  • Florida man faces trial for a catastrophic school shooting, but before he does, he must face jurors for a battery case. Prosecutors say that’s Parkland School Shooter, 23, on footage rushing a Broward County jail guard in November 2018. Jury selection is scheduled to start Tuesday, Oct. 5 at 9:30 a.m. ET. Opening statements are scheduled for Oct. 18.
The Shooter is the person facing 17 counts of first-degree murder, and 17 counts of attempted first-degree murder for opening fire at Marjory Stoneman Douglas High School in Broward County, Florida on Valentine’s Day 2018. Then 19, he was a former student there. While awaiting trial at the Broward County Jail, he attacked one of the guards, say, prosecutors. In the Nov. 13, 2018 incident, the guard told him not to drag his sandals on the floor, prosecutors said. The Shooter flipped him off, and, as clear from the video, rushed him and struck him. He initially had the upper hand, but the guard regained control, and The Shooter eventually gave up.
17 people died in the high school shooting: 14-year-old student Alyssa Alhadeff, 35-year-old teacher Scott Beigel, 14-year-old student Martin Duque Anguiano, 17-year-old student Nicholas Dworet, 37-year-old assistant football coach Aaron Feis, 14-year-old student Jaime Guttenberg, 49-year-old athletic director Christopher Hixon, 15-year-old student Luke Hoyer, 14-year-old student Cara Loughran, 14-year-old student Gina Montalto, 17-year-old student Joaquin Oliver, 14-year-old student Alaina Petty, 18-year-old student Meadow Pollack, 17-year-old student Helena Ramsay, 14-year-old student Alexander Schachter, 16-year-old student Carmen Schentrup, and 15-year-old student Peter Wang.
Officials arrested The Shooter shortly after. Interview footage showed him insisting a voice in his head told him to carry out the shooting. He called it the “Demon.”
“Personally, I think you’re using the demon as an excuse,” said Broward County Sheriff’s Detective John Curcio.
The Shooter’s defense has not disputed that he is responsible. They have been trying to save him from the death penalty.

Broward Co. Officers reacted quickly to this situation. They did their job, instead of how Uvalde Law Enforcement responded. They did not know where the shooter was, but they risked their own lives to get the wounded out first and evacuate the other students.
I used to live in Broward county and the police in Hallandale Beach got me out of a DV situation involving a knife. They used a taser on the perpetrator and got me to a hospital for care and safety. I will never forget Officer Hatch. And all the while this kid has no idea the kid sitting in the booth with him - just killed 17 people at his school, injured at least 17 more - and one of those injured people - is your sister - now fighting for her life. I understand that the defense's job is to hopefully prevent testimony or exhibits that could be 'prejudicial' and lead to their client getting the death penalty. That's their job. I also understand everyone is entitled to a fair trial - and therefore every defendant must have a defense team - but, since this defendant confessed to all the crimes he has been charged with - his defense teams objections to relatively minute details, sound ridiculous, unnecessarily argumentative and insulting to all those affected by this terrible crime.

Their objection in the beginning was actually a particularly strong argument. Since this is capital murder with the Death Penalty in play the Prosecution is attempting to establish aggravating factors and the Defense mitigating factors. The Jury will be deliberating on those and determining whether or not he gets the Death Penalty.
Granted I have only seen the objection at 27:15 in this footage, but that was a reasonable objection to exclude the testimony. Immaterial evidence following the crime should be excluded.
In that particular instance the prosecution is making quite a stretch with the attempt to say that everything following the criminal act was planned (which would be an aggravating factor and something the jury would be considering in their deliberation for the DP).
I’m not defending Nikolas by any means, but legally, I do think that the judge should have sustained the objection to that particular objection.
