    As a Canadian, the actions of the Supreme Court, has been the saddest moment in my falsely and naive belief, that moral integrity existed somewhere in such a powerful neighbouring country. . It is corrupt through and through. God help us all.

      1) Authored the Starr Report and recommended Clinton's impeachment
      2) Personally pushed to make all the dirt on the Monica Lewinsky scandal public
      3) In his only supreme court case argued for weakening protections on the executive branch
      4) Used federal funds to support non federal outside investigations into the Clintons
      ... Is now, years later, as a supreme court justice himself, suddenly extremely concerned about protecting the executive branch from "creative" abuse of prosecution.

      If the president performs an act that he/she believes is in the best interest of the country, it cannot be challenged. Bush invading Iraq, Obama killing Anwar al-Awlaki, or Trump challenging the validity of the election - each president believed that his actions were in the service of the country, so you have an illegal invasion, the extra-judicial killing of a US citizen, and the challenging of election results. All of it is distasteful but the precedent was set long ago.

      I think the 3 Trump appointed justices should recuse themselves from all cases that relate to Trump also. That would still leave 5 justices to deal with this case and that's plenty. They should never have taken it anyway. It is a B.S. claim. No one should have total immunity.
      Vote Biden/Blue all the way down the ballot. Vote every MAGA/election denier out of office.

      Justice Roberts spoke to this, you are 100% wrong. On the lower court ruling - "it says simply a former president can be prosecuted because he’s being prosecuted" which is considered to beua very dumb position haha by the lower court. Law doesn't work like this.

    SCOTUS does a lot of handwringing about having to do their job and then they punt on doing their job. KBJ said it best and I paraphrase "why are we even here talking about what crimes the President is allowed to commit" when POTUS is required to faithfully execute ALL of the laws. Alito was worried about POTUS making mistakes which might run afoul of criminal law but you have to have bad intent to run afoul of criminal statutes. Over 40 Presidents in our history managed to do their jobs without absolute immunity. We are only here because of the misdeeds of Donald Trump. If there was ever any doubt of SCOTUS being a political body, today should have squashed all doubt.

      It’s time to exercise congressional oversight of the Supreme Court and impeach justice Thomas for conflict of interest and falsifying records and to impeach justice’s Kavanaugh and barite for lying to congress and finally have a real investigation into kavanaugh for attempted rape, if for no other reason than to remind them they are neither above the law nor the law they are there to interpret the constitutionality of laws not to advance their political views

    I think Thomas sounded guilty himself, judging by the tone of voice and questions he asked. I believe he’s fulfilling “a favor tho” and I think this host is right. Thomas should have recused himself. 😮

      The rest of the World is starting to see what a facade "American Exceptionalism" is. The Constitution has been revealed to be weak, the "Rule of Law" to be "The Rule of the Rich and connected". The Country isn't really a Representative Democracy, it's an Oligarchy. Anti Intellectualism is strong in America. Education has failed the country. Like most countries with a Presidential System of Gov't, it's prone to civil wars, dictatorships and corruption. The US thinks freedom comes from being able to own a gun, unfortunately for them, many other first world countries are much safer to live, and have affordable health care, and are just as free. People outside the US can clearly see the country has fundamental flaws, and is all about money and fame. The US, with a narcistic, rich, vengeful idiot at the helm, keeps the rest of us up at night wondering what nightmare is going to be thrust on the rest of us to deal with.

Presidents have sovereign immunity for acts that they perform if they believe they are in service of the country. Trump thought the election was stolen and the correct thing to do was to challenge it.

      Considering the founders didn't plan for the SCOTUS to be involved in these kinds of decisions in the first place it's kind of weird that the textualists want to get their word in what the DOJ is allowed to do (Congress created the DOJ, and the modern argument is that agencies are more representative of what the people want than SCOTUS, but apparently only when it's a republican president not a democratic one)

      This case should never have been taken up by then to begin with. There is no need to "decide" immunity for a president. A president is no more above the law than any other individual. If any ordinary citizen has done what Trump has done, they would have been locked away for life.

    America has to take the politics out of the justice system. In Canada judges apply for the job and are"hired"by a panel. No body asks how they vote. There is no built in bias, ie, Obama appointed or Bush appointed.

    Maybe Biden should just lean into it, since they're such huge fans of the president being immune - guessing they don't mean non-GOP presidents, though.

    Where in the Constitution is presidential immunity mentioned? What law was compounded to define it? As neither of these exist, why is this issue before the court? Executive immunity is a courtesy extended by the Justice Department and nothing more. It’s up to the Attorney General to decide this, not the Supreme Court.

      no doubt, luckily if presidents have immunity, biden has a duty to protect america from trump.

      @@DannyMancheno Unfortunately, Biden is too weak and institutionalist to take that kind of an approach. Which is a shame, because at that point, it might be the only thing left to save America from the fascists. But sadly, as people with common sense have been saying since 2016, none of this would be happening if we had elected Bernie.
