- In an interview with 60 Minutes, the Federal Trade Commission head said the agency believes it has the authority to ban non-compete agreements - and will defend its case in court.

They need to push this. I worked for a company in 2022 and cannot work in the 'competing' industry for two more years!! And the 'broad strokes' they use is what is messing with the average worker. For instance, the company I worked for I was not getting any benefits because it was a small startup. AND the partners took most of the 'close to home' jobs, leaving me to get the outliers and random one offs. So I did much more travel and last minute things. Unpredictable. So I decided to apply with a manufacturer that did the same type of thing, but with the brand new systems. Even though the details of the systems were completely different, they considered the non compete valid. Even my old boss said that it was not valid for that transition.. So here I am doing something else for the next two years unless they get this sorted out.
This woman is a hero . The government deserves to give her more money to fight these companies .
I had to sign a non-compete when I was a window cleaner ffs. There were only two companies to work for at the time but starting your own window cleaning business was pretty cheap, except now I wasn't allowed to do that. It's predatory because where else are people in this field supposed to go, McDonald's? It's absolutely crooked and harmful to the economy and workers.
It’s about time that we remove non-compete clauses for regular lower level employees.

Khan is not deceiving people / entities to get her way so that description of her is BS. Khan is as straightforward as it gets. Maybe you do not realize that describing an appointed government official as cunning is definitely not a compliment and is a character trait deserving of removal from office.

I'm a lawyer who has had to deal with non-compete agreements forced on my clients as a condition of employment. I've successfully used state law in several cases to get these clauses invalidated. What is needed though is federal law or a federal administrative rule that prevents employers from using these agreements on widespread scale. They stifle competition and innovation. Non-compete clauses hurt the public as well as the employee. If the courts are here to serve the good of the nation they should not uphold such agreements.

For far too long, the tables have been tilted toward the direction of corporations and their heavy-handed chief legal officials, otherwise known as Chief Legal Counsel or General Counsel.
Gotta wonder why lawmakers in Congress never attempted to even remotely address this systemic problem. Perhaps the lobbyists that corporate America has engaged has far too much sway over lawmakers.

I’ve signed non compete at pretty much every company I’ve worked for and gave them zero consideration as it’s unenforceable if you’re not a damn CEO or something

Mergers, acquisitions, stock buybacks, non-compete employment "agreements" and general market concentrations by larger corporations are enriching the "Executive Class" while squashing competition at the same time. Where is the "Free Market" competition that is supposedly at the core of our economy? We need more Anti Trust action to stop the destruction of our economy by the "too big to fail" predatory corporations.

Doesn't Congress also create the agencies?
Are there no assignments of authority specifically granted to such agencies created, when created?
Or is there, and it's a matter of interpretation and enforcement of whomever is in authority over that agency at any given time?
Congress gives them that right and they have done so for decades. There is nothing wrong with that. Congress is not full of experts on anything. Thats why these agencies are created because the experts have at least more knowledge and experience on the subjects being regulated. I trust the EPA more than a fossil fuel mogul to draft regulations on environmental protection issues

Double edge sword. Person A who works for Raytheon quits and now can create a company for China with no repercussions. That’s how a non-compete works to protect highly sensitive materials.
there are laws for that. many people with no-compete agreements are on service jobs or fast food. You need to read about it a little bit more.
