Thank you for creating this video! The world & the people in the United Kingdom need to know about this! As you said in the video, most people are unaware of this. I am in a similar situation. When I announced that I will be leaving the U.K to move to Brazil to be the person I love, most of my friends responded by saying: "Why doesn't she just move to the U.K, there's so many foreigners here already!?" I said it isn't as simple as that, followed by a long explanation as to why it is not easy for the lady I love to live with me in the U.K. I then have to explain the process & rules etc of TRYING to obtain a spousal visa. That's if I earnt enough money according to the MIR (Minimum Income Requirements) or the Financial Threshold to obtain a spousal visa. I lived in Cornwall, so I didn't earn this, but even if I moved to another part of the country & got a good/well paid job in a city, as you explained, I could spend 6-12 months doing this - and I could still fail! In other words, the Home Office, or our government can still refuse your spousal visa, even if you do everything correctly & earn enough money. So I stuck my middle finger up to the U.K when I left the country last year & moved to Brazil to be with & live with the person I love & we got married. I/we would like to live together in the U.K, but it is not an easy process as you explained clearly & in detail here in your video. So for the time being we are happy living here together in Brazil & enjoying a normal life, like every couple should have the right & privilege to if you are in life. But if you are a British or U.K citizen & you are in love with a foreign spouse or partner, who lives in a country outside the E.U, that comes at a price! It is a bit out of date, it is a few years old, but I created & uploaded it when we were apart & struggling to find a way to be together. But it is from our hearts. I'm Greek and I used to live in London from 2009 up until 2016 .During Brexit I was in the process of getting married with my partner and we postponed it .We ended up not getting married because all this was too complicated and he wasn't willing to move in Greece with me . I left UK and moved back in 2016. We broke up and i guess it was for a good reason. Now I'm very happy and in love again with another English man I met in Greece ( what on earth ? It must be the accent that attracts me 😂 ) Hopefully this time will work out and the distance and complications of life will not be an obstacle that will separate me from the one I love .
Me my wife and daughter have been parted for 6 years now :( We met lived and worked in dubai for 7 years. I came home and we have been parted for 6 years now. We tried the whole Ireland thing which took 18 months for them to say no. We appealed with the EU consulate who took 13 months to reply just to say that it was so long before that we would have to apply again and if we was turned down then to contact them again. another 12 months Ireland turned us down. now waiting on EU commission again for 5 months now. I think my only hope is if Labour win! And change this dreadful law aimed at british people only. If i was french, polish, german or from any other EU state, id be welcome to bring my wife and daughter, but as im british I can not. I have lost 32kg since leaving dubai. I am suffering serious depression, working zero hour contracts just to keep a roof over my head here, and a roof over my daughter and wife's head in the Philippines. It was not supposed to be like this. We planned to settle and work in our own business here, employing staff, paying tax. instead most of what i earn goes to supporting my family. I need my other half back. Without her im so lost!
I think they look at the relationship duration as a whole as well. Me and my wife did long distance for 7 years and decided to do visa process we still sent a book of information but it went through. I think if you been with your mate for a short time they look at that as red flag and will ask more information. I also went through the process after 4 years obtained a fiancé visitor visa then married then left to the states waited years later to do spouse visa approved. I think the track record is what counts the relationship duration is almost like a solid indicator that it’s not about money it’s about love and patience and perseverance and not giving up.

I knew about it but I thought it was a discriminatory against foreigners of darker skin, but from your video it appears it applies to any foreigner regardless of race.
They make you pay thousands of pounds and don't even email or get in touch to let you know what's happening with your application. My husband earns way more than 18600 pounds a year and we have a baby girl who is a British citizen but we are still waiting for my visa to be processed. We paid extra for the priority service and it's been nearly 7 weeks we havnt had any reply from them yet. It's just inhuman and insane to realize how cleverly they are robbing people's money.
We paid over 500 pounds so that our application is processed urgently. They are more than happy to take people's money but refuse to do the job on time.
We went through something similar to your case in March. When our visa was rejected (for a very weird reason; no it's not money, my husband earns way more than the minimum amount) we didn't even know :/. Had the office (in my home country) not called me about picking it up we would've been waiting and waiting and calling with no answer so if it was approved it would have been too late because the 30 days would have passed :/ . We are trying again so we are anxiously awaiting their response.
You did a big public service to people who truly love each other to death. I love my wife and there is nothing I wouldn't give up to be with her until the day I die.
Now they have privatized the visa application service, contracted out to French company Sopra Steria, with biometrics done by Indian company BLS. These companies openly admit they are interested in this 'business' as it has a high profit-margin. Well, obviously does, since they have the monopoly on a service which people who are married to foreign spouses have to use. They are opening over 50 new applications centres in public libraries. However, the Home Office still does the processing so the answer times are no quicker, and in fact, slower. The fees have increased, but the service has got worse. It's a national disgrace. So much stress and unhappiness, and faceless bureaucracy.

