But after course completion when placement comes they even are not able to clear first round of technical discussions. I even don't mind if the reservation is no longer there for creamy layer. But my question is totally different here. This reservation was actually caste based and not based on economic status in the first place. So if now these people do not get reservation, are they now upper caste people? Do these people now get the same societal privileges as other upper castes? Or still these people will get discriminated at every walk of life and still not get reservation. And yes intercaste marriage is one thing to abolish castes. Why supreme court is not focusing on the root cause and not trying to abolish caste first?
SC Reservation was introduced for representation of socially oppressed classes of Hindu society for 1000s of years, that is why a Christian or Muslim convert of such caste is barred from SC caste reservation.... ST reservation was introduced for representation of people based not only for social causes but also indigenous rights as they are the original inhabitants of these lands before other people migrated and dominated this subcontinent.. a tribe conversion to Abrahamic religion does not disqualify him from ST status.. Economic factor is not at all the criteria for all such reservation.. For economic upliftment though helpful due to these quotas is mainly done from Government poverty elevation programs and not from reservation and quotas for such classes.. These reservations are meant solely for representatives purposes of such people and the right of such people to compete within themselves, mind it, they are still competing amongst themselves for their allotted seat, be it poor or rich SC and ST community .. I think the decision to introduce sub classification within these group should be in consultation and involvement of these people.. Judiciary has already caused a major law and order problem from such parliamentary subjects such as in Manipur where the violence and warlike marginalization of two groups is still happening..The ruling Government has to bear the consequences of these ill conceived decisions.. BJP lost in Manipur from both warring factions constituency and is still not being able to face save itself.. Government should stop the Judiciary from interference in parliamentary affairs where thousands of life and law and order problems may arise just that few highly privileged Judges with no ground knowledge of reality interprets the constitution in a vague and illconceived manners.. Empirical data is already available with all states. The high school/ higher secondary students caste data and numbers are available with education department for the past atleast 60 years. The no of students joining professional and higher education is available with govts. Also PSCs have data for employment. Therefore from these data each state can identify under represented groups in sc/sc/obc category and grant quota within quota. Only vested interests want countrywide caste census for implementation knowing well that the centre is not going to concede the demand.
First of all it's "quota within quota" . It doesn't mean it excluded all the creamy SC's from reservation . Quota within quota means if 10% is reserved for SC quota out of 10% for example 6% would be reserved for sub-quota . This is the real meaning of quota within quota . Otherwise they would have been said all the SC creamies are now in general .

SC judgesment is totally brainless. Because this will not come in the SC judiciary. First of all, this problem should be discussed in parliament and the central govt should take decision on it. Even how state govts. will decide of this kind of complocated issue. The SC judhement is totally against to constitution.
You need to read a lot bro. Supreme Court hasn't given this judgement on its own. Government of Punjab brought this case to Supreme Court. The government seeked permission to continue quota within quota which is already in place in Punjab. This judgement is mere a permission to all states. It is not mandatory and binding on every state. Creamy layers is not in ruling itself. So, creamy layer is not part of judgement. It is media which is talking ton of nonsense. Any judge is supposed to write his thoughts, conclusion, reasons, analysis, observations as record alongwith judgement seperately. It is in this section this creamy layer comment came which is not part of judgement. This part which is written alongwith judgement is for future references. As new judges will start ahead only by reading these points and decide what to do next.

Why is SC (predominantly of higher castes) so eager to dilute SC quota for select groups while maintaining its own creamy layer, creamy layers in bureaucracy, in army, in private sectors etc.
This judgment may lead to conversion of scheduled caste communities who are facing differential treatment or marginalization or oppression and deprived of reservation. They will certainly think that why they are remaing as scheduled caste.

Even the wealthy ST/SC s don't have enough epresentatives in both public and private sectors.. Out of 100% SC/ST population,only small percentage may hold good position in both public and private sector.. The vast majority of ST population are still socially educationally and economically backward.. I aslo believe that it is not yet time to bring subclassification..

First supreme should clarify what is base of reservation. What is the SC/ST, OBC population in our country? Which census is caste base census after independence? Then the question of judgement.

I even don't mind if the reservation is no longer there for creamy layer. But my question is totally different here. This reservation was actually caste based and not based on economic status in the first place. So if now these people do not get reservation, are they now upper caste people? Do these people now get the same societal privileges as other upper castes? Or still these people will get discriminated at every walk of life and still not get reservation. And yes intercaste marriage is one thing to abolish castes. Why supreme court is not focusing on the root cause and not trying to abolish caste first?

SC Reservation was introduced for representation of socially oppressed classes of Hindu society for 1000s of years, that is why a Christian or Muslim convert of such caste is barred from SC caste reservation.... ST reservation was introduced for representation of people based not only for social causes but also indigenous rights as they are the original inhabitants of these lands before other people migrated and dominated this subcontinent.. a tribe conversion to Abrahamic religion does not disqualify him from ST status..
Economic factor is not at all the criteria for all such reservation.. For economic upliftment though helpful due to these quotas is mainly done from Government poverty elevation programs and not from reservation and quotas for such classes..
These reservations are meant solely for representatives purposes of such people and the right of such people to compete within themselves, mind it, they are still competing amongst themselves for their allotted seat, be it poor or rich SC and ST community ..
I think the decision to introduce sub classification within these group should be in consultation and involvement of these people.. Judiciary has already caused a major law and order problem from such parliamentary subjects such as in Manipur where the violence and warlike marginalization of two groups is still happening..The ruling Government has to bear the consequences of these ill conceived decisions.. BJP lost in Manipur from both warring factions constituency and is still not being able to face save itself.. Government should stop the Judiciary from interference in parliamentary affairs where thousands of life and law and order problems may arise just that few highly privileged Judges with no ground knowledge of reality interprets the constitution in a vague and illconceived manners..

Empirical data is already available with all states. The high school/ higher secondary students caste data and numbers are available with education department for the past atleast 60 years.
The no of students joining professional and higher education is available with govts. Also PSCs have data for employment. Therefore from these data each state can identify under represented groups in sc/sc/obc category and grant quota within quota. Only vested interests want countrywide caste census for implementation knowing well that the centre is not going to concede the demand.
First of all it's "quota within quota" . It doesn't mean it excluded all the creamy SC's from reservation .
Quota within quota means if 10% is reserved for SC quota out of 10% for example 6% would be reserved for sub-quota .

You need to read a lot bro. Supreme Court hasn't given this judgement on its own. Government of Punjab brought this case to Supreme Court. The government seeked permission to continue quota within quota which is already in place in Punjab. This judgement is mere a permission to all states. It is not mandatory and binding on every state. Creamy layers is not in ruling itself. So, creamy layer is not part of judgement. It is media which is talking ton of nonsense. Any judge is supposed to write his thoughts, conclusion, reasons, analysis, observations as record alongwith judgement seperately. It is in this section this creamy layer comment came which is not part of judgement. This part which is written alongwith judgement is for future references. As new judges will start ahead only by reading these points and decide what to do next.
