The DA is paid to be there. The cop is paid to be there. The bailiff, lawyers, judge, stenographer are all paid to be there. The only person that is out of pocket are the ones who had their rights broken. They have to take a day off from work, pay a lawyer in many cases, and all the additional times the DA bounces the court day out to punish the innocent more. The system is rigged against the people.
We got parking police here in my city. But they are just write parking tickets and are not legit law enforcement. This cop be racist because he saw a black person at 4am at night and used this as an excuse to arrest them. This is why I'm happy Canada legalised weed here so it stopped cops from ruining people's lives over nothing. Even before it was legal, the RCMP in general country wide made it a non-issue reason to jame someone up internally unless you was DUI or some other major issue.

Parking while black) to check him (because probably the cop guessed the drugs would be in the car and not on the woman.) I *hate* that weed is legalized in so many places (and used everywhere) but I love this country and our laws enough that this isn’t the way to handle things by law enforcement. Considering the case loads these prosecutors have, if the officer is not in attendance all they can really go on is the report. The incident occurred at 4:30am, so officer works overnight shift, court is during the day. You prefer the officer using his 40 hour week out on patrol or waiting in court? The 18" off the curb is a cheesy excuse which is why I love the Judges comment of "parking while black".
Stuff like this ends when the judges start hauling the officers into court and charging them with contempt for wasting the court's time for bringing these ridiculous cases.

TRANSP 545.303 / parked more than 18 inches from curb is about a $59 parking ticket. Not a traffic stop, or justifiable cause to search a vehicle without a warrant. But here we are in a probable cause hearing for marijuana possession. Can you imagine your car being searched over a parking citation? Which is why the Judge is in disbelief.
If the cop smelt weed that’s the probable cause to search the vehicle without a warrant, apparently not measuring the 18 inches was the only issue, cannabis should be legalised so I’ve no issue with the outcome tho.

I love it whenever the judge admonishes a defendant by saying, “Stop! Are you losing?” and proceeds to give the defendant a sound advice what to do and how live their life so they don’t get into trouble going forward.

The problem is most prosecutors become prosecutors because it's a pipeline to being a judge. Then once they are judges they have the same attitude that both of of those prosecutors had. They just rubber stamp whatever the prosecutors and police say. Those two prosecutors are likely future judges.
What part of the Constitution do you see was the issue here? The contact with the driver was not a forced, it was consensual. So the 4th Amendment doesn't come into play. During that consensual contact the smell of pot made them believe that there was probable cause to believe that the man was in control of a motor vehicle and under the influence of a mind altering substance. I do not agree with the judge in this instance.

He was not detaining the driver by activating his emergency lights or issuing commands. He walked up to the guy's window and began a conversation. I’ve watched a video of this judge tearing into the prosecutor because their documents were badly prepared, he seems fair, but can be hard when he needs to be, especially when he’s given someone a break and they end up back in front of him.

Different view - The Judge should have asked more questions and got more info. Its possible the car was much more than 18 inches from the curb, enough to be obstructing traffic and police were just going to issue a parking ticket. But the female smelling of cannabis approached the police and started the investigation. If the police let them go and they got into a car accident that killed someone, then everyone would be angry that police did not stop them when they had the chance. The prosecuting attorney should have been more prepared.
He's reacting to the report. If you are going to initiate a court case, you better be exact in your court documents. EVERY little mistake is going to work for the defendant. You have prosecutors here, misrepresenting the report as well. The probable cause hearing is the initial court hearing, making sure there is a case in the first place.
As he has said in other videos, "then they should have written a better report." The DA even says at the very end she is going to ask the officer for more information to understand why he stopped -- so you know it was not in the report.

If they smell marijuana on someone just walking around, there is no real reason to detain them. If that person is driving and smells like marijuana, I would understand detaining them though.

Probable cause was established to protect law abiding citizens from police reoccurring traumatizing harassment. Cops lie constantly. They are allowed and trained to lie. Citizens can’t trust anything they say. I have never had a negative encounter with an officer. I have never been arrested. Nonetheless, the cops are poorly trained, most are uneducated, and are now being used as revenue generators. For them to say they are there to protect and service is a joke.

He was not detaining the driver by activating his emergency lights or issuing commands. He walked up to the guy's window and began a conversation.
It was during that conversation that he smelled pot and viola... we go to court.

Not gonna lie, i have a very strong distrust for law enforcement and the justice system as a whole based on personal experiences but I gotta say, this judge is a breath of fresh air and makes me feel like maybe there are still good judges out there that serve the people instead of being pretty much an extension of law enforcement.