I am from Mexico City, my wife, Katrina, is from Brighton and we were considering applying for this Spouse Visitor's Visa for myself as the immigration officer got quite nervous this last time I came to Brighton. It would seem obvious that we will be coming to the UK to visit Katrina's family at least once a year... well it isn't for the Border Control Officers. In their minds everything is a plot to live in the UK and abuse their system. IT IS INSANE!! The officers usually don't even know very well what is going with their own regulations. I am a lawyer and I have kept updated with the changes in the immigration policies of the UK since I met Katrina on the 11th of July, 2011, and the things they say are just ridiculous. To begin with they think that entering the UK is a prize for me. As soon as they see "MEXICO" in my passport they immediately think that I am desperately trying to set up residence in the UK. I am sick and tired of all the questioning and mistreatment I get in the UK almost every single time, with few and treasured exceptions. Several times I have considered filing a legal action on the grounds of discrimination, but I rectify when I realise as well that whatever I do, I mean just business. It is incredible. All I do when I come to the UK is spend the money I earn from my own businesses in Mexico, yet I am questioned as to how I can give them more of my money by paying for visas, taxes, healthcare and all the stuff they need to fix. I bring money from Mexico to the UK, yet in their scared minds it is me who is demanding benefits from their country!! Immigration policies in the UK are a great disaster. The stupid Surinder Singh route also requires my wife to be working in Europe in order to come to the UK... Why the hell would you come to the UK if you have a nice job elswhere in Europe? Again this is all because the immigration officers think it is such an award for all us Non-Eu citizens to enter the UK. I would be up for participating in any pressure groups and producing any arguments as needed in order to change this, if it would help any other couples. It is outrageously painful to live all the family problems that you already go through when you leave your family, there is no need to be reminded by your own country (in the case of Katrina) that you are on your own if you decide to marry someone from a different culture... like if it was some kind of medieval punishment for betraying their Kingdom... Hey, my boyfriend is also from Mexico City. I am from Scotland. Totally agree with everything you said. We have a british born son but live in Mexico and as you know the wages are low, we don´t own our own business and cant even afford the application process. The earning threshold is even higher when you have a child I think its at 23k per year making it even harder. How is your situation? are you any further forward to getting a visa?

Very useful video, I have been married to my British husband more than six years. I battled for four years to get the visa. At last I could get a visa based on human rights. I spent more than £6000. In November my visa is running out so I am planning to apply for spouse visa. I thought I will be get it at once. But after seen this video, I am worried if I don't get it once I will have to leave my huaband because I have not lot of money to spend on visa over and over. This is ridiculous. I never seen country which has put rules on people's marriages. Unfair.
You forgot to mention that even if you do find work that pays over the required amount, you have to earn this for 6 months straight before even applying for the visa. My wife is Japanese and fortunately we are happy living here in Japan, however it does feel sometimes upsetting that I am basically being punished due to the fact that my wife is Japanese. We could do it, but we would have to separate, I would need to find work, wait 6 months, the process from there probably takes longer, lots of money, it is ridiculous. I am with you when you say you understand the need for restrictions on immigration, of course, but for hard working genuine tax payers like me with something to offer, why should I be punished? We decided to get the Japanese spouse visa instead though and we live here now. Middle finger to the UK.

I am worried now for me and my boyfriend. We met in Austria while on holiday and have been in a long distance relationship and are talking about marriage. My wife and I wanted to move to the UK for work. We lived in France the past year. We went through the UK marriage visa minefield and ended up with a refusal. I am looking at moving elsewhere in the EU. Never in my life I thought it would be this ridiculous to get a marriage visa in any country. My family wants me to reapply, but it's too easy for them to find a reason to reject it and pocket the huge money.
Preach. Just gone through it. Made sure I got salaried employment upon arriving back in the UK after 9 years abroad to avoid the self-employment stress. A horrible process that I wouldn't wish on anyone. Thankfully, ours was straightforward and sorted in 19 business days. And it's true... most people don't understand how difficult it is.

IN 2011 the government officially stipulated their goal of reducing FAMILY BASED immigration by introducing extra burocratic requirements for spousal visas. As a result they managed to reduce family-based immigration from 70thousand to 35-40thousands a year. The financial requirement designed to stop people who would fall trapped into burocratic paperwork. The re are thousands of people who earn well above 18600 but cannot meet the burocratic requirements. That's their goal- TO REDUCE THE NUMBERS on family based immigration. nothing else. A very rich person with assets and bank accounts not in his personal name(e.g. in his company's name) would be labelled as poor and potential burden!!! Buy-to-let owners would not be able to meet the requirements!! THEY wish everybody to think that they are stopping poor people/burden on the state but that's not true! They are trying to stop as many spouses as they can whether they are rich or poor.
This is what really worries me. I can afford the process, but I can't afford to go through it 2 or 3 times only to be denied on the whims of some unanswerable bureaucrat with absolutely no right to appeal. Unfortunately, my future wife is from Vietnam, so I reckon it's going to be even worse than most. We're in Malaysia at the moment, and we might have to look at living in another country instead.

