      JoTheGeekGAMING B I have a band called surgeon general's warning and they said we are signed under orchard enterprises and we are not. Not sure what to do with this info yet.

    The Orchard Music is claiming that they own the new introduction to our videos. The basis for their claim, is that they claim they are the copyright holder to the music, bearing an adulterated name of one of our videos that has the music in it. The stolen video was downloaded from our channel, and reposted with our title, with three symbols in front of it. We filed a DMCA takedown demand against the video, and it has been removed... but the Orchard's copyright claim persists.WOULD YOU BE INTERESTED IN JOINING A CLASS ACTION LAWSUIT AGAINST THE ORCHARD? Let me know.

      +Wandering Sole Images RUclips are not made for the content creators but to make money, they get more income to show advertizing in videos that copyright trolls claims the right to than support and protect free content, so in other words are RUclips the largest copyright troll in the world (according to me).

    I've just got a claim on a track I produced 8 years back. I OWN the track. I know it isn't a dream because i spend some good hours on it plus I got paid for working on it. Now they are claiming it. Unreal.
    I am wondering what sort of justice these people will get for stealing.
    456 people on this one page have said something and RUclips isn't listening. I applied to be in the content ID (not to monetize but to manage my music rights so no one can claim it but no one has gotten back to me in for over 3 years now and I have 5000 tracks).
    But a thief is allowed to apply for content ID and make claim on works belonging to others. What gives?

    I've had Orchard claim the music _three_ separate times on the *same* video!
    I have won the dispute twice before, and I am in the middle of trying to dispute the third claim. I have paid for a licence and have full permission to use the music so I can monetize my video. However during all the time the dispute is going on, monetization is put on hold, so I am losing money. Money I was hoping would offset the cost of the music licence I paid for in the first place.
    I do have to deal with this one carefully as I am at the stage where if they refuse my solid evidence (which they have done before!), RUclips states there is a possibility of the video being taken down. I partially blame RUclips for not properly looking at the evidence I previously sent showing that I have full rights to use the music.
    The claims process does not offer many options, and as you all know, there is zero official support for a small channel.
    Thanks for the info in your video, I will try to contact Orchard directly this time.

      Yes, and moreover, since Orchard have the 'right' to place ads on videos in which they claim to own music, they must be making money off your video and someone else's music at the same time as you are losing money! Even if you eventually manage to block them, they will probably have made a good few cents off your video in the meantime. Therein lies the root of the scam.

    Yeah this is totally f*ed up! I have been uploading MY ORIGINAL MUSIC that I CREATED (and copyrighted), and every time I upload it, RUclips says someone else has the copyright to MY music. The first two videos I think will clear up, because I have those songs with CD Baby. I'm pretty confident those will get cleared up. But today I uploaded ORIGINAL MUSIC that is...wait for it...UNRELEASED, and The Orchard Music has claimed they own the copyright to it. This is ridiculous because the music is UNRELEASED, there is no way this original music of mine has ever seen the internet until now. Ridiculous, I am so angry right now. I filed a dispute with RUclips for each of these instances. Probably will take awhile to find out what happens.

      I wrote them yesterday - disputes @ theorchard . com and they removed their copyright claim on my music at the end of the day yesterday. They were very polite and professional about removing their claim on my music. I guess it still takes humans to oversee the robots.

      Michael Maricle Really? Because once I realized it was they who released the content for the guy with whom I have a trademark issue, I originally contacted them. No human or robot ever got back to me. BTW that's awful! Did they give you a reason? I guess I better prepare in case that ridiculousness happens to me. Glad you got it taken care of so quickly.     The Orchard put a claim on a video of my cats simply MEOWING with no other sounds! Turns out some DJ sampled the meowing from my video without my permission!

    Someone stole one of my tracks, released it through The Orchard, they accepted it, didn't even check and came to claim copyright. the track in question was deposited SIAE and ASCAP, they never answered, they had to remove the claim after a month but they are not willing to remove the track from their catalogue.

