    It's crazy the original lender will sell the debt to a debt buyer at such a huge discount when they could have offered that discount to the person in debt.

      Disagree. The advice RE the FDCPA is quite awful. No mention of lawyering up and suing the debt collector.

      I fixed my bad credit report with the help of a credit repair specialist who I was referred to by my colleague, they helped me improve my bad credit and erased all the negative items affecting my score negatively.     I had some things go to collections when I went through my divorce. It was a combination of already having financial problems and my ex not giving me my mail. I remember getting those calls daily.
    I spent the next several years cleaning up old debt. I listed my debts smallest to largest and worked on them one at a time. After all the bad debt was taken care of I started focusing on getting rid of the current “good” debt. It took me 4 years but I owe no one now. My house is paid off now. I won’t ever borrow money again. Now I save for retirement.

    I've been to collections once, and all I had to do was write a letter telling them to pound sand. I kind of figured later that I really didn't owe anything, and they were just trying to shake me down. It was homeowner's insurance, and when the policy period expired, I had already shopped around and renewed with another company. The original company claimed I owed them premium from the renewal date to the day I told them I had gone with another company. It wasn't much, and I just told them I wasn't obligated to renew with them.

    I went through debt hell a few years ago, and it was the scariest experience of my life. I actually went through all 4 levels - I finally got a summons for a bill, and ended up declaring bankruptcy. Even though it sucked, ultimately declaring bankruptcy was a fresh start I needed. I don't borrow anymore, although if I were to get sick again, I'd be in trouble.

    Medical billing is the worst. I once had an ER, try to double collect on a bill. I was in an auto accident, the other person's insurance paid for my ER trip. But the hospice kept calling me to collect $1500.00 past due on the bill. The auto insurance would not pay..... WHY? Because the medical billing department billed them for blood transfusions, which was not needed for a superficial cut on my hand. They litigated and the judge asked me what is your blood type. So I gave blood type and proof of it to the judge. The judge then turned and asked the medical billers, why did you give an O+ patient A- blood?

    This was stressful but educational to watch.
    Only stressful because it brought back memories when debt collectors would hound me and threaten to repo my car.
    Got my debt because I got seriously sick and couldn't pay because it was hard to earn money while bed ridden.

    I never had any of my debts go into collections but I did co-sign multiple debts that did go to collections. Still have a rocky relationship with my sibling even after settling with the collectors. Never co-sign any debts unless you’re prepared to pay it in full yourself.

    I recommend if you somehow missed a small enough balance and end up in debt collection, FIRST attempt to contact the original company/business you are in debt to and try to settle with them. They're able to recall the debt back from collections and none of the moochers make money off what was probably a small mistake.

    The analogy between debt and hell is well chosen. I had been in debt with years of payment to do and I did. The feeling of being free from debt is priceless! I have never been in debt again. It’s a bondage. You really owe something when in debt and that is terrible. The only thing I would eventually go in debt for is a house with garden. But only if my money pays off at least 2/3 of the price.
    Note to myself - Check assets!

      While true, that quote overlooks those who become unable to pay their regular bills (rent, phone, utilities, etc.) as these are also a form of "debt".
      Say you were laid off during the pandemic and couldn't pay some of those bills. They'll those businesses will take you through the same debt collection steps eventually

      @yulyu I never said anything about abstaining from luxuries which you feel would actually bring value to your life (such as a car which would most probably be used daily). I mean if someone who owns 20 red lipsticks and never actually wears it, but for some reason decided to buy another one then that would be a waste. I would hate to have the mindset that "NOTHING is a waste of money". That sounds like a way to justify spending money on absolutely anything you feel like (regardless if it will provide any genuine use to you, and of course it is up to the individual to make that decision). But whatever enjoy being broke lol.

