Judge Sentenced Woman To 93 Days In Jail For Laughing During Fatal DUI Sentencing

  • Phillip Scott reports that Amanda Kosal has been sentenced to 3 to 15 years in prison for a deadly drunk driving crash this past summer in Redford Township.
    Kosal, who was 25 at the time of the crash on June 23, admitted she was drunk when her vehicle crossed the centerline of Beech Daly Road near Plymouth Road. She struck an SUV head-on, killing 31-year-old Jerome Zirker and severely injuring his fiancé, 31-year-old Brittany Johnson.
    During Thursday's hearing, Judge Qiana Lillard had two people removed from court for speaking and laughing before Kosal was sentenced.

      I worked with a HS kid that was killed by a drunk driver in the worst way. Not only was the car totalled, but it rolled down a steep hill and was hit by an 18 wheeler after impact.
      The woman only walked away with a few scratches and cuts, on top of her car being totalled. She got 25 years no parole.
      Sad because the girl I worked with, Kira, had just graduated HS at 16 and was headed to Clemson University on a full ride scholarship.

      Merlin and Fire, don't pay any attention to their comments. Don't give their comments any more power than what I am giving in this response. The difference between your opinion and theirs is simple. Your thoughts derive from an opinion based on character. You mentioned the judge is "good" because she held the defendant's family accountable for laughing while the victim's family was speaking. That has nothing to do with race, gender, etc. That is sheer character. Then on the flip side, you have this random troll saying the judge "sounds like ghetto trash" and that she threw the laughing woman in jail because she was "laughing while white". The commenter then concludes their statement asking for a debate, as if this situation is debatable. LMAO. The judge didn't throw her in jail because she was white, she threw her in jail because she lacked a common person's decency and acted out in a court of law. In the end, it's her courtroom and she has the power to enforce laws based on good judgment. How can you be so blatantly disrespectful to laugh while a grieving family is sharing their testimony? You see, this isn't about being white. It's not about being black. It's not left or right, up or down. It's about showing your respect for a family who's mourning over the death of their loved one. Some of these commenters, along with the disrespectful family in the courtroom, are showing very clear character flaws. Until we can move forward together, we have to stop basing our opinions on outdated stereotypes that do more harm than good.

      ITHEREONETHATHASNT The judge seemed like she did act more for a respect for human life and the court, but the judge did handle it poorly. The clip doesn't show enough to really make judgement or, if it does, I wasn't able to detect enough of a disturbance to validate contempt, personally, but I am very doubtful that it was anything racially motivated.
      On the topic of the judge herself, she is not the most fluent in her rationale, in my opinion, and comes off as unprofessional with the way she speaks. She seems to be reactionary, which is a horrid quality for a judge. It could, however, just be because of this specific incident. I don't know the judge well enough to make that assertion with certainty.
      I like to live in a world where race and gender don't matter, because they really don't. Genetically, you are better suited for certain things because of your race and gender, and we have no right to change genetics, but we also have no right to restrict a sentient being from doing as it pleases.
      I consider myself a right leaning libertarian, (primarily a centrist with a distaste for the radicals and a mild tolerance for activists.)

      Inquire98 I agree. It's okay to drink, have fun with friends, but make sure you have an organized sober ride home or call a taxi or Uber. If you can, spend the night at your friends and everyone puts their keys in a bowl and put away away. Also you have to be careful in the mornings to make sure you are not still intoxicated because you can still be DUI.
      One of the worst things that can happen in a person's life is to take another life simply because you didn't prepare a safe, sober ride. It runs your life along with the family and friends of the victim.
      As for laughing at another person's pain in this situation, it is entirely possible that when certain people get nervous, scared or tense in a sad situation they laugh involuntarily and that laughter can be contagious. It's like when you are in church, and you are asked to bough your head and pray, you can hear a pin drop as the room is so quiet, and all of a sudden your stomach growls so loud that it makes you and every one around you laugh. Now it's an inappropriate time to laugh but it is indeed an involuntary laugh. If it happens in church you may get disapproving looks but you won't be banned from church for 3 months.
      Laughing in a trial where people are grieving the loss of a lives one at the hands of your friend or family is more than inappropriate and 3 months may seem harsh but perhaps she is sending a message to them that needed to be delivered. I do believe that the time will be reduced as there is not a lot of room to hold people in prison for contempt charges as its expensive and reserved for people that have committed more severe crimes. But the Judge got her point across and hopefully it will make an impression on some very immature and uncaring young people with chips on their shoulders.
      I hope this makes sense to all of you. What are your thoughts.....I would love to hear.

      The best sentence for the DUI offender would be to provide payments to the deceased family in place of the father's income that was providing for that family, instead of making the taxpayers responsible for someone that broke the law. If they can't do that, then they should be sentenced to a lengthy prison term. Fifteen years isn't even punishment, it's more or less a reason to get by with murder.

      If it was so funny, if I were the judge I'd sentence them to pay restitution to the victims family until the youngest child turns 18 years old. That would be the appropriate sentence. Hit them where it hurts, in their pocketbook.

    What a shame! I am glad the Judge caught it. I am so sorry to the family for seeing this disrespect for them and their family member who lost his life. RIP!

      Yes, I’m VERY glad that the judge caught it. I’ve seen lawyers coach their witnesses right under the nose of a judge, laughing, arguing with the prosecutor, and so on, so it is very refreshing to see a judge actually be aware of their courtroom, and hold people accountable!!!

    #1 People are capricious, moody, irregular, defensive, and sometimes egotistic.
    #2 Judges are people.
    #3 Contempt of court is largely subjective, and the judge decides when it has occurred.
    #4 Therefore, in court you are at the mercy of the judge's whims, in a very real way.
    #5 That makes any court a dangerous place.
    #6 If you are not prepared for the threat, stay out of the danger zone.
    In this case those people had it coming. Might as well be laughing at the funeral for all the difference that makes. Disgusting trash.

      There is such a thing called protocol; court protocol. The last time I was a defendant, when I walked up to the front of the courtroom to meet the public defender she said to me “ I thought you were one of the lawyers.” Can you imagine why?
