BANNED BY POLICE (SOTA)

  • I was activating ON/ON-001 SOTA and Flora Fauna.
    The Police banned me after 3 contacts and after discussion I go with a penalty.
    No official points with this 3 contacts...
    He told me I will disturb the GPS tracker of the black grouse birds.....
    No words for that......
    (I have everything on video but I will not upload any videomaterial of this Belgian policeman)

    I don't think you will get any offical warning letter for this. I'm sure these letters are fact checked before being sent out, and at least that person should know that the statement that you with your 2m band activity should not be interfering with the GPS trackers of the grouses. You should have asked for which of their rules he thinks you violated exactly (ideally as a written statement or an audio recording) and his name or identification number.
    In 2010 I had LED daytime running lights installed on my '92 Mazda 323F. I got stopped by the police a few months later, because the policeman thought it was illegal to have those DRLs. I disagreed and didn't pay the fine on the spot, so he gave me a paper that he had issued a fine. I went to the police station the next day, showed the car to two policemen, both of them agreed with me that my DRLs are fully legal, installed and working according to the law. They cancelled my fine.

      Thank you for your detailed answer.
      The problem is I was in Belgium I do not know the laws. That is a critical part if you are not in your own land.
      I have the discussion on tape but I will not upload this. If I get in trouble by an officially paper I can send this video.

    I have been checked 3 times this year, in May and June in Namurois by the police and at the beginning of September in Ardennes, Semois valley by forest guards, I am still active in Belgium with Harec license card....and inside the campervan or by bike in GoGreen mode and only in FT8, Silence is golden........it's hot in Belgium lately.

    We also have park rangers here in the Black Forest, they are very strict, but we always find a way to the qrg, 73 from the CB-QRP Crew 📡🙂

    Years ago I had the same problem in OZ, I was in my Motorhome in the parking lot right above the grass blocks, the antenna tied to the camper and therefore no problem of occupations of public land; when I also showed them the oz license they kicked me out kindly and without a fine, telling me that I could only broadcast while camping; you're abroad and with ignorant people what's left for you to do, I dismounted and left. 73 Paolo I2AE as 5Q2AE.

    Sadly the quality of Police in Europe has gone way downhill with many not knowing the law correctly and running with their own interpretations.
    Raise a complaint, though do dig into what laws they are on about and wait for this letter.
    Might be a cop trying a cash shakedown. Certainly all the hallmarks.

    In Costa Rica we have had problems in some places and in others we have been welcome, problems with park rangers who are unaware of our activity, or with private guards in public parks, who are also unaware of what we do, in part it is that, merely ignorance, on other occasions It is pure authority with overtones of selfishness.

    Sorry for your spoiled mood and a very nice activation :( But it looks very unusual for me that the "officer" was demanding for 250 EUR, cash! This is very unusual in Belgium. I used to live in this beautiful country for almost 8 years and have ever never encountered a police officer demanding cash from me. I think, they are actually forbidden by law to collect fines right on the spot, in cash :) Normally, they can only issue a verbal warning, or, in the worst case, send you an official letter with invitation to pay a fine, but in this case it should be clearly stated which violation have you made etc. I used to take part as a solo-participant in actually every field day in Belgium which involved me parking and putting up antennas in many public places, like parks, off-road forest parking lots etc. I've been checked by the police almost every time , obviously I've been reported by the concerned citizens because my 18m Spidermast could have been looking suspicious :), but that's it. After explaining who I am and what I was doing, showing my ham radio license to them , they've been wishing good luck and leaving me alone. But these were real policemen in a real police car, not just "dressed in green" as you say :) So , in your case, could the would-be rangers be just a scammers? May be Belgian hams could leave a comment here, they obviously know best on how to arrange the park activation the right way in ON-land. Good luck with your Moxon next time! 73 ! Linas LY2H

      Hello Linas, I like Belgium I am only 2 minutes away from the borderline.
      Please check the whole video.
      It was an officially police officer in a official car.
      But he told me that he can give me a 250€ penalty but he did not want it. He gave me the warning and I will get a paper from the government.
      5 minutes before he came, there was another man and he was wearing green.

    The bird trackers are on 160 MHz, approximately. Also the receivers are quite broadband, and it is possible that you may have caused a complaint.

    The world gets crazier by the day! Did you show him your licence ? and ask him where are the signs which say no transmitters etc allowed on that site ?

    What's the difference using a radio than using a mobile phone ?
    Did anything become of this ?
    In Ireland I would tell Police to take a hike, nothing they can do, you have a licence to legally transmit. You got to challenge these crooks and ask them what laws you're breaking and demand to see a supervisor.

