He filed chapter 11, only a class of bankruptcy protection. This was common practice for many during to 2008 housing crisis too. In the USA it’s valid tool. In Canada it comes with a terrible stigma. In Canada you’re painted as guilty, as if it’s a sign of financial failure. The MSM media is using it as a smear tactic. It’s quite common practice there to prioritize your creditors and remain operational. Viva miss understands it value as a tool for business.

Viva, please look a little deeper into this. From what I have heard, the defamation case against him is still being litigated. The judge is trying to default it is favor of those against Jones for "not receiving requested documents" when the judge rejected the requested documents. Filing for bankruptcy puts all the info out there and makes it impossible for the judge to reject it in the defamation lawsuit, meaning that Jones can proceed with defending himself.

Agreed. The case was in default because the judge claimed that Jones did not provide all of the information about his financial standings. The only way to get the judge to accept that what he did supply is to give all of his financial documents to the court by bankruptcy. This is where Viva got his information incorrect because the fraud claims came prior to the babkruptcy filings which is why the judge claimed that not all of the financial documents were not submitted in time to the court which is why the case was lost in the first place.

I went through this and when the judge asked if there were any creditors who objected none of them showed and my case was north of 14 million. No creditor wants to be left holding big debt. They will negotiate. If Jones is listed as an employee he can be paid. The bankruptcy court will review what his lawyers and accountants worked out. If Jones went step by step according to the business laws of Texas and filed all his taxes correctly with the state and federal governments and acted with due diligence with his fiduciary responsibilities then he’s good. In Chapter 13 everything in your life and business is laid out. This is a way to protect himself and go through discovery without opposing counsel making unfounded accusations and then go through a long process of dealing with motion after motion.
The Sandy Hook attorneys are screaming because he took a whole chapter out of their hands.

The "chemicals that turn the frogs gay" for example. Yes, there are a bunch of chemicals in water, and if you start looking for one that has a conceivable effect on a gene that might turn you gay, you'll probably find it. If you were to dedicate the same amount of money and research into proving that one of those many chemicals turns you straight, you'll probably find that as well. It means nothing.

That is the tricky part about diving into conspiracy theories. Sometimes you find red herrings, coincidences, miscommunication, etc. It sends you down a path where you are wrong about 50% of everything even if you are correct in pointing out some inconsistencies. Defamation lawsuit is a good way to stop snoopers from discovering the truth but also a good way to hold defamers accountable when they are accusing innocent people. Just because they are filing lawsuits does not mean to me that we know the truth about that day

Probably part of a larger tactic to make the judgement look worthless to any prospective debt buyers. If the attorneys and plaintiffs cannot get a third party to buy the judgement they're more likely to settle for a smaller compromise.

No sympathy here. While it was wrong for Alex to say that the parents of dead children were "crisis actors", it was not worth millions of dollars wrong. There was no obvious malice in his being wrong, whereas there is clear and obvious malice in many of the similar terrible things that CNN, MSNBC, etc. do against conservatives such as the Covington kids and Kyle.

@@stevenwilson5556 I'm disinclined to believe anything any alphabet network or agency says about Jones. They pegged him as the second coming of Rush Limbaugh and have said and done anything to discredit him. His only malice was towards the networks that take special glee in parading around grieving families for victim footage.

He has a right to his opinion and what he said has been seriously twisted. With his reputation, I'd think the Maddow defense would work.

    • @S.ASmith

It could, given his reputation with the media & a lot of the public, it could be construed as protected under the 1st ammendment. The issue he'd face with that is a handful of his listeners being retarded and sending death threats & bomb hoaxes to the parents of the killed kids, where they could state his actions created the situation leading to them needing relocation or police protection.

Jones could motion to remove jurisdiction of the civil defamation case to the bankruptcy court as an adversary proceeding. The bankruptcy judge could then be asked to determine the amount of damages (liability) owed to the Plaintiffs. The bankruptcy judge may be more impartial than the state court judge that issued the default judgment against Jones - not because he failed to appear and defend but rather as a sanction for certain conduct during the discovery phase. Its an extremely severe sanction disfavored by all courts. Heck, Jones might even move the bankruptcy court to set aside the default judgement.

If I recall, AJ made claims to the effect that there were no kids killed at SH, and anyone claiming to be the parent of a deceased child were paid off by the state via real estate and tax exemption. So a claim of illicit financial gain through public corruption, vs a dead child. Parents had a solid case if AJ could not provide the sauce. According to the court, he did not.

Here are the elements a plaintiff has to show for defamation:
      - The statement, which must be about the plaintiff, must be false. The families of the victims sued because AJ accused them of being crisis actors amongst other claims regarding the shooting being a hoax, none of which he was able to prove was true in court.
      - The statement must be published to a third party. AJ made these statements on his show that his viewers watched.
      - The defendant has fault amounting to at least negligence. AJ made these statements shortly after the shooting occurred allegedly based off sources that he failed to properly look into before publishing his statements.
      - The statement caused damages/harm to the plaintiff. After AJ made these statements, the families suffered damaged reputations and distress due to being harassed by alleged viewers.

FBI, CIA and DHS are known to poke mentally fragile people into acting out and committing acts of terror or mass shootings...often times just to keep the agencies occupied or justify budgets. Look at that Senator kidnapping case that was scrubbed recently because 90% of the people involved were all feds, the plot was even set up by said feds.
I don't think anyone was paid off, that the families knew or whatever, but i do quite imagine that one of the agencies was involved in making sure the perp had access to a firearm & the ability to get into the school, while psychologically prepping the geezer to go in and murder a bunch of kids. Even a schizo doesn't just go out and randomly shoot up a school for no reason, there's tens of thousands of people with severe mental health disorders in the US that live their entire life not entertaining the idea of butchering infants. Only takes one fed to plant the seed and get the mind racing in someone like that over a period of months though.

Even VivaShorts are at times frustrating because we know there were other moments that could also be worth presenting.
Maybe it would be too enormous a task but if a VivaShort could present all important excerpts, with you setting up each one, it would greatly improve their information density.
