40 year vet here. Started HVAC work in 1974, have had my own business for 24 years now.
It's tough getting started. The wife and I ate beans for the first 3 years.
I had to fight the urge to expand the company. I wanted to keep it small so I would KNOW my customers, and I do. The biggest I let it get was 3 of us and now that my helper and good friend retired, I'm on my own again at age 60 and still going strong.
I guess when you love what you do and have a good rep with your customers it makes it so much easier. I do live in a small town surrounded by a bunch of other smaller towns/cities, so I do have the advantage of being more personal with them.

newstart49 “you ate beans for 3 years!”... you must not have been very good. I started in 79’ (19 yo)in NYC and was a millionaire by the time I was 28. In 3 years we went from one truck to 12. From 12 to 30 by 1986!...just sayin’

There is a lot to learn in the HVAC field just don't get lazy and start doing all of the shortcuts that are so common today. You have an advantage over most people because you are here on RUclips looking to continue your education. Keep it up and you will be rewarded in short time.

I was trained to be a salesperson and that's what I enjoyed until it things started to change to rapidly for me. I am pretty good with service and I am continuing to get better. I started making these videos for myself and a couple of guys at work and I am thrilled that so many have been able to find them here on RUclips and learn from them.
I hope to one day soon get back to making more..

Everything happens for a reason..
Your company name "Home Performance Solutions" should be at the top of your brochures or other advertisements. You are not Bryant Heating and Cooling nor are you Bryant manufacturing company. If Bryant Heating and Cooling is knowingly and willingly continuing to run commercials with your picture, then you can sue them for damages to your business. If you did not sign a non-competition contract or agreement with Bryant Heating and Cooling, then there is noting they can do to you for stealing customers from them other than send you a cease and desist letter for the purpose of scaring you into doing what they want you to do.

I feel your pain dude...
My wife has worked in corporate sales all her life and has recieved many demand letters over her life time, 99% percent of these letters were just scare tactics to keep her from stealing customers, she never spent 1 day in court but your situation is a little different because you know the owner. Most businesses don't take legal action because they won't recover their legal fees spent fighting you even if they win.

LET people recognize your picture from the company you worked for, it's free advertising with no words! You starting your own is the best of both worlds for customers... you have the experience, and can personally give them a deal!

Really like the second brochure.
2nd flyer looks good. IMHO, l would put my company name and logo at the top, and my name under my picture. You are selling yourself which is you and your company. This needs to be in front of the public. Good luck, I am pulling for you.

Hey Eddie, First off, I enjoy your videos. I learn a lot from you and guys like John Israel, Fritz, T&N, Dizzie Dallas, etc.
Sometimes you have to weather the storm from the bigger companies trying to bully you. I've been there years ago when a bigger business, different than HVAC, tried to bully us cause we were doing a better job and their contracts were coming our way. We just knew how to treat customers cause we didn't have the get rich quick attitude.

If anyone is confused it is due to that other company. The logo is clearly Bryant heating and cooling systems. You didnt cause the confusion.
But, maybe they will take you to court and make you get a face lift ;-)

Good video, if I may make a suggestion; by the Bryant log, have it worded "we feature Bryant equipment". This may help avoid any confusion. I f I were 30 yrs.younger, I would do what you are trying to do. HVAC is so competitive, maybe down right cutthroat.

Put a magnet or something in with the flyer and that will be more permanent and on there fridge as the mail usually gets tosses in the trash..magnets we always put on our fridge..im just starting hvac..just got some tools and a jb platinum 10cfm pump..been watching you and fritz ac videos..i love them..spent my whole day off watching them since 8am..getting tired now..i hope to meet you guys one day and learn from some good guys..your the person i want to be..keep it up eddie...Ryan

I felt bad watching this video after all the other ones you did. Like the others have said, I also believe you're a good and honest guy and it sucks that these people are trying to put you down. I'm a new tech and I learn a lot from your videos. I'm sure this is just a minor setback and I wish you the best so you can keep helping us new guys.

I am very clear when it comes to introducing my company. I DO NOT want to be considered the same as the service company that I use to work for. We are Home Performance Solutions and we are one of the few companies in the state of Kentucky that offers service the way we do. We have spent a great deal of money on tools and a considerable amount of time on training on how to properly use them and all of this is to do the right thing for the customer.

