I saw a video where an ATF agent went to a house to get a firearm from someone and the person inside, did an open the door and called the police saying a man was trying to break in. The cops came and handcuffed the agent at gunpoint and put him in the car. 😂 that citizen was smart because she took the heat off herself

Sadly this is facts. I had an employee try to steal my car from a dealership because his boss wanted to talk to me. So I left. The cops heard "car and stolen". They put me in handcuffs ane were going to charge me for stealin my own car. Finally a supervisor explained to the cops what happened. Cops are useless.

Unfortunately in the IRL streaming community its not uncommon for streamers to have fake SWAT or 911 calls to their houses, sometimes its encouraged by streamers because they aren't aware of how dangerous it could be for them, just wanna keep up the engagement. I definitely don't think that these streamers deserve half the attention that they end up receiving because they teach their audience some real dangerous shit but there's still little justification for putting peoples lives in danger and wasting resources like this..

Something a lot of people don’t realize is the first amendment applies to recording in a public place MOST of the time (some federal building or military bases and earlier mentioned with cops being a grey area) But this wasn’t in a public place, this was on his property, which allows him to record or livestream 100%. They own the land they are standing on the officers don’t have any right to tell you to not film, record or stream on your own property.

I know it was incredibly frustrating to watch him just get arrested and dragged out of his own backyard but in their defence they showed up to a call with a reported violent person who had a gun. The reason officers withhold information like this is to control the persons reactions and avoid escalating a situation. They are trained to wait until a person is detained, removed from the situation at hand and read their rights before they begin to investigate. They certainly could’ve done better and I think that starts with a long conversation about what swatting is. However, they also could’ve kicked in his gate, drew their guns on him and screamed at him to get on the ground and then before he can think, dog piling him like a highschool football team. And they wouldn’t have faced any consequences. It’s important to remember the officers aren’t the ones taking the 911 calls. We have no idea how information is relayed from dispatchers to officers. But one can imagine that calls about suicidal/homicidal people with guns are taken very seriously. I certainly agree that it could’ve gone better but the point is, there are many different ways this could’ve gone. I’m just hopeful that it will go better in the future and this will serve as a lesson to the entire department on what “swatting” is.
Their excuse for not immediately explaining, is to secure the situation first and explain later, which I believe has to change. They want to first comply and then they will explain. Their are alot changes that need to happen in policing.

Cops tell the RUclipsr that they are on his side,while handcuffing him immediately , keeping him in handcuffs, not telling him why, not allowing him to say who he is, and putting him in the squad car. How is that, apparently being on his side?
I want to see speed react to this video, he'd be so happy. Creators like him are the key to spreading the word around how this scare tactic trolls use against streamers are the absolute gruesome thing that can be done to another human. I'm grateful this ended the way it did and didn't escalate once the officers finally understood eventually what was going on in their thick skulls.

Hey ATA, swatting is a very serious and heinous act plaguing modern online content creators on many platforms. I'm glad you're covering this topic, and the content of this video is just as amazingly presented and incredibly well researched as all your other videos. However I would request in the future that incedents of swatting don't get referred to as "pranked" in the official titles. "Cops Handcuff Famous RUclipsr During A Swatting Incident" or some variant of that would be more accurate, and wouldn't portray swatting using the same classification as harmless practical jokes.
I like ATA, but it's not great sometimes. For example, in this video he cites reference to filming in public while not understanding that they were all in his fenced backyard and therefore the entire "film in public" analysis is entirely irrelevant. It would also be fully unreasonable to assume that someone cannot film the goings on involving them in their own yard.
So many things wrong with this video. 1) It's 2022 and none of the officers know what swatting is?? 2) If they did think he was going to "harm himself" why are they treating him like a criminal who is lying and committed a crime?? @@toobier there have been literal major news network coverage of swatting so any suggestion of their age preventing them from knowing the term "swatting" falls flat. They should know what it is full stop. Edit: just to make sure I'm not crazy and there has been plenty of coverage utilizing the term swatting I spent 2 minutes typing "swatting fox news" and looking at the results and even checking two videos where the term is outright said and spelled within the video. Fox news demographic tends to run older on average so there's just no excuse to act like it's normal for the cops to not know the term swatting. I'm not saying they should automatically believe the RUclipsr, but at least they should be aware of the damn term and respond appropriately confirming that awareness.

