Actually from what I understand the owner took "taxes" out of the original $10,000 which they shouldnt have done , that is straight up theft and then said the rest was to be split with ALL the wait staff , including those that didnt work that day ( so their daughter could be included I think ) some of the kitchen staff got mad and rude because they werent included and this server went to her boss about it but didnt want to name anyone so she was punished and sent home supposedly for 1 "mental health day " , when she texted in the next day to find out her shift she was ignored , then ignored again when she texted the next day , she then said she didnt like playing games and asked if she was fired and was told yes . She got $1600 out of the $10,000 , got ignorance at work , got punished and sent home , got ignored , treated like shit , fired , then threatened and intimidated . smdh
As a humble delivery driver, I received a $50 tip for delivering some pizzas to a veterinarian office on Christmas eve. It's the biggest tip I ever got, and I was so thankful.
Years ago, got a 4 cent tip on a hundred dollar order. These folks had a party every weekend and this is mid nineties. The owner was a great dude, drove right out to that house and dressed them down. After that, they tipped well and he also added a tip, to boot. RIP Kevin.

What really bugs me is that while $10,000 could certainly make life easier for her for a while, it's not anywhere near life-altering money. And since she had to share it with several other staff, and then pay taxes on the rest of it, it doesn't sound like she walked away with much of anything. Of course. Thats why tip sharing was invented....so owners and managers could get a cut of the server's tip...which is in reality their commission. They also claim it makes it easier to do the accounting (lie) and increases teamwork (lie). Most of the staff works for at least min wage, EXCEPT the servers who get $2/hr and commission (tips). The $2 is enough to cover 8% of gross for SS and 20% for Fes and State income tax witholding. No business that night servers take home $10 but it is likely deducted for taxes ...however they did hours of setup and restaurant chores for literally no pay. My wife worked as a server in her 20s....she refused to be in a tip sharing pool.

you clearly don't understand how paying servers works. They DO make minimum wage. However, it's expected that their tips will cover the minimum wage. If they do not report enough in tips at the end of the shift, the owner pays the difference. Now, whether or not the employee is being pay under the table, I don't know. If you are working under the table, then you may not be getting minimum wage. But all lawfully employed servers make minimum wage. Why are there so many uneducated people blathering on about how servers don't make minimum wage?!

A good friend of mine passed away a few years ago. He just so happened to be a multi-millionaire. We had a conversations about money and the power it can have over people. He told me that if he wanted to destroy someone's life, all he had to do was GIVE them a large sum of cash money. In some cases it would take a million, and in some cases only 10K would be all that is needed. The lesson in my story is money does not change people, it reveals them.

I'm going to counter your position -- you CAN be nice to most people. That's a choice, and generally it works out in your favor and pays dividends. But, even with the occasional risk involved with being nice, being terrible or neglectful toward other people isn't a smart path by comparison.

that happened to me on my first job. I finally figured out why I was fired, but it was painful when it happened. I knew I was a great worker, on time etc. It made no sense that I was fired. So sad that jealousy and greed exist, but they do.

Michigan is an all-party consent state for recording private conversations, which could make the recordings unlawful under their state law, though doubtful the AG would go after her in this situation. While I agree that you should keep your finances close to the vest, I'll drive, purchase, travel, etc however I want to because I work hard for it and make choices in my life that allow me to live well. If my boss and/or coworkers can't handle it (and many haven't been able to), that is on them. My life will be as glorious as I want it to be and they can focus on making their lives what they want them to be. Me dimming my shine won't level them up.

Legally she has to pay taxes on all her tips. The IRS makes you do this, not the owners. The owners also legally have to pay payroll taxes on this money.

I just tried calling that location to ask for more information about what’s going on and two of the employees lied to me and told me that I reached the Tennessee location which is closed, and the owner or manager of the location. Michigan is a state with at-will employment. Unless employees are union members or have an employment contract stating otherwise, they can be terminated at any time, without notice, and without reason. Likewise, employees can quit without notice at any time.

