      @kristycrow9586 What about mui's lies...that's what really screwed him. It showed his consciousness of guilt, which is a legal form of circumstantial evidence used to show his awareness that he knew he engaged in blameworthy conduct. Not intentional, but in hindsight, he knew he had no need, or right, to do what he did. It's very sad. He was not in shock. People in shock don't do or say what he said and did.

    Just thought I’d put the Wisconsin statute here because lots of people in the chat seem to think this an obvious case of “murder” just from the fact he stabbed them;
    939.48  Self-defense and defense of others.
    (1)  A person is privileged to threaten or intentionally use force against another for the purpose of preventing or terminating what the person reasonably believes to be an unlawful interference with his or her person by such other person. The actor may intentionally use only such force or threat thereof as the actor reasonably believes is necessary to prevent or terminate the interference. The actor may not intentionally use force which is intended or likely to cause death or great bodily harm unless the actor reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or herself.
    So keeping the law in mind, you have to ask yourself when being pushed down in a river, punched in the head and attacked by a mob of drunken 17-24 yo’s who are accusing you of being a child raper, if a reasonable person in that situation, as in being attacked in the moment, would believe their life was in imminent danger.

      It stays so difficult. If I was the mom of Isaac, I would also want somebody to pay. Nicolae.
      But in this scenario, it went so horrific terribly wrong. So many sides.
      First group of 6.
      Second group of 5.
      Being surrounded by a mob of 13, I also would have used my knife, if I had a knife.
      Isaac had his both hands around the throat of Nicolae.
      Pfff, this stays so difficult. A mom lost her son.

    Thank you for airing this but PLEASEEEEE figure out the audio. The frequent changing of the volume. Raising it up high is terrifying and hard to watch. My volume is at a reasonable level but it’s raised to hear the attorney then the witness speaks and he’s shouting so loud. Please just leave.

      I doubt The Defense will request a psychological on their client as the probability of the result, will be evidnce for THE STATE. Certainly was poor action to drag multiple witnesses for the Defense into a courtroom. THEN ALL DEFENSE WITTNESSES CALLED BEFORE THE JUDGE AS A GROUP AND REPREMANDED FOR VIEWING LIVE TESTIMONY ON A CELL PHONE!

    I feel completely different about the situation after seeing the video. Yes, Miu seemed odd approaching the younger group with his goggles in hand. But the group of boys acted like a pack of hyenas --- taunting, surrounding, bullying him, and Jawahn Cockfield was one the main instigators, encouraging the pack-like behavior. --- It seems like Jawahn and the other individuals should face repercussions for creating this intense situation.

      They were still kids and they never said they were innocent, that does not give him the right to stab multiple people if he had to use a knife then why did he not just stop after stabbing one he carried on and that led to a kids death and that one kid that did die never laid a finger on him

      No, if you look at the x wife’s testimony at 5:08:20 she says they all stayed there while the police came and everything, returning to the tubes after the whole ordeal was over and police had already talked to them ect.

I don’t understand what you guys think happened… she’s saying she stayed 20 minutes after the police arrived, which is about the time it’d take for them to take down the identity and/or statements of everyone there (assuming it was multiple police) and for the first responders to take away the injured ones. Why would she stay longer than it took for authorities to deal with the situation? What else is there for her to do there? Are you like expecting it to be some dramatic movie where she drops to her knees while the rain comes down and she cries facing the sky for an hour after everyone’s left?

      I'm not there yet in the trial but I think his best defense is I didnt think anyone would believe me. After seeing there was a video I regret my past lies and want to tell the truth should be his defense.     Chat is awful. This is a trial and every witness is going to be a regular ol' human who's not used to being on tv or speaking publicly. I'd love to see AND hear everyone in the chat mocking all the victims looks and voices. Guarantee 99% of the a-holes are 100x worse than all of the things they're nitpicking on. Especially anyone older in age. Most people outgrow mocking a victim's looks by their early 20's, but if you're still judging people on their clothes and faces and voices in your middle aged or later years you have some inner work to do.

