      No. Most of the time, these charges pay off. Defendant usually pleas out, pays fines and/or supervised probation (never meeting a parole officer) for a year, and it more than pays for the proceeding.
      Judge Fleischer is a former criminal defense attorney, so his perspective is different (fair). But this "loss" by the Harris County DA is like not winning on a stolen scratch off lottery ticket.

      This judge is one of the very few that knows what is going on out on the streets.
      He is probably appointed, so the person that appointed him is also fed up with the “system” as well.
      Clogging that same “system” with cases that are nothing but cash grabs undermines the very fabric of justice.
      Cops should be very thankful that true Equity is not being practiced.

      He actually did try to say something, the judge shhh'd him. You should see the one when the judge was going through a similar scenario with another man, and after talking with the prosecutor and seeing no PC, the man started to say something, Judge said "shhh, are you losing?"

    If he was driving at an unsafe speed, why didn't the officer write a ticket for speeding? Instead he arrested him for "eluding".
    Seems like the cop was fishing and thought he caught one. Sometimes they jump out of the boat.

    so the cop starts following him because of the speed and doesn't make an attempt to stop him. The guy pulls over and the cop drives past, then the cop sees that they guy made a u-turn, presumeably in his rear-view mirror, and that's why the guy got cited? That whole thing sounds like bullshit

    He went ".5 miles before pulling over" is not far. That can be less than 30 seconds on a highway and a minute on street. It may be a few seconds before a person realizes they're being pulled over. I'm sure this wasn't the reason why the fleeing law was created. We need to stop wasting resources and criminalizing people with laws meant for something more serious.

      And traffic law states to pull over in an area that is deemed safe. So the driver may have continued until he found a safe area, like one that is well lit.

      It appears from the cop’s own report the gentleman drove through a dark, unlit carpark before stopping. Thus, one can only assume he stopped in a better lit area. As you are instructed to do.
      Maybe he was looking for an address, maybe even looking for a dealer, but nothing in the officer’s report indicates anything criminal happened, except the possibility of excessive speed. No statement about failure to indicate turns, that the u-turn was against local laws etc. not to mention, no record of what specific speed the driver was going, and how much it may or may not have exceeded the posted speed limit.

    We've got a judge who openly questions whether the traffic stop was racially motivated, and a prosecutor who openly agrees that he came to court seeking to indict a man in a case with no probable cause for the arrest. Sounds like a civil rights lawsuit is in order.

    Pathetic harassment by the officer. Until the officer turns on his lights the driver can do anything he wants including trying to lose the officer by making turns, turning off his lights, turning around or any other behaviors that might be suspicious. The officer has no right to even turn on the lights until he violates a law. Once the lights come on, half a mile isn't a long distance to travel, even if the officer believes he could've stopped earlier.
    Stopping him without a violation of some kind should result in consequences for the officer. Arresting him without a violation or any broken laws should result in the driver being awarded damages and the officer put under review for his job. Horrible policing.

      ​@@realkingtv7885 I agree this is an absolute abuse of power and the officer should be punished for wasting this man's time. But to say the judge knows the officer's race is absurd. There are hundreds of officers in Houston and the judge definitely doesn't know each ones race. Statistically, he was probably white, but maybe not.
      I'm a white, overnight uber driver. This has me parked in suspicious areas late at night. I regularly have officers of every race approach me. A white officer cost me 45 minutes because I was in a high crime area and he wanted to search my empty car even after I showed I just dropped off a passenger. He could easily see nothing was in plain sight to give him probable cause for a search. It was overzealous policing trying to find a crime without evidence one had been committed.
      Not everything is about racism.

      @@wilson2455 The 10th Judicial Circuit of Polk County has a few misdemeanor Judges. Sadly, one would not make a difference in Judd's "press conferences." I live in Lakeland, Florida. In the heart of Polk County. Crazy how he can get on TV and presume guilt without a conviction while at the same time, denying body cams for his deputies.

      the prosecutor didn't admit anything -- the judge asked for the police officer to clarify things and tell how fast the guy was speeding -- the cop probably told the prosecutor "I can't recall" or some other nonsense -- so the prosecutor knew the judge wouldn't accept the answer -- so the prosecutor had no choice but to dismiss the case -- he knew if the cop came to court the judge would have chewed him out

      They deserve nothing. Their job is not to automatically prosecute anyone by a report from a police officer. They should've read the report, understand that it's sketchy at best, just like the immediately judge did, check with the cop and reach the conclusion that there's nothing there and drop it before bothering the courts with this BS.

    When the process is the punishment, the police have no concern about whether the charges get dismissed. The slogan "you may beat the charge, but you can't beat the ride" is not referencing the trip to the jail.
    Until there is personal, substantial consequence there will be no change. We all know this. The cost of actual deterrence has to be high. Take speeding... we know it's wrong. We do it anyways because the costs don't outweigh the benefit. We know enforcement is low and, when caught, the personal impact is minimal. M*rder? Different story.
    Violating rights is just the cop version of speeding. They know enforcement is few and far between and, when caught, the personal impact is non-existant.
    When the attitude is "go ahead and sue me" there is an obvious lack of deterrence and fear of consequences of court decisions. When you see body worn video of police cowering behind cruisers as lead flies around them, there is an obvious fear of immediate consequences. I have my opinion as to which is more effective deterrent value.

      This misses the point that the DA determines prima facie if the case should even be presented and pursued. Blind Freddy, much less a lawyer, should see the holes in this case. "Suspicion" is not a crime and the charge was Eluding, not Speeding. Notwithstanding, the OR did not categorise the speeding offence as x miles over. Incompetence and BS

    Kudos on the judge for listening to the report and recognizing there was no legal justification for the stop much less the prosecution, but I am curious if he does this for non-poc defendants. The only cases I have seen that feature him have been black males.

    Our legal system would be improved - if arresting officers had a financial penalty for false positive ticketing - and arrests. That would mean that every person brought before a judge should be a slam dunk - rather than cooking a pot of pasta - and throwing it against a wall to see what sticks or not. Lack of accountability for sloppy policework is a huge problem.

    Never hear a cop warned re his conduct and lying on statements. These DAs should be sacked for lying and malicious prosecution. Jail them for Perjury. Funny how it takes two to take on one citizen. Dismissal dos not go against the DAs office and it should has the person has being charged and forced to attend a Court.

      Black men aren't children. They don't need protection. This man just had a good judge that knew the law. I swear most black women need to learn grown ass men don't need protection. These men barely want to protect YOU when shit hits the fan. In fact, they kill people that look like YOU at more of an alarming rate; more than any other race of man does to their own race of woman. They would victimize someone like you first before a police officer would to them. Know who needs the true protection from whom in this community.

    This judge isn't giving cops the rubber stamp. I respect him because he knows what's going on. This will force police to do their job better or face some consequences (hopefully).

    I'm white, and my girlfriend is black. I pretty much never get pulled over; maybe twice in 15 years. She gets pulled over at least five times a year, usually for 'random' DUI checks. She doesn't drink, so once she passes the tests, then the questions start, trying to trip her up into admitting something/anything.

    The sad truth is that we see this as being the abnormal. When in fact, this judge is what we should expect.As the normal, the probable cause should be set to an extremely high standard.

    Wow. The officer didn’t even bother to state how fast the defendant was going. Even though he was supposedly speeding. Yet the defendant has to come to court based on a half ass report from the officer. This was harassment.