Take that JUNK name(Bryant) away from your name. You know your job.you will ALWAYS get customers so just drop the Bryant name connections & don't worry about it. Your good.you got this. I don't know you from Adam but as a fellow Kentuckian (S.E. KY) and as a good judge of character,I can tell you seem pretty honest & straight forward so believe me when I tell you that you will go far without that crap anywhere on van,brochure,or ads. You don't need it. I been in this biz. For 30 yrs & have been covered up,been without much work,& all in between. God won't let you & yours go without what you need.
Personally I live in an area where coal mines have shut down & not a lot of work to be had but always enough to get thru.
Started with a service company out of Chicago about three wks ago because I no longer wanted the headache that comes w all the paper work & stuff you have to keep up with by running your own business. I'm still doing what I love(service) but now I don't have all the stress & worry of the paper chase.
Hope all works out for you but don't let it keep you up at night. It's just a stumbling block being cast before you. Over,around,or straight thru. That's your choices but this time 3 yrs from now,you won't even think of it.👍
I just saw your Utube clip its May 2018. Sence 2012 you had the irs, the state Unplowment people want money, along with state licences and county inspections. Its hard to make it.
I like the 2nd one.and do a mini commercial when you can on you tube.You can say a factory trained dealer on Bryant Products on your brodure they have used you long enough and always pray about these issues.Let the customer know upfront who you are as much as you can.and maybe get a couple of witnesses saying that on video just in case. I will do a video too for you.
Hey Eddie I watch a lot of your Videos on RUclips and I think you should use the brochure with our logo and Bryant because you would still get your calls and some of there's but without the moral obligation to send customers to your old company. Wish you much success.
#1. Carrier/ Bryant requires you to have certain things before becoming a dealer, one of them is that your vehicle has YOUR company name, logo and number. Your field rep. Should have went over all this with you (that’s if you did things correctly)
#2. Carrier/Bryant does not just gives these vehicle stickers out.
#3. If you were a Carrier/Bryant dealer they also help build your company and help with options of web sites, listings on their site etc.
#4. Your field rep. (If you had one at all) would not have given any authorization to use name, logo, etc. without proper business set up and capital.
#5. Carrier /Bryant requires you to place their vehicle stickers in certain locations on the vehicle. You have yours stuck to the door/s.
The list goes on and on to what needs to be done and the regulations to be followed according to Carrier/Bryant as a service partner.
First off I love your videos, I am a hvac Tech in S Utah and love to get home and check out your videos. You should make a instructional DVD that you can sell.
Shit I would buy one.. Keep up the good work and keep making videos..
PS, Out here some supply stores will pay a % of your advertisement if you put there name on it. You should ask one of your sales men/women..
Hey Eddie I see you have cleared things up and this has blow over already, but you seem to be aa better tec. then most out there and you will do fine out there. I have been on my own for almost twenty years. You don't have to be that good, you just have to show up. Most guy's out there can't even do that. Best of luck and keep making the device videos.

How the fuck did you stay in business for 20 years with that credo and under how many different names? The courts are full of service people like you who are part changing bullshit artists. I am a 35 year tech and business owner and I am “the best” at what I do and proud to say so. I have to be positive! what part is defective and why. Why this is doing this and make it work “my way” the right way. Showing up to a customers house or business is not a fucking bonus it’s a meal ticket and a bonus when you get reviews. You really need to change your attitude especially if you are training others. That shitty mindset leads to poverty. Knowledge is power!!!!
Hey Eddie love your vids man dont let these strong arm tactics get you. I have a little legal experience with this stuff and I dated a lawyer for a while so I can tell you one thing the burden of proof is always with the accuser to prove you did something wrong so never even slightly say anything to incrimenate yourself or their lawyers will blow it out of proportion, and also you said they want copies of your invoices. If that is not a court subpeona telling you to do so then you dont have to!! Look into free legal help from your local social services and city hall, or court system some have a nice self help area with people that can point you in the right direction, hope this helped

Hey, Eddie I think if you switch your logo to the top of the page n place the bryant logo in place of it I think that would stop the confusion since your logo would be the first thing they would see, but honestly I like second one the best. Thanks for the videos I just got done with trade school n I'm going to start working for a company next week I know I got a long way to go to become a good service tech like yourself but I sure hope ill become one. I would do the second brochure for sure. The first is good, but you dont need that confusion. I dont think it was illegal at all. I guess I would say use your prestige all the while transitioning your association as clearly as possible from Bryant to Home Performance Solutions. I would make sure your logo is everywhere that Bryant logo is. Maybe people will see the famous guy from TV works at this other place- "lets call them now!"

