    Immensely useful for starters like me, Senior (by age) but a Jr adv (LLB in 2022,) as I decided to pursue law after 28 years of experience in IT. Though it is advisable to follow the Senior - Junior cycle of learning, the best, yet we require to get thorugh the learning stages as early as possible, so that we start our real time practices soon. Here atleast, I understand what are the broad stages, though there will be lot of intricacies in each stage. . Thank you.

    Sir you said at one point for examination of witnesses, that ek program banta hai and wo dates bauhot paas paas NAHIN hoti hain, but then you said "lag ke hi hoti hain, like 1st day-2nd day and so on"... As far as evidence after charge is concerned, going by bare Act, there shall not be any adjournment and witnesses shall be examined from day to day... what about examination before charge ? In reality, does it always happen day to day, if there are no grounds for adjournment ? Is it that ALL the delay is only before the stage of evidence (after charge)?
    Reason I am asking: I know of some cases in Magistrate's Court (I understand that this video is regarding Sessions trial) where it's been years and the case has not even reached the evidence stage (after charge)... In one that I know of personally, the Complainant has changed residence and likely moved out of the city/probably even Country .. In fact shortly after the framing of charge, he had stopped showing up in Court... The case is going on since 12 years just like that and has not reached evidence stage... Why don't APPs not withdraw these cases ! Even Magistrates should be answerable, but transfers are so frequent that the question is, who will answer !!

      Hello Rishita! Thanks for your comment! I think if at all I said that the dates paas paas NAHIN hoti, then it's my mistake. Please take it as my slip of tongue. I will watch that portion again and if possible edit it.
      As regards delay in some cases, it's most unfortunate for the people of India. That...means delay in dispensation of justice itself is injustice to the people.

I was trying to understand whether all the delay or greater part of it can be attributed to the stage before evidence... Because theoretically atleast, evidence must be conducted from day to day...     Sir, our FIR filed in 2010 is still going on in Kurla court,we owners filed against builder for forging our ten signatures in letters to collector office and aquid the extra FSI and build 3 extra flats.and now still want to do the same and build more. The handwriting openion was not similar and his lawyer crossed a number of people and is still going on just harresing senior citizens to come to court when they have no connection with the forgery of signatures.i would like to know for how long can he go on. We qre seniors, two dead, two sick , just two of us left
    Please can you explain what can be done before another goes. Thabk you

    Sir service matter or corporate law ke liye video banaiye. Maine Allahabad High court me abhi practice start ki hai. National law company tribunal me kaise advocacy karte hai? Nature of case kya hota hai?

      Thank you for your suggestion. But honestly I do not know much about the National Law company tribunal practice. As I believe, the nature of advocacy is the same in all courts and tribunals except with a little difference here and there in formats and procedure of filing and drafting.

    Sir,
    can it start by filing a complaint before police. My property documents is forged by one person and he has sold a portion of our property has GPA holder representing our property.
    Is forgery for harming our reputation, misrepresentation, fraud comes under cognizable offence. So police can direclty file fir without permission from court.

      जहां तक मैं समझता हूं कि अगर आपकी केस जिला स्तर की है तो आपको जिला स्तर पर ही मदद मांगनी चाहिए। वहा हाईकोर्ट का लीगल एड सेल शायद ही मदद करेगा। अगर आप को जिला स्तर पर मदद नहीं कर रहे हैं तो आप उनसे ऊपरी अधिकारी से मिलकर रिक्वेस्ट कीजिए। अगर उससे भी बात नहीं बन रही है तो डिस्ट्रिक्ट जज साहब की अपॉइंटमेंट लेकर उनसे मिल कर देखिए।

    I come to understand the process of criminal case. Other side of criminal cases is final Report. Victim is laiyer. Victim is telling lie. Then protest petition come in process and reinvestigation . FIR 378/2019 in shipra Path Thana mansarover jaipur Rajasthan. Court is ACMM1, Jaipur metro 2 in FR status from 4 years. Your suggestions regarding this or a new video.