The pig didn't care about the car being far from the curb, he saw a black man parked in the middle of the night and had to intervene somehow. Probably out there again tonight doing it to someone else as I'm sure he received zero discipline.

How does the judge know that the officer can’t make a determination that it’s more than 18 inches what if the car was parked in the middle of the road over the center line it’s obviously more than 18 inches and if I saw a car touching the curb with its tires I would know it’s less than 18 inchesso why can’t they get a ticket? I’ve watched a video of this judge tearing into the prosecutor because their documents were badly prepared, he seems fair, but can be hard when he needs to be, especially when he’s given someone a break and they end up back in front of him.

He's not holding THIN BLUE LINE TERRORISTS accountable. Holding them accountable is charging them with 18 USC 241&242 with a minimum of 2 years in prison. This judge makes sure that fake charges and false arrests don't destroy people's lives.

The female prosecutor did not look happy when the judge said no PC. She stared away from the judge with an eye roll type look before saying," we'll be sure to call the officer on this." Like a spoiled child that didn't like to be told no. Such professionalism.
They can go with a grand jury if they want and get probable cause that way. However the case may not be worth that much trouble.
@@tt-ew7rx they could try, yes. But, does the officer have body cam or car cam. Or anything that can prove the vehicle was more than 18 inches away. If not then even a grand jury may have a hard time establishing probable cause without proof.
@@tt-ew7rx My mistake. I should have looked before commenting. Looks like the Harris County Sheriff's Office does have body cams. I'm not sure which agency preformed the stop/search. If it was them, then yup. Grand Jury may have all the evidence they need to find probable cause.

This is why as the judge has told officers before make your report accurate if its not then the error is in favor of the civilian not the DA/cop.

When the cops are randomly picking stupid laws as a possible way to entrap someone says it all. The passenger may have approached the cop, but he's the one that pulled up behind them, ran their plates and appeared to be getting read to make a Terry stop. So no, he was reaching big time and the judge saw right through that.
So you recognize that this was not a Terry stop. Which means the contact was consensual. Evidence obtained during a consensual contact is fair game.

In court for 2 ounces of weed. Him parking 2 feet from the curb is what got an officer's attention. It's nice that the judge let the kid off, but there absolutely was probable cause, because in most jurisdictions by-law is upheld by police on off-hours. And 4AM is an off-hour.

He's smoking weed in a not-so-parked car. Then was going to drive. Alcohol is legal, but you're not pounding back whiskey while driving. The judge had probable cause and decided not to use it. Don't drink OR smoke and drive folks.

Different view - The Judge should have asked more questions and got more info. Its possible the car was much more than 18 inches from the curb, enough to be obstructing traffic and police were just going to issue a parking ticket. But the female smelling of cannabis approached the police and started the investigation. If the police let them go and they got into a car accident that killed someone, then everyone would be angry that police did not stop them when they had the chance. The prosecuting attorney should have been more prepared.
He's reacting to the report. If you are going to initiate a court case, you better be exact in your court documents. EVERY little mistake is going to work for the defendant. You have prosecutors here, misrepresenting the report as well. The probable cause hearing is the initial court hearing, making sure there is a case in the first place.
As he has said in other videos, "then they should have written a better report." The DA even says at the very end she is going to ask the officer for more information to understand why he stopped -- so you know it was not in the report.

2) It would appear that parking a couple of feet away from the curb is a crime in this jurisdiction. A couple of feet is a long way. Everyplace that I've gotten wind of the ordinance the required distance from the curb was 12 inches.

If they smell marijuana on someone just walking around, there is no real reason to detain them. If that person is driving and smells like marijuana, I would understand detaining them though.

She's the one who got them caught, and they were blazing up in a car with a blunt, about to drive. Judge just has bigger problems to chase, but NOTHING unethical happened in that arrest.

Have you been outside at 4AM? Also, did you know the police enforce parking rules at night? Did you know the people were smoking in the car and self-reported by approaching the cop? Did you know they had a burnt blunt and 2 ounces of weed in the car? You wouldn't drink and drive, so why is it ok that this kid was blazing up and was clearly going to drive since there were 2 people in the car and it was "parked" 2 feet away from the curb?

@@Nathan-dt2tu To combat profiling. During the era of "Stop and frisk" where police didn't need "probably cause" over 90% of detainments found nothing illegal. Probable cause was established to protect law abiding citizens from police reoccurring traumatizing harassment. Stop and frisk is also against the Constitution's protection against unreasonable search and seizure.

Whether or not they were going to drive under the influence is unrelated. Police cannot just stop people and search them without good reason. Hope that helps!