And also why I am so saddened/sickened by the chat. I expect this behavior from poorly raised drunk teens, but there's no excuse once you enter middle age and beyond. I don't excuse the teen's behavior either to be clear, and find it vile and cruel. It doesn't warrant what ultimately transpired due to Nic's refusal to back down and retreat from the drunk boys.

    Did he really say he was looking for little girls? Did he really punch the girl? Or is that what has been talked about, so it must have happened. Doesn't match any of the initial interviews.

      I personally (no factual evidence or proof, just personal opinion) wonder if it was one of a few possible scenarios:
      1. He was simply misunderstood because he was muttering or speaking softly, but actually said something like, "I'm looking for a girl's phone..." (most likely without any video/audio proof)
      2. The teen videoing everything simply pretended to "hear" him say that when he ignored them and didn't respond because he thought it would be funny since he claimed the man was acting weird. (Also very plausible considering how drunk teen boys tend to act when they have too much confidence)
      3. Or...Mui was immediately on the defense the moment the teens asked him what he was doing, (maybe they asked it in a rude way) so he hurled an insult at THEM first, such as, "I don't have to tell you what i'm looking for, little girls..." And they misunderstood him but picked up on the hostile vibes so decided to take it too the next level in retaliation.
      (obviously that last one is a huge speculative leap, but it's possible since he seems like the snarky type with his smirking and refusal to back down or retreat even after 12/13 people started surrounding him)

    Legal duty to retreat....WI is not a stand your ground state.... when he came back and initialized the contact self defense went out the door...also he could have retreated after first stabbing

      Legal duty to retreat is only in the northeast, though I agree this SHOULD be a situation where the defense clearly should have retreated since he had so many opportunities throughout the 10-15 minute encounter. Everyone on his side seems to have only watched the edited video clip of the main event without any knowledge about what lead up to the climax and who is who or what is being said. They are all screaming for him to leave and just go back to his friends. The teens called him names prior to that, but also in between yelled at him to stop and to leave them alone and "go away." They weren't' trying to exert authority and tell a man he couldn't be on a public river like so many are trying to claim, they just wanted him to leave their vicinity and let them pass and continue down the river. He even had a window of opportunity AFTER he was shoved and hit when the first "mediator" stepped in to try to stop the fight. Everyone stepped back and turned away from him, but he lunged at them and started stabbing.

    Without the video we'd have no idea what happened. The eyewitness testimony is demonstrably unreliable. People do not get a free pass to do whatever they want because they're under 18 and have chosen to drink irresponsibly. Once Miu was punched, downed, and punched again he had the legal right to defend himself against the dozen people who were tormenting him. He wasn't required to ascertain their ages or genders and hold back on either account.

    Before I saw the video, I watched the prosecutions opening statements. Was sure he was guilty. But then I saw the video. It’s sad and tragic, but the kids started this fight by knocking him down, punching him in the face, and taunting him the meanwhile. He was outnumbered by a lot. I’d vote not guilty.

      I saw that also ~ someone’s leg swishes around while he’s reaching down for his goggles, I think one of the kids possibly got the goggles w/foot and tossed backwards which is why Nic walked around the tubes to the other side and reached in the water.

    The kids definitely instigated this and their behavior was disgusting!!! Where I struggle with the self defence is 1. if he was worried at the outset, he could've headed back up stream to his group while the kids were all still sitting in their tubes floating downstream.. he didn't attempt to remove himself from the situation, rather he chose to pursue it by rushing them. 2. He didn't even attempt to talk to any of the parties involved or ask for help or yell at them he wants to leave, it looks like nobody is home in the videos. 3. At the point he felt threatened enough to pull the knife out, he never attempted to make it known or threaten them with it in order to get them to back off and let him go back to his group. He instead chose to start stabbing.