Yup…but depends on how it was distributed. At my place , if it was visa tipped, I would have paid the taxes then distributed the required percentage in cash to back of the house and my Busser but that was always my complaint with this system: my wages went down with the tax while theirs went up(and they usually made more per house as servers usually only get minimum wage). The gentlelady who received such a great tip and who shared it as requested by the giver, found out that she should not be at that restaurant. The person who was willing to fire a great waitress showed her that she should be working at some place better.
The details of what went wrong are very vague. On the face of it, a waitress get a $10,000 tip, is asked to share it, apparently takes measures to share the tip, but somehow this engenders bad feelings? I hope I'm not the only one who feels like we're not getting the whole story.
We aren't getting the whole story, but the part of it we do get from her indicates that she is the cause of the toxicity and drama that she describes. The reason for this is obvious. She made a public and unnecessary post online that is defamatory towards her former coworkers and managers. This by itself is bad enough but wouldn't indicate that she was the one in the wrong. It is the contents of the defamatory post that tells us who was the cause of the drama and toxicity because it is her actions which she describes which are toxic. She starts off describing herself in a self-aggrandizing way and then describes a situation where she is: 1) she was told she could have a day off 2) she was then told she could have another day off 3) asking her managers if this was a "professional way" for them to tell her she was fired 4) instead of waiting until her managers get back to her she then implies to them that they are playing games and says she "really don't like to play games" 5) the next day they call her and fire her in the only professional way which is to actually tell someone they are fired This description of her actions is enough to tell us that she crossed the line. Let's assume for a moment, that her managers had no idea what the drama was all about and told her she could have a day off on Sunday so they could sort it out and then texted her that she could also have Monday off because they still hadn't had time to sort it out and instead of getting a short text from her saying "thank you, see you on Tuesday" they get a much longer text implying they are playing games with her and being told by an employee that she "really don't like to play games." What might they realize at that moment? That the sole cause of the drama and toxicity is her because all they did was say she could have a day off and mean it and she escalated with them too. We don't really need the whole story, because her version of the story is enough to tell us she is a very toxic person who causes drama. Managers may not know what the cause of work drama is but there are times when it is apparent and this would be an instance where she made it apparent. At first, they may just suggest an employee take a day or two off so they can figure out what is going on and have the time to do other things that are also pressing. Then they may get around to talking to all the other employees one by one which may take them a day or two. But, in instances like this they may get text messages or emails from employees which tells them what they need to know. It's really easy to tell who causes drama if you tell them they can have a day off and they read into it as them being fired and tell the manager that the manager is playing games. Imagine you are a manager and you tell an employee they can have a day off and have this sort of exchange: You: You can take Sunday off (so you can have time to look into things) You: You can also take Monday off (because you didn't get around to looking into things yet) Employee: Is this a professional way for you to tell me I'm fired? You decide you won't respond until the next work day and can call because it's not urgent or appropriate for you to have this sort of conversation (at night) by text Employee: I really don't like playing games (immediately the next morning before you have time to reach out to them) Unless you were actually playing games, it's very likely that you would come to realize that your employee is emotionally unstable and is the cause of all the drama. The ADA doesn't protect people who have emotional or mental health problems when those problems cause workplace issues. In other words, it doesn't protect someone who inappropriately texts their managers to imply their managers play games because their manager didn't immediately respond to them by text.
There was no severance package when they fired her, so there is NO confidentiality clause for her to abide by. She did nothing but share the truth. The truth is that instead of firing several employees who had felt ripped for not getting their piece of the "shared" tip because they were not working that shift, they fired ONE employee...one employee is easier to replace than several...even when the several employees were the real problem. The new problem would be multiple positions would have to be filled if they fired the correct employees. Then the Cafe decided to double down with THREATENING the person they improperly fired. She is due unemployment that they will not be able to deny, and the labor board should be working on punishing the cafe for the reason she was terminated. When you fire and employee AND you give them an unwarranted reason to justify the firing, they can be found liable, sued, and fined. This is why smart business owners just say "you're fired" and leave it at that. Similar push back is that an employer is not allowed to even say they fired an employee or why they fired/employee quit...they are only allowed to say "yes, they worked here from this date to this date"...anything more and they can be sued.
Something tells me that the Mason Jar Cafe will not be bustling with patrons very soon.