    It's ironic that over the weekend, we have been discussing (with FCC Attorney friends) how companies can file automated claims against various sound tracks on RUclips. There are honest companies out there, such as SmartSound and TripleScoop... we pay them, for royalty free music. Yet, the claims from companies such as Ioda, Orchard Music and others automatically lock down RUclips videos and prevent them from monetizing for various periods. The system is broken apparently. We are tied up in appeal processes, while profits are lost. My suggestion is, that these many Royalty Free Music Groups, get together and have a method of identifying who is and who is not authorized to use which music. If you can send out crawlers to find and tie up videos, you can certainly have a system that informs on legally shared music. Always ALWAYS dispute their claim, when you are in the right, don't abandon the video... keep pressing on.

    Well, I am a youtuber. I make my living by google / youtube. I have contacted Kevin MacLeod and written two different emails to The Orchard group in the form of a cease and desist order. I also informed them, that if they do not respond within 10 business days, that I shall bring suit. I then contacted an entertainment lawyer through my business partners.
    I plan on suing them anyway, for defamation, harassment and require that youtube purge the system of their data.

      you can imagine that I have my label and I'm the composer of some 1000 compositions and I had the misfortunate to have my entire catalog sold by my distributor to the Orchard without my consent.... Then I legally terminated the contract 3 months ago with a letter signed by both party, but they NEVER took down my music and I cannot upload on youtube without get a strike... SUPER FRUSTRATING... this is the age of big scam and hungry sharks on internet and we are basically screwed.... if you have an attorney that's into it, please let me know at management@ictusrecords.com

    I've not even seen the video yet, but it's already been helpful! Thanks a lot for uploading it, and mostly for the description! First thing I've seen was the description, and then I went straight to mailing them. The problem in my case is that I have used music composed by Giusseppe Verdi in the late 1800s, that should be public domain since 1971. While they didn't claim the copyright on his behalf, they did find a band, Antropomorphia, that used several seconds of the same part of his music in an intro to one of their albums, and claimed the copyright on behalf of their record house. Even more, I've used the entire Tuba Mirum from Verdi's Requiem, unlike the band they called the claim for, who only used a lazy 30-40 seconds of it! Well I'm not here to criticize the band or anything, and I might even check out their music, since I'm pretty fond of black metal, but the point is that both the band and myself have used public domain music, and that scumbag algorithm they use has flagged me - just my luck, huh. Now I'm waiting for the results of my dispute, it's due on 31st of Decemer. Now I'll be off to watch your video, see what you had to say about this :) Take care o7

    They fixed it! The Orchard Music granted my appeal and removed their hold on my video. A second simultaneous hold was filed by BFM Digital. They tried to escalate the issue on RUclips but immediately released their claim when I emailed them and then called them on the phone today. BFM threatened to place a strike against my account if I lost the second appeal. They were much more polite on the phone.

    Orchard Music did put a copyright notice on my last video, but the song is actually owned by them. They, for some odd reason, did not delete the video, the video is still up, it's just blocked in a select few countries. Why didn't they take my video down if it actually was owned by them?

      ChristianTheSnowman Because the artist who actually owns the copyright is being represented by them. The Orchard Music Group is collecting royalties for them by telling RUclips to place ads on the video. Your uploaded video using the artist's music is known as "UGC" or User-Generated Content.

    I also have a problem with Orchard, I had a notification on the video and disputed it as mistaken identity. They have now refused my disute and opened the claim again. I am glad that you have made this video. We can all put a stop to this!

    I have a copyright claim by Orchard Music for a song called "Amanda" on my video - but I have no idea which track it is they're talking about as I have no song called Amanda in the my video?? It must be a song that sounds similar in melody maybe?

    I use NCS (No copyright sounds) and one track, 'Lumian - Fly' got disputed on several videos. I can't even FIND the track they're talking about and I spent a good hour searching. The band exists, but the track has no results.

    I just disputed 2 copyright claims on MY ORIGINAL CONTENT by these people and guess what! My copyright was released! YAYEEEE!! Justice! This has been weighing down on me for months because I disputed and they held it, and then they started claiming on other songs of mine. But VICTORY!!

    Thank you for making this video. I'm glad that this is the top result on a search for Orchard Music Group. They pulled the same stunt on one of my videos today which was using Creative Commons music suggested by youtube themselves. I just removed the song, but now that I've seen your video, next time I will know to dispute the claim.

    This also just happened to me. My friend's band lets me use their music in my videos, and let me tell you, they are NOT called "The Orchard Music Group." I am so angry because I actually make money off of my videos, and these thieves are stealing my hard earned money. I have emailed TOMG and also have disputed a claim to RUclips. If this is not fixed, believe me, I will raise hell.

