    I had a man come to my porch and then walked around to try to get into my locked backyard gate. Called the police who arrived pretty quick. It turned out he had early onset dementia and thought he was at his house. His daughter finally showed up about an hour later to explain everything.

    If suspect was asked to leave and he didn't, that's criminal trespass in the state of Texas, even on property. Unfortunately for the woman, if the suspect had no weapons and wasn't trying to break into the house, she's not allowed to use deadly force. And she should've stay silent till she spoke to attorney.

    The exact same thing happened to me. I also had a gun, but called and waited for the police. The man did try to open my door repeatedly and went to various windows, but did not gain entry. If he had, then I would have taken more action. It was also 1AM when this took place. Police came, he was drunk and was arrested. He was on the wrong block.

    I don't think this will go well for her because she could have waited for the police to arrive by locking the doors and staying inside. If he breaks in then by all means she should protect herself and her children. What's crazy is she shot him 4-6 times.

    Im not from Texas so im not well versed on their stand your ground laws and what constitutes a justified shooting. however i will say I believe most adults know how protective ppl are of their homes and if you’re a stranger to the homeowner, you are to some degree making them nervous by being on their property. This is one of those instances where you just have to comply with the homeowner who’s telling you to leave. Sure this guy could’ve been hurt or lost or whatever but lets not act like ppl don’t kick in doors and hurt people. I can say, personally I wouldn’t have shot this dude in this case but im not a woman and don’t have kids at home to worry about.

    I do feel for the homeowner. However, she will have a problem with stand your ground. After calling 911, she was most likely told by the operator to remain calm, ensure all doors and windows were locked and not to confront the person. Police had been alerted. She should've stayed indoors until they arrived. If the suspect had broken into the home. Thats a whole different situation in which she has the right to fire for self protection. Hopefully she has a good attorney to represent her in court. If the trespasser dies, she could well be charged with manslaughter. One must know the gun laws, because if not, it can become a headache with the district Attorney's office.

    Folks be careful shooting people outside of your house when you're inside. Unless they're trying to break in or threatening you, you could get in trouble. It could have been a harmless drunk or mentally ill person.

      The law still applies to those groups of people. Drunkenness nor mental illness is no exception to law. In Texas, you're allowed to protect property if you feel an imminent threat of property crime is present. Based on the fact that she told him to leave and he didn't, it's reasonable to believe there was high probability of a property crime. It wasn't like he was soliciting anything.Even if he was, those people promptly leave when you ask or decline thier solicitation.

    I'm confused. Did she shoot the man while he was outside on the porch and she was inside the home? Was he attempting to break down the door or had he gained access into the home? Seems like there's some missing information. If he was outside and she was inside with door closed/locked I'm not understanding why she shot him instead of waiting for the police to arrive to deal with the situation. Again, it seems like some information is missing, or else I missed something in the news story.

      What would i do?
      If there was a creepy guy outside, between the relative safety of my locked house and my car outside,
      I would not be thinking to try and get to my car with my children just to take them to school until that man was long gone.
      I sure wouldn't shoot him unless i was being threatened.
      I would call and keep calling the police until they came to deal with the trespasser.
      She certainly cannot say that she had to shoot him because she needed to get her kids to school. 🙄

      How do you know one shot would have sufficed? Why would you only shoot someone one time? Do you own a single firearm? Have you ever taken a class with it? Never EVER shoot one time.
      80% of people shot with handguns survive, including those shot multiple times. Shoot until the threat is no longer a threat.
      Let's save the virtue signaling until the details come out. Shooting someone on your property in Texas isn't against any laws as long as they are a perceived threat. If she can prove she perceived him as a threat, she walks. And I hope she does.

    The mama bear defense is not law. She should have waited for police to arrive because just because somebody doesn't comply which is not legal anyway you cannot shoot them. I own plenty of guns but if you are going to arm yourself you better know the law or you might be the one needing a lawyer. No one should go from leave my property to gunshots without letting police handle the situation. Will be interesting to hear what she told dispatch on her 911 call.

    I see that happened in Texas, it seems gun laws are different from Florida. The suspect needs to actually break in the house and with or without weapon the victim can make that move. Its good to have protection but some people just don't know how or when to use it properly.

    We had a deaf guy here that had issues and new neighbors didn't always know about him for a bit. He wasn't very sensible and he's lucky he didn't get shot by someone who didn't know him as he would walk right into people's houses if he needed help. of course we all kept doors locked who knew. We had to call an ambulance for his GF once and it IS startling but we knew his situation (even though he was also a druggie and we didn't like him ) but new neighbors didn't know he was deaf. and he'd freak them out because his boundaries weren't "normal" because communication and he couldn't work his special phone.