    I've been debt free for 4 years now. Although I did get a collections call for an ambulance that I didn't need. The landlady for the place I was living in kept the bill from me after I had moved out. I had no idea I had that bill till they called me at work. Nearly got fired. Didn't pay that collector. I paid at my city hall, in cash $387, not a Penny more

    Never send a check. Never allow EFT. Always pay your debts in collections with money orders.

      what is EFT? are you saying they'll have access to your bank account that way with the account/routing number?

      @@michelep9477 EFT = Electronic Funds Transfer. Meaning, you pay it via a transfer from your bank account. By doing so, they could potentially obtain your bank details. If you ever decide to stop paying, they'll already have your bank info and could try to pull money from there, even if it's illegal for them to do so.

    This is incredibly informational! I've always been curious about this process- thanks for the info! :)
    I've been super careful, got a ding on my credit for someone else's debt and immediately it went down 100 points from excellent to about 600 which is insane.
    I immediately appealed it because I hadn't gotten anything in the mail for that amount and they took it off within 24 hours.
    Totally ruined my day but it was so great seeing my credit back to it's squeaky clean score!

    I love that when people ask me about these kinds of topics, I can just send them y'alls videos. "What do I do about getting a car?" Watch this Two Cents video first. Then, we'll talk. Thank you as always for such amazing content.
    Years ago after a failed stint at college and massive credit card bills, I waited out several debts that went into collections and then were discharged. Now, twenty-five years later, I have wonderful credit and credit card companies BEGGING me to take their cards. You can recover from these situations, but the best idea is don't get into them in the first place.

    It’s amazing to me how fast companies give up on debt repayment happening. I’ve heard bits and pieces of the steps but if 3-6% is all companies pay for it that’s probably not too much less than the percentage actually paid off after just half a year!

    I went through Debt Settlement recently. It sucked. Discover is the worst. They immediately sued me after 90 days, right on-the-dot, while the debt settlement company was actively negotiating with them. What a horrible company and an abuse of the legal system.

    As someone who was once in $46k in credit card debt I recognized that I am the one who asked to borrow the money, I am the one who made bad decisions (with the help of my ex wife) Therefor it was my job to pay it. Having debt was awful, but I am the one who made mistakes so I saw it as my job to fix it.

    I had debt brought to a collections agency because they kept telling me that they would contact my insurance and that everything would be fixed. Then my insurance brought them to court and got my credit score back up. Cigna may be a lot of things, but they will most certainly fight for you.

    The credit score is just the "suckers' score" because it rewards credit utilization, not paying off credit cards. I could care less what my credit score is.

    My dad and I had a lot of debts in Pennsylvania. I had about 3k in medical bills from 4 different hospital visits (which were because I was uninsured and unemployed). My dad had about 30k in credit card debt. With my medical bills, they were eventually sold off to a debt buyer. 2 of the 4 are already off my credit report because they passed the 7 year mark. The other 2 medical bills will reach the 7 year mark in 2021. With my Dad's credit cards, the balances were high enough that many of them did try to sue. However, they were unable to serve the court summons paperwork and they eventually just gave up, since my dad is living off the grid. He does not have any assets that can be legally seized.

      I have a 3k medical bill from this year. I refuse to pay because the service provided was horrible & extremely unhelpful. After 7 years do they stop charging? How did it work out for you?

      @@nm6857 After 7 years, it will no longer appear on your credit report, regardless of the state you live in. The only way it could stay on for 10 years is if they sued and got a judgement against you. However, that isn't likely to happen given that it's a pretty small debt. Note, some debt collectors might purchase your debt after the 7 year mark and send notices asking for payment. They are trying to get you to pay even a slight amount to revive the debt and restart the 7 year clock. DO NOT fall for that trap. Look up your state's statute of limitations for suing over debt. In Pennsylvania, it is 4 years. After 4 years, it can still be on your credit report until the debt is 7 years old, but they can't sue for it.

    I had a debt collector call me at work. I tried to let them know I was at work and couldn't speak to them at the time. They made some rude comment... so I told them I wasn't going to pay them. Thanks specifically to their tone. I asked them to not call again... they kept calling during my work times. I ended up suing them. They forgave my debt, which was $800.00, and settled out of court for a few grand.

