- The plaintiff hired the defendant to refinish his wood floors. He claims the defendant completely botched the job, so he’s suing for a refund, damages, and the cost of new flooring. The defendant argues he has been doing floors for 25 years, and the plaintiff is just one of those customers who is never happy.

who cares about that , the defendant caused damage where there was no damage before he started the job . as a guy who works on homes myself , i make sure that even if the customer is not 100 percent happy that i at least do not make things worse or cause damage that did not exist before i did the work .
@@marleonetti7considering it’s not the first comment mentioning this. I’d say people care. Yeah people need to make things right. But we did hear the defendant trying to make things right. Defendant offered to take money off the job to help pay for damages…. He offered to fix them. None of this deserves a threat to one’s physical well being.
@@Djkommode well my point was that too many people are focusing on the wrong thing and they are more drawn to the DRAMA of a person being accused of making a comment about the mafia instead of paying attention to the actual reason the case was being heard by the judge in the first place . and a verbal threat would not have had any affect on the verdict anyway .
@@Djkommode but again , thats all drama that has nothing to do with the actual facts and merit of the case when talking about who threatened who . if the defendant was afraid of the plaintiff then he would have never showed up to court and to me that is proof that no affective threat was ever made except for threatening to sue the defendant .

Just because the defendant, who is the business owner, has a lot of experience, doesn’t mean his employees have as much experience or the same skill level. We hired a small tile business, to do our master bath, and the owner did all the work and it was a beautifully done, professional job. When we had the small guest bath done, we had the ceiling done,as we did in the master. There were employees on the job, instead of the owner. It looked like it had been done by someone who was intoxicated. When the over head light was on, it revealed so many unlevelly set tiles. His expression when he saw the shoddy work confirmed my judgement. He had it ripped out to the plywood or Hardy board and completely redone. Much later, I discovered that the workers hadn’t put tile where behind the door trim. It is a very narrow space and no one would probably look there, but I know; but too much time had gone by for me to address the issue,
Hi. Ran into the same situation. Hired workers sheetrocked over the heating vents. The owner was extremely embarrassed.
In the Plaintiff's defense, I had some granite damaged exactly like his and within a year, the scuffed area began to erode and crumble. And, that was after the contractor resealed the scuffed area. It really does need to be removed and replaced. That, plus the polyurethane being on the cabinets where it shouldn't have been, would be really irritating. He probably threatened the Defendant. But, there were three major issues which the Defendant/Defendant's workers caused. And when the Defendant tried to fix one of the issues, he caused even more damage. Anyone would be fed up.
That’s what the small hand sander is for you don’t go up against other finishes with the large sander. No one does that that knows what they are doing?
This issue could’ve been alleviated with pre-stain applied to the flooring to even out all the wood. You use it on wood floors, casings any open grain surface remedies the situation.

If there was a threat made to me, I'd call the cops.
When the floor originally installed, the darker and lighter wood that was used determines how the floor will look, you stain the darker wood it will get darker, the lighter wood when stained will be lighter.
I don’t think applying a stain to light colored wood I makes it become lighter. Some kind of bleaching process would have to be used to make the color lighten. I’m not a stain expert, this is my opinion and seems to be common sense.

The defendant did not portray himself in the best light. Saying the plaintiff was impossible to please, when he or his employees caused damage to other parts of the home consistently, is ridiculous. How can someone expect the client to continue having patience and faith in their work when they make a mistake, acknowledge it, and make another while trying to fix the last one?
The plaintiff was most likely over the top when demanding his money back, but I can certainly understand his frustration. Especially with the admitted irreparable damage done to 7ft of his cabinets.
The defendant needs to implement better precautions while completing all his contracted work.
It sounds like the issue was more with his employees. He needs to reassess who he has working for him

The judge was wrong about awarding money from the scuff as that matter was settled when they both agreed to except the £150 so all she should of done is award the money for the frame.

@ yes I certainly have. I’ve done thousands of jobs over my 50 year tenure with 18 to 25 employees seasonally adjusted in the Chicagoland area so I may know more than you and most people. I know that I do.
He hired sometime at a very low cost for that kind of job. The defendant should have been more careful. But the plaintiff getting almost double what he paid the guy doesn't make sense. Judge Millie should have mentioned, "the cheap comes out expensive" like she often does. I didn't think this was a good ruling.

dude needed to take pictures without glare and lights on. He did a terrible job of making it clear it was not a board by board issue, VS larger areas that covered multiple boards as if a sanding or prep was done wrong. JM seemed to think he was complaining about adjacent boards.

Please know they must BLEACH the floor after sanding to even the pigmentation on the floor and remove the dark spots. Think of it like hair color. You have to bleach the hair to remove the red. The defendant should not do floors terrible businessman for cutting corners not adding bleach and the plaintiff should never take pictures again 🙄
Hello. Respectfully speaking, bleaching isn’t an industry standard, though and is not always done (or warranted). It’s use depends on multiple factors, some of which may include condition of the current floor, certain stains, the new color selected (especially if it’s lighter than the current floor).

I'm only 7 minutes in but just wondering this is natural wood, but couldn't they use some sort of pre-treatment to get the wood all one color and then stain? Also if you take the pic and see the flash, why not take the pic again with the flash off or do a video?
EDIT: OK finished watchign and he did strip the wood, and the plantiff is difficult the way the lady he brought with him smirked and her body language when he was talking said it all. He sooooo threatened the defendant.

This was a reasonable ruling based off the evidence presented in my opinion. The defendant's workers obviously made mistakes but I do believe that he was threatened as he said.

I agree with this comment Adrian but it's hard to ignore the fact that if the plantiff was black, you would flip out that the judge was racist and think the plantiff deserved EVERYTHING back, including pain and suffering which is always an eye roll in my opinion when people sue for that..
If this entire scenario had been switched, the plaintiff wouldn't have had a judgment rendered in his favor. Just the way it is..

Pain and suffering don’t apply in a case like this. They’re applicable in physical injury cases. Possibly mental suffering, but you would probably need to meet a high standard of proof. I’m not a lawyer.