I absolutely agree that most British people are unaware of this, and would be horrified if they knew the truth. Thanks for posting this excellent summary of the effects of the 2012 and 2016 Acts. Means-testing the right to a family is a morally grotesque policy. My wife is Cambodian and we have been married for 10 years with a UK marriage license. I see no other outcome than eventually living in exile because that is the best the UK can offer its own citizens. Congratulations on getting your visa, and good luck with your residency application. I was wondering how mine will be ; I'm a tax payer, I earn more than my British born partner, but we don't reach the minimum household income,£(18,600/year) , we still make ends meet and don't have debts, he retires this year but what I see is every application is different, and each one has its own luck. 6 years we've lived together, I'm holding my fingers crossed ,

It's beyond ridiculous and their way of not being able to control EU migration so they control and more or less strictly rip off UK citizens instead! Going through same thing myself and being self employed I thought tax return was enough and that we should be ok to apply any tips please do share can't wait to see labour back in power.
5 years fought for no reason I was detained because my fault was my everything was genuine and legit like you said your one. in the last luckily I got right of appeal after lots of attempts. the honorable judge allowed my appeal on the spot. since I was detained I can't deal with my mental health I cant cope with depression I can't cope with my anxiety. yes, I spent more than 35k on legal and home offices fees, the same story my wife is British we meet here the home office wants us to go and both live in my back home country.i also understand the people abusing the rules and law that's why the requirements and process are very tough but to be honest the abuser and the fake people never been caught they always getting over of these things fast and easily. they never caught those who abuse the law.
Ive been married 23 years to a Japanese woman and i have 4 kids with British passports. I and my children can live in the UK but my wife cannot. It is insane. Two years ago my father passed away. He was a loyal civil servant since he was 16 years old. My grandfather was in the first world war and my Uncles were in North Africa under Mountbatten and in Burma, Java and Singapore. When my remaining 85 year old mother passes away and my stel mother i will inherit. If i am not allowed into my own country with my wife, then I hope I will be allowed to get all of my money out. I have a successful business in Japan and wasnt thinking of moving back, but to have your rights removed is a disgrace. I am appalled with my home country and the government which sanctioned this. To be married in 96 and affected by a law made in 2012 is dishonest and disgraceful.
That's ridiculous, I am facing the same situation, the minimum income requirement is ridiculous. Like the international student suddenly meet their right person, with out marriage visa they can't find a job, without a job they can't meet the income requirement. Both students how they can expected full time study will have full time salary. On the give notice day, we only be taken few official documents, which they needs, I don't know how home office going to make decision. Why not council give an interview for home office, save both party's time. I am so sorry to hear your experience, that's so tiring, hope I can go through easily.
I think you hit the nail on the head when you said rhat the immigration officials are under pressure to refuse visas for any arbitary reason. Friend of my son's was refused because he did not state whether his salary was gross or nett even rhough he was so far above the imcome limit it would have made no difference.

Those making a comment against the cost of visa's etc. They were elevated to deter people from applying and persude against life in the UK. The same for delays. Yes there have been some staff cuts, but it is more to hope people change their plans.
I’m in this situation now... first of all the visa ruling is forcing me to get married without being able to have the wedding I want.. but fine whatever, I’m doing it so I can be with my boyfriend. Second the guidelines are so unclear for people who are moving back from abroad- I earn over the amount stated, but it is from a PhD untaxed studentship which there are guidelines for, but the guidelines refer to someone with a studentship in the uk so it doesn’t apply to me so much as I am studying my PhD abroad. I also have a job offer for when I return to the uk earning way over the minimum requirement but I still worry that it will get rejected, and having to wait at least 3 months for any outcome seems ridiculous!

Setting an amount of income for the spouse to earn makes sense but the part I never understood is you have to find a job and earn money for at least six months before even thinking of applying - so either way you have to separate from your loved one. I’m on a spouse visa in Japan and all I did was some papers, prove I pay taxes and haven’t committed any crime and pay a small fee then I get a 3 year visa that easy. What’s wrong with the UK nowadays? splitting up genuine couples and essentially driving your own people (British nationals) out of the country seems outrageous. Being in control of immigration is great but at least give us a chance to come and settle down then surely if rules are broken only then you penalize couples.

