      I have a question: I totally agree that Qualified Immunity for govt.workers is unconstitutional, however, in this case, If this city council claims immunity, where's hers? They violated hers then. As elected, sworn in exactly as Mayor, if he has immunity, so does she... I see this as an additional point to the rest of the lawsuit. (??)

    A man in my area fought back in a different way. He bought a piece of property to put a landscape and flowers store. He went to zoning and got thru the red tape but before he started to build other similar businesses complained so they stopped him on a technically. Instead of fighting thru the court and because it originally farm land he went and bought 200 pigs put up the ugliest shack and pig pen that you would ever imagine. After 6 months of people complaining to the town they let him put his business there. And the best part it is really a nice place.

In order to avoid this eveuality Congress and the Supreme Court has to act to right the ship and remove or weaken Qualified Immunity and force Police and other powerful governmental figures to have to take personal responsibility for thier own actions and be punished when they break the law and violate people's right.

    Our car was taken away by the police in Arizona a few years ago. The Institute for Justice got it back for us after months of hard work!
    We are forever grateful to the lawyers of IJ ! They also helped our friend in Richland/ Washington to be able to add on to her house !
    It is good to know we are not completely helpless . Thank you again Keith and Paul Avelar. We will never forget you . Merry Christmas to all ❤️

      Simply put, there have been instances where officials wrongfully sheltered behind qualified immunity, only to learn that that immunity is ineffective against lead.
      Which is precisely why that immunity can be stripped from them by a lawful jurist.

    All of the people who are involved in the incarceration of the woman should, if there's any justice, be incarcerated themselves.
    By depriving her of liberty under color of law they violated federal laws.
    This should be brought to the attention of a federal prosecutor and the people who are involved in this should be prosecuted to the fullest extent of the law

Certainly, they would have created evidence that could incriminate them while they were attempting her removal. Perhaps the Feds need to get involved. Hope y'all nail them effers to the wall.

      Qualified immunity is reserved for royalty in Brittain, England and is not legal under the Constitution as no leader shall exercise a freedom under a crown title. Its an act of TEASON against the US. If people wouldn't keep picking up what the govt. Is laying down and instead educate themselves they could better challenge the lies they keep feeding us.       Qualified immunity doesn't protect anyone from criminal charges. It only protects the person from being sued in a civil court. It was created to (financially) protect people who were following orders within their given profession. In no way does it shield anyone from being prosecuted for criminal charges.

      Immunity is based on past precedents. If there are no prior convictions in a similar scenario, then there is no precedent, and the person can claim qualified immunity.

      Qualified immunity is a ruling for unchecked tyranny.
      When the court made that term up, it proved itself a tyrannical branch that doesn't function as intended.
      The fact that the courts haven't reversed it, is proof that it continues to be a tyrannical branch.
      A rotten branch must be cut off or it endangers the entire tree.

      You guys in Texas need an initiative petition to roll back and freeze property taxes like in California with Proposition 13 or in Massachusetts with Proposition 2-1/2. Just make sure local government can't make an end run-around using the police issuing citations forcing people to pay fines through the nose or get thrown into debtor's prison

      I was in city government for 10 years. So much stealing and corruption and the whole council and mayor told the citizens I was crazy. Finally I said I was not running again because they were going to go to jail and I wasn't going with them. Finally the mayor got caught stealing from his regular job and the city clerk turned on him and gave him up for stealing $10,000 in stealing from the city. By giving him up in the investigation she eliminated an audit. The state auditor did not even answer my calls for an audit to stop the stealing. The clerk was in on the stealing and saved herself by proving that small amount. That was a very small amount of what they stole and it wasn't just the mayor. But he did go to jail. I have no faith in government after my experiences at a city level. The power the federal government holds is a million times worse. They are using our tax dollars as an endless flow of cash. They do whatever they want with NO accountability and when you challenge them they have the corrupt press dismiss you in awful ways. But surpress their wrong doings. The press is as corrupted as the government.

