      1st offender plea deal, 5 years probation and their criminal record will be cleared and sealed upon successfully completing probation. Even a mildly incompetent public defender can get this sentencing.

      @@jonnie2bad Any mildly incompetent ADA would say hell no. Plea deal for 25 years, with parole eligibility after 10 years served. Train wrecking is a capital offense in some states, though they are usually old laws from a different time, and probably wouldn't be enforced today. That said, it can still be a life sentence.

    He not only endangered the train crew, but if the train was moving faster and had hazardous or flammable materials on board, an entire neighbourhood could have been destroyed. He had no idea what speed the next train was going or what it was hauling.

      Me too. But I don’t even film them sometimes. I just live in the moment because most of the trains I see are just NS locomotives. Unless I know a heritage unit is nearby i usually don’t record.

      @@NorCaliRailroading2023 I think I know the video you're talking about. It wasn't clear from the video if the person was still standing near the camera, or not. If he placed the camera and walked back, then it's no big deal. If a loose strap is swinging and destroys the camera, it would suck for sure, but it's replaceable. If he was actually standing by the camera when the Z flew by, then that's just stupid on his part.

    You know up until the one kid started uploading the videos of setting switches and trespassing to get access to locomotives at a yard, railroads thought Railfans were somewhat of a nuisance but one that had a higher benefit of being able to see areas and warn them of nefarious people and actions along the rails. Basically a free set of eyes and ears that would offer a little more security for nothing more than filming their trains doing their job. Now that this is happened, that will swing completely the other way. Railfans will be declared dangerous and the people that hated you at the railroads will win in the conversation. Not only that but they will have to increase security around switches in dark territory to prevent this from happening again, costing them even more money to retrofit switches. Although, if a kid can do it, it probably should have been fixed years ago.

      Older fans probably were more of a help, wanting to be a part of the endeavor. But with social media, simply being a fan and being a part of it isn't enough, now you have to do more and more to get views and likes and all that. Pretty sad.
      What's going to happen now is anyone posted up watching a train will have the police called on them for fear of another incident.
      Truthfully though, it's shocking these switches don't have any automation or sensors. Small solar and cell/satellite sensors are dirt cheap today and could be deployed everywhere rather quickly.

      The reason why the rail industry hates 'railfans' is because they didn't lift a finger to punish people who did things like this. The fact that the first guy making videos of himself playing with switches didn't get physically battered and publicly humiliated by the 'railfan' community ensured that other guys would do the same thing. When your group's reaction to dirtbags within your community is to whine about it and let the police handle it, then things will never get better. I'm not saying you guys should kick the crap out of this kid. That boat has already sailed. Now you get to be considered equally as malicious as him while he makes fun of your community for being pushover cowards who won't defend their own hobby from imposters using it as a shield to commit crimes against society.

    Its starting to make sense why many railroads dislike railfans. And its a shame too because not every railfan is willing to derail a train for clout. It sucks that im saying this, but I can easily see railroads here in the U.S start to take major action against railfans after this accident in the near future at least.

      @@DanknDerpyGamer Like them reporting railfans to the railroad police the moment they spot them near the tracks with a camera and a tripod. (Except for maybe a railroad crossing), possibly them having to have a security guard on board the locomotive at all times as one commenter said, anything really. I may sound unrealistic but considering this kid managed to flip a yard switch (which by the way should have been locked) And derail a freight train and caused major damage and could have gotten someone killed, those are almost the railroads only options to prevent this from happening again now.

    Yesterday I went to see 4014's return to Cheyenne, and some dingleberry tried to get into the cab, but he relented when Ed told him off. Ridiculous as that was, I miss the days when that was the worst you could expect from railfans.

      Would that be trespassing to try to climb into a steam locomotive cab on a class 1 while it is idling but in active use? Probably yes. He had no prior permission to do that. I got to climb into 611's cab at Strasburg in Sept 2019 for a whistle blow I already had paid for. We rode behind 611 as well before that.

    I, from the start, thought it to be quite a coincidence that he happened to be RIGHT where the train derailed. Along with that, he already came up with a full-blown story of how an empty coal train had forgotten to realign the switch to the main after setting off a car. Already had an unlikely event, but he already came to the conclusion that the switch was misaligned well even before the investigation was complete. Also, judging by his reaction to the derailment, he handled it surprisingly well. I think most of us would have said some other things.