Kids didn’t realize the possibility which is him drowning after every teenager feels there oats on guy they think is worst kind of person . Any adult in this situation would be in bad spot , these kids were telling the other groups he’s hurting kids , at first the guys just looking for his phone and he smiled has they heckled him he was foolish but they kind of baited him too .

      He didn’t have any reason to believe his life was in imminent danger before they started pushing him to the ground and punching him in the head, that’s when he made the decision using his knife was necessary to eliminate the threat. Now if he had started stabbing while they were just yelling, prior to them actually jumping him, agreed it wouldn’t be self defense. It’s also illegal to threaten with weapons unless you feel your life is in imminent danger, and again, he did not believe that until after being jumped. If he had threatened before it was clear his life was in imminent danger and they backed off, he could have been charged.

    The witness claims it could have all been solved if Miu tried to use words. It doesn't sound like anyone was interested in his side anyway. From the video it seems to me that Miu started walking towards the women because he thought they were an unbias party coming over to help. He starts pointing back in an attempt to explain something but was immediately met with a verbal attack. In that moment he realizes they were not there to help him or even mediate the situation. Now he is in a situation where he has two groups of people being aggressive towards him. I think he was so nervous and/or scared that he couldn't really say anything. Not that anything he could have said would have miraculously made those two groups behave civilly.

      I worked in the court system for years and was shocked by what people of all ages wore to court! Sometimes they show up drunk and or high, wearing a t shirt with a pot leaf, when they’re already in trouble for alcohol/drugs. Some wear pi’s and others wear club clothes. It was like a show every day in court!

AND IF U TAKE A CLOSER LOOK AT THE VIDEO he was holding the knife in his hand before any altercation began of pushing or touching. he knew what he was there to do and that was to kill. he had ample opportunity to leave if he felt so “threatened” but he did not because his ego was hurt. not only that but out of the 5 people stabbed some were completely innocent and did not have anything to do with the altercation. he was not “afraid”, he was angry.

    Regardless, the older gentleman should have enough sense to just walk away. Had plenty of opportunities but didn't. Should have never hit the girl to begin with. Lied about having a knife, then said he took it from one of the victims who clearly never had one. After stabbing multiple people just walks away and changes into something making him look as if he wanted to be disguised. Guy just should have stayed away! Couldn't handle some punk kids heckling him. Guilty!!!!

      It's as simple as this but people who didn't watch any of the trial think otherwise. The guy initiated all contact and violence as well as continuing to harass the kids and even under law, technically, false imprisoning them by grabbing their rafts.

      @@jeffdavidson2390 His friend didn't show up until Nic's wife asked him to go check on him. Nic had already been hit and pushed into the water. His ex-wife even stated she loves him the same as when they were married. Some defendants get divorced to protect the assets of their spouse.

      I 100% agree with you....he is an adult and should have just left the youngsters alone to start with, why go over to them and start causing crap. Who goes into the river, with a knife in your pocket...intentions to use it? When things got heated, he should have walked away. No matter what was said, it doesn't make stabbing people and killing one....right. Sorry...guilty (and I have been watching every day of the trial)!

    Why did Nic not retreat back to his group before the escalation? His ex wife admitted that he went back twice? Did he go back to his group the first time to get a knife? Wisconsin law probably does not have stand your ground laws which would require Nic to retreat if possible (he went back twice so clearly he had the opportunity to retreat) before using deadly force. Prosecution seems inexperienced and the defense is failing to establish the imminent threat threshold required for an acquittal. Sad mostly for those injured and murdered in this case.

      @@johannawebley4101 He still could have stepped aside for 30-60 seconds and waited for the unruly teens to pass by rather than letting them get to his ego. There was no reason for him to refuse to walk away after he stopped their tubes from continuing down the river. Most mature folks would've rolled their eyes or yelled something snarky back at the kids and carried on with their lives rather than feeling for their pocket knife the moment someone hurls a weak insult their way. I float almost every weekend in the summer and there was absolutely no reason for him to stick around. It would've maybe taken a minute out of his day to step aside and ignore the kids while they passed, but instead he reacted like someone who isn't capable of controlling their emotions.

