I'm considering a defamation lawsuit against a relative. While I was with family, they made a false police call saying I was suicidal, and then took my daughter away and said if I didn't get a "mental evaluation" that I couldn't have her back. Also, the following 2 days, another fake police report was made saying that I slashed tires....which was a lie. And another for stealing (but there's no proof). And she tried to extort money from me. Taking advantage of me. As you can see, it's pretty messed up. But I think that I should but I want to sue for the max.
There is also felony false reporting, so it's a criminal case, too. Make sure your reports are iron clad. You can use them in your civil case.

Great information and video. When you mention "defamation" do you also include slander as well? You speak a lot about online libel (written statements) but do you represent people who've been slandered as well? Thanks!

Since Minc Law focuses primarily on online defamation, since our expertise in this area makes us different from other law firms and its where we add the most value for clients, we generally don't take on cases that involve non-internet related matters. This would include slander cases.
However, we will consider and make exceptions for cases/clients located in the same state as our home office (Ohio). Or a situation where a client wants us to come on as a consultant for their local lawyer, in order to supplement their local lawyer's experience and expertise in this area of law. Otherwise, no.

@Koriander Yander , thank you for the question. The answer is potential. Punitive damages and attorneys fees can be requested as part of any verdict and awarded by the jury. However, there is a high bar to prove damages. You must show actual malice.
Do you practice in Florida? This is against an online newspaper. Or do you know an good attorney that you would recommend?

I have alopecia and my front teeth went missing since COVID. I filled out a form the best of my ability and had suffered the worse any woman could ever imagine and they are still taking me in for testing.And social services knew I was in need of financial benefits and they only gave me food stamps and medical insurance. I feel that I have been sabotage by the system and had been homeless and called 211 a few times before I was helped. A few months after, I started to suffer fibromyalgia. I was born premature so I was born disabled. When a human has experienced a disability and then cures they would still need trauma treatment. And it's a civil violation to have lead a civilian on in the scene where they think it's ok to settle in order to be a part of a community and are still in dangers because the suffered already. The system promised them that the ground they live on is a safe haven and they still suffered harm. To be immune to a disease or more than one disease is disability on both parties so the situation should be handled with patience and compassion especially if it is God who created or is planning to create us as human beans and his or her love for us is going to be unconditional. To live a miracle can happen to any of us and it's not right to hate, we should just try our best to be happy for one another and wait our turn. The check is never enough to live comfortably anyways.

I was accused of taking a pregnancy test from a dollar tree. I walked inside to store, noticed the lines were ridiculously long and walked right back out because I was in a hurry. The store manager followed me on my way out outside the store, stood by the door and stated loudly, in the middle of a busy parking lot, “next time you take a pregnancy test from my store, make sure you pay for it!”. After figuring out that property wasn’t taken, there was still no apology, it was super humiliating.

Couldn’t you just go back to the store, explain that you didn’t steal anything, and want ask for an apology because of how humiliating it was?
@@pikira2246 Once something like that is said, you can't undo it. Every person who heard this may recognize the woman in a different venue and whisper to a friend, That's the woman who got caught stealing a pregnancy test. And on and on. I wouldn't ask for an apology. I'd sue for slander.
You may not be able to prove monetary damages, but you could sue for a PUBLIC apology, something that made it into the local media so that everyone in the area is apprised of what really happened.

Does it have to be an online threat. Can it be the neighbor shouting it out load as you walk by so the other neighbors can hear? I don't want to say the words being used i feel pain already mentioning this.
If a police officer made inflammatory comments to their department prior to a criminal investigation which has resulted in an individual needing to pay 20k in civil court to protect minors…. Should that police officer be brought up on slander and liable charges if the police officer wrote a character reference indicating that they said x, y, and z to other department officials?

@@MincLaw Person defame to me to high ranking state and federal officials. I can prove he sent letters and that the statements he made were false. I'm not sure how to prove damages since the government is never going to admit these letters caused me to get additional screening at the TSA or placed on some kind of government list.

What if you can’t afford it but have a case ?
If your behavior is the reflection of if you think a person can afford to sue you or not is your first mistake. It might cause you to behave in a way that could make the case brought forth against you worst.

I am a homeless man living in my van trying to start a small business to get on my feet but being homeless in a van I get told to move by police often and there is a city council member of my town that will online shame me and publicly post the details of the information from the police scanner I'm in a small town so word gets around and makes me look bad when all I'm trying to do is park and end my day

I was told by several defamation attorneys it usually costs about $100k when all is said and done...
What's the average amount of money people who sue get? I mean how many people got $15 grand that they would just pay out of pocket?
I think its one of the reasons why I think defamation should be abolished or considerably re-evaluated. If you fighting against a person who has more resources than you, its very hard to win your case. You could be completely on the right, but without the money, in the eyes of the law you could very well be wrong.