In a lot of other countries the police will first call the house to verify if something is wrong before sending in the excessive force. That is why you dont hear as much about there being mass SWATTING going on in other countries, except in the US

It’s actually common police protocol for them to withhold the reason you’re being detained until they handcuff you. If they say “you’re being arrested for attempted murder”, or something like that, the suspect might try to flee.

@@FudgethePudge You are correct, it is a common practice, but their rationale is stupid, "if you tell a suspect he is arrested for murder he might try to flee", but the issue is if the suspect did commit murder he already knows it and probably would try to flee without being told what is going on. On the other hand I doubt there would be many if ANY suspects that didn't commit murder that would try to flee from police after police say they are there to arrest him for murder.
"You need to calm down" is a surefire way to ensure that someone doesn't calm down. In my view, it's often the first step on the path to claiming someone was noncompliant, which will justify charges for assaulting an officer and resisting arrest -- the "go to" when the cops have no real crime for which to arrest someone.

I wish the actual author of ATA had never stopped his narration of his own videos....I thought he was just fine. So, trying to say whether or not livestreaming is protected by the 1A as a form of media is troubling. A news organization doing live scene reports verses is the same as anyone else streaming from their phones.

To be fair. He was never under arrest. He was being detained in which there is a distinct difference between the two. Second, under the red flag laws in Ohio, law enforcement has a right to detain, investigate, and search any individual who has had a report submitted against them without a warrant, or without verifiable proof until the incident can be determined otherwise.

THIS right here! Livestreaming IS recording! It's just recording to someone else's storage device, thus increasing the reliability/integrity of the recording. What if the (local) device fails, or is broken, etc? Evidence lost. "The cloud" doesn't suffer from that type of single point of failure.
No the issue with live streaming it is the live part. It gives anyone who's watching detailed information about the location of the officers and what will the officers might do next.

I honestly don't know how to feel about this statement... On one hand, livestreaming is essentially momentary recording "with extra steps", so I can see how it could be treated similarly if done in a public space. Bear in mind that not all streaming is saved and preserved as a video record that can be used in court. On the other hand, broadcasting information in real time during an investigation could alert hostile individuals to that exact location to cause interference or worse. For example, a legit criminal streamed a police interaction to his friends, the ones on the receiving end could coordinate to extract this person from police custody in a more readily available (and possibly violent) manner. Severing communication can also prevent fake stories from matching up if multiple suspects are involved. Should be interesting to see how the court views it...

@@Mateoski97 Except in the latter case (recording), the courts have ruled that it's a protected activity (1st Amendment). They haven't ruled on "streaming live" part, and there have been rulings in the lower courts explicitly stating that there might be a difference. You just don't want to give LE an excuse to grab your recording device and turn it off. You want to leave more options open in your favor if this goes to the court.

A police officer ending or asking the livestream ended on public property is a thing but they entered a private property and that’s a complete different thing.

I've been swatted before.. Its a scary a very situation. I was afraid one of them was going to shoot me, my brother, or one of the animals I had at the time. ( My brother was visiting me when they busted down the door. ) What was shown in the video was very light compared to what I got, and what I know has happened to others.. The people who swatted me told them I was making bombs and also told others I had hostages.. My brother ended up having a heart attack during this.. In my opinion, those who swatted others need to be charged for attempted murder, one count for each person that was there who was swatted. They also should be charged with animal cruelty if there are any animals there that could have potentially been harmed due to the swatting.. And IF anyone dies due to that swatting.. That person needs to be fully charged for murder. Because that is exactly what they are trying to do when they swat someone.

I think there may be a certain danger introduced if live streaming is to be allowed during traffic stops. Anyone watching would know the exact location of the stop and thus could potentially go to the scene and cause harm to the officers or try to intervene. That is the only reason that makes sense to me, as to why it may not be protected.

The sheer length these officers took to "figure this out" was a clear indication of their intelligence level. Given the the facts clearly visible and explanation given by both boys a separate times it was obvious nothing illegal was happening
A person has to be either completely brainless or simply pure evil to "prank" someone by swatting them. Either they're so stupid that they don't understand the danger of it, or they're simply that malicious and do wish for the victim to get killed.
Most if not all “swattings” are done out of hate/dislike for the streamer/RUclipsr. For example the guy that has “swatted” Adin Ross, another very popular streamer, straight up told him he would do it again until he stops bringing black people onto his stream.