    Hey! Maybe a time to be more stealth! Take it as a challenge! :-) I have never had a problem with authorities when doing HAM radio, but heard a lot of stories... And even casual people staring at me, asking questions (sometimes it is a good conversation, but often the questions are dumb and they're just laughing at me), etc... I don't like that and so I aim to work in a stealth manner... However, in foreign countries, it's useful to have a license copy, maybe along with CEPT, such papers with stamp and lots of text, looking "official" and "important", may be "impressive enough" for them...

    I thought Ukraine was a wild country, but I’m surprised by this in Europe! I regularly had problems with drunken loafers annoying me, but only once did I have a long conversation with a policeman who was called in by people who thought I was a spy. But since I am a lawyer, I simply wasted my time explaining the legislation to a police officer who heard about ham radio for the first time in his life. In your case, I advise you to find a local lawyer, I’m sure there are some among radio amateurs, and ask for advice.

    But what was their "reason" for penalty? Maybe you should contact local ham radio community to ask for the specific rules in their country.

    The only thing that I can think of is that you should ask permission first before activating. However, it seems the Rangers are not all on the same page. You were going to get messed app either way, regardless. Besides that, you should have had a good activation.

    I think it's just confusion on his part: The Cop was confused as to why you wouldn't just "roll over" and fork over 250 Euros, and it was Good on you for not overreacting. Best to contact your ARRL "equivalent" or operating authority and let them sort it out. Any citation that you are issued I would guess must state whatever specific provision/statute you have violated, and I'll bet that you haven't violated any at all.
    Even here in the US I always carry a copy of my license to show to any authority. Once, operating in a high crime area, I even showed it to a THUG. Said THUG (I think?) was more concerned if I was/wasn't the police, go figure! I DON'T recommend this by the way . 😂

    Hate to say it, but you were probably in error setting up.. Good you asked but it looks like a flora sensitive area and since this was Belgium, there might be different rules.

    This is POTA park ON-0385 . It is a large park. You were in one spot in the park. I find it hard to believe the entire park is off limits for you. It might be the location at the peak you were at. W7RTA

      Well, if there is no rule that you have broken and they cannot prove... you have a valid radio licence and RF usage is supposed to be the responsibility of BIPT as the authority and not any ranger or the police.

    Always Always carry your licence with you when operating in the field or portable as there are stupid laws and stupid people around. Then ask them where are the signs prohibiting transmissions signals ? and on what frequency ? Dont give in to these people who dont have a clue

    A lot of people will blame me for saying thus... but EU slowly becomes Romania before 89'. If you can't enjoy a nice clean hobby in nature.. even a natural park.. then is no different than communism. Actually... before 89 we were allowed to do much more ))). Strange is the direction the world goes into... and the really silly laws. 73 David. P.S. I very much doubt that the GPS tracker will be disturbed. I used GPS trackers on my friend's racing pigeons and never had any issues. The only thing that was indeed disturbing it were the cell phone towers as the signal was always messed up when flying close by.

    If you’re being fined in person in BE you will need to pay on the spot. Or they are happy to escort you to an ATM or to the station if you can’t get money out of it. That’s normal practice there. (I’m from NL, you get it by mail here).
    That said, their argument that you interfere with tracking equipment is bullcr*p ofc. You are doing nothing wrong. I even doubt if they have any rules/laws for HAM Radio use in their woods. I think it was an unlawful action, but I would have done the same, because I wouldn’t want to test it 😅
    Would be nice if someone could sort this out.

    With a Ham Radio licence you got a right to antenna, so they NEED to provide you with the law you've broken, otherwise....

    In some cases they are legal on demanding direct money. I am very sorry for you with this experience.. The police man is not actual on wat you are doing. i say . Go to the police station and explaine wat you ware doing. 0N HF you cant disturb a gps. So let them know that they have to prove wat they complain abbout. Not just asking 250 euro. Myselg ,i wil not pay this.

    After the last wild fires in the “Hohe Venn” authorities have become more and more sensitive to violations of the park rules (like leaving the trails). So in the end it would have even been better if the Ranger who approched you first would have been more strict 🤦🏻‍♂️. Belgium Police can be tough to deal with. Sure this officer might have been a bit „eager“ but apparently you get away with a written warning. So don’t get hung up too much on this.

    It was probably some power trip idiot. They have NO right bothering you if it is a public park. I would fight that and report the Ranger or cop or who ever it was who harassed you.
    Don't let anyone tell you what to do or make threats to you. Your a free person and you can do what you want.
    Besides ham license Trumps over park rangers. Know your rights and laws in your area.

      @@tim46767 Of course, nature must be protected. But "nature", or the "climate" in general, has become a religion. It is about everything else, EXCEPT nature. The result is maximum complexity - for everything there is some rule or law, which is also very dynamic - no one knows what, when, why such and such a law applies. You have this legal uncertainty at all levels. Have fun actually wanting to protect nature in this environment.
