      Some companies do so. But some companies extend the relieving date as ours

    U can't force employee to serve notice period.

    Maine to 37 days ka notice period pr tha but absent 10 days v tha isme and company ne 14 days hi notice period hi served krna pada.. not extend from company side my notice period duration.

    This is wrong information…..person can take leaves if they are not well even if they have any leave balance , also casual leaves can be taken from approval of manager

      Casual like not the sick leave ones, wud the manager approve it without extending notice period for service based companies ??

      @@kyalifnoronha2443 yes you can share Doctors note and they cannot reject it and notice period cannot be extended if person was not well

      Bhai jab organisation chod hi Diya toh itna kyun dar rahe ho...bhad me jayen unke rules...aap leaves lo agar lena hai toh...agar woh extend karte bhi hain, toh aapko unki baat maan ne ki kya zarurat hai? Aap boldo ki jo relieving date hai, uske aage aap Kam nahi kar sakte and refuse the extension..kya kar lenge woh log?

    I was working in a hair solution treatment company where I worked for 15 days, they even deducted 500-600 days for 1 day sick leave as they marked me absent at that time.... Now I have medical condition I have anxiety and stress unable to work, head told me you have to serve notice period and I said I won't serve it as it was not mentioned in my offer letter not even pay in lieu is mentioned, she was forcing me then I said I won't serve it do whatever you wanna do... She told me we'll take action... Nothing was mentioned in the offer letter not even about pay in lieu so will they take any action and do the things like linking my aadhar card with bad reviews which will hamper my career like It will be difficult to get another job? Please enlighten me as I am terrified, also I don't need 15 days experience certificate as they are nothing to me... I will say I am a fresher if I apply to another company, I haven't got appointment letter yet

      If you haven't got an appointment letter then be sure nothing gonna happen because to do something legal company needs to show the proof regarding that and as you mentioned there was no offer letter served then be sure they can't do anything

    Matlab resign karne se pehle toh organization ke hisab se chal hi rahe the, ab resign karne ke bad bhi organisation ke hisab se chalo, notice period ke wajah se...
    Mai toh kehta hun, itna dar dar ke jeena hai toh jiyo hi mat...there is no need to live or work on anyone else's terms....denying you leaves just because you are on notice is absolutely unreasonable. One should have as much right to take leaves during the notice period, as one had before resigning.
    The notice period is served to give the organisation some time to find someone else before one leaves...Now it's not as if, if you take a five day leave during your two month notice period, the time that the organisation has to find someone reduces by five days..The organization still gets two months, as it's not that they had to hire someone for just those five days ...So there is absolutely no reason why your relieving date should get postponed by 5 days...
    Very unreasonable and employer-centric laws

    I am in a notice period, and my last working day falls on Friday. If I take one day leave in this period, my last day falls on Saturday. Since saturday and sunday is a holiday, should I be relieving on Monday or i can relieve on Friday itself.

    I would be grateful if you help me with this. There is a buy out option in my offer letter if I want a quick release during my notice period but it depends on my manager.

    Mam if i got job in GOVT organisation and now in my current company notice period is 90 days then how i can join PSU at the earliest because if I join late then my peers this will impact on future growth slightly. So is there any kind of option there. Pls suggest

    Is it apply on that employee who is working with any non registered institutions....where is not clearing on joining time that there is any type of notice period is applicable when you resign...like if working with any shop or with any small business...??? please reply

    Hi Sister, I have an offer in my hand and i have resigned from my current organization. And a new company is asking to join in one month. In my current organization a 90 days notice period. I spoke with HR and said okay I can relieve you and you have to pay the amount for the rest of the days. But now my manager is not approving it.
    1) Buyout -- my manager not approving
    2) Can i ask for a project release.
    3) Can i put 22 days of my leaves and join a new company.
    Please suggest my brother. I am not getting sleep I think of this daily

      Dear Pavan, you will have to speak to your new company, and ask them to give you more days to join, when you appeared for interview, you must have told that your NP is 90 days, they should be okay with this wait then.
      If you take leaves and join another company, it will be a "background check" fail, because you will still show as an employee in existing company and this will be a case of dual employment.
      Only 2 options are there, either convince your manager or convince the new company about your NP.

      @@theCorporateDiaries New company called me 2 days before and said if you are not joining tell me i will check with candidate. So now my situation like my manager in current is not reliving me even though there is no dependency in the project. I don't know what to do ma'am

      Mai aapke jaga hota toh Mai sochta, current company bhad me jaye...aap relieve Karo na karo, mai toh Naya company join kar raha hun...ab kya hum resign karne ke baad bhi darenge kya apne purane company se

      It can rake upto 30-90 days depending on how big the company is.

    I have a notice period of 3 months. If I serve one month, have 34 leaves and pay for 1 month. Is this the way it works? Or 2 months basic will be deducted and leaves be encashed.

      Its when you pay money to your company to leave early, means you are not serving the notice period.. and when you show that payment proof to your new company, they reimburse that amount to you...
      But remember not all companies reimburse, only if they have agreed to do so during offer, they will reimburse else no..