      @@saneuser That's actually pretty remarkable that the mayor went to jail, or that even the small amounts of tax theft were uncovered. That's what good people can accomplish. Though it left a bad taste in your mouth, you remind us good people get in too. Thank you for your service.
      As for the corrupt press, they are pretty much an arm of the govt. There's been talk of CIA ties for some time, which has been proven. Most of the presstitutes are run and do the bidding of the huge, always getitng bigger corps, who have far too much money and power. Though they are getting far more by leaps and bounds w/ these citizen ruining lockdowns. It's a big mess of crony capitalism, but it amounts to a technocracy in the end.

      @Harry Flashman jurry nullification is allowed everywhere in the USA. The US Supreme Court has ruled on that. What is not allowed is for you to say the word Jury nullification in a court room, if you do as an attorney you will be disbarred. If you are on the jury and say the word you get kicked off the jury. There is a case that was in the news not to long ago where a guy was standing outside of a court building and was arrested for jury tampering because he was handing out flyers that explained jury nullification. My point wasn't that it doesn't exist, I was saying that you should be able to plea for it. In other words ask the jury to set the law aside. That is not currently allowed anyplace that I have seen, that portion of the TN allows jury nullification but it doesn't guarantee that the defense can present it as an option for the jury.

      I hear/read "should FACE the wall" several times.
      As a ESLspeaker I can't really understand what picture you paint with it.

      Funny I was thinking Justin would love to hear about this case. I believe they said it was in Bexar County so he is pretty familiar with that area too. Betcha Kelly and sloppy Joe know the city manager and chief pretty well too. I am so impressed with the way Justin was able to help turn the council around in LV.

    Anytime things like this happen, a single complaint to a state DOJ should trigger an investigation that would land everyone involved in jail. Small town governments should never feel like they can get away with stuff like this. Government is supposed to exist to protect our rights. When they don't, they dont deserve to exist.

      Unfortunately "qualified immunity" is not even a law and cannot be repealed. It was just an opinion by the Supreme Court that has been given the undeserved status of a law.

    I love the institute for justice and what you folks do, but there are times I think donations would be better served in helping people purchase bulldozers and steel plating. Some days it just seems like there is no justice available except the extreme.

    Led here by link on facebook group "The Change Leon Valley" (also a city on outskirts of San Antonio) .
    The citizens of this town should take the Leon Valley route, recall elections & electing members/mayor who will take action against city manager & cops!
    You should do a story on that town where a corrupt city council & police force was overthrown by both election & legal moves!

    Then those who participated in ousting her, should be arrested for abuse of power. We need to put those drunk with power on notice, the people are now aware of the corruption that runs through our political system and we are looking to clean out the filth so that we can sleep at night knowing that the people running things are working in our best interest.     Anya means "Graceful", "Inexhaustible" and that characteristic came across in your presentation.
    On a side note, most people do not know "case law" is a misnomer. It is legally a matter of Federal Policy and not a matter of "law", case or otherwise. Judges issue "opinions",not law.
    Only legislatures make laws. Justice Kavanough is correct when he stated
    "Judges “must interpret the law, not make the law,” observed Judge Brett Kavanaugh in accepting Donald Trump’s designation to fill Justice Anthony Kennedy’s seat on the Supreme Court."
    Supreme court made it clear
    ""Stare decisis is a principle of POLICY, not a mechanical formula of adherence to the latest decision" " Helvering v. Hallock, 309 U.S. 106, 110 (1940) *emphasis mine!
    Payne, 501 U.S. at 828 says about stare decisis "IT IS NOT “an inexorable command.”
    I bring this up because I went Pro Se all the way to the Supreme Court relying on "res judicata and stare decisis". Not only that, but also on "clearly established law" found in published Federal Statutes. The Federal court found ways to get around "Case Law" as well as published federal law by simply ignoring both. The only effect was to embarrass them for their criminal and "controlling" political agenda which they mitigated by assigning "un-published,no precedent " to the case.
    Don't expect any relief at the District Court level. If lucky you may find relief at the appellate level or Supreme court due to new justices being seated. I only received "partial relief" when I appealed it "en banc", even then it was still a cover up for the District Court.
    These courts have become a major embarrassment to the American Justice system.