    I worked with someone who I was talking to about a job opening at a state department of Revenue office (tech position) where I had worked, and he was a great tech.
    He told me they wouldn't hire him.
    Apparently he had a problem a few years before and couldn't afford to pay his state taxes.
    So he didn't. And didn't talk to them. He just did nothing... He ghosted them.
    And yeah, they had (still do) a policy that you had to be clear on your state taxes to be employed there.
    Ouch. Never do that. If you have problems and can't afford it, call them and talk to them.
    A plan, even a really minimal one, is always better than ghosting them. That adds fines / penalties on top of everything else...

    I worked as a debt collector for a couple years. I’d agree with this video overall, it’s best for you to just call your lender and tell us the situation. We can waive late fees for you, we will even let you skip payments and pay them later. Just like any relationship, communication is key. And if you’re an asshole to us, we’re unlikely to work with you.

    Debt collections can really ruin your score, but once you get it cleared and send confirmation to the reporting agencies; it bumps back up over a month or two. Thank you for making this video. It’s annoying and often frustrating but you can fix this! Also, you guys are clearly fans of Milton and Dante :)

      I fixed my bad credit report with the help of a credit repair specialist who I was referred to by my colleague, they helped me improve my bad credit and erased all the negative items affecting my score negatively.     Definitely one more thing to add, dispute any suspicious debts that come up in your name or with a creditor you have no relationship with. Credit karma and other services have that available to you on their site, but talking to the credit agency is also a good move.
    I remember when a debt collection agency stole my identity, and I had to contact the CFPB because it was on my credit report. Thankfully, the CFPB and Transunion handled it, but some of those third party debt collectors do some things that are questionable legally. The moment you pay a debt it becomes yours, and they know that.....know your rights, always get information, dispute first, and don't fall into any psychological traps!

    My $100k in student loans fell off my report this year, this explains why that happened. Thought those never got charged off, but then again they have been passed through multiple companies by now. I'm not gonna question it, my score is incredible now.

    I recall being late on bill. I had trouble in past so I stepped up my game called them told them. they told me for then, we give a 2 week grace period which was enough time for me. It's good to know all this info tho. I do know sometimes people try to get you pay off died family member account but don't fall for that.

    I used to work for the largest debt buyer in the world, Encore Capital (if you got a bill from them it would be titled Midland Credit Management). The company banks on you not showing up to court and they just robo sue massive amounts of people at a time. I talked to an Uber driver who ironically was driving to work that day and I talked about what I do and he told me about showing up at court for a summons they got from Midland CM. Simply showing up to court is a huge bonus so you don't lose by default. Encore will definitely settle for way less than your amount due. Sadly Encore has gotten their legal costs down so much that they robo sue smaller balances now. Never ever send them a payment without negotiating your balance down and always show up to court. So glad I don't work for that greasy ass company any more. They shoved me in a basement and I read depressing hardship letters showing us still trying to collect on debts on people with crippling medical debt. They also pay their para legals $20/hour and try to get them to move to Detroit. Shameless and greasy as fuck.

    I could have really used this a few months ago. I canceled a plan and the company told me they will send me the bill. I was okay with that. For months it never arrived and I kept asking them. Turns out the agent put the wrong number. They tried to make me foot the bill but since it was recorded, they paid for the late fees and even offered compensation for the harassment they put me through for a clerical error on their end.

    I had a debt collector try to revive a debt too old to revive. They called everyone but me, including people on Facebook I'm no longer in regular contact with or who were just random friends with public phone #s. I contacted a lawyer who knew she'd win and charged me nothing out of pocket. I sued them and won. They had to forgive the full debt and pay thousands to myself and my lawyer.

      One big different in the UK is that you generally don't go bankrupt because of medical bills. In the U.S., it's the most common cause.