Maybe someone watching this, who is a lawyer, can help you to countersue for still advertising using your face. I enjoy your teaching videos and I learned a lot about how to find a leak. I have a PTAC that is a suspect for a leak and the "Friedrich" tech wants to charge me ridiculous sums to check it out. I wish you are here in N.VA as we need people like you here.
Try saying at the top of the Logo, " WE USE, high-quality Bryant equipment "
I work for a hvac company with 40 or so employees and we have advertisements that have the name of the equipment we install across the top of the flier. The offer we have going at the time, then our company logo at the bottom with contact info. We sell three different brands and run specials all the time trying to move one product or another. Your trying to move "bryant " products! So you lead with it!!!! Good luck with your company and try not let them push you down. You have a right to advertise any way you see fit! Including using your product and your likeness to get your foot in the door! You probably do a better job than them anyway so your doing the customer a favor!!!!!

Intimidation at its core. I would go with the 2nd brochure with one change. I would swap where you have the bryant logo with where you have your company logo. That puts your company at the top and the brand you sell/install/service midway down. You are after all trying to sell HPS first and bryant systems second. It would also cut out a lot of the confusion.You did nothing wrong, whereas they did when they continued running the ad depicting you as their employee. Take care, Brett
Hey Eddie, second flyer is a much better looking one. Don't forget to add the 3D bar code in the bottom corner tho. And if you dint have any specific loyalty to Bryant just switch it to carrier. I'm sure you know Bryant is just a sub of carrier anyway. And I think carrier has a better name recognition anyhow. Even tho I'm a York/luxaire man my self.
Eddie, You are a breath of fresh air and I wish your business was in North Texas. I would gladly use your service if it were available here. There are too many unscrupulous opportunist in our area that overlook a blow run capacitor in an attempt to sell a new system.

Good luck with this Eddie! It sounds like they should have treated the face of their a company better. You are recognizable because they used your face, it's their fault there is confusion. I don't know what the laws are when it comes to communicating with your former employers customers, but I would think unless you signed a non-compete then I wouldn't think they could do anything. Both brochures look great to me.

eddie,i think u are very honest,and you are trying to get started,i dont see you have done anything wrong,i think they where wrong for using your face even after you left ,that was wrong of them,they should have thought about that knowing you were going to get started on your own,that is there mistake,and i would have took advantage of that also,i think your logo is the coolest but you need to keep phones ringing,man hang in there as long as you can and i will be here watching every vid u make
I went through something similar when i started my business 18 years ago. I consulted with an attorney BEFORE i started. There is plenty of case history on this exact situation. Typically the rule is this; Assuming you don't have a non compete you can go after anyone you want former customers included... As long as you didn't market to or inform them while you were employed with the other company. Sending letters is cheap, i wouldn't expect this to go much further than that.
Compliance, is a tricky area. You want to avoid litigation. Get an attorney and have him review any contracts you signed, and consult him on your mailers. In addition you may call bryant for some guidance. A few hundred well spent dollars in advance can save you thousands later. Keep up the good work and i wish you luck.
I would say severs all Bryant AC units and the I like the number two mailing list better.

hey Eddie don't know if you got this all resolved yet, i know its kinda of an old video, but make sure you save any similar advertising material you get in the mail or online especially using the bryant logo, that way if you do go to court you can prove you are not the only one doing that, and further that your old company is targeting you and possibly even have grounds for a counter claim.
I never signed a no compete and I never sighed anything stating that I could not advertise to his customers.The only thing that I signed was a confidential agreement.

My contactors relay for my AC is working good with thermostat but when I reconnect pull switch in the AC unit still turns on even when thermostat is off. I can send you or show you image of the wiring on the contactor on my g+
Luba Luba call an experienced service company and stop looking for diy advise, it’s dangerous and no tech on RUclips should show you how to mess with electricial components
The Bryant Logo is the major focus on your ad instead of your company name. Bryant name should be a secondary focus not the major focus in my oppinion. For as customers go, I don't think anybody owns the customers, so best company wins. It should be all about customer's own choice for service and equiptment. You should be focusing on your company first in the ad.

We have one guy who subbed for us. We quit using him and he got into a plant that we have a contract with and has begun stealing a lot of work from us at that plant. There is nothing we can do to him because he never signed a contract that said he wouldnt go after our customers.
Also... look into the best way to structure your business...someone told me one time that an LLC...I think can protect your personal stuff from lawsuits brought against your business.