      ***** I sympathize with you. An independent musician sent me music for use in a video and it was claimed by TOMG. He has zero affiliation with them. They seem to claim a lot of music outside of America. Well, they don't realize they messed with an American that lives not too far from their headquarters. And I have plans for them...oh yes I do!

    This has recently happened to me. I used a free instrumental under CC and received notification from YT that "The Orchard Music" has claimed ownership of the music when it is in free and owned by the company who's site I downloaded the music from.

    Hi, I have had a smiler thing just happen to me- I used music from macs jingles in iMovie surely this is like garage band open to public.....have you had the same issue with iMovies jingles, holy, booms etc...

    Thanks for this. I made a review of an old Commodore Amiga video game from1991 called Turrican II. Orchard say they own the music. I can find nowhere on the Internet to back this up. As it was a review, I was speaking all over the top of it in any case and believe this is allowed under the terms of Fair Use. On top of this, I'm told the game is also available as a Free download online so therefore in the Public Domain. Was a little scared to dispute this before. I guess that's what they count on.

    My name is Richard Pearson and I present a monthly astronomy program. Orchard Music got me too. I always credit contributors at the end of the program, and obtain copyright permissions before the program is broadcast. In this case I personally played the piano Moonlight Sentra in my own style for a short section celebrating Sir Patrick Moore 1/1/2015. They claim my artistic work belongs to them. It does not! It is a bogus claim and I have contested it to the appeal stage. I am so angry because it locks down my program and we receive no earnings from it. Thank you for posting this video. It is a thorough and informative demonstration of Orchard Music's flagrant abuse of the Content ID system that continues today.

    I dont blame you, I just received copyright claim from them for the fourth time on my Commentary Gameplay video for The Crew Beta on Xbox One. Part 1 to be exact, and I have had music removed from that video countless times. So I dont see where the Orchard Music company, or anyone else keeps finding music content in this video. We should start a petition to have Orchard shut down, or keep them from filing content claims on RUclips users. Just like you said, they're harrasing us, and to be honest I'm fed up with it too.

    This is an interesting "dispute" issue with Utube.com & Orchard Music Group membership for indie singers particularly. Question: Is this topic can be resolved by a "consumer complaint" filed with U.S.government agency who addresses "consumer complaints ?" .

    This literally just happened to me: The Orchard Music have just claimed a song by Jordan Comolli called Fallen from the Alpha Records royalty free playlist on their RUclips channel. All of the music used is copyright free that I use.

    Thank you for doing the research about The Orchard Music.
    What drew my attention to this was that the song "Long Live The King" by the heavy metal band "Sabaton" was blocked wholesale by The Orchard Music group. Look the song up on RUclips, and you will get no results because all videos have been taken off listing.
    This ticked me off because the song is a good song and that "Long Live The King" is published and/or licensed (I'm not a lawyer, I don't understand political gubbins too well.) by Sabaton and Nuclear Blast Records. Nowhere have I heard that The Orchard Music group has any claim on "Long Live The King."

      Correction. Not all videos of this song were struck by The Orchard Music. Nevertheless, they have no claim over the song.

      Sabaton's Label Nuclear Blast are distributed by the Orchard so they do in fact own the right to monetise it on RUclips. A quick 2 minute Google search could have told you that. If you want to monetise RUclips DON'T USE COPYRIGHTED MUSIC - if really quite simple to understand

    Thanks for posting this. I ran into our friends of "Orchard" as well. In my most recent case I had actually purchased a license from a musician that allowed me to use his music for private and commercial purposes, but Orchard lays claims to it, and RUclips ignores my complaints. As content producers (writers and photographers) my wife are as irritated as you are when people lay false claims on copyright, especially since we are strong believers in the creative commons concept. Unfortunately even asking for an attribution seems to be too much, but beyond violations of the use conditions we, too, have experienced cases where third parties claimed our work as theirs. Orchard seems to have elevated this to a totally new level. So far I didn't bother to do something about it, swallowed my anger and moved on using different music (own, Garage Band, RUclips Collection). However, I may in the future use RUclips for professional purposes rather than merely for the occasional just for fun or non-public family-sharing video, and in this case this issue becomes a serious commercial risk. The Internet increasingly becomes a play-ground for free-wheeling marauders who are not playing by the generally accepted rules and completely lack any decency.
    Orchard is part of the Sony Group. Since many people seem to be bugged by it, the big word that comes to my mind is: CLASS ACTION LAWSUIT. If we find enough people willing to participate, Orchard - and hence Sony, respectively - is likely to reconsider their practice, and it may also be a warning shot for other big businesses who think they can treat small independent content providers as they like.

