He offered them half back, which was more than fair. If he hadn't rented it out until December, they wouldn't have gotten anything back, and they were lucky to get half back.
"Where she comes from is warm" is somewhat of a valid point. I've had friends that have moved to Canada from warmer climate countries, and they are always freezing. Puffy winter coat while I'm comfortable in just a long sleeve shirt lol
I kind of agree with them. Moving is a horrendous job and very expensive, especially if you don't plan on moving for a long time, and then you are forced to do so.
This is ridiculous. They decided to move during a hurricane. They want their expenses paid for. They should have moved at the first indication of no heat for months. Or got space heaters. So they got what they were offered from the beginning half security. Everyone's power was out.
It’s a gamble being nice to people because they take advantage. He seems like a nice person. I think if he were someone else she wouldn’t have pulled this stunt. And the husband is basically mute.
Wonder how cold the apartment was. My landlord used to tell people who came down to the office in shorts and a T-shirt to put on a sweater. The apartment is heated to the state minimum. Buy a space heater if you want 82 degrees. Otherwise rent would be raised on everyone.
@krytietv1684 My sister's place got a dusting of snow in the desert hills a bit north of Palmdale, Cali. Crazy. The weather feels bitter cold, but we'll warm up to the low 60s, so it's not too bad. 😅
@berryhij1 Ikr? Here it's cold AF in the morning, and then by noon, it's in the 70s. And apparently, this upcoming weekend, it's going to rain Friday through Monday morning. I love the rain, so I don't mind that... it's just the up and down of it all, lol.
The storm through off our plans....so the LANDLORD should eat that cost? That truly is a crappy tenant attitude. They often get the idea that landlords are all multi-millionaires who just pocket their rent checks to spend on expensive toys and fun times.
Do people not know space heaters exist? Our heat stopped working during dead winter last year. Immediately my husband went out and bought 2 small space heaters for our room and our son’s room. Yea, it needs to be fixed but in the mean time, get a damn space heater. They weren’t that expensive at all either.
The plaintiff/wife is just an angry, unreasonable, dishonest, and extremely greedy person! Can’t stand listening to her and looking at her face when she talks.
Technically they did, which is why they only got back half. If he hadn't been able to rent it out half way through the month, they would have gotten nothing. He's just not allowed to double dip the rent so they got what he offered.
She’s hot tempered and was frustrated that she had to move in the first place. I can understand her side but it will always cost you if you let your temper lead.
Sooo the plaintiffs are VERY lucky they live in NY or they could have had to pay 6 months rent (or whatever was left on the lease! Yikes!) Love the plaintiffs remarks afterward regarding why they weren’t out sooner! “I’m not blaming the storm, but we couldn’t move because of the storm!” - sooo you are blaming the storm!!! lol!
Plaintiff is a "always a victim" tryin to get landlord to pay for her moving costs and everything extra, including the days they said over. They should have started moving out long before the last day on their lease. Storms happen. They should be prepared and not blame everyone else.
I found the plaintiff to be overly greedy and very obnoxious and I did not want the Judge to give her one thin dime. They rejected his offer of half, so you snoose you effing lose. Not happy about this judgement.
In the tiny town I live in here in the west, I'm already friends with the landlords & manager, & have been with previous landlords & managers. It was the one manager I wasn't friends with that I had most of my problems with.
No! They're not completely right but not wrong either. The judgement was fair. You can tell he's a nice landlord. She's a bit edgy and angry for no reason.
The landlord has to give the tenant 30 day notice but the tenant doesn't have to give the landlord notice. Make that make sense..... hmmm only in New York
The "deacon's" veracity is in question here. There is absolutely no reason a tenant with a small child should be expected to live with no heat. Landlord is a scumbag.
Even they admitted that it actually worked whenever he came over to check it. Most likely it just wasn't as hot as they wanted. Landlords can only fix what they see. They could have also gotten space heaters. If the building heater was broken and they got the heaters to compensate, they could have taken it out of the rent. They had options, but probably just wanted to cause trouble
well the Landlord Must provide adequate heating for the tenants. Sounds like its a up stairs down stairs suites in a house. The landlord is a cheap ass. The plaintiffs are foolish having crappy environment for a baby. Be happy you got anything back
The plaintiff seems like an angry person. She definitely wears the pants in that household. I rent a house to a young man in his 30's I've known since he was 6. Year long tenant contracts and we keep it business. He's great and I keep the place in great shape. I do see him a couple times of years at family functions. When he decides to move it goes on the market. I don't want to be a landlord and fortunate he's a great guy and tenant.
He's only paying what he offered, which is half of the deposit. $650 is FAR less than the plaintiff wanted and only got that because he was able to rent the place out on the 15th.
I bet he had heat in his home!! He cared nothing about her toddler. It probably cost a lot to repair and he didn’t want to pay. I can’t stand nasty landlords and no one cares because you’re a deacon with the Catholic Church !!
He did get it fixed for the new winter, but they left before using. Also, it worked whenever he went to see, by her own words, so more likely it just wasn't hot enough for them so said it was freezing. They could have gotten someone professional to fix it and take it out of the rent or did the same with space heaters, yet chose not go.
The tenant moved in that way. The landlord isn't obligated to provide furniture or whatnot unless stated otherwise. I think, though, the landlord did give the tenant blankets to use.
@@jedimasters1462 yes, I understand he had no obligation, but would hope that he did toss him a blanket just out of human kindness...and I don't know that I would have brought that up when the case was about questionable heating

The plaintiff is mad for no reason. The landlord didn't summon the storm. Half was fair, she was being difficult and greedy.
The plaintiff’s were hasty in their lawsuit filing and got back what their landlord originally offered 🤷♀️
He offered them half back, which was more than fair. If he hadn't rented it out until December, they wouldn't have gotten anything back, and they were lucky to get half back.
Plaintiff will not listen to anyone, she is in her feelings and thinks that’s all it takes
Plaintiff is greedy and I'm glad she wasted her time. I think the heat issue was also exaggerated.
"Where she comes from is warm" is somewhat of a valid point.

As a Canadian in Montreal I put on my heat by September and I’m wearing my winter coat . I’m always cold too

Plaintiff's lied and said they were out on the 1st but actually out on the 6th. Perjury!(Judge Mathis voice)😂😂😂

I would never live in a place, where I could not always be in control of running both my air and heat , NOT THE LANDLORD 💯
Some people live in those situations because that’s all they can afford
For real!
Seriously!!! That would totally suck having to depend on someone else to control your environment comfort!!!
They can always buy a freakin space heater!! Plantiffs are kinda ridiculous imo. They filed a lawsuit 3 days after leaving?
In NYC - every apartment , the heat is controlled, and paid for by the landlord. period.