      @@johannawebley4101 gotcha! Sorry I jumped to conclusions. I think this is one of the hardest cases without seeing every second of footage because so many people acted out and if any one of the 2 groups and/or Nic stepped back or didn't get involved to begin with, this wouldn't have happened.
      (and just leaving this here for reference for other readers, not as a direct response: Nic was originally looking for a friend's phone with his goggles/snorkel set. The teens wound up next to him while he was snorkeling in shallow, 1 foot deep water, and they seemingly were weirded out by this and asked him what he was doing. I'm not sure they asked in a polite tone, but also not sure if they were simply being friendly and curious as there's no video/audio evidence. Shortly after this, based on recorded timelines, Nic lost his snorkel while lunging at the teen's while they were floating by in their tubes. He first has the snorkel/goggle set in his teeth, then drops it in the water while he's yanking on their tubes. This still doesn't mean that he couldn't have simply stepped aside or up onto the bank while he waited for them to pass, after which he could have resumed his search for the phone and his snorkel.)

    I'm only 4 minutes in but doesn't 1st degree require some premeditation. This was in the midst of a fight? or disagreement? What he did was horribly wrong and he will do time I"m sure but I'm in the early stages of this so.....Okay I'm back after an hour and my opinion has changed. I feel the same about this as I do the Byron Smith case of an ex-marine who was repeatedly robbed and harrassed by teens until he killed them when they broke in his home again after they had already stolen his grandfather's watch. They accussed him of basically "laying a trap for them" like WTF. He did park his truck down the street and left his front door unlocked and waited in the basement for them though. His mistake was he recorded everything and taunted them as he stood over them and shot them and didn't report it until the next morning. I still think they should release him because you don't know what someone with PTSD is capable of and they had tormented this man in his on home and law enforcement wouldn't do anything about it. If this guy gets anything more than a few years I'd be surprised. I'm not soft when it comes to this generation at all. All this coddling and not teaching kids to be respectful is gonna eventually come back to bite parents in the butt.

They warned him to go away and he rushed them, they defended themselves by hitting/pushing him. He could’ve retreated but he stabbed instead. He’ll get 15 years hard time.

    Several of the states witnesses today helped the defense more than they did the state. The sober girl lied about everything and Mr. Williamson was just telling the truth and that truth helped Mr. Mui.

      I think the video of the disemboweled guy getting stabbed also helped the defense. It showed him pushing Mui down in the water. Then when the defendant gets up, the guy goes to push him again. As he pushes, Mui stabs him. The momentum of Miu falling back from the push is what causes the upward slicing motion.

    Does anyone know why the prosecution, after seeing the video, still chose to pursue 1st degree murder as opposed to a lesser charge (manslaughter, 2nd degree, etc.,)? Also, were there ever any charges for the other victims (ie., attempted murder?).

They could have just shut their mouths and called it a day but alcohol tends to make people rowdy, especially people at this age, while lowering your inhibitions and making you feel invincible. Miu initially had the knife in his pocket. It was only after he'd started being harassed and berated while surrounded by first 6 people which quickly turned to 17 people that he felt the need to defend himself.

    These are definitely not the brightest prosecutors and the defense attorneys are condescending.
    This case should be an example to people to not put yourselves in harms way. It seems like the defendant knew how to harm people. In mere seconds hed injured several severely and killed another. Someone without knowledge on how to harm people couldn't have done what he done. He should've just went on down the river. The kids shouldn't have taunted him and just went down the river. Totally avoidable.

    The ex-wife said he was looking for jewelry in the water. I'd never think to do that myself, but I guess it's not that different from searching for jewelry in beach sand. Maybe he said he was looking for "little jewels"? Of course, that's mere speculation on my part, but that could sound a lot like "little girls" if he has an accent.       It's a Supreme Court ruling. In most cases witnesses aren't allowed but if you are a victim you are allowed to watch either in person or streaming
