- Opening Statement by Solicitor General Elena Kagan before the Senate Judiciary Committee during her confirmation hearing to be the next associate justice to the Supreme Court (from C-SPAN 6/28/10 coverage).
Her life story is very inspirational and she is worthy of tremendous respect, not that one would gather that from some of the comments here. The American judicial system is uplifted and given great credibility when served by a person of Justice Kagan's intellect and wisdom.
Kagan's opening statement demonstrates she has a thorough understanding of the fabric of our Constitution and the guiding principles that makes this a great nation. Her responses to the questions confirms my belief that she will make a honorable member of the nation's highest court. So let me join the multitude of intelligent people in this country by saying, "Congratulations Justice Elena Kagan!"

She is someone who I would defintely want in the supreme court, seems very clear and intelligent. This should never be about left v right but picking the best person for the role.
she was the most qualified person even before Sotomeyer. It was inevitable.

Justice Kagan is a brilliant and down to earth person. I much prefer the judicial philosophy of Justices like Thomas, Alito, or Gorsuch, but Kagan is the perfect model of what a Justice should be as well. That’s undeniable.
RELEASE THE KAGAN!
@aruba91961 I truly wish I could share in your optimistic view of corporations, but recent history forces me to do otherwise. I do agree, however, with your contention about lobbyists. They are the ones who have polluted the process irreversibly for the most part. I'm a big fan of free speech as well, but I also think that gov't does have an obligation to look after everyone's interests and to enact measures to that effect. Free speech is not an unlimited right.
@aruba91961 You're applying free speech to those entities in general terms. I'm not. When it comes to specifically trying to exert undue influence in the political process, corporations, unions, social clubs, etc. should be restricted from doing so, regardless of which political party may be in power. If you don't trust power in the hands of the powerful, (and I tend not to either), you should be able to agree with me. Do you trust corporations to look out for the average voter's best interest?
@LordBicen It doesn't matter. There's no constitutional requirement that says you have to be a judge before you can become a Supreme Court Justice. Chief Justice Rehnquist, (appointed by Nixon and Reagan), was never a judge either, and that was OK with everyone. Why the double standard? I'm an Army vet and a proud American, I took the same Oath you say you took, and I believe Kagan will be a good Justice. By your logic, Rehnquist should have been voted out too. Drop the unfair double-standard.

@tolbiny66 Unfettered is a term Im not familiar with, however they have always been retrictions on what guns you can own. In 1934 they past federal law that put retrictions on machine gun ownership, depending on which state you live in you can own one if you pay the $200.00 dollar tax stamp on the machine gun and have a class 3 curio license. I don't what else to tell you.
She's amazing, speaks with such power - so highly of her country, its people and the field of law. Wow!

I looked at the statute, and it is clear that it only refers to tools that could be used by corporate and non-governmental entities to exert undue influence in the political process, and I certainly agree with Kagan in that those tools should be banned, even if they come in the form of a book. The only ones who should be allowed to exert their influence in our electoral system are the American people, not giant corporations or unions. Corporations have no 1st Amend rights.

Irene Imanil (real, with nevus, Agripina's grand daughter) with breached identity calling to express my deep admiration over her adjudication of cases that I have yet to learn. The side of justice wins over the side of strength of force that dis regard the rule of law.
Today, we live in a precarious time of uncertainty and unknown future resulting from advancement of technology. In particular, the tool and use of computer, cell phones coupled with breached gridline at the highest level and that is the gridline of military is rather a cause of fright for many people. The judicial system must get involved over the interpretation of the usage of these technology. However, nothing supersedes the federal government of the military when it comes to the discussion of the national security of the nation. Or isn't there? It has to be me to make this wise decision for everyone knows that no one is immune from prosecution against crime committed, but one group earns that immunity from prosecution.
I am waiting for that moment but given my prevailing situation, it is nearly impossible to even bother to talk to individuals who stole my names for different purpose.

@aruba91961 That may be so, but I can almost guarantee you that the remark has been taken so out of context that its use to justify any animosity towards Kagan isn't appropriate at all. And there was no hatred involved in my earlier statement. I was just stating the facts as they are. McConnell IS an anti-American clown, and he offers proof of that everyday when he commandeers the Senate floor to go on his absurd rants.