    I happened the same, a vídeo with my daughter's record voice was claimed by Orchard Music, it is incredible, for this reason I won't permit that, I Contract a lawyer for demand this fake claim, if someone have to demonstrate that the contain is yourself, contact to me, the next month I will travel to USA to start the demand, maybe you can help with this cost about lawyer, The Air ticket I wil pay.

    Hi! This also happened to me. The copyrights are very important to me, since I also work as an artist. This is why I use royalty free material or material made by myself. This is why I was very surprised to find that OMG had claimed the music used in my video was theirs. It was´t. And thanks to your post I disputed it and now YT sent me a notice that this has been cleared and OMG has now withdrawn their claim.

    Thanks for posting this! These morons just tried to file a claim on one of my videos today. They are looking for soft targets that won't dispute their claim and they are clearly making money off of the hard work of good, honest artists. Someone should put them in jail. RUclips isn't helping as they allow companies like this to file claim after claim after claim. All it would take is for someone to look into all the songs they claim the rights to. Then it would be transparent that they are simply stealing money from artists. EVERYONE NEEDS to leave them a negative review on Google.

    The Orchard is a scam. They have made a claim on a video i released 10 years ago!! Back then I purchased a program called Smartsound which is a royalty free music program you buy sound packs for. I bought the comedy pack. It came with loops, layers and different pacing beats. The Orchard Music goes after anyone using royalty free music, places a false copyright claim, keeps your video up but monetizes it for their benefit. They hope most won't bother disputing, because youtube places all the burden on you, NOT THEM! They should have to prove they own the copyright before they can make a claim. Sadly, Orchard has monetized thousands upon thousands of music that does not belong to them and they do not own. RUclips will not ban The Orchard because no matter who is monetizing the video, RUclips gets their cut of ads. They will not be on your side. The Orchard deserves a class action lawsuit, not revenue. They're making millions off fake claims on royalty free stock music that we think we won't care about a dispute on.

    Not even Let's Plays are safe, they're trying to claim some music from my Ape Escape 3 walkthrough. Despite the fact that it's the actual game music. Fortunately for them, it's just the initial automated alert so far, so wish me luck in disputing it!

    Thank you for posting this video! I ran across it after attempting to research The Orchard music site. They claimed ownership/infringement on one of my videos that I created and posted with appropriate permissions. I used Adobe Premium Pro and the content is copyrighted. I was asked and given permission to create the video. Its terrible that Orchard is doing this. They should be checked by RUclips since there are so many others fighting the same fight. I have sent in my dispute.

    This just happened to me and I got the response back rejecting the dispute.
    Aren't there high-power attorneys willing to take on this case pro bono class action? I have a network that can speak with some attorney. I just don't have the knowledge or experience to round up hundreds of people that would be willing to sign.

    I posted a video on my channel about four months ago and made money on it but it recently got copyrighted by the orchard and I am quite annoyed. I used many songs in it for about 15-20 seconds each and many of them were speed up. If I file a dispute through youtube can I mark it as in the fair use guidelines or am I just screwed and these ppl get to take my future earnings from it? If anyone has any suggestions pls reply. my video I'm talking about is on my channel "extreme room makeover", I'm not trying to advertise my channel here just trying to get some help.

    I got a claim on an old video of mine, i cant find the artist they claim to be representing, idk if to continue to dispute and give them my contact details and risk finding out a video i downloaded as public domain to recut actually is one of theirs , or what. idk.

    I got one of these too and I got an email saying their claim is also still valid. This is crazy that someone is able to do this! I'm in touch with the guy who I got the tracks off and he's doing what he can to get this sorted. Let's hope he comes through.