My daughter is going through this in reverse. She is trying to get her fiancée from England to the United States. And you’re right, they don’t have a ton of money and the clock keeps on ticking. This is now the middle of July and the last time they saw each other was January 19, 2019. We are now, as the parents, having to do sponsor him and to be totally responsible for all his actions, health and welfare of all kinds for the time until he becomes a US citizen. You would think that England would just say okay good bye, no they like the US would rather take care of the aliens who have not worked or earned any rights to come into our country. I am a Malaysian married to a British army in October 2016. Not only we have to face lots of protocols and rules within the army system, such as, we are denied army housing until i get a UK Visa, bear in mind, we are not residing in the UK at the moment. My husband is posted in Brunei since 2015, and we met in that same year, and got married last year. Second, i am not classed as a dependant because i dont have a UK Visa. Bear in mind, i dont need a visa to stay in Brunei. I am currently in the process of waiting for my UK visa to be approved, and it is pure torture. 😭 and the crazy thing is, we just found out my husband is going to be posted to Germany in jan 2018. So we have a few more months to get things together before we have to move in early Dec 2017. Fingers crossed.
I have just married the love of my life. And I'm wondering if the visa is even worth it. I'm currently going through the visa appeal, and I'm terrified that I'll be refused again. Financially my wife and I would be better off in the UK than in the US. But there is just so much "what if" and the constant changing of the rules.
I have a challenging situation which might be impossible because I am just a student. Anyway, I am going to be a University student this coming September for four years and I have a Japanese girlfriend currently working in Japan. We were thinking to visit each other during the holidays to show proof that we genuinely love each other in the period of two years. I won't be working once I study but my income comes from an investment in the Philippines which can cover everything like my tuition fees, rent, food, transport and so forth. On top of that my annual net income would still be well over the threshold of the required income. As for accommodation, I was thinking to rent a place together because we are not entirely sure where we would live after I graduate. My girlfriend also stated that she will work for two years in Japan for her savings. We even considered to marry after two years and then attempt to get the spouse visa. What really worries me is that there is a high chance she will get her visa rejected most likely because I am student. We have been trying to find alternative ways to get her here. If there is anyone out there who could suggest any alternatives for her to be in the UK or at least any ideas how I could be with her then I would really appreciate it. I thought of many things like transferring to Universities in Japan or her coming to UK with a working visa. I know for a fact that if I drop out of Uni she will kick my ass. We honestly don't want to lose each other all because of this strict immigration policy in the UK. I was shocked to find out how the home office works and the fact that many british people didn't realise that the home office is racist.
We have gone through very much the same situation. we are already looking at what it will take to renew next year so we are prepared. I came from the US and although I met my husband over 20 years ago, I had to spend almost 2 years proving it. The financial side is just crazy. Thank God we had the finds to get help putting everything together. After watching this video I am now scared about what happens when my 5 years is up.
Please prepare yourselves for the new fees now dumped into the process. The health surcharge for a 2.5 year further leave to remain visa is now double what it was. Ours was £1000 on top of the standard visa fees. We were not permitted to file our application until 30 days before my residency card expires, but the decision process takes 8 weeks, with the option to pay an additional £640 to get a decision in one day, which we couldn't afford after the health surcharge surprise.
As an israeli married to a british citizen who'm I live with in Israel and searching to leave the country asap I am so upset about this visa requirements! Here's a trick for Brits, you can move together to another EU country and exercise your treaty rights and bring your spouse. After living in another EEA country for a year, you can then be classified as an EEA citizen and invoke EU law even in the UK, which is far more lenient than UK law.
This is known as the Surinder Singh route and although technically allowed, UKVI can reject your attempts at bringing a non-EU spouse into the UK if they suspect you're doing this route to circumvent UK immigration law. Twats.
I dont know if things have changed since Brexit, but I certainly hope so. My husband is a British citizen, myself and my children are Canadian. I've visited England twice and fell in love with it right away. All of this red tape nonsense is extremely discouraging and worrying as we have been talking about moving there for years. Currently I work for the Federal Government and am nervous to give up such a career only to be denied a life in England.

I have been shown nothing but love and kindness in France. But with brexit, my European citizenship and rights have been stolen for nothing by ignorant racist anti European bigots. My background is European languages and I'm a qualified translator who - in the past- has worked in France Spain and Germany. No longer because of brexit. So you continue to like these people if you so wish. I no longer feel British and never will again. It's no longer my country or my people.

But its okay for a EU person living in the Uk to get married to a non Eu person and will get their Visa right away becouse they have the same rights. One of the reason is the multicultural environment, which make special UK . Foreign are embracing English culture and are proud to be be part of UK. See for example Dua Lipa, George Michael, academic workforce etc . Saying that , I am in strangle to bring my wife in UK due to visa rejection. Do you know why? I need to prove that I was living with my wife for two years. Question is do we must need to live with the partner for two year before marriage? and ..how this will work if you are in different country? To prove that we need to show sharing bank account, bill etc. So before marriage we needed to open a sharing bank account? And if we decided to not to marry? each time you are with a partner (abroad for example) you need to live Uk live with her , open a sharing bank account to prepare? Love and wish to build the family ..forget about. So, Italian must marry with Italia , English with English French with French ..do not fall in Love with any one outside your country. I agree that if you are a uk born national have your own house in the uk, your wife or husband should be able to stay and work. With no 3 English tests and thousands of pounds to work and pay taxes this country is backwards in thinking.
The whole process seems contrary to British justice. No communication ? No detailed reason behind a refusal ? No appeal ? Although we would wish to apply for a Spouse visa eventually, my wife has twice applied for a Tourist Visa with detailed supporting documentation.. Because we are each caring for elderly parents in our own countries, we thought it would make sense to apply for a short stay visa. My wife has other relatives who are prepared to care for her parents for a short time. I do not. We have twice been refused on the grounds that she may not return to her home country. How is it possible for us to prove a future event ?
share the video and then what?, what bothers me about the UK visas procedures is that they claim to respect article 8 Human Rights Convention but they violate our human rights non stop and no one does anything about it. If you miss a document for Canada, they contact you and ask you to submit it, with the UK visas they take all the time of the world processing a visa and then they have every single stupid excuse to deny based on false accusations or presumptions. Once they deny, you are expected to do it all again and pay the full fee again, why? They don´t let you know how the process is going and you can´t even call them or email them if you need some additional info. Also they make the rules so complicated that is like they want you to fail. It´s disgusting, racist and discriminatory. I wonder if we can all come together and sue the UK government for violating our Human Rights. I´ve been there before, it´s exhausting and a waste of time and money. I will have to apply for a spouse visa again soon and I seriously don´t know what that fuck to expect.