      When the previous train set out the defective car they would have had to realign the switch to the main to back onto the rest of their train, unless the defect was the very last car.

    As rail fans we should disavow this publicly and make it clear these people are not rail fans nor are they part of us.

      That's meaningless. They're part of your community because you let anyone be part of your community. You have no organization that can police members and speak officially to other parties. You create a market of ideas and your social group financially rewards people who record events like this. This means that the criminals are part of the community since they feed off of it while using it as a shield. Had there not been trainians all over the world messing with trains, then there would be much more scrutiny for people who seem overly interested in the rail system.
      Saying you disavow this criminal is like saying you 'stand with Ukraine;' it meaningless words unless you actually try to do something to help. Your opinion about a criminal disguised as yourself means nothing to the potential victims of criminals like him. Unless you can create an organized group akin to the VFW, Masons, or Rotary for your hobby that can punish criminals and speak for your group, then you'll always be burdened by criminals who try to use your hobby for their own personal gain regardless of the cost to you or to the rest of society.
      When previous criminals within your hobby were causing problems in the past, you guys should've done something about that. You should've made sure to punish those individuals for tarnishing your reputation instead of just relying on the police to handle it. This is what groups like the VFW or Masons do when criminals enter their organizations and try to exploit them for person illicit gain. Those organizations make sure to punish the criminals harshly and distance them from their groups regardless of how well the police and courts punish the perpetrators. A bad doctor should fear his peers more than the law. A bad veteran who's a member of the VFW should fear their response to his illicit actions more than the punishment dealt out by the courts. When your social group has an organized system, then it can weed out the bad people and punish the criminals who try to weasel their way in.

    I maybe harsh! Good! As a retired Locomotive Engineer,I thought I had seen it all from irresponsible "foamers",Climbing on Equipment,running across tracks as we were bearing down on them,etc. I even had one character use a flashbulb to take a picture of me in the cab.I was running Multiple Unit Equipment. I thought the cab exploded and put my train into Emergency. Having said this,I have found that MOST railfans are respectful of Property and have even assisted us like when you are stuck somewhere when it is 95 degrees and somebody brings you a cool drink. This VANDAL should not be charged as he was. He should be charged with 2 counts of Attempted Murder and Felony Assault for the Engineer and Conductor,who I am sure suffered some sort of injury. This is WAY beyond the pale,and serious time should be given upon conviction.

The railroad paid for exclusive use of those frequencies, long story short, don’t mess with the government’s money.

    5:41 The gross overuse of the term "terrorism" really drives me up the wall. Was this destructive act for the furtherance of political goals? As far as we all know, no. So it does not fit the definition of "terrorism," which is the act of, or threat of, violence in the furtherance of political goals. The way it's been misapplied and stretched by the government in the last 25 years to cover things it shouldn't is infuriating. The least we can do is not misuse the term, and check those that do, to start reining its use back in to where it ought to be.

      "One bad apple" is bullshit, hobbies are not barrels of apples that face disease. "Good" railfans don't become bad just because there are bad people who like the same hobby,

      No, because the railfan community had no barriers to entry and thus criminals could walk among them and use them to profit off of criminal activity. The guy dropping concrete blocks onto cars isn't part of any community except the pedestrian community and that community would actually physically punish him if they saw him doing that instead of sitting on the internet and whining. If you open your doors to everyone, then you're going to be inviting in problems.

      @@ryelor123Barriers to entry are a silly thing to consider because the criminals don’t do it to be a part of any community. They do it for social media clout. And that has no barriers to entry. You don’t need to be licensed doctor to post medical advice on RUclips unfortunately,
      although sometimes there is enough outrage that a video is taken down. You won’t ever get this for people filming trains though.

