    Ok if there was a draft then all you have to do is refuse and when arrested say NOT guilty and demand a trial by jury. With jury nullification which is legal, no one would do any jail time. Another thing is that you can make it clear that if forced into the military, you would turn your weapons on your CO which a few people did or organize and turn against the government which is what Malcolm X did.

    • @janefelix3821
      @janefelix3821 Год назад +1

      That is what was happening towards the end of the draft in the USA, mainly during President Nixon's first term, 1969-73. However, at that time roughly 65% of men ages 18-70 (jury age) had served in the military and thus women in that age group were heavily sisters and wives of veterans. So getting a not guilty vote was impossible, there were none. However, roughly 15% of the trials ended in hung juries (mistrial) so those men walked free. Plus with roughly 12,000 refusing to go, the DOJ could only handle roughly 400 cases so most were let go.

      Yeah if we're at War nobody's going to care. All bets are off if China and Russia start dropping bombs in your neighborhood. There's not going to be a court to go to. If you think it's not going to happen just pay attention to the news. Things are getting bad out there and you're not going to be able to rely solely on men and women that are willing to volunteer to be soldiers. This isn't just for young people either during the second world war professors were drafted. Right now I think the cutoff is 36 but if we're at War I'm sure that'll change real quick.

    The elephant in the room is that the draft in both world wars went up to FOURTY FIVE years old. Given we would be facing off against a country with about 4x our population and an ability to draft whoever they hell they wanted from their population, I think it's safe to say the draft age would have to be higher than would be the case against relatively puny powers like Korea or Vietnam.

    • @janefelix3821
      @janefelix3821 Год назад +1

      Actually, during WW1 the draft age was 21-31, so that was roughly 10 million men, a little less than half were either called up or enlisted. It was just that the war ended roughly 19 months after the USA entered it that the age did not have to be increased. During WW2 it was 18-45, giving a pool of roughly 33 million and the USA's involvement in that war was nearly 4 years, a little of 15 million were either called up or enlisted. Today's enlistment pool is roughly 130 million, ages 18-45, it is larger since women are now considered combat available, unlike in the past. So even 8% of that pool would be over 10 million, way over what is needed in today's war, if not that the massive protests (lack of interest or desire) would cause the USA to seek terms of peace as we did 50+ years ago in Vietnam. Yes, during the Cold War era draft, 1947-73, the draft age was 18-25, but neither Korea nor Vietnam were all out wars.

    • @buckaroobonzai2909
      @buckaroobonzai2909 Год назад +7

      Yep. And nobody talks about the reality that they can just... You know.... Change the rules.
      I could see them drafting any unmarried man and woman under 50 if they draw their number.
      I, personally, will not fight. If my option is jail, I will take jail.
      I am a veteran, though anyway. Hopefully they don't say I am more draftable.
      My last resort, I won't say, but I won't fight for the USA.

    • @janefelix3821
      @janefelix3821 Год назад

      @@buckaroobonzai2909 The enlistment pool is roughly 135 million. So if 4% enlist, that would give a force of slightly more than 5 million, enough to fight wars today. If only 2 million enlist, that represents only 1.5% of the enlistment pool and thus with that small an interest in the war, a draft would fail, if there is that little interest in the war then the draft would not realistically be enforceable.

We shouldn't be forced to fight in a war if we're not in the military. It's against the constitution for a draft and it's against our freedom. They can't just force someone into the military. The president can't just authorize a draft either. It would have to go through the Senate and the House. If the Senate rejected it then it wouldn't even go to the House. It's not impossible... But if the US military wants another repeat the Vietnam war and lose more of their talented soldiers to fragging, it would be in their best interest to never reinstate the draft. No draftee is willing to die for an overzealous officer trying to seek glory and make a name for themselves. If an officer is going to send hundreds to an area that they know is a death zone, that officer is sure to get a grenade thrown into their sleeping quarters
    Protests were only a contributing factor to the change, though fragging was a major reason why the US military had to change. Getting killed by their own soldiers and the fact that said soldiers also used the threat of killing their commanding officer to coerce them for favors is the reason the US military resorted to a full volunteering force.

This seems much more fare to me, everyone would be involved like it or not.

    Well if you are drafted you do have to respond. Doesn't always mean you will be tossed to the front lines. They will put you where they need you. If they need you in communications they will put you there and so on. If you don't respond it is a felony offense, I don't remember what the timeframe of jail time is. If you leave the country to avoid it you are never allowed back into the country, my dad had friends who went up to Canada to avoid the draft during Vietnam, they completely regrest it but cannot come back for anything. Not even a funeral.
    Besides a draft is a very very last desperate resort for if their is an immediate threat of an invasion from an enemy. That is one of the reasons President Lincoln had so many drafts enacted because the enemy was right next door and were "coming across the border" so to speak so he had to keep the military numbers up for defense. It will be the same scenario for a draft to be enacted.

    • @janefelix3821

      If you remember, President Carter, on his first day in office, January 21, 1977, granted a global pardon/amnesty to the roughly 35,000 who left the USA to avoid the draft during Vietnam. Many of them did return and lived their lives in the USA. Also, the draft is not only used as a last resort for an invasion as did either North Korea or North Vietnam invade the USA or pose a threat of invasion? Yet the USA drafted for those conflicts. The draft is used for whatever Congress says it's used for. It is just very hard today to impose one as laws and standards in the military have changed, especially with the Americans with Disability Act (ADA) so it may be very very difficult to force anyone to enlist.

      Doesn't make a difference as Congress will decide on who gets drafted only when they actually implement a draft, not before. Currently, Selective Service is a data mining entity of names that can be used for recruiting purposes, but there is no way of making anyone who does not want to enlist.

    In these times of equality and women's rights, why are females exempt from the draft?
    Also, given that there appears to be no one in government that can determine what a woman is, how do they decide who is eligible for draft and who is not?

    • @beadoll8025
      @beadoll8025 Год назад

      Women have the continous burden of birthing the next generation. So, you want women to birth and serve on the frontlines? Are you a coward? What is the man's burden? Are biological males capable of birthing children? NO! Men's burden is going to war. I don't agree with draft, but your daughters shouldn't be on the frontlines when men are nearly 40% stronger than women. Drafts are rare, but men need to be men and stop thinking women should be put on the frontlines.

      No, they're not. There is an election next year. A draft would guarantee a Republican being elected. Plus a draft has to pass Congress (Republican House) and deal with a Filibuster in the Senate. Good luck.