You mention the lack of consensus in rulings on filming LEOs in public in the 6th circuit, BUT this was on PRIVATE property, not in public. The streamer still has the right to film anything on their property.
They never do. And they can hold you and not tell you for up to two days before bringing you in front of a judge. Only at arraignment do they have to tell you.
If the cops would stop long enough to let him speak they could have simply cleared it up, but they insisted on taking him to a car and creating a huge scene. Once he was in cuffs they could have deescalated and let him explain his side. They took an anonymous callers word over everyone at the scene.

Law enforcement won't even pursue most fraud cases across state lines because the investigator with the victim doesn't get the collar for the perp in another state - they aren't going to pursue swatting for the same reason.

I would honestly be so confused if guys dressed in uniform just randomly walked into my backyard and started trying to put me in handcuffs. It was really weird the way they handled that. Sometimes I have to wonder if cops actually WANT you to freak out, so they have an excuse.

On paper LEOs supposedly need a warrant to enter private property, but on youtube time and time again we see LEOs going onto private property, start giving orders, start handcuffing people while refusing to explain to anyone what is going on. To me common sense would dictate if you have a search warrant the people being searched should be given enough time to read the warrant to make sure it is legit. And when LEOs have to go in without a warrant they should be ready to explain what is going on BEFORE they start giving orders and handcuffing people.

The issue is that live streamers dont immediately end their stream as soon as they relaise they are being swatted. It would take the fun out of it if you didnt get to watch your misdeed unfold. Afterall why set a building on fire if you dont get to watch it burn down.

you don't need a warrant to enter a private property if there is reasonable suspicion that anyone is in immediate danger. Same goes for the handcuffs he was not arrested he was just detained for the officer's safety. While he should have been released earlier, there's nothing here worth suing :)
They got a call of a ongoing murder/suicide, that requires no warrant. The cuffing was fully legal since the caller said he would harm himself and other people. I understand that it's tough to understand basic legal procedures in the 21st century where it's cool and hip to hate police, but you don't have to exaggerate.

The initial detainment was fine, but after they learned it was a swatting incident they should not have put him in the squad car. He should have been released at that point and treated like the victim he was.

I think a point you didn't bring up is this was not in public but on private property. If an officer can legally make you stop streaming can they also demand you deactivate your ring doorbell or other cameras around your property that are also connected to the internet?

They had to. They got a call that he was armed and ready to harm others, so they have to be cautious. That's the rules they have to follow as a police officer as to make sure he's not dangerous. Whether or not they know his streams, its mandatory as police. If you see police raiding streamers, you can see that even though its obvious a fake call was made, they still have to detain them just in case
I feel like the rationalization in this case - while arguably not a justification - is that the responding officers felt secure in the swatting nature of the call and exercised an overabundance of caution to protect against the possibility they were wrong.
Yeah, people keep saying that the cops were just trying to arrest him and treat him like a criminal, but I really didn’t get that sense. From the start, the first officer seemed to be trying to remain calm and secure the person so that he couldn’t harm himself. I don’t know if every single thing they did was correct, and they definitely need more training, but I don’t think they had any malicious intent. I’m usually against the cops in this channel’s videos, but some people are a bit overboard with the hate in the comments on this one.

Unfortunately in the IRL streaming community its not uncommon for streamers to have fake SWAT or 911 calls to their houses, sometimes its encouraged by streamers because they aren't aware of how dangerous it could be for them, just wanna keep up the engagement. I definitely don't think that these streamers deserve half the attention that they end up receiving because they teach their audience some real dangerous shit but there's still little justification for putting peoples lives in danger and wasting resources like this..

Something a lot of people don’t realize is the first amendment applies to recording in a public place MOST of the time (some federal building or military bases and earlier mentioned with cops being a grey area) But this wasn’t in a public place, this was on his property, which allows him to record or livestream 100%. They own the land they are standing on the officers don’t have any right to tell you to not film, record or stream on your own property.

Bad take and bad reason
I know it was incredibly frustrating to watch him just get arrested and dragged out of his own backyard but in their defence they showed up to a call with a reported violent person who had a gun.
The reason officers withhold information like this is to control the persons reactions and avoid escalating a situation. They are trained to wait until a person is detained, removed from the situation at hand and read their rights before they begin to investigate.
They certainly could’ve done better and I think that starts with a long conversation about what swatting is. However, they also could’ve kicked in his gate, drew their guns on him and screamed at him to get on the ground and then before he can think, dog piling him like a highschool football team. And they wouldn’t have faced any consequences.
It’s important to remember the officers aren’t the ones taking the 911 calls. We have no idea how information is relayed from dispatchers to officers. But one can imagine that calls about suicidal/homicidal people with guns are taken very seriously.
I certainly agree that it could’ve gone better but the point is, there are many different ways this could’ve gone. I’m just hopeful that it will go better in the future and this will serve as a lesson to the entire department on what “swatting” is.