    Here’s some context, as this incident is semi-local to me.
    This is the OPPD arbor line, it runs from Lincoln, NE to Nebraska city, NE. The power plant in NebCity owns the line, a 3rd party maintains it, and BNSF hauls the coal to the plant over the line. There is one shuttle elevator that UP serves further east. This line is dark territory, also very hilly and curvy which requires trains to run 2x3, and they still stall out coming out of Lincoln on occasion. The crew of the empty train would’ve had to throw the switch back after setting out the defective car to put the train back together as stated above they had 3 DPUs. It was also said the switch had been tampered with and supposedly locked before the incident occurred with the loaded train.
    It’s pretty obvious the kid did it, which tallies this up to being the THIRD incident to occur in the Bennet area in the last 3 years. This line was reopened in 2021 after 17 years of dormancy when BNSF got the coal bid back, the first incident in ‘21 was a washout causing a derailment NW of town, derailment 2 east of town when a bridge gave out in ‘22, and now this.

      @@JH-wd6dp That was a legit derailment, a wooden bridge gave out underneath one of the loaded coal trains. It was one of the bridges they didn't replace when rehabbing the line in late 2020 for the reactivation.

      A big difference now is that the kid used the train-sniffing community to make money from his criminal act. He wouldn't have done it if there wasn't a community that would praise him had everything gone to plan. This is why innocent people who are part of a group get blamed for the bad apples within their community. Train-lovers should've created an official club with membership and standards that would police the members of that hobby. Instead they didn't and they complained every time some criminal used their hobby as a means to profit off of crime.
      This is why groups like the VFW, Rotary, Masons, various unions, and professional organizations all exist. Its so that their social communities can impose standards on its members and punish criminals beyond what the law itself would do. The trainsexual community should create their own trainwatcher organization so that stuff like this can't happen. If you want to annoy train captains - or whatever their drivers are called - without being labeled as a terrorist, then you need to weed out the criminals from your hobby lest they define you as another one of themselves.

    The kid at 1:26 could not have "found a talk button on his scanner," that's like finding the "pop wings out and fly" button on a Honda Civic, it wasn't built with those parts. Kid must have been using a different kind of radio transceiver and set it up for the railroad frequencies. It's cheap. It's easy. It's STUPID. If someone knows to be looking for you, it's so simple to track you down that radio hobbyists practice it as a game, they call it "foxhunting". It gets punished severely when you get caught, the FCC can't be bothered if you interfere with ham radio hobbyists but they bring down the hammer of the gods if you mess with business bands. If you don't know what you're doing you could interfere with something safety-related like airport navigation aids or ambulances. Don't do it.

Just don't do anything too stupid like jamming the band or transmitting out of band, both of which are likely to get some unwanted attention from the FCC.

      I was a railroader for over 20 years between Amtrak OBS and CSX T&E. When I finally left, I made absolutely sure that they recorded my turning back in my radio and switch key, just for reasons like this, so I would not get a knock on my door from a special agent checking to see where I was when someone stupid did something like this within a hundred miles of me.

    I have always been a rail fan. But I would never do very dump and dangerous things like this kid. I had model trains and, when I was old enough, I went to work of the Southern Pacific Railroad. I had a great career with that wonderful railroad. Train wrecking is a Federal offense which can send you to jail for a very long time. To be a rail fan means that your "love" trains. And you don't try to destroy and cause problems for something that you love!

    So this is where the rest of us step up and show them all how real railfans act. For years now I've been saying we need to set the example, not try to be the exception, and now is the time we all really have to do that. Stay a safe distance from the tracks. Cross only at marked crossings, if crossing on foot, stop, check both ways, step over the rail. If we act reasonable and set the example for how to behave safely around trains, then the railroads and trains crews will not have any reason to dislike us.

    Im known on my old subdivision by some crews and maintainers ive gotten a vest and even crossing bells they know im not crazy. I have learned to stay back from the tracks after having a random reality check a couple months ago. Its just mind blowing to me how him having autism was an excuse to some people.       I’ve gotten a few things as well. Have a decommissioned cross buck stashed away for some year to grace a shop wall given to me watching crews replace an overhead cantilever signal.
      In 30 plus years being mindful and courteous I only got in trouble once. And yes I had to pay a small fine.
      Up at the cascade tunnel, pre 9/11 we could almost walk up to the tunnel for shots. Post, even a decent 300mm telephoto makes shots different due to the Telesmoosh. I wanted a better shot so I entered the edge of the yard to and hiked to the Tye River Bridge and set up on the edge of the edge. 5 mins later I heard on the radio a “RF” was in the yard.
      I didn’t try and run. I just was met by an officer at my truck.
      I believe they have laxed it a bit recently but this will just make it harder.