My at will business was sued by an alcoholic employee who was showing up drunk. Not only did they get rehired but they also got rehab paid for AND damages !! Of course. Thats why tip sharing was invented....so owners and managers could get a cut of the server's tip...which is in reality their commission. They also claim it makes it easier to do the accounting (lie) and increases teamwork (lie).
Most of the staff works for at least min wage, EXCEPT the servers who get $2/hr and commission (tips). The $2 is enough to cover 8% of gross for SS and 20% for Fes and State income tax witholding.
No business that night servers take home $10 but it is likely deducted for taxes ...however they did hours of setup and restaurant chores for literally no pay.
My wife worked as a server in her 20s....she refused to be in a tip sharing pool.

If they do not report enough in tips at the end of the shift, the owner pays the difference. Now, whether or not the employee is being pay under the table, I don't know. If you are working under the table, then you may not be getting minimum wage. But all lawfully employed servers make minimum wage.

If my waitress does a good job, I leave the tip for her, not for the bozo serving other people on the other side of the restaurant who I never even met. I can understand cutting the busboy in, even the cook. They all contributed in some way to my dining experience. The one group who had nothing to do with it are the other servers!

Mason Jar Cafe has removed their Facebook page, suprise, suprise. This poor woman. No good deed goes unpunished...the old saying. That restaurant is despicable. She should immediately stop payment on every check she gave to co-workers, if she wrote checks, and keep the money since she now has no job and is being harassed for being honest and generous. I am sure the tip-giver must be horrified at the treatment she is suffering and would agree. I hope NO ONE goes to this restaurant. Boycotting them is the only thing they will understand!

A good friend of mine passed away a few years ago. He just so happened to be a multi-millionaire. We had a conversations about money and the power it can have over people. He told me that if he wanted to destroy someone's life, all he had to do was GIVE them a large sum of cash money. I'm going to counter your position -- you CAN be nice to most people. That's a choice, and generally it works out in your favor and pays dividends. But, even with the occasional risk involved with being nice, being terrible or neglectful toward other people isn't a smart path by comparison.

Michigan is an all-party consent state for recording private conversations, which could make the recordings unlawful under their state law, though doubtful the AG would go after her in this situation. While I agree that you should keep your finances close to the vest, I'll drive, purchase, travel, etc however I want to because I work hard for it and make choices in my life that allow me to live well. If my boss and/or coworkers can't handle it (and many haven't been able to), that is on them. My life will be as glorious as I want it to be and they can focus on making their lives what they want them to be. Me dimming my shine won't level them up.

Legally she has to pay taxes on all her tips. The IRS makes you do this, not the owners. The owners also legally have to pay payroll taxes on this money.

I just tried calling that location to ask for more information about what’s going on and two of the employees lied to me and told me that I reached the Tennessee location which is closed, and the owner or manager of the location. I was speaking with finally talk to me after four different phone calls and she told me it’s none of my business what happened and I shouldn’t even care because I’m from California, I asked her why she could hear their side of the story and she said labor law prevents her from speaking about any of it and it’s none of our business anyways

Michigan is a state with at-will employment. Unless employees are union members or have an employment contract stating otherwise, they can be terminated at any time, without notice, and without reason. Likewise, employees can quit without notice at any time.
On another report she does have a lawyer. I hope she wins some type of compensation.

Yup…but depends on how it was distributed. At my place , if it was visa tipped, I would have paid the taxes then distributed the required percentage in cash to back of the house and my Busser but that was always my complaint with this system: my wages went down with the tax while theirs went up(and they usually made more per house as servers usually only get minimum wage). Tipping is a bonus…people don’t share their bonus’…just saying. Restaurant work is filled with entitled drama queens who are usually the slackers but somehow they seem to have a bigger team and those like Lyndsey get the shaft! Also only those she worked with she only should have had to share with. Team Lyndsey!!