I am still waiting for a decision although I am in the UK with my husband it is frustrating. My student Visa was valid till 11th September and I have not got a job confirmation possibly because of this. It is so annoying and nothing much we can do. Oh when I left to UK to go to the Philippines I was not even married to my wife at this time but it only cost me about 100 pound for the visa I not need a medical I not need to prove I have enough money to stay in the Philippines. Thank you for creating this video! The world & the people in the United Kingdom need to know about this! As you said in the video, most people are unaware of this. I am in a similar situation. When I announced that I will be leaving the U.K to move to Brazil to be the person I love, most of my friends responded by saying:
"Why doesn't she just move to the U.K, there's so many foreigners here already!?"
I said it isn't as simple as that, followed by a long explanation as to why it is not easy for the lady I love to live with me in the U.K. I then have to explain the process & rules etc of TRYING to obtain a spousal visa. That's if I earnt enough money according to the MIR (Minimum Income Requirements) or the Financial Threshold to obtain a spousal visa. I lived in Cornwall, so I didn't earn this, but even if I moved to another part of the country & got a good/well paid job in a city, as you explained, I could spend 6-12 months doing this - and I could still fail! In other words, the Home Office, or our government can still refuse your spousal visa, even if you do everything correctly & earn enough money.
So I stuck my middle finger up to the U.K when I left the country last year & moved to Brazil to be with & live with the person I love & we got married.
I/we would like to live together in the U.K, but it is not an easy process as you explained clearly & in detail here in your video. So for the time being we are happy living here together in Brazil & enjoying a normal life, like every couple should have the right & privilege to if you are in life. But if you are a British or U.K citizen & you are in love with a foreign spouse or partner, who lives in a country outside the E.U, that comes at a price!

I'm Greek and I used to live in London from 2009 up until 2016 .During Brexit I was in the process of getting married with my partner and we postponed it .We ended up not getting married because all this was too complicated and he wasn't willing to move in Greece with me . I left UK and moved back in 2016. We broke up and i guess it was for a good reason. Now I'm very happy and in love again with another English man I met in Greece ( what on earth ? It must be the accent that attracts me 😂 ) Hopefully this time will work out and the distance and complications of life will not be an obstacle that will separate me from the one I love .

We tried the whole Ireland thing which took 18 months for them to say no. We appealed with the EU consulate who took 13 months to reply just to say that it was so long before that we would have to apply again and if we was turned down then to contact them again. another 12 months Ireland turned us down. now waiting on EU commission again for 5 months now. I think my only hope is if Labour win! And change this dreadful law aimed at british people only. If i was french, polish, german or from any other EU state, id be welcome to bring my wife and daughter, but as im british I can not. I have lost 32kg since leaving dubai. I am suffering serious depression, working zero hour contracts just to keep a roof over my head here, and a roof over my daughter and wife's head in the Philippines. I think they look at the relationship duration as a whole as well. Me and my wife did long distance for 7 years and decided to do visa process we still sent a book of information but it went through. I think if you been with your mate for a short time they look at that as red flag and will ask more information. I also went through the process after 4 years obtained a fiancé visitor visa then married then left to the states waited years later to do spouse visa approved. I think the track record is what counts the relationship duration is almost like a solid indicator that it’s not about money it’s about love and patience and perseverance and not giving up.

My husband earns way more than 18600 pounds a year and we have a baby girl who is a British citizen but we are still waiting for my visa to be processed. We paid extra for the priority service and it's been nearly 7 weeks we havnt had any reply from them yet. It's just inhuman and insane to realize how cleverly they are robbing people's money.
We paid over 500 pounds so that our application is processed urgently. They are more than happy to take people's money but refuse to do the job on time.

We went through something similar to your case in March. When our visa was rejected (for a very weird reason; no it's not money, my husband earns way more than the minimum amount) we didn't even know :/. Had the office (in my home country) not called me about picking it up we would've been waiting and waiting and calling with no answer so if it was approved it would have been too late because the 30 days would have passed :/ . We are trying again so we are anxiously awaiting their response.

Now they have privatized the visa application service, contracted out to French company Sopra Steria, with biometrics done by Indian company BLS. These companies openly admit they are interested in this 'business' as it has a high profit-margin. Well, obviously does, since they have the monopoly on a service which people who are married to foreign spouses have to use. They are opening over 50 new applications centres in public libraries. However, the Home Office still does the processing so the answer times are no quicker, and in fact, slower. The fees have increased, but the service has got worse. It's a national disgrace. So much stress and unhappiness, and faceless bureaucracy.