Hey ATA, swatting is a very serious and heinous act plaguing modern online content creators on many platforms. I'm glad you're covering this topic, and the content of this video is just as amazingly presented and incredibly well researched as all your other videos. However I would request in the future that incedents of swatting don't get referred to as "pranked" in the official titles. "Cops Handcuff Famous RUclipsr During A Swatting Incident" or some variant of that would be more accurate, and wouldn't portray swatting using the same classification as harmless practical jokes.

So, trying to say whether or not livestreaming is protected by the 1A as a form of media is troubling. Any judge that decides live streaming is a "safety issue" is abhorrent to the Constitution, and a disgrace of an American.
I honestly don't know how to feel about this statement...
On one hand, livestreaming is essentially momentary recording "with extra steps", so I can see how it could be treated similarly if done in a public space. Bear in mind that not all streaming is saved and preserved as a video record that can be used in court.
On the other hand, broadcasting information in real time during an investigation could alert hostile individuals to that exact location to cause interference or worse. For example, a legit criminal streamed a police interaction to his friends, the ones on the receiving end could coordinate to extract this person from police custody in a more readily available (and possibly violent) manner. Severing communication can also prevent fake stories from matching up if multiple suspects are involved.
Should be interesting to see how the court views it...

They haven't ruled on "streaming live" part, and there have been rulings in the lower courts explicitly stating that there might be a difference. You just don't want to give LE an excuse to grab your recording device and turn it off. You want to leave more options open in your favor if this goes to the court.

I've been swatted before.. Its a scary a very situation. I was afraid one of them was going to shoot me, my brother, or one of the animals I had at the time. ( My brother was visiting me when they busted down the door. )
What was shown in the video was very light compared to what I got, and what I know has happened to others.. The people who swatted me told them I was making bombs and also told others I had hostages.. My brother ended up having a heart attack during this..
In my opinion, those who swatted others need to be charged for attempted murder, one count for each person that was there who was swatted. They also should be charged with animal cruelty if there are any animals there that could have potentially been harmed due to the swatting.. And IF anyone dies due to that swatting.. It is frightening the courts don’t allow live streaming as a protected first amendment activity.
I think there may be a certain danger introduced if live streaming is to be allowed during traffic stops. Anyone watching would know the exact location of the stop and thus could potentially go to the scene and cause harm to the officers or try to intervene. That is the only reason that makes sense to me, as to why it may not be protected.

A person has to be either completely brainless or simply pure evil to "prank" someone by swatting them. Either they're so stupid that they don't understand the danger of it, or they're simply that malicious and do wish for the victim to get killed.
Most if not all “swattings” are done out of hate/dislike for the streamer/RUclipsr. For example the guy that has “swatted” Adin Ross, another very popular streamer, straight up told him he would do it again until he stops bringing black people onto his stream.
On this one, I'm tempted to go along with the version where this dude actually made that call himself.
Something does not sit well with the way it does feel in their reaction like they were expecting the cops to show up.
And, his line about "I am famous"??? Who finds oneself in handcuffs and goes... "I am famous"??? And he does a victory dance when he's released?? really??

You mention the lack of consensus in rulings on filming LEOs in public in the 6th circuit, BUT this was on PRIVATE property, not in public. The streamer still has the right to film anything on their property.
The cops need to begin their explanation way sooner. You know the person is going to start panicking if they legitimately don't know what's happening.
They never do. And they can hold you and not tell you for up to two days before bringing you in front of a judge. Only at arraignment do they have to tell you.

If the cops would stop long enough to let him speak they could have simply cleared it up, but they insisted on taking him to a car and creating a huge scene. Once he was in cuffs they could have deescalated and let him explain his side. They took an anonymous callers word over everyone at the scene.

I HOPE there is a taskforce or a jurisdiction division that tracks these swatting jokers so they CAN BE held accountable to bringing harm and discomfort into the life of an individual for ANY REASON(S)
Law enforcement won't even pursue most fraud cases across state lines because the investigator with the victim doesn't get the collar for the perp in another state - they aren't going to pursue swatting for the same reason.
Why would Cops reduce their capabilities? They like that this happens... there is and will be no accountability. That is what government is; the ability to commit crime with no accountability.