I don't understand what the dispute is about. She certainly should not take her post down, provided that it is accurate.
The gentlelady who received such a great tip and who shared it as requested by the giver, found out that she should not be at that restaurant. The person who was willing to fire a great waitress showed her that she should be working at some place better.
The details of what went wrong are very vague. On the face of it, a waitress get a $10,000 tip, is asked to share it, apparently takes measures to share the tip, but somehow this engenders bad feelings? I hope I'm not the only one who feels like we're not getting the whole story.
We aren't getting the whole story, but the part of it we do get from her indicates that she is the cause of the toxicity and drama that she describes. The reason for this is obvious. She made a public and unnecessary post online that is defamatory towards her former coworkers and managers. This by itself is bad enough but wouldn't indicate that she was the one in the wrong. It is the contents of the defamatory post that tells us who was the cause of the drama and toxicity because it is her actions which she describes which are toxic. She starts off describing herself in a self-aggrandizing way and then describes a situation where she is:
1) she was told she could have a day off
2) she was then told she could have another day off
3) asking her managers if this was a "professional way" for them to tell her she was fired
4) instead of waiting until her managers get back to her she then implies to them that they are playing games and says she "really don't like to play games"
5) the next day they call her and fire her in the only professional way which is to actually tell someone they are fired
This description of her actions is enough to tell us that she crossed the line. Let's assume for a moment, that her managers had no idea what the drama was all about and told her she could have a day off on Sunday so they could sort it out and then texted her that she could also have Monday off because they still hadn't had time to sort it out and instead of getting a short text from her saying "thank you, see you on Tuesday" they get a much longer text implying they are playing games with her and being told by an employee that she "really don't like to play games." What might they realize at that moment? That the sole cause of the drama and toxicity is her because all they did was say she could have a day off and mean it and she escalated with them too.
We don't really need the whole story, because her version of the story is enough to tell us she is a very toxic person who causes drama. Managers may not know what the cause of work drama is but there are times when it is apparent and this would be an instance where she made it apparent. At first, they may just suggest an employee take a day or two off so they can figure out what is going on and have the time to do other things that are also pressing. Then they may get around to talking to all the other employees one by one which may take them a day or two. But, in instances like this they may get text messages or emails from employees which tells them what they need to know. It's really easy to tell who causes drama if you tell them they can have a day off and they read into it as them being fired and tell the manager that the manager is playing games.
Imagine you are a manager and you tell an employee they can have a day off and have this sort of exchange:
You: You can take Sunday off (so you can have time to look into things)
You: You can also take Monday off (because you didn't get around to looking into things yet)
Employee: Is this a professional way for you to tell me I'm fired?
You decide you won't respond until the next work day and can call because it's not urgent or appropriate for you to have this sort of conversation (at night) by text
Employee: I really don't like playing games (immediately the next morning before you have time to reach out to them)
Unless you were actually playing games, it's very likely that you would come to realize that your employee is emotionally unstable and is the cause of all the drama. The ADA doesn't protect people who have emotional or mental health problems when those problems cause workplace issues. In other words, it doesn't protect someone who inappropriately texts their managers to imply their managers play games because their manager didn't immediately respond to them by text.
She didn't have to share with anyone. She did the nice thing and folks still complained. Ungrateful in nutshell.
There was no severance package when they fired her, so there is NO confidentiality clause for her to abide by. She did nothing but share the truth. The truth is that instead of firing several employees who had felt ripped for not getting their piece of the "shared" tip because they were not working that shift, they fired ONE employee...one employee is easier to replace than several...even when the several employees were the real problem. The new problem would be multiple positions would have to be filled if they fired the correct employees. Then the Cafe decided to double down with THREATENING the person they improperly fired. She is due unemployment that they will not be able to deny, and the labor board should be working on punishing the cafe for the reason she was terminated. When you fire and employee AND you give them an unwarranted reason to justify the firing, they can be found liable, sued, and fined. This is why smart business owners just say "you're fired" and leave it at that. Similar push back is that an employer is not allowed to even say they fired an employee or why they fired/employee quit...they are only allowed to say "yes, they worked here from this date to this date"...anything more and they can be sued.
I hope the news station does a follow up report noting the sharp loss of business and its ultimate closing because of their actions .
