If riots, looting, and violence ensue in regards to the upcoming verdict, you won't have any business to conduct. Business owners will be completely moving out if the area, never to return. Housing will also suffer due to residents leaving the area, never to return. Therefore, relocating your construction business there would be financial suicide. The judge is doing a great job at ensuring a fair trial. Neither side should be able to sneak in last minute evidence. To be clear a mistrial doesn't mean that he's innocent. It just means that they would have to do everything all over again.

You can't bring additional evidence that the defense cannot review as part of established procedures. The prosecution brought it's case. They had plenty of time to review evidence and provide the defense required information.

This “new evidence” is to give a plausible excuse to the state when the time comes for them to explain how they butchered this case so badly.
At this point, the prosecution ought to trigger a mistrial anyway so they can fix all their mistakes.

@@Pats4lyfe I didn't get the impression he was saying that he wanted someone to humanise Mr Chauvin, I thought he was talking about standard defence practise especially given the damaging video evidence. It's possible to discuss what should happen in a case without wanting it to happen. Not everyone has a personality disorder that makes them emotionally invested in the business of strangers like you seem to be.
The simple fact is that one would expect the defence to try to make Mr Chauvin seem sympathetic. That's something they do even in cases of child murderers, when the defence team try to come up with excuses as to why the person has done something worse than an animal would do. Usually if the guilt is known, they use the pervert's own abuse as a child to get sympathy.
In this case there's no way to humanise Mr Chauvin because if the defence brings someone in to say that Mr Chauvin is a nice, angel of a man who would never do such a thing, that would open the door for the prosecution to ask about an incident from 4 years ago when Chauvin did the same thing to a boy who was about 14 years old. He knelt on the boy's neck even whilst the boy cried and pleaded that he couldn't breathe, until the child became unconscious and the only reason the boy lived was because he was put in the recovery position. The *judge* wouldn't allow this incident to be mentioned. That's also why Chauvin couldn't testify in his own defence. If he claims he didn't know what he was doing, the prosecution can immediately bring up this issue as well as his record of using excessive force elsewhere.
The prosecution didn't do anything to protect the man. The prosecution team are lawyers not medical experts. It's the doctors' fault that the evidence was made available in time. Please calm down and look at it objectively.

@Sarah Alderman he is penalizing them by indicating that a mistrial will be declared in the event of the witness discussing certain aspects of evidence. The defense wants that. And he made a good point that sequestration due to the Daunte Wright issue could lead the jury to believe that they are in more danger than they probably already believe themselves to be in. Don't get me wrong, they are in danger. Moving to a different location would further add to the stress on the jury and influence their opinion, likely towards conviction.

To be clear, the judge *believes he has no choice* but to declare a mistrial if the whole trial train lurches off the tracks. Everybody has to adhere to the rules of the court room. Evidence was filed *very late* so you have to proceed carefully 😬

All a mistrial will entail is a new trail, re canvassing of jurors and the prosecution, defense and judge getting to cross their T’s and dot their i’s.
They’ll have to go through opening statements and witness examinations again but that still doesn’t determine the out come or help the prosecution.
No, actually the judge tried to prevent a mistrial because the prosecution was about step onto thin ice. I thought the judge actually did a good job here, having the foresight to delineate clearly what the witness was and was not allowed to talk about.

I really really cant say this enough. But this judge is top notch. Bright. Alert. And 100% in charge of this trial. And has been very differential to both sides. And I've enjoyed watching him conduct his court room.

Didn't the witness in fact bring up what the judge said they better not, and instead of calling it a mistrial, he went back on his word . I think he is being influenced by what's going on with the riots. He didn't even sequester the jury when when the riots stated this pay week. You don't think that will have an affect on the jury?

In any of the cases I have watched this judge is probably the best in regards to his thoroughness,so as to make sure there is no stone left uncovered in regards to fairness for both prosecution and defence.

It is the prosecutor's "evidence". If there was evidence it is the prosecutor's fault for not bringing it before. This prosecutor is obviously aiding the defence.

The way they charged him, there was never a solid chance of conviction. The verdict will be not guilty and riots will ensue. Stay armed and stay safe people.
I've been watching most of this trial, and I gotta say this judge is pretty solid. He knows it is a high profile case, and yet he has remained even keel the whole time.