    You know, I was telling someone a while back I'm starting to want to distance myself from the railfan community for all of these reasons. I don't understand what has gotten into people lately. I genuinely worry that within the next few months or years, even being spotted near tracks with a camera is going to warrant investigation or be outlawed entirely simply because people can't stand to keep their hands to themselves. I sincerely hope we can go back to being normal railfans and not genuine felons and delinquents.

I'll admit that outlook is fairly dark, but these days there's no telling what will happen. I only say that because maybe i am less worried than i would be if i were still hardcore. but you will always have crazy people doing stuff. some that we will never hear about. i have distanced myself slightly, because a lot of railfans seem to be opiniated or bullies at times now. but also because photography opens up everything, not just trains.

    I'm gonna be that guy. Let's put down our pitchforks for a minute and admit that the idea this kid really did cause this derailment is mostly speculation.
    1. This kid was filming trains at this spot for a long time. Railfans are contantly moving back and forth to try and get better shots. That can explain the security cam footage of his car, but that footage DOES NOT PROVE HE MOVED THE SWITCH.
    2. The switch was supposed to be physically locked. From my research the lock was supposedly found to be missing, which could be explained by a railroad worker just plain forgetting. The kid could have cut the lock,, but there seems to be no evidence of him having that kind of equipment with him, nor that the switch was actually tampered with.
    3. The lead investigator of this is EMPLOYED BY THE RAILROAD. How is that not a glaring conflict of interest? The company has a financial interest to blame this on malice rather than worker incompetence.
    I'm sorry, but this evidence is just not compelling enough, and railfans love to pretend that their fellow railfans are idiots and the rail company can't do wrong.

    Also in the video, kid is breathing heavily like he knows its gonna happen. Then he screams "Oh my God" before impact even happens. Further more train that set of the bad order had dpu on rear. They had to line switch back to normal position to tie back up. Yet this kid says crew failed to set switch back correctly. Its also being reported that they are seeking to charge him as an adult, and if that happens, he'll serve some serious time. He'll be in juvenile hall until he turns 18, at which point he will be transfered to Prison.

      The train was off the “main” (don’t think I’d call the OPPD Arbor a main lol) before they were in the video.
      They didn’t say “Oh my God” until right before it hit.
      Yeah, OMAX trains run with DPUs.

    As an engineer myself I tend to dislike FOAMERS. There have been time when I don’t blow the horn for them because I’m already 10 hours into a shift that started at 1 in the morning and they end up flipping me the bird. FOAMERS that get too close to the track because they NEED that perfect shot of a train. I have no respect for them.

      You can go to stations n stuff. Or just a stretch of track with no switches or nothing by em. Stay the allotted 50 ft or so and don't record people or trains standing around. If things are moving people won't care. Least in my experience

    I still believe in the railfan community, there’s still normal railfans out there, and many people still do this hobby. Although I’m still young at 14, even I don’t do this. I guess you could say the “dumbest” (not really dumb) thing I did was stand a little close to a crossing signal for a good train angle. The train crew didn’t seem to mind when I did it either, I may have gotten lucky

    I’m not a railfan myself, but I occasionally film some trains like DART, TRE and TexRail during holidays. I played video games and sometimes stream than filming trains and sirens.

    It has been YEARS since I last railfanned in any meaningful way. While I can't say I never trespassed on RR property, I never stepped on rails, walked on bridges, walked "inside the gauge", and I always kept a good sense of what was going on around me. I enjoy watching trains with VRF, Steel Highways, and some other channels.

    Just to be clear, just because he got video of a train derailing doesn't mean it had help being derailed. There are plenty of videos on youtube and elsewhere that show trains being derailed. I have seen a train derail while sitting a crossing. Now in this case there seems to be other evidence that he had something to do with it and he should be prosecuted to the full extent of the law. All I'm staying is just because he managed to video it, doesn't mean he had something to do with it.

      To be fair some of the metra crews are chummy with some of the more well known railfans in Chicago. I've seen meetups at the IRM. It's not common but I have seen it. We were once on the platform at Stone Ave and somebody whose in like flynn asked if the Q heritage unit was running that day. Sure enough conductor replied wait about an hr 20. Sure enough got a beautiful run by.
