    Today's registered wills are live recorded by the registrars office. Where even after execution of will the testator and executors or witnesses have to take oath confirming the same verbally to the registrar. Rest of the points from the lawyer or advocate *if practicing* were awesome a class 👏

    I disagree .After death of Sohanlal,as per will Leela Devi became property holder.So Leela Devi can do will as per her choice.Whom so ever is taking care of her,she will do will on that person's name.Generaly in India,once husband dies,a lady doesn't have kids her brother or brother's son takes care till she lives. Husband's family will not come to see her also. According to me, property should go to her brother 's son,who took care of her.

      this is very tricky situation, the widow lady in most cases would like to live her life with her own relatives because obviously she has more love and attachment with her family then her deceased husband's family, so ultimately when she falls sick her family members will take care of her and in return she will give her husband's side property and wealth to them in her will. Now in such cases the true legal heir of that property (husband's blood relatives) doesn't get anything. Now if the Supreme Court revokes that will and gives the property to husband's niece or nephew , isn't this an injustice to the wife's family member, who took care of her and also they were named in the will.

    WILL is WILL.All other factors are formalities. When a simple paper signed by a person is considered binding on the person then too much thin legalities are being seen in WILL is really awful. In Govt service even an initial is taken as binding and found fit for dismissal of the signatory.😢😅😂😂😂

    You made a good video. Left some vital aspects. Of course you cannot cover it all in 10 minutes. Just tell that just like hologram Will, it can by typed by self at home on computer, print and get signed by a Doctor (who can say if need be, that you were not forced, intoxicated or influenced while making and signing it) and a known & young Lawyer as far as possible. Update & Rewrite the will case there is considerable change in your assets. The Will with latest date prevails. Designate with full details a good family friend/member or relative as manager to execute it in case of dispute.

    Registration valid nehi hai .
    Koi format nehi hai kaanooni . Toh will karne ke liye kya lawyer banna parhega aam logo ko ?
    Koi format keu nehi bana rahe hai court ta ke baad me problem me naa parhe woh log jinko hum apna jaaydaad yea ooska hissa dena chaahte hai ?
    Kya kisi barey lawyer ke help se banaye gaye will ko bhi manyata nehi milega ?
    Court efidebit ki tarha procedure kya will banane ke liye kargar nehi kiya jaa sakta hai ? Aise procedure me toh upasthit sarkaari logo ke bhi hastakshar mil sakta hai will banate waqt .

    Digital records are prone to hackers manipulation. Nothing is safe! Challenge is a challenge and will be best resolved through courts. All need be done is that courts should process cases within genuine time limits and tactics of representing lawyers should not be allowed. Hire more Judges for property dispute settlements!!

    Will by a person who has full rights to distribute or take final call on his/her assets. By constitutional law court cannot deny the rights of the same and the precedore too . Court cannot dictect the verdict in this category

    Exactly, one sibling forges signature on a new will almost when the morher or father are in their final stage. And their crony friends counter sign that will. And the one sibling whacks the entire property. It is not uncommon in india.

    When the property is given by mother by going in court live ,and witnesses are brother-in-law and friend of son ,who is suspected by his brother that he influenced and threatened ill mother ..what is solution..The son who got property never cared the mother and one who didn't get has not with mother on last phase of life..

    Why is it "Hindu succession Act"?
    What rubbish legal system. So confusing..
    The will should be written by a registered conveyancing lawyer. This will should be admitted to the probate court.
    There should be 3 signatures:
    The lawyer & 2 witnesses.
    Their full details and a disclaimer.
    I have understood all the terms and condition and witnessing this will in full mental state. (In legal language)
    The final corse probate court should invite all the owner, lawyer and the witnesses to confirm that they have understood the due legal process and confirm that they have signed in their proper mental capacity. Probate court make sure its genuine, and stamp it. Final!
    No one can then appeal against it or turn hostile..
    If the owner changes his/her mind want to change the will, they need to apply to the probate court for "change of circumstances"

    Ma'am Excellent information. I want to know one thing, if some one has got immovable properties in 5-6 cities/ states within India, can he make and register one will in one city/ state for all the properties in favour of his son, daughter & wife for ease of transfer of ownership after property holders demise. Regards.

    Nomination is not valid,registered will is not valid.Then what is valid .What is wrong with our Judiciary.Laws are meant to help people not trouble them.Is judiciary lacks in common sense

      Registered will is very much valid. The instance mentioned is exceptional. Nomination is also valid but nominee is only a custodian and needs a will to prove ownership.
