It's a commonsense that Will will come into effect only after the person making will dies. After death GPA becomes meaningless. So , simple. But if lower court and high court cannot understand this means our judiciary doesn't possess sufficient intelligence and understanding the problem. Really sad situation for the litigants and common man. Indian judiciary on the whole is mediocre and below average to say the least.

Presumption should be made that property is gifted for welfare of senior citizen particularly when made by senior citizen to avoid future suffering of senior citizen. Onus should be made on Donee that property is gifted not for welfare of senior citizen. VISWANATH E.N