      @@LegalInspiration क्रिमिनल केस का एक पक्ष आपने बताया कि चार्जशीट पुलिस प्रस्तुत करती है तो कोर्ट में कैसे कार्यवाही होती है । वो समझ में आ गया आपका वीडियो देखकर। अगर क्रिमिनल केस की एफआईआर में पुलिस यह कर फाइनल रिपोर्ट प्रस्तुत कर दे कि पीड़िता रेप का झूठा इल्ज़ाम लगा रही है व्यक्ति पर । तो कोर्ट में फाइनल रिपोर्ट प्रस्तुत होने पर पीड़िता कोर्ट को बताती है कि पुलिस ने सही तरीके से जाँच नहीं की व प्रोटेस्ट पीटिशन प्रस्तुत करती है। तीन साल तक तारीख मिलती है वकील देर से नियुक्त होता है जिला विधिक सहायता केन्द्र से तो कुछ समय इसलिए भी निकल जाता है। कोर्ट के आर्डर होते है कि पुनः जाँच हो । तारीख मिलती है कि 16/08/2022 को पुनः जाँच की रिपोर्ट प्रस्तुत की जाये। पुलिस रिपोर्ट प्रस्तुत नहीं करती तारीख को और एक तारीख और पड़ जाती है 3/11/2022। तो ऐसे मामलो में आपका कानून क्या कहता है? कितना समय लगेगा कानून पीड़िता की बात पर जाँच हो सही तरीके से । पुलिस ने बलात्कार स्थल को देखने से मना कर दिया कि ये हम तय करेगे कि हमें वो क्राइमसीन कब देखना है।

      Okay! So reading your question it seems that you are concerned with the long time taken in the court proceedings.
      तो मै इतना ही कहुंगा की केस लिस्ट नहीं होना, केस में जल्दी सुनवाई ना होना, केस में बहुत देरी होना, केस लिस्ट होने के बाद भी अलग अलग कारणों से तारीखे पड़ना वगैरा-वगैरा इन सब बातों से हम वकील भी परेशान हैं।
      लगता है यह स्थिति सारे देश में है। वर्तमान में ना मेरे पास इसका सोल्यूशन है और लगता है ना किसी और के पास।
      जैसी भी है स्थिति को स्वीकार करके उसके अंदर जो जो कर सकते वह करते रहिए और आशा करते रहिए कि आपकी केस जल्दी हो जाएगी।
      आपके लिए और मेरे सभी व्यूवर्स के लिए प्रार्थना करने के अलावा मेरे हाथ में कुछ भी नहीं है। ‌🙏🏼

    In My relative Mact Case lower court judgement come in Nov 2017, After that Insurance Company Go to apple in High court. But in last Six years Case stand on "Regular" Case tag, Pls make a video on Regular, Urgent or Pending Status. Thanks

      We lawyers are also troubled because of non-listing of cases, no early hearing of cases, long delays in cases, even after listing of cases, etc.
      Seems like this is the situation all over the country. As of today, neither I have a solution for this nor does anyone else seem to have.
      Accept the situation as it is, and do what you can within it and keep hoping that your case will be resolved soon.
      I have nothing in my hands except to pray for you and all my viewers. 🙏🏼

    एक विशेष महत्वपूर्ण विधिक प्रश्न है :
    चार्ज फ्रेमिंग की स्टेज अभी बाकी हैं । चार्जशीट सेशन कोर्ट में दाखिल है । तारीख पे तारीख शुरू है । प्रॉसिक्यूशन विटनेस को विटनेस बॉक्स में खड़ा कर उनके बयान दर्ज करना बाकी हैं।
    परंतु एक महत्व पूर्ण डिफेंस विटनेस की आयु 75 वर्ष से ज्यादा है और ऐसा संभव है की अनेको शारीरिक तकलीफों के कारण वे केस की उस स्टेज तक जीवित न रह पाए जब डिफेंस एविडेंस को रिकॉर्ड किया जाता हैं।
    ऐसे में वो कौनसा कानूनी प्रावधान है, कौनसी कानूनी रेमेडी है जिसके तहत उनका डिफेंस एविडेंस /स्टेटमेंट सेशन कोर्ट में अभी इसी स्टेज पर तुरंत रिकॉर्ड किया जा सकता है ?
