      One does not simply trademark all 16777216 colours. Also, what happens if 30-bit or 48-bit colour becomes a thing? You'd have to apply for either a billion or 2.8 * 10^14 trademarks.

      Late af but kinda fun fact, Saint Laurent actually got away with violating the trademark, since when they got sued by louboutin, the judge ruled it was ok since the whole shoe, every nook and cranny was meant to be red and it can't be done if they don't paint the soles red, it entered a loop hole and they where able to produce it

    Trademarks differ from other forms of IP (copyright, patent, TS) in that they are consumer protections. It is meant to prevent companies from confusing consumers about the origin of a product, where other IP are meant to give companies the exclusive right to something to further their business interest. That should have been explained as it give a lot of insight as to the thought of why trademarks for colors are a thing.

      @@HollywoodF1 I'm late af, but even broader than that, using trademarks is only a problem if you use them "in commerce," so more or less in connection with selling goods and services. So most people never have to worry about trademark law emptying their wallets at all.

    It is extremely difficult to stop people from "illegally mixing paint" to produce a trademarked shade of color. If I mix the precise pigments to produce "Tifanny blue", then the burden is on Tiffany & Co. to prove that I "knowingly" produced their exact shade of blue. That's a steep hill to climb.

      No, this is not true at all. They don't have to prove you did it "knowingly". It's on you to figure out if you're violating any trademarks. A lab can determine if two colors are identical. But, they can only trademark it for a certain product field, or any field where they sell products. If you're using it for electronics, not jewelry, you'd be fine. Your comment is moot for another point. Even if you do all that, they could still sue you and bankrupt you from lawyers fees to defend yourself.

      It’s like you watched this whole video but didn’t understand the concept. How would you like it if you spent thirty years building up a product in the minds of consumers using a specific shade of puke green to sell, say, tubas, and then some joker comes in and starts selling shoddy, low quality tubas with your same exact shade of puke green and this lowers the overall perception of your product as well as undercut your own sales by selling a similar looking but ultimately inferior product. Should someone just have the right to copy your hard work to piggyback off your puke green tuba selling success?

    I ran into this doing a package re-design for 3M. That red 3M you see on all their stuff can ONLY be used for the logo. I found that out the hard way when I suggested a red package use the 3M red color for printing as a cost reduction measure and ended up with legal on my case about it. If I had watched this video 8 years ago, I would have been savvier.

      i suspect you'll have a very poor showing in court, when the other side rolls out that paper has been white for the last 100 or so years, and has been manufactured in that color by pretty much every paper company ever.
      Though you could probably go for a lovely shade of red, pink, or light blue if you wanted.

    I used to work a company (Digital) who were part of one of those important trademark cases. They made VAX computers. When somebody else thought Vax was a good name for a vacuum cleaner the lawyers thought otherwise. The court said that since the products were completely different with no chance of confusion, Vax vacuum cleaners were OK.

    This was an unusually entertaining episode, but it's a bit confusing: At the beginning we're assured that we *can't* make a Tiffany-blue pingpong paddle, but by the end we're assured that a Tiffany-blue pingpong paddle wouldn't violate the Tiffany trademark because Tiffany doesn't make pingpong paddles. :P

    I'm surprised you didn't mention "Illegal Flags", where strips of colour are used to form a picture, that, when converted into the hexadecimal index for each colour and kept in the correct order, will form data that is legally protected in some manner. So you might be liable for a federal offence if you make and display a flag with vertical stripes of purple, green and blue... provided they're all the exact right shade.

      nah, it's only for specific uses. The thing is WE HAVE ALL SEEN products that are clearly meant to deceive you into believing it's something it's not.
      It's not fair to someone who spends a lot of time creating an image to have someone else come along and steal that reputation by creating a cosmetically similar product (often of worse quality).
      I mean is it fair if you work hard to get a pay bills on time and build your credit that someone can come along and steal your credit score and commit identity theft? No? Well that's what trademark infringement is often trying to do. It's stealing a known companies identity to profit off it's recognition and perceived value.

      I just think it's just a choice from greedy people. I think as long as you don't intentionally make the color similar you should be fine. Sadly good people get punished because we live in a cruel world.

    If the color helps you identify a brand, then isn't it functional? Thus negating a trademark?

      No because identifying a brand is not functional (in the legal sense of a perfect world where there are competitors selling similar products with the same functions so choosing one brand over another has no functional benefit). By the way, this limitations is not just for colours, functional designs can not be trademarked either so you cannot trademark a particular way of building a bridge when it's a vital part of the construction of any bridge of that type. For functional stuff, you need patents.

    I remember a few years ago McDonalds tried to enforce copyright on their name in Scotland against traders of all sorts. Shall we say it is a common name in Scotland so there are a few. Of course they lost heavily and were generally ridiculed, particularly as the representatives clearly did not get the message that others had the same name and had a prior trademark claim which trumped theirs.

      Nah, just one that immortal companies own almost everything. We just got a public domain dump recently from copyrights expiring, and that hadn't happened since 1998 because of disney. Expect them to try and do it again, because the mouse is only safe until 2024.

      @@thenewjustiny.3686 If you're talking about Mickey, then they should make a new logo. I wouldn't be very mad myself if I had created it, because I would be long dead if I was around as long as Disney has been.
      The copyright laws were intended for people, and set to expire far past when someone would die (75 years, plus however old they were when it was copyrighted) so it could be exorbed back into society for someone else to use it, mix it up and make a living. I'd say Walt Disney himself got enough milage out of Mickey mouse; they were never intended for immortal corporations who never die.
      The best part is they took a lot of their best works from the public domain like Cinderella.

    This works for lots of things. For example, the word “pods” is a trademark of Proctor and Gamble for the not-edible Tide Pods, the developer of “Aqua Pods” water bottles, and PODS Inc. for their storage containers and services....and there could be more for all I know. PODS sued U-Haul for using the term for a portable storage container and won., but the unrelated uses coexist nicely, with only P&G having to have Rob Gronkowski explain how NOT to use their product.

    Fun fact: the Michigan State Police has a Trade Mark on the color of “State Police Blue.” And so only cars made for them are painted in that signature color. It used to be in a contract that retired vehicles had to be repainted, but that isn’t a thing anymore, but the only way to have a car in that color is to get a retired MSP car.
