The defendant caught JM off guard over the hearsay comment. Normally, I'd find a litigant telling a judge how to do their job a bit cringe-y but she was holding them to different standards in that moment and I'm glad he self-advocated.

The place I live in is bad I'm sure there is mold in every wall, things leaking, pipes breaking all the time, no heat sometimes, I get rid of mice a couple times a year, and so much more but it's cheap and I just could not afford a place that doesn't have problems (rent is about $2000 and up near me) plus the actual moving expenses including first months rent and security... I want to add I pay my rent early every month and never plan on suing but with the kind of problems I've had I could (I would 100% rather move than ever sue and maybe one day I'll be able to be sure I can afford a more expensive place)
I lived in a 2 bedroom apartment in California in Costa Mesa and it cost 2200 plus 2200 deposit and last month rent.. so sometimes it's easier said than done but I will say before u move in anywhere do your research. Really look at the place.. talk to neighbors. I mean ur gonna live there. I'm so glad I own now.

I had a friend who did the 34 requests for repairs for every little thing. They finally raised his rent $500 a month and he had to move out. To this day he still thinks it's normal for rent to go up by $500 a month upon lease renewal. My rent went up by 1.6% this year and 0% the prior year.

I understand it’s inconvenient, but it’s a two bedroom not one bedroom house. She didn’t have to go to a hotel or sleep on a friend’s couch. They had addressed her complaints and fixed the repairs. If she likes the neighborhood look for another place in the area or just simply move.

If you can’t turn the thermostat off or it’s malfunctioning then turn the light switch off. Don’t be helpless. It’s important to know these little things when renting or owning. Where the electrical box is, water shutoff is, gas shutoff is. If all else fails at least you need to know how to turn stuff off.
If you don't like the house you have choices like moving, buying your own house, not renting this specific house, etc. Defendant seems high maintenance so maybe she should buy a house/condo/town home instead of renting someone else's home.

Judge is 100% right. She was clearly nitpicking EVERYTHING she could to attempt to get rent back, 34 requests is calling in about everything. It wasn’t that bad If she continued staying month to month. If that landlord wants to avoid more lawsuits and payouts In the future, she needs to be kicked out and don’t give any leniency. Some landlords let you take an extra day MAYBE two to move, but if she stays anything beyond the move out date, change locks and put her stuff on the sidewalk. Or charge another months rent (or prorated depending on what’s Allowed). I’m sure that’s what this tenant would do, “I moved out two days before the month ended so I need 100% of that months rent returned”.
there is a retaliation law in california which states that a landlord cannot evict a tenant until after six months of any type of dispute or lawsuit with the tenant .
I hope the defendant uses this episode as evidence in the eviction case. She claim multiple times that the apartment was not in a tenantable condition. Case closed, get out!

Judge is 100% right. She was clearly nitpicking EVERYTHING she could to attempt to get rent back, 34 requests is calling in about everything. It wasn’t that bad If she continued staying month to month. If that landlord wants to avoid more lawsuits and payouts In the future, she needs to be kicked out and don’t give any leniency. Some landlords let you take an extra day MAYBE two to move, but if she stays anything beyond the move out date, change locks and put her stuff on the sidewalk. Or charge another months rent (or prorated depending on what’s Allowed). I’m sure that’s what this tenant would do, “I moved out two days before the month ended so I need 100% of that months rent returned”.
there is a retaliation law in california which states that a landlord cannot evict a tenant until after six months of any type of dispute or lawsuit with the tenant .
I hope the defendant uses this episode as evidence in the eviction case. She claim multiple times that the apartment was not in a tenantable condition. Case closed, get out!

It's California, one of the worst states (if not The worst) in the country. All their laws are to help criminals and bad people while hurting good people and law-abiding citizens. Heck, the entire country has more rights for squatters than homeowners. Unfortunately, the people in this country are too lazy to object to these laws in court, and get them removed,