I would honestly be so confused if guys dressed in uniform just randomly walked into my backyard and started trying to put me in handcuffs. It was really weird the way they handled that.
Sometimes I have to wonder if cops actually WANT you to freak out, so they have an excuse.
Considering how wild he acts in his streams, I'm happy he stayed fairly calm in this situation. I'd be freaking out if people in uniform randomly started trying to put me in handcuffs for no apparent reason.

On paper LEOs supposedly need a warrant to enter private property, but on youtube time and time again we see LEOs going onto private property, start giving orders, start handcuffing people while refusing to explain to anyone what is going on.
To me common sense would dictate if you have a search warrant the people being searched should be given enough time to read the warrant to make sure it is legit. And when LEOs have to go in without a warrant they should be ready to explain what is going on BEFORE they start giving orders and handcuffing people.
What's the alternative to a real situation?
@@yuikol14 The alternative is to introduce yourself and make your intentions clear. Talk to the person like a normal human being. Explain to them why you're there, instead of slapping on handcuffs while telling them to "calm down".
Speed was basically swatted on stream, they said they’d tell him why they are cuffing him, but they don’t even tell him for a while, what sense does that make
They actually tell him pretty quickly, the edits that occur make it seem longer, but they pretty much cuffed him, walked him ten feet, then told him

@@HumanB312 Police policy, is to ensure that there is no threat when a seriously dangerous call is made, they are to make sure there is truly no danger, commencing a short investigation while the person in question is cuffed so as to protect themselves in case that person actually wants to do harm
@@HumanB312 the only thing they knew about the situation when walking into the backyard was that someone reported that he had a gun and wanted to hurt people. To not cuff him would be mindblowingly stupid.
The issue is that live streamers dont immediately end their stream as soon as they relaise they are being swatted. It would take the fun out of it if you didnt get to watch your misdeed unfold. Afterall why set a building on fire if you dont get to watch it burn down.
Surprised it was not mentioned that the officer went hands on with his friend, taking the phone out of his hand, and stopping the live stream on 'PRIVATE' land. His mother clearly stated it was her house.

you don't need a warrant to enter a private property if there is reasonable suspicion that anyone is in immediate danger. Same goes for the handcuffs he was not arrested he was just detained for the officer's safety. While he should have been released earlier, there's nothing here worth suing :)
They got a call of a ongoing murder/suicide, that requires no warrant. The cuffing was fully legal since the caller said he would harm himself and other people. I understand that it's tough to understand basic legal procedures in the 21st century where it's cool and hip to hate police, but you don't have to exaggerate.

Police seriously think putting someone in handcuffs is no big deal, and the courts refuse to correct them on this.
I think he gets an A+ man was at his own home just streaming, and got thrown into this situation due to a Swatter. None of this was his fault.

@@kobisanchez4483 I know that, but this isn't an auditor. This is a victim of swatting. He should have basically no expectation of knowing anything because he's a victim, and giving him a grade just seems weird. Giving grades to auditors is completely different.

This whole incident is a prime example of guilty until proven innocent.
Calmly and clearly explaining the situation even going as far as explaining the reason why they were called out and all he gets is a "work with me, mkay?"
cop kept saying "im on your side" while actively trying to find something to charge him with while illegally detaining him. Id sue
The initial detainment was fine, but after they learned it was a swatting incident they should not have put him in the squad car. He should have been released at that point and treated like the victim he was.

I think a point you didn't bring up is this was not in public but on private property. If an officer can legally make you stop streaming can they also demand you deactivate your ring doorbell or other cameras around your property that are also connected to the internet?

They had to. They got a call that he was armed and ready to harm others, so they have to be cautious. That's the rules they have to follow as a police officer as to make sure he's not dangerous. Whether or not they know his streams, its mandatory as police. If you see police raiding streamers, you can see that even though its obvious a fake call was made, they still have to detain them just in case
I feel like the rationalization in this case - while arguably not a justification - is that the responding officers felt secure in the swatting nature of the call and exercised an overabundance of caution to protect against the possibility they were wrong.
Yeah, people keep saying that the cops were just trying to arrest him and treat him like a criminal, but I really didn’t get that sense. From the start, the first officer seemed to be trying to remain calm and secure the person so that he couldn’t harm himself. I don’t know if every single thing they did was correct, and they definitely need more training, but I don’t think they had any malicious intent. I’m usually against the cops in this channel’s videos, but some people are a bit overboard with the hate in the comments on this one.
