Memory wasn’t the reason for not charging Biden or Mike Pence. It was that they offered to return them. The DOJ and LOC had to tell Trump to return his documents, and Trump lied to them and hid them after refusing to hand over anything. Obstruction of justice.

I don't fault Garland for making the report public because that's his job, but why did he even allow Hur to submit the report in this form? He could have told Hur that he needs to re-submit the report with the disparaging language removed but chose not to.
I suspect that is what Hur was hoping for -- the gambit was to have a 'sanitised' version of the report that was released, so he could release the unedited one and do twice the damage. He'd get the same play on the right wing gibberish outlets for the memory stuff, plus play to the MAGA (de)base(d) with reports of a DoJ cover up
His job is now to prosecute Biden with the same aggressiveness for the exact same crimes. Do you really think he's going to do it?

They likely didn't want to be seen to be censoring something negative about Biden - this was a classic poison pill in that regard as I'm willing to bet if they forced the removal, the unredacted version would have been leaked and Hur comes out performing like a martyr on the hack networks

Biden said he didn't know his VP staff put those documents in his home and the Penn Biden Center. He didn't clarify how docs from his senate days got there.
Hur recommended no charges, the DOJ under Merrick Garland had the final say if charges against Biden could be laid, and if the WH did not have any influence on Garlands decision, Biden could have been charged inspite of Hurs recommendation.
There's a big difference between Biden's attorneys discovering classified documents and reporting it to the National Archives, and the Archives requesting documents from Trump then having to seeking every legal maneuver possible up to and including an FBI raid to obtain them. Anyone who can't see that is being willfully obtuse.

So uninformed, you do know Trump is not being charged for possessing the documents or how they were originally stored but for refusing to comply with an order to return them, lying about returning all of them, and concealing and lying about moving them.
He didn’t willfully retain documents and gave them all back. What would he be charged for exactly?
No because not even defendant Trump was charged with stealing classified documents, he was charged with refusing to return them despite being given every opportunity to do so when first asked to, then subpoenaed to and finally after a search warrant was issued and executed to retrieve them.
Neither Biden nor Pence were ever going to be charged for having documents because in their cases, they were the ones to reveal it, gave them back freely and fully cooperated with the initial investigations.
There should not even have any follow-up investigation of Biden but his own AG appointee is falling over himself to be seen to be impartial, just to appease Republicans, despite Trump's corrupt AG appointee covering for him and acting as if he was his personal attorney!
