  • Are you or your business the target of defamation and want to know how long the statute of limitations is for you to file your lawsuit?
In this video, I am going to walk you through how long you have to file your defamation lawsuit so that you can best preserve your legal rights and do not miss your chance to recover damages or hold the perpetrator liable for their actions.
    Watch and learn:
    1. What the Statute of Limitations is and when the Statute of Limitations starts “running” for libel and slander claims.
    2. How long you have to file suit after the defamation in question occurs.
    3. The most common exceptions to the statute of limitations that can extend the limitations period, such as the discovery rule and single publication rule.
Finally, I tackle related torts to defamation that businesses may rely on when faced with defamation (and their typically longer statutes of limitation).

This is great information and makes me pretty certain I have an extremely rich libel case against rental property owners and their lawyer. You would never believe the insanity of this case. But when I contacted your firm I was told in chat that you don't handle Libel cases. Have you stopped?

Hi Jacquline, generally, unless you are located in Ohio, we typically don’t take ordinary libel cases. Only libel cases that involve online communication or publications on the internet. I don’t know if that’s the issue. But that may be the reason you received that response from our chat representative. You are welcome to call our office on Monday though and double check with our paralegal / intake team though if you’d like to make sure or that wasn’t the issue. We appreciate that you considered our firm for help with your case regardless! Thank you.

Yes, I was gonna Sue a libelous neighbor for content on NextDoor. On top of that, there were intruders coming onto my property. I had enough to Sue for libel, harassment, malice, emotional distress & insurrection. She openly called for users to call & to physically remove my dog & harm my family.

The standard of proof for defamation is generally much higher than other suits that could more easily apply where the federal statute of limitations is five years. Still, the discovery, repetition, republication and fraudulent concealment rules could very well apply as well.

question please,i took very good care of my father in my house for many years,he made it to 95 .5 years with absolutley no prescriptions, only good natural food from my large garden and vitimins, its was very hard on me doing this but i did it for him because he was my dad,we had a very close friendship,But at the same time i was doing this my older sibling became very very jelous, she struck out at me & filed a complaint with adult protective services in my state, every single allegation, i proved false and the report was unfounded,So now i have 14 pages from this state agency proving that yes i did take very good care of my father, and her accuzations are false, the old saying of the proofs in the pudding rings true in my case i have buckets full of puddn,i couldnt take the time to deal with this because i concentrated on taking care of my dad,but hes gone now & im ready to go after this jelous & spitefull sibling,,the statute in my state is 3 years for libel which it was libel because it is in writing and published in the state format, can you help me with this matter ????

Wow, yes republication was prevented by an admin host of Nextdoor. I was advised to write two formal emails to ND about my neighbor’s post & it was about my intention to Sue the boozy libelous lady. I believe she was ordered by ND or someone to removed the post. In addition she was not on ND for about 2 or 3 months. Also if she wants to become a user again, she had to agree to not make defamatory comments again.

Fraudulent concealment brought up another problem. What if the defendant lives in Europe? Not sure if you'd actually tell me, but are you better off going to that country where he lives?
I mean will this statute of limitations even matter and if you don't know the defendant's address for sure can you amend that in the complaint?

Q: How much can an original Complaint be amended after filing? Or, how detailed does one have to be at initial filling (if, for example, you're just trying to get the case started before statute runs out)? Thanks in advance for your time & sharing knowledge.

Hi Kate. That's a good question. It's a very fact and circumstance-specific question that we can't easily answer directly in this forum and without a lot more information. Generally though, to provide some sort of helpful information in response, most states have a civil rule that allows you to amend your lawsuit. In federal court, its Federal Rule of Civil Procedure 15. You can start there as many states model their own rules off of this one. However, there is a ton more that goes into this analysis, including how far along your case is, who you name initially, what your claims are, whether the amendment relates to new parties or new claims, .. etc. Hopefully this provides at least some starting point to research further as it pertains the individual facts of your case.

@@MincLaw Thank you! It does help since I didn't realize there'd be a civil rule specifically for it. I'm in NY; I'll check NYS rules. The Gov's EOs, which tolled statutes during Covid for 229 days in 2020, add that time to statutes here, + the regular time still hasn't run out (weeks or months left, depending on which publication/defamation). It's a doozy. We can easily name the defendant(s), can immediately add details; we haven't retained lawyers yet & want to do this properly, which could take time. (We=me+minor child, doxxed, stalked, & very publicly, falsely accused - & made it to tabloids). My very wealthy, very brutal narcissistic/abuser ex - who kept everything of ours - spearheaded. Convinced lots of others to believe & join in while we've stayed fearfully silent. (This post is the most I've ever said publicly.) Money & power & a license to bully can be very convincing for a lot of ppl, apparently. As a result of their many ruthless, retaliatory, colossal (& provable) lies, we've lost nearly everything & everyone. We're ready to respond, but not with little defenses online. With a lawsuit.

Also: I'm a private person (in every sense of the word); i'm not a public figure & in most ways neither is my ex (tho as a lawyer they've been on brief tv segments here & there). They've managed to keep their names entirely out of the publications, but my family's personal info - esp mine - are everywhere. Most of the wide-spread damage came with tabloid publications (printed & online) - i begged them not to run it, to give me specifics of what they planned to print & let me send them documents & evidence to show them how false nearly all of their article(s) would be, but my words carried no power. They had "deadlines" (hours later). They'd already contacted my then-work, kid's school, family & friends from childhood and everyone in between. Shattered our lives before we knew it was happening, & before printing a thing. Then they made it complete with publication. We'd already been so discredited & didn't know how to stop them - & they saw $$ + sensationalized clickbait. (btw, we have no crim records, not violent, not accused of violence.) I also don't believe they'll ever stop unless forced to. It began when my ex discovered that we were going to finally report their years of severe abuse. Before we felt safe enough to report, they went on surprise attack, & have aggressively controlled the narrative & most of our support system ever since.
I'm not sure what I'm expecting to hear from you, since we're in diff states & your specialty is online (right?). Maybe I'm just ready to speak up, & your lucky channel was the last spark I needed to move forward (sorry about the length). But. I am very grateful for your content, as it explains very clearly, step by step, the general process, & some specifics to pay attention to. Also, you engage with your audience, which is amazing. Thank you. You guys, + the channel of the beloved @DoctorRamani (psychologist) have kinda saved my & my kid's lives by giving us some hope & some solid info. (If interested, see her: malignant narcissists, smear campaigns, flying monkeys...) Like maybe we won't have to hide in fear forever, & could someday live again, use our names again, get hired again, reinstate our social media & walk outside without thousands of threats & hate msgs from mobs of profoundly misinformed & pretty f-ing cruel ppl again. Anyway. Truly: Thank you.