I am from Mexico City, my wife, Katrina, is from Brighton and we were considering applying for this Spouse Visitor's Visa for myself as the immigration officer got quite nervous this last time I came to Brighton. It would seem obvious that we will be coming to the UK to visit Katrina's family at least once a year... well it isn't for the Border Control Officers. In their minds everything is a plot to live in the UK and abuse their system. IT IS INSANE!! The officers usually don't even know very well what is going with their own regulations. I am a lawyer and I have kept updated with the changes in the immigration policies of the UK since I met Katrina on the 11th of July, 2011, and the things they say are just ridiculous. To begin with they think that entering the UK is a prize for me. As soon as they see "MEXICO" in my passport they immediately think that I am desperately trying to set up residence in the UK. I am sick and tired of all the questioning and mistreatment I get in the UK almost every single time, with few and treasured exceptions. Several times I have considered filing a legal action on the grounds of discrimination, but I rectify when I realise as well that whatever I do, I mean just business. It is incredible. All I do when I come to the UK is spend the money I earn from my own businesses in Mexico, yet I am questioned as to how I can give them more of my money by paying for visas, taxes, healthcare and all the stuff they need to fix. I bring money from Mexico to the UK, yet in their scared minds it is me who is demanding benefits from their country!! Immigration policies in the UK are a great disaster. The stupid Surinder Singh route also requires my wife to be working in Europe in order to come to the UK... Why the hell would you come to the UK if you have a nice job elswhere in Europe? Again this is all because the immigration officers think it is such an award for all us Non-Eu citizens to enter the UK. I would be up for participating in any pressure groups and producing any arguments as needed in order to change this, if it would help any other couples. It is outrageously painful to live all the family problems that you already go through when you leave your family, there is no need to be reminded by your own country (in the case of Katrina) that you are on your own if you decide to marry someone from a different culture... like if it was some kind of medieval punishment for betraying their Kingdom... We have a british born son but live in Mexico and as you know the wages are low, we don´t own our own business and cant even afford the application process. The earning threshold is even higher when you have a child I think its at 23k per year making it even harder.

Very useful video, I have been married to my British husband more than six years. I battled for four years to get the visa. At last I could get a visa based on human rights. I spent more than £6000. In November my visa is running out so I am planning to apply for spouse visa. I thought I will be get it at once. But after seen this video, I am worried if I don't get it once I will have to leave my huaband because I have not lot of money to spend on visa over and over. This is ridiculous. I never seen country which has put rules on people's marriages. Unfair.
You forgot to mention that even if you do find work that pays over the required amount, you have to earn this for 6 months straight before even applying for the visa. My wife is Japanese and fortunately we are happy living here in Japan, however it does feel sometimes upsetting that I am basically being punished due to the fact that my wife is Japanese. We could do it, but we would have to separate, I would need to find work, wait 6 months, the process from there probably takes longer, lots of money, it is ridiculous. I am with you when you say you understand the need for restrictions on immigration, of course, but for hard working genuine tax payers like me with something to offer, why should I be punished? We decided to get the Japanese spouse visa instead though and we live here now. Middle finger to the UK.

IN 2011 the government officially stipulated their goal of reducing FAMILY BASED immigration by introducing extra burocratic requirements for spousal visas. As a result they managed to reduce family-based immigration from 70thousand to 35-40thousands a year. The financial requirement designed to stop people who would fall trapped into burocratic paperwork. The re are thousands of people who earn well above 18600 but cannot meet the burocratic requirements. That's their goal- TO REDUCE THE NUMBERS on family based immigration. nothing else. A very rich person with assets and bank accounts not in his personal name(e.g. in his company's name) would be labelled as poor and potential burden!!! Buy-to-let owners would not be able to meet the requirements!! THEY wish everybody to think that they are stopping poor people/burden on the state but that's not true! They are trying to stop as many spouses as they can whether they are rich or poor.
Will be trying our third attempt soon. It’s so relieving so see this finally someone talks about how insane the process is.
This is what really worries me. I can afford the process, but I can't afford to go through it 2 or 3 times only to be denied on the whims of some unanswerable bureaucrat with absolutely no right to appeal. Unfortunately, my future wife is from Vietnam, so I reckon it's going to be even worse than most. We're in Malaysia at the moment, and we might have to look at living in another country instead.

Means-testing the right to a family is a morally grotesque policy. My wife is Cambodian and we have been married for 10 years with a UK marriage license. My fiance and I are going thru this right now...its ridiculous that we can't be together because he doesn't make enough. Its hard on us....they want me to have a certain amount of savings to come over, yet I have to start over just to go and see him or him to see me.

I fully agree with you, and your information is making me worrrying because it might happen to me. We have not applied for UK Visa. All I just want to be is with my wife. 5 years fought for no reason I was detained because my fault was my everything was genuine and legit like you said your one. in the last luckily I got right of appeal after lots of attempts. the honorable judge allowed my appeal on the spot. since I was detained I can't deal with my mental health I cant cope with depression I can't cope with my anxiety. yes, I spent more than 35k on legal and home offices fees, the same story my wife is British we meet here the home office wants us to go and both live in my back home country.i also understand the people abusing the rules and law that's why the requirements and process are very tough but to be honest the abuser and the fake people never been caught they always getting over of these things fast and easily. they never caught those who abuse the law.

