Great observation! The reason is that he did not have to make a decision. S177 of the Constitution has a process for the removal of judges. The JSC finds them guilty, the National Assembly votes 2/3 that the sentence is removal (impeached) and then because the President had to 'formally' approve each judges appointment (as the most senior representative of the people of a country), he must ALSO 'formally' remove them.
The President played NO role in this process. Removal of a judge follows a set process under S177 of the Constitution. The President only 'stamps' the resulting finding and sentencing, as the most senior representative of the people of a country.

Since being suspended on full pay in Jan 2007, Mr Motata has earned about R27m. He does not need to still suck on the taxpayer for an ongoing pension.

I think this is unfair to Judge Motata. How many people in high positions get drunk. They could have just suspended him with caution