@@penelopesimpsonadams624 It's his job to drill them for information, not to be nice and courteous. Sometimes you really gotta drill a person for information, because if they show any doubt in their own testimony that could cast doubt on the entire prosecution. If they know what they remember, they'll stand firm in that belief. The court isn't going to let foggy memory get used as evidence, so you have to be strict on witnesses.

People know nothing about law. A mistrial doesn’t mean that absolves him and acquits him from the chargers. They just retrie him again, this time with all the evidence.
I am absolutely gobsmacked that we get to hear this but the jury does not!
The judge is discussing the evidence. It would entirely inappropriate for the jury to hear what the judge thinks in regards to the witnesses and the evidence they've given. If the judge could in principle have this conversation with a jury in the room, then a judge would have the ability to directly influence the jury and that would be very wrong. Even if in this case, it may have been beneficial.

You don't get to spring evidence in the middle of a trial. Everyone knows what's happening months in advance so all information can be investigated. This is the prosecution trying an I got you.

Failure to disclose in discovery or concealing evidence, exculpatory or not, should automatically lead to the prosecutors being brought up on charges.
Did you even watch till the end when they clarified that there is no new evidence. Abd that the defense already has the evidence they were talking about. Next time watch till the end.
@@lovepeace216 This evidence was labeled in pre-trial hearing, but when defense team's medical experts were reviewing physical evidence many samples were not available. I'm not claiming anything sinister. BUT, with any high profile trial, everything must be perfect. I suspect a huge part of the problem lies with the courts budget being cut and the expense of the soaring crime rates.

So the prosecution left out obvious important evidence leaving daylight for the defense. Smh
You gotta listen better the judge is trying to ban certain pieces of evidence based on some court procedural issues that out of his own mouth were not done in bad faith so at the courts discretion any new evidence can be entered into the trial, the judge is trying to help the defense secretly because he knows the defense nothing to stand on, but if you listen to the last few mins of this video, the prosecution just said that the evidence was already submitted on both sides an that the o2 % reading is inversely related to the co2 % meaning the findings was not new evidence being entered into the court but a more thorough explanation of the evidence that was already submitted by the prosecution in may. You gotta pay attention this judge just showed his true colors he wants a mistrial end of story.

@Raymond truth hurts, pony soldier. He used a less forceful approach than he was justified to use, and apprehended George on the ground at his request. In previous arrests, George also used the "I can't breathe" (Eric Garner) and "momma" lines as a means to escape custody then, too. It's a tragedy he died, of course, but George Floyd alone could've prevented his death from the moment he woke up that day. Or the day before, if he was up all night getting high. I get high too, but I dont use counterfeit money to rob stores or do anything but fully comply with police if I'm being detained lawfully.

Prosecution states in the closing argument that 02 sat was 98% & co2 normal level. How can he have died of asphyxia if his oxygen level was normal? Im in the medical field so this got my attention. The jury may not be aware of the implication.
This prosecution did this purposely. The judge is pretty upset and said "even if it due to bad faith", however he knows he has to upload the law.

Prosecutors make this calculation all the time when there's strong evidence they aren't allowed to introduce in a case that hasn't gone as well as they would've liked. If a mistrial is granted, the State gets a do over. If their isn't a mistrial, then the Jury hears the evidence.

Don’t forget the prosecutor works under the attorney general and any evidence is submitted through the ag office first before anything else. So the ag knew full well the exculpatory evidence prior to it coming into the court

This is puzzling to me. When Dr. Tobin took that oath, he is bound to reveal and "speak the WHOLE TRUTH". Restraining him and preventing him from speaking about that normal or acceptable Carbon monoxide range on George Floyd of 2 % would be contrary to the oath he took. So you can’t bring it up to the jury but when they go home for the weekend they can put on you tube and watch it.
They are told not to but they could. They really have no choice but to trust that the jury will be honest and that they don't want to anyway after hearing it all day long.
Jury’s always go digging and they always talk amongst each other about the case before deliberation (which they are not supposed to)

If I was on jury, and I am not biased because I don't live in Minnesota and I don't know either one of these gentleman but with all the contradictory testimonies by the medical professions it would really be hard to say guilty or not. Too many differences to go on.