    They are still doing it - I have just had a claim on a piece of music, Iess than a minute long, I put together from a straight sequence of Apple loops that came with Garage Band. I have already been through all this with the same video with AdShare MG for a Third Party who also seem to trawl RUclips making false claims. I contacted Apple Inc after AdShare MG refused to release the claim and the guy I spoke to at Apple Inc just laughed at their claim and said, tell them they will need to sue Apple Inc if they think they own the Garage Band loops. When I told ADShare MG what Apple Inc said, and sent them a link to the legal notice about Apple loops, they released the claim straight away. And now it is happening again with Orchard. This is nothing short of being robbed in the street online.

    that's happening to me too. I have a few promo videos up of MY music, they tried that a few months ago with my one song worm, I disputed it & that was that, but just recently they are trying to say 3 of my other songs are theirs. what the hell?

    The Orchard music gave a copyright claim to one of my videos of a 45rpm record playing "Three O'clock thrill" and "when" by the Kalin Twins which the songs where from 1956 or 1958.

    So how can you find out whether or not they have a claim to a particular song. I actually noticed it just now. I uploaded some vids I made at concerts and now I see that they are the plaintiff. They didn't take the vid down but there might be some ads from which they collect the money. And with 7854 viewings that can be quite a bit of money...

    This is happening to me right now. I used royalty free music. The "matching" content that they're claiming I used was published nearly THREE YEARS after video was posted. PLUS it has spoken word over it with the music softly playing in the background, when mine does not. I gave them all this info and the source of the royalty free music that I have license to use and they STILL rejected my appeal. Emailed them and waiting for a response. What they're doing is reprehensible. Plus it is SO BROKEN, that RUclips uses the freaking honor system to deal with copyright and the monetization of that. They're scamming their way into all kinds of monetization money that they did NOTHING to get. YT doesn't care because whatever money is made from ads, they get a cut. It's SO MESSED UP!

    Why does RUclips routinely honor fraudulent copyright claims, often not report who filed the claim (so they can be sued or prosecuted for their criminal activity against original artists or the public domain), and why do they continue honoring requests by companies such as UMPG or The Orchard that have such an extreme track record of fraud? ALL information belongs to the public. Copyrights are a temporary exception, and it is the copyright claims that need to be defended, not the exercise of free speech.
    It is not enough to just dispute fraudulent claims. These companies are committing crimes against original artists and against the public domain. Using an automated system is not an excuse for committing the crime of libel. A crime is committed each time a fraudulent claim is published. It is time law enforcement focus on the REAL criminals in the war against the public by Big Media.

      If an automated system is created that continually breaks the law (ie, committing fraud and robbing people of their royalties) then the person who uses that system, knowing it's broken, is liable for the crime. End of!

      Rebecca Newman I have already asked the US Federal Trade commission to investigate this criminal activity on the part of RUclips and Orchard, but these companies get by with their routine theft of other artist's royalties because they haven't been forced to prove their claims in court. Since US law enforcement has failed in their duty to follow up on this consistent crime, it may be up to individuals to file individual lawsuits. I don't know what equivalent legal resources you have in the UK, so I can't give meaningful advice, except that I hope you will choose a response that helps protect everyone's rights, but I also realize you need to protect your own rights first. Whoever succeeds in getting the courts to correct this systematic theft of royalties from thousands of individuals, I hope you will demand punitive damages several times the face value of the collective value of the thefts. Orchard Music needs to no longer exist. Any less severe penalty would be a travesty.

    Amen. Orchard laid a claim on one of my videos yesterday. My video contains NO MUSIC whatsoever. The only background noise is my neighbors lawn mower. I am wondering if Google diverts any of my unpaid ad revenue to Orchard when they make the claim?

    They are attempting to do this to me also, for music I arranged from a track purchased from Quicktracks, using their software, licensed to me to create royalty free music. Why does not RUclips eliminate these scammers?

