shows HOW MANY people they harass and harm with so many cases. 🤦)

“Under advisement for a year”….that means it’s an open case on his record. Any time someone runs a background check, it will be there for them to see…and JUDGE him. So they control his life for a whole year because these cops got their feelings hurt by someone that knew their rights. Real nice.

He was walking down the street doing nothing at all and they had him in cuffs under 15 seconds. He didn’t even have a chance, but they just assumed it was him right away.
They arrested him as soon as they reached him, they didn't investigate at all, they didn't check if he has a weapon, they didn't do anything, cuffs first, ID second. 😒 They never actually checked for a weapon AT ALL. 🤦

Clearly showing on camera that they had no reason to detain or ID him prior to obtaining information from the young lady. This women even said she saw him running. I don't know to many people that don't run and duck for cover when bullets start flying. So now we arrest people for protecting themselves?? I heard what the women said and I emmediately thought " OK, so he was running from gun fire! where is the crime in that"?. Most cops go on a power trip when people refuse to talk to them or show ID. It's the same old same old.

Idk I'm thinking about joining law enforcement and I see why there needs to be a union. We only see them in the big cases where someone dies, but mostly it's the internal things they help with. Problems with hours, wrongfully fired (like firing people before they qualify for pension).

This is one of my biggest issues. When cops show up they split everyone up to get the right story but cops never get arrested before they get questioned so they have all the time in the world to get their stories straight. I'm so sick of this feeling I get when I think about all the injustice people have faced when body cams couldn't be used to get to the truth, and that's only a fraction of the way innocent people are wronged my government officials.
A cop's testimony should be as valuable as any one else's or even less valuable because they're less likely to be charged with perjury if they're caught lying.
This is why I don't judge those who pop off at police at the beginning of an interaction. It's self defense at this point.

They respond to a call about a shooting, approach who they think is the victim, detain him, look for warrants on him, then ask a witness to give something that'll justify detaining him, and then arrest the alleged victim.