    But some people I know aren't making rational decisions and blocking our plans
    Mortgages
    homelessness
    no money
    can't have any dating opportunities
    And people still prevent me from fixing stuff

    I have two student loans through me state that were discharged/written off a few years ago when I was serving in Americorps. I was living on a stipend of $800 a month and was able to put my federal student loans on forbearance. I tried calling my state’s student loan line to see if I could do the same, but no luck. I would have to pay $75 a month which became challenging at times. I’m still trying to figure out how to remedy those discharges on my credit report two years later and increase my credit score....

    Play nice with the initial location YOU purchased from. If you ask to buy something, pay for it! Don’t think you can flake off when you got the goods but didn’t pay your pay plan.

    I had a debt that went bad and went to collections. I was broke. I moved several times and literally 25 years after I incurred the debt they found me, it had already fell off my report. I laughed into phone and said NO.

    Some debt buyers may want to see friendly with you and convince you to pay $1 toward the debt as a sign of good faith. NEVER DO THIS. It is a ploy to restart the Statute of limitations on how long they can attempt to collect on a debt. If you intend to pay off the debt do it in as large amount as possible or in a lump sum. 50% on the face amount with no interest is a very common offer on less than $10K Balances. 20-30% is more common on balances more than $50k. Negotiation is the key. 5 year experience at a multiple collection law firms.

    • Debt-collectors are lazy and rarely do anything more than keep calling the same phone-number over and over (beyond what's legally allowed). They never think to do some actual work like trying something different like actually looking up the person or contacting the tax-agencies or sending someone to the door or something. Woe be the person who has the number of a past debtor and doesn't answer the phone to tell them it's the wrong number (or even does say it's wrong). ¬_¬
    4:44 - The biggest problem with debt-buyers is that they'll often end up re-selling the debt again and again, passing it around like a hot-potato, and for some idiotic reason, your credit can take a hit from each one, that is, each new one reports you to the credit agency when they are unable to collect. That's absolute BS; you shouldn't get punished multiple times for the same debt. 😒
    5:20 - But does the limit exist for the debt itself or for the collector? Can't they get around it by just passing it off to someone else just before it expires and the new person gets a whole new 2-10 years to collect? 🤔
    5:43 - Some debts will expire, but not student loans, because you deserve forgiveness if your debt was for jewelry or running-shoes when you were 40, but not if it was for education when you were 17. 🤦 😒
    5:54 - I still don't understand what the hell business your financial credit is of employers. (Yes, _some_ employers might be wary of hiring people with a lot of debt, like banks, casinos, security, etc. but most have no damn business knowing your finances. ¬_¬)
    6:15 - That won't stop them from stepping right on the line, calling at 7:​00:​05am or 8:​59:​55pm. And they apparently _are_ allowed to call family members, neighbors, etc. which is more BS. I guess privacy doesn't count when money is on the line. 🙄
    6:17 - They can't threaten arrest for debts? Wait, so that Indian guy on the phone warning that the local sheriff is coming to put you "behind the bars" unless you immediately go and get Walmart and Google Play gift-cards to pay your taxes isn't real? 😲
    6:20 - Maybe not in the US, but some places _do_ still have debtor's prison. (But those places usually also still have smallpox. 🤷)
    6:54 - What if you don't show in court because they got the suit filed in another city or you're in the hospital or _you're dead?_ 🤔
    6:58 - What if you don't have wages or assets? 🤔

      I understand that some unscrupulous debt collectors will call your work and your boss' home and so on to shame you. Not sure if that's legal or not but have heard of it happening.

    My old company Ed Napleton didn't pay a hospital bill that was under workman's comp from a bolt that fell out of ceiling rafters and hit me and I ended up having debt collectors come after me on and off for years cause my name was on the hospital bill. Told them what it was from and that I had no legal obligation to pay, but was still annoying, thankfully statues of limitations came up and haven't had anyone try to collect since.

    I would also know that small debts can easily be defeated by invoking the arbitration Clause that is in many contracts.