Ive been married 23 years to a Japanese woman and i have 4 kids with British passports. I and my children can live in the UK but my wife cannot. It is insane. Two years ago my father passed away. He was a loyal civil servant since he was 16 years old. My grandfather was in the first world war and my Uncles were in North Africa under Mountbatten and in Burma, Java and Singapore. When my remaining 85 year old mother passes away and my stel mother i will inherit. If i am not allowed into my own country with my wife, then I hope I will be allowed to get all of my money out.
I have a successful business in Japan and wasnt thinking of moving back, but to have your rights removed is a disgrace. I am appalled with my home country and the government which sanctioned this. To be married in 96 and affected by a law made in 2012 is dishonest and disgraceful.
That's ridiculous, I am facing the same situation, the minimum income requirement is ridiculous. Like the international student suddenly meet their right person, with out marriage visa they can't find a job, without a job they can't meet the income requirement. Both students how they can expected full time study will have full time salary. On the give notice day, we only be taken few official documents, which they needs, I don't know how home office going to make decision. Why not council give an interview for home office, save both party's time. I am so sorry to hear your experience, that's so tiring, hope I can go through easily.

I think you hit the nail on the head when you said rhat the immigration officials are under pressure to refuse visas for any arbitary reason. Friend of my son's was refused because he did not state whether his salary was gross or nett even rhough he was so far above the imcome limit it would have made no difference.

Those making a comment against the cost of visa's etc. They were elevated to deter people from applying and persude against life in the UK. The same for delays. Yes there have been some staff cuts, but it is more to hope people change their plans.
I’m in this situation now... first of all the visa ruling is forcing me to get married without being able to have the wedding I want.. but fine whatever, I’m doing it so I can be with my boyfriend. Second the guidelines are so unclear for people who are moving back from abroad- I earn over the amount stated, but it is from a PhD untaxed studentship which there are guidelines for, but the guidelines refer to someone with a studentship in the uk so it doesn’t apply to me so much as I am studying my PhD abroad. I also have a job offer for when I return to the uk earning way over the minimum requirement but I still worry that it will get rejected, and having to wait at least 3 months for any outcome seems ridiculous!

Setting an amount of income for the spouse to earn makes sense but the part I never understood is you have to find a job and earn money for at least six months before even thinking of applying - so either way you have to separate from your loved one. I’m on a spouse visa in Japan and all I did was some papers, prove I pay taxes and haven’t committed any crime and pay a small fee then I get a 3 year visa that easy. What’s wrong with the UK nowadays?

My daughter is going through this in reverse. She is trying to get her fiancée from England to the United States. And you’re right, they don’t have a ton of money and the clock keeps on ticking. This is now the middle of July and the last time they saw each other was January 19, 2019. We are now, as the parents, having to do sponsor him and to be totally responsible for all his actions, health and welfare of all kinds for the time until he becomes a US citizen. You would think that England would just say okay good bye, no they like the US would rather take care of the aliens who have not worked or earned any rights to come into our country. I am a Malaysian married to a British army in October 2016. Not only we have to face lots of protocols and rules within the army system, such as, we are denied army housing until i get a UK Visa, bear in mind, we are not residing in the UK at the moment. My husband is posted in Brunei since 2015, and we met in that same year, and got married last year. Second, i am not classed as a dependant because i dont have a UK Visa. Bear in mind, i dont need a visa to stay in Brunei. I am currently in the process of waiting for my UK visa to be approved, and it is pure torture. 😭 and the crazy thing is, we just found out my husband is going to be posted to Germany in jan 2018. So we have a few more months to get things together before we have to move in early Dec 2017. Fingers crossed.
I have just married the love of my life. And I'm wondering if the visa is even worth it. I'm currently going through the visa appeal, and I'm terrified that I'll be refused again. Financially my wife and I would be better off in the UK than in the US. But there is just so much "what if" and the constant changing of the rules.
I have a challenging situation which might be impossible because I am just a student. Anyway, I am going to be a University student this coming September for four years and I have a Japanese girlfriend currently working in Japan. We were thinking to visit each other during the holidays to show proof that we genuinely love each other in the period of two years. I won't be working once I study but my income comes from an investment in the Philippines which can cover everything like my tuition fees, rent, food, transport and so forth. On top of that my annual net income would still be well over the threshold of the required income. As for accommodation, I was thinking to rent a place together because we are not entirely sure where we would live after I graduate. My girlfriend also stated that she will work for two years in Japan for her savings. We even considered to marry after two years and then attempt to get the spouse visa. What really worries me is that there is a high chance she will get her visa rejected most likely because I am student. We have been trying to find alternative ways to get her here.
If there is anyone out there who could suggest any alternatives for her to be in the UK or at least any ideas how I could be with her then I would really appreciate it. I thought of many things like transferring to Universities in Japan or her coming to UK with a working visa. I know for a fact that if I drop out of Uni she will kick my ass. We honestly don't want to lose each other all because of this strict immigration policy in the UK. I was shocked to find out how the home office works and the fact that many british people didn't realise that the home office is racist.
We have gone through very much the same situation. we are already looking at what it will take to renew next year so we are prepared. I came from the US and although I met my husband over 20 years ago, I had to spend almost 2 years proving it. The financial side is just crazy. Thank God we had the finds to get help putting everything together. After watching this video I am now scared about what happens when my 5 years is up.
Please prepare yourselves for the new fees now dumped into the process. The health surcharge for a 2.5 year further leave to remain visa is now double what it was. Ours was £1000 on top of the standard visa fees. We were not permitted to file our application until 30 days before my residency card expires, but the decision process takes 8 weeks, with the option to pay an additional £640 to get a decision in one day, which we couldn't afford after the health surcharge surprise.
As an israeli married to a british citizen who'm I live with in Israel and searching to leave the country asap I am so upset about this visa requirements! It is comforting and sad to hear more people battle over this visa!