    2018 and this scammers still operating on YT platform. Today i receive a content id claim (not to remove the video but to monetize my video in my face) the video was a simple presentation of a guiness record of MY city (Pan de Azúcar, Uruguay) because here they harvested the first watermelon in the shape of a country in the World and they presented it during a small folk festival that takes place here every year. These scammers claim me the first 30 seconds of the video, where what exists is the festival's publicity vignette, which does not even belong to them because it is written and interpreted by local artists, who ARE MY NEIGHBORS here in the city and who never in their lives they have heard the name "The orchard music" nor are they artists of any music recording company. I asked for advice on RUclipsTeam on Twitter, so far nothing has been said about it. Right now I am in the dilemma if I make a dispute, which leaves me exposed to receiving a negative response because it is "the orchard" who decides on my claim AND NOT RUclips AS SHOULD BE. It is a complete abuse that since 2011 when you have had this problem, to this day RUclips does not do anything against these scammers, who have even wanted to become owners of works by Carlos Gardel (Tango), whose authorial rights have been in the public domain for years, just as I have also read that they appropriate anything they found interesting from small channels. A boy in this thread that I leave then complains that they appropriated their own musical composition (registered in SADAIC Argentina).
    This is a barbarism. These scoundrels attack small channels that do not have networks or that are not yet reaching the minimum required to monetize, and thus pocket millions stopping the profit of thousands of videos that do not belong to them.     These people are driving me mad! I use the music from Final Cut (Royalty Free same as GarageBand/iMovie etc.) and several times now they've claimed against my videos because they've made a song using the same loop then submitted it into content ID. I've contacted RUclips, they don't seem to care too much and have just told me they don't mediate copyright claims!

    Found your video from googling The Orchard Music. This is the first time I got a claim from them, on original rap with a free-to-use beat. The claim was with a song title I've never heard before (google gave me nothing?), the place didn't even make sense. This is very stupid, I can't believe they are getting away with this even though they're already famous for "stealing". I disputed. I didn't explain about the frauds but provided all the needed links, I guess. Fingers crossed.

    Thank you for posting this video. I am also disputing 2 claims from this so call "The Orchard Music company". They are claiming the rights over the background music I used in a couple of videos I produced. I used Garage Band/Apple Loops to produce the sound track and they are claiming ownership over the Royalty Free Apple Loops. They are currently taking away ad revenue from me, from my work. This is ethically wrong and disturbing. I will categorize this behavior as a scam.

    Two weeks ago Orchard filed a claim on one of my videos which contained music performed and record by me (under the name "anakrid") and released by me on my own label "Stereonucleosis Records". I jumped through all of the youtube hoops to verify that my work was my own and today I got an email back stating "After reviewing your dispute, The Orchard Music has decided that their copyright claim is still valid." So I had to jump through all of the hoops again to declare that my work belonged to me and was released on my own label. In filling out those forms there was a vague threat of litigation if Orchard wanted to pursue the claim. Considering I had only 400 views on my video, I just decided to take it down as opposed to have to waste money and time in litigation with these scam artists.

    Just happened to me. I am an independent artist and dustribute my own composed/recorded music. They are claiming 31 seconds of my 6:20 song is their's. I was able to look up the song they "claim" is being infringed right here on RUclips, no similarity, not even the chord progression. SCAMMERS. I filed dispute as you advised and WILL pull the video if this is not rectified. Thanks for your video and the heads up. Seeing others here experiencing the same.

    Thanks for making this vid. More and more of us need to keep outing these scammers. I don't dispute right away with RUclips. I contact the scammer, provide all the documented proof that proves their claim wrong and let them know I am CC'ing it to the actual owner, so far they have all complied. But still what a pain in the @$$ to deal with these leeches in the first place.
    On an off note I really like Kevin MacLeods work as well, there are some great creative commons and public domain music out there that we can use.

    I have just noticed one of my ALL original songs has a copyright claim by the Orchard Music Scammers, I have filed a dispute with youtube. I am starting to think though if there are so many YT users claiming this scam then YT must be a part of it IF YT has not done anything about it.

    Orchard Music actually did the same on some of my Android videos. I made a video called "Cell wants his money from Android 17" and then I made a sequel to it and they both got copyright claimed. Watch out for Orchard Music

    I put up a clip of Donald trump being interviewed in the '80s, there's no music on it, and The Orchard Music claimed a share of any profits I make. Lol, the joke is on them, RUclips has de-monetized me, I'm not making a dime, because of my world view and politics.

    You are absolutely correct. It is a SCAM and a complete fraud by numerous music publishing companies to obtain the royalty for each of your views. They have done the same thing to others and could be grounds for a class action lawsuit.

    I'm starting to feel the pain here. The only sound in my videos is either my voice or the games. I don't really see how they can own any of the game music or any of their sounds. If anything things things belong to the actual creators. I hope they are dealt with soon. Wish me luck.