    Let me guess? She shot him because he was on the porch, in the way, and she didn't want the kids to be late for school? This incident made them even more late.
    I really don't see much imminent danger here. Of course as a mother, it's frustrating and stressful to have someone on your property that you have no dealings with but to shoot 4-6 times, was not a scare shot.
    She may have repeatedly asked the guy to leave but shooting someone that many times was a shoot to kill defense. Not a warning.
    Now, I wonder the outcome of this? Will there be jail time, probation, or a slap on the wrist like like a parking ticket 🤔🤨 There are alternatives to picking up a gun and shooting with the intention to take a life.

    I can’t blame the home owner her motherly instincts kicked in she had to go to survival mode in order to protect herself and her children 💯 I don’t blame her “Desperate times calls for desperate measures” I would have shot the unknown man/intruder as well I’m glad her and her family are safe 🙏🏿 people have gotten out of control these days 🤦🏾‍♂️

    A friend of mine got scared when she saw a man washing himself in her bathtub the man said called the police so I go to jail and have 3 meals a day . She was surprised and realized he was no threat to her , she called the cops . He was arrested without incident and thanked the cops and her for going to jail . He did it on purpose to get cleaned and go to jail instead of being in the streets .

    Several years ago in the Houston area a man shot and killed a couple of guys "on the street" that had just robbed his neighbor. He got off with no charges. Let's see what happens here.

      They were committing a crime (b&e, theft, etc) at night. Trespassing at night in Texas is a capital offense... during the day it is not. I think she's in trouble.

    This happened to us years ago at my grandparents home. Elderly man thought he was at his house, found out he was from the nursing home 🙁a few blocks away.

      Same or just about, Had this big dude, Im 6'5 and 275lb and he was atleast 7ft and 300 wandering around my front yard after I got home from work, and got out of the shower, while getting dressed I saw him out the window, he finally came up and sat down on a bench about a foot from the door , I went out the back and came around to the front, I had a weapon on me, didnt wave it around, tried to talk to him and he was babbling and waving his hands like he was swating at flies, called 911 they said they were on the way and ask for a ambulance to come, the police showed up started screaming and pointing guns at everyone me included, I told him I had been with him for about 20 mins and he had done nothing to make me think he was dangerous, but seemed to be having a medical issue, the Paramedics showed up, they took a look at him, said it looked like he was going thru insulin shock gave him something and he started talking in about a min, they loaded him up and took him to the local hospital he was released later that day. The cops warned me about how they were trying to do there job and I should have stayed out of it. He came by a few days later said thanks, told me that his kids had let the cat out when leaving for school and he was out looking for it and didnt remember much else. He lives 2 blocks from me, His name is Harry.

      happened once to my grandmother she took a broom to him and whup him with it until he lef the property, we lived 2 miles from her by the time we got there she done ran him off the 3 acre property to the highway, my father chased him down and they got into a argument he started to run down the highway to get away after that

You have to be in Immediate Life Threatening Danger. Castle Doctrine Doesn't Extend to the Sidewalk or the Front Porch. The Threshold of the Door would need to be Breached or Attempted Breach. You can't shoot a Heckler on the Sidewalk. "Get off my Property" - "I'm Not on your Property, I'm on the Sidewalk"

    I hope the woman is not punished for this. A person should be allowed to defend their property. She asked him to,leave and he refused. It’s a shame the law probably says he had to be more threatening before shooting him. She should not have to wait until he harms someone.

      We live in a rural area. I had to protect a neighbor from her husband who tried to stab her to death. The closest cop was at least 20 miles away. I held him at gunpoint (and yes we had kids too) until the cops came. It took a long time- almost 30 minutes but I didn't HAVE to shoot him and didn't. He stayed outside and we were inside our house with the doors locked. No need to shoot unless (nor legal) unless they are capable of harm which means IN the house, or entering, armed, threatening.

      Protect her property from what? We don't even know what happened. I'm all for gun rights, but folks are so trigger happy these days, a simple mistake can result in death.
      I say this because I had a drunk kid trying to get into my house one night. He was beyond shitfaced, had somehow driven from the bar to my home, and was attempting to open my door. He was like a zombie, unresponsive to me but alert enough to be standing and fidgeting with the door. I asked him to leave multiple times. I called the cops. They came and handled it. Nobody hurt, nobody dead.
      I understand protecting yourself, family, and property and everybody has a right to when it's necessary. However, according to this news report, we have no idea what was actually going on, so, based on my own life experience and that of others I know (gun owners and gun nuts included), this woman over reacted.
      People these days want so badly to use their gun to feel like their doing something big and noble. Guns make emotional situations into permanent decisions, and in this case, you're so happy this person got shot when you literally don't even know the situation.
      It's ironic because everyone loves to say America is land of the free, but you're not free to do what you want when everybody has a gun and is ready to shoot for any reason. (Renember the lady who was in a car accident and knocked on a door for help and was shot and killed? Home owner thought he had a right to protect his property). People are terrified, but hide behind a gun and call it bravery.

    I'm usually for self-defense, but there was no need to shoot a guy 4-6 times that wasn't trying to attack you, but just standing/sitting on your property. Call the cops and wait for them. Sounds like he had mental issues.