Here's a trick for Brits, you can move together to another EU country and exercise your treaty rights and bring your spouse. After living in another EEA country for a year, you can then be classified as an EEA citizen and invoke EU law even in the UK, which is far more lenient than UK law.

This is known as the Surinder Singh route and although technically allowed, UKVI can reject your attempts at bringing a non-EU spouse into the UK if they suspect you're doing this route to circumvent UK immigration law.

I dont know if things have changed since Brexit, but I certainly hope so. My husband is a British citizen, myself and my children are Canadian. I've visited England twice and fell in love with it right away. All of this red tape nonsense is extremely discouraging and worrying as we have been talking about moving there for years. Currently I work for the Federal Government and am nervous to give up such a career only to be denied a life in England.

It's so unfair for a British person to get married to a non eu person. But its okay for a EU person living in the Uk to get married to a non Eu person and will get their Visa right away becouse they have the same rights. Which i think is so unfair when we are born and raised here then our partners dont even have the same rights as us. I am not British citizen, but one of the reason that I live in UK in the last 20 years, moved from Italy, is due to the fact U.K. is the greatest country in the world, well apart the weather 🤣. One of the reason is the multicultural environment, which make special UK . Foreign are embracing English culture and are proud to be be part of UK. See for example Dua Lipa, George Michael, academic workforce etc . Saying that , I am in strangle to bring my wife in UK due to visa rejection. Do you know why? I need to prove that I was living with my wife for two years. Question is do we must need to live with the partner for two year before marriage? and ..how this will work if you are in different country? To prove that we need to show sharing bank account, bill etc. So before marriage we needed to open a sharing bank account? And if we decided to not to marry? each time you are with a partner (abroad for example) you need to live Uk live with her , open a sharing bank account to prepare? Love and wish to build the family ..forget about. So, Italian must marry with Italia , English with English French with French ..do not fall in Love with any one outside your country.

Right to Marry is a Natural right, government can not infringe on this right, all you need to do is take them to the high court and ask the judge to give you your remedy and he/she will grant it.

I agree that if you are a uk born national have your own house in the uk, your wife or husband should be able to stay and work. With no 3 English tests and thousands of pounds to work and pay taxes this country is backwards in thinking.
The whole process seems contrary to British justice. No communication ? No detailed reason behind a refusal ? No appeal ? Although we would wish to apply for a Spouse visa eventually, my wife has twice applied for a Tourist Visa with detailed supporting documentation.. Because we are each caring for elderly parents in our own countries, we thought it would make sense to apply for a short stay visa. My wife has other relatives who are prepared to care for her parents for a short time. I do not. We have twice been refused on the grounds that she may not return to her home country. How is it possible for us to prove a future event ?

share the video and then what?, what bothers me about the UK visas procedures is that they claim to respect article 8 Human Rights Convention but they violate our human rights non stop and no one does anything about it. If you miss a document for Canada, they contact you and ask you to submit it, with the UK visas they take all the time of the world processing a visa and then they have every single stupid excuse to deny based on false accusations or presumptions. Once they deny, you are expected to do it all again and pay the full fee again, why? They don´t let you know how the process is going and you can´t even call them or email them if you need some additional info. Also they make the rules so complicated that is like they want you to fail. It´s disgusting, racist and discriminatory. I wonder if we can all come together and sue the UK government for violating our Human Rights. I´ve been there before, it´s exhausting and a waste of time and money. I will have to apply for a spouse visa again soon and I seriously don´t know what that fuck to expect.

I am still waiting for a decision although I am in the UK with my husband it is frustrating. My student Visa was valid till 11th September and I have not got a job confirmation possibly because of this. It is so annoying and nothing much we can do. The immigration agency through which we applied is chasing it up every week.....

My mum's parents and her siblings and my dad's parents and his siblings living in uk for 4 5 decades. They only visit Pakistan for us (my parents and us three kids). The joke is it's harder for people to legally immigrate to be with their spouse, which is the kind of immigration you want, compared to doing so illegally.
Mine took 4 years the pressure and stress of living in limbo unable to travel study or apply for a new job destroyed my marriage.
This makes me nervous as a non born Brit citizen who is wanting to bring my husband and kids to the UK next year. I’m guessing an immigration lawyer is the best chance? The fact the visa only last for 2.5y too and then you need to reapply.

Oh when I left to UK to go to the Philippines I was not even married to my wife at this time but it only cost me about 100 pound for the visa I not need a medical I not need to prove I have enough money to stay in the Philippines. But also being here ten years have only cost me about 250 pound for the visas in total. Unreal
