      It takes practice. Then you need feedback, and then rewrite it. The more you do, the better you get at it.

      In my paralegal courses we used IRAC. This was when we did everything manually with books etc. In Law School we did CIRAC which is more close to CRAC. Never saw CREAC until this video .

    CRAHNC. Conclusion, rule, analysis, however (counter argument), nevertheless (counter-counter-argument), conclusion. Probably quite close to CREAC but this method ensures I don't forget to argue both sides. This plus Anki flashcards is primarily how I've stayed near the top of my class with quite limited time for full-time law school (20-30 hours a week on average).

      Do you do this every time, are do you skip H and N when none make sense to use?

      @@Learnlawbetter I use this formula *almost* all of the time. Most of my professors have highly valued counterarguments, I think I've only taken 1 or 2 exams where it did not made sense to use this basic formula. Thanks for the videos!

      @@Learnlawbetter If I ever decide to attend law school and successfully take and pass the state bar, would the judge attempt to deny me a liscense to practice law on the grounds of the existence of a few different types of disabalaties?

      The legal profession will evaluate the disability to see if it will potentially hurt the client. For example, someone with kleptomania will almost certainly be denied admission to the bar.

    Hi Professor! I took my Torts final and wanted to say this video of yours helped me a lot with my organization on the exam. On that exam we had 2 parts. Part one had 25 short answer questions (60%) where we needed to write ~1 paragraph per question, and part two (40%) with a 3-page fact pattern and 3 questions, one of which was an open-ended "identify all liability claims." I answered each question on the exam and managed to find 8 claims of liability, but only wrote about 2 (I did list the suits that would be brought and under what claims, but only very briefly). I made the choice to complete a full negligence analysis on one claim of liability over addressing 4-5 issues with a paragraph. The other issue I managed to write a paragraph about, and I bulletpointed two more claims of liability with potential counter-claims and defenses for each argument I made.
    In your experience as a professor (and I know this is different for everyone), would you have preferred brief 1-paragraph arguments on each claim of liability, or the route I went in showing that I understood how to make a full negligence analysis? Did I make a good call?

    • @Learnlawbetter
      @Learnlawbetter  3 года назад

      On this type of exam, you have to manage your time effectively. Suppose you had 1.5 hours for the 8 issues, then divided that time by 8. You need to not only spot the issue, but then provide a rule and some analysis. If you define negligence once, then when you get to the rule say "see rule above" and jump to the analysis. But I don't know what your prof will. do. At this point, don't worry about it and focus on your next exam. And after that, enjoy the holiday. In January, reflect on what worked and didn't work, and make changes.

    Hi Professor! I'm currently using CRAHNC (Conclusion, Rule, Analysis, However, Nevertheless, Conclusion). My Professors advocate for us to analyze counter arguments, so I found that this method is useful. My finals for 1L begin this coming Thursday (Torts) but I am nervous.
    The exams are open book, and I have done my best to make an extensive outline, currently making a checklist for issues on an exam so that I hit whatever I want to, but I am still terrified of identifying the wrong issue on an exam. Do you have any advice for me? I feel like I'm doing everything correctly on paper but I can't help but feel like I'm missing "it"

    • @Learnlawbetter
      @Learnlawbetter  3 года назад +1

      People miss issues for one of two reasons: one, they don’t know a rule. Or two, they second guess themselves. The second one is easier to fix: go with your gut and write it down on the exam. The first one requires learning the law at a deep level. This requires taking practice exams and doing multiple choice questions. As you review the practice tests and questions, you will expose gaps in your knowledge.
