I dunno, seems like a bit much especially for how complex the court system and law already is.
If the maximum u can sue in a small claims court is £10,000 then everything above is probably “large claims court” . I dont think anyone would propose a medium claims court since it doesnt seem necessary and wouldnt serve a purpose since there shouldve only been one claims court anyway, the only reason small claims court exist is so that its easier for less fortunate people AND to clear up traffick with the large claims court thats just my opinion though
It would help to do that or even to raise the "small claims" amounts (which does happen sometimes, but not enough). The problem is that it requires a law to be passed, and legislators usually don't care about adjusting old laws, only passing new ones, if they care at all. This is why many laws have absurdly low dollar amounts, like "grand theft," which in many places is as low as $200 and is rarely above $500. A delivery driver could get charged for grand theft for making off with a customer's large food order.
For anyone going through small claims, my case took 9 months from start to end. Hearing took about an hour. The pandemic has delayed many cases, _even though it's been years since._ *Something I didn't hear mentioned is that you can include the file fee in your judgment payout; making the defendant pay for your court fees if you win*
Where I live some people cases got delayed 2 years because of the pandemic 😂

Pandemic makes the line longer. In my jurisdiction i can still see docketed items with a 2020/2021 case number.
In Germany both lawyers are paid by whoever is guilty of causing the case. Usually this is the loser. So if you are in the right you lose nothing by filing a lawsuit. There is however a limit how much money can be demanded because of legal costs.
What if both parties are not guilty but just don't agree with each other, disputed hard enough to go to court?
Loser pays in the US would be a Godsend

3:39 could you do a video on (assuming this is usually possible), how small claims court can allow you to sue for money from telemarketers that illegally call people on the Do Not Call registry?
I did not do specific research, but my quick guess is this cannot be easily solved in most small claims courts. Small claim cases are more like an exact number on a paper like your rent deposit on you rental agreement, or the charge on a dealer’s receipt for repairing your car wrecked by the defendant’s fault. You’re not asking the marketing company to give you a sum of money (unless you want to seek emotional damages caused by their intentional infliction of emotional distress-highly unlikely), so I believe you should go to a normal court and seek an injunction against them, not very expensive lawyer’s fee expected.
@@tennyho3236 The TCPA provides a direct right for consumers to sue the companies for a set fine per call, so there's direct legal precedent that should simplify the process massively. At least, that's how I believe the law currently stands.

I did a small claims case against a towing company, it was less than a thousand dollars. It turns out the judge actually wrote the towing laws and when we went in he asked all of the other peope waiting for their hearings to step outside of the courtroom, asked my dad and I too step up to podium, and started asking a few questions. The towing company was notoriously owned by the local italian mob, and never signed their summons, yet we got it (we sent it to the main office of the company after a lot of digging), he then looked through the file, pulled out things he didn't think helped my case, and I was awarded 3x the cost of the tow (which was the law at the time) plus court fees. Did I ever see the money? No. After calling trying to get it a few times my dad was like "so, this is the mob and we should probably just let it go."
Though I did become so knowledgable of the laws that when someone who went through something similar with a company owned by the same group had an issue the person I worked with on the txdot claim (you had to call them first) referred someone to me.
So, that's how I sued and won a court case against the mob... though I never saw a dime 😂

@@og_3rd_st_saint_gat Yeah, probably not. Defamation lawsuits require proof of _actual_ damages. You have to be able to show that you were substantially harmed in a significant way that affected you financially, or, rarely, in some other tangible way. You also have to be able to prove that the statements are both untrue and not simply an opinion. Truth is a 100% defense against defamation suits. And all that's assuming that you have proof that the person in question made the statements about you, which basically requires them to be in writing or recorded unless there are many reliable witnesses.
Take the Depp case. He was able to prove that the defamation cost him several large roles. The defamation was in writing. It then took a very, very long time to prove that the statements were actually false. (Public figures have a higher bar to the opinion vs. statement question, so it's not the best example, but it's one everyone knows.)
This is why Mike should probably do a video on this.
Basically, they are hard to prove. My friend's son had a girl say he diddled on her without her permission. It was on social media. The boy won largely because it was written down.
Maybe stop bein a snowflake if its small or if its serious gather proof of innocence (which shouldnt be hard if its a false accusation) and just defend yourself… your likely not going to get anything from a claim such as this for reimbursement. But the truth will eventually show especially if its 100% true it wont be that necessarily hard to prove.
Wait until Ace attorney fans find this out.

I have a small tree company. A large franchise hired us to do some tree work back in March and they have ignored me and not paid. There’s a lot more details to this project. I think I can go into small claims but I would have to reduce the money they owe me, supposedly according to a friend, I can only sue for the potential profits of the job. I think it would make a really awesome video for you.
That thing about profit is nonsensical and contradicts itself. If you can only sue for the profit you would have made, that means you eat the cost of labor/materials/travel yourself, which cuts into your profit, which means more profit you can sue for.
Besides, most states allow you to sue for up to 3x what is owed.
I'd like to see how to take a company to small claims court for making it difficult to terminate services/subscriptions.
Companies have losing revenue, but they don't need to be horrible like Vonage to keep customers and do automatic drafts from bank accounts w/o one's knowledge. Good thing the FTC had to step in.

Hi, I asked for a pre-owned vehicule in a well stablished dealer, I received a quote from them for it, we saw the vehicule, we like it so we accepted the quote, but then, they wrote a price much higher than the one quoted. I talked to the manager and he answered that they "won't honor that quote", as clear as that. Is that legal? Honoring an accepted quote is not mandatory in the USA?
Doing a quick legal search showed me it is indeed legally binding.

Normally that would be property damage in small claims or otherwise, but if it turns into tree law, you might just wish the tree fell on _you._ Tree law is ridiculous.

@@bt3324 There's this thing called a do not call list in America. Telemarketing agencies are not allowed to call you, If you registered your phone number. So If they call you and you sue them. They will pay you some like $1200 to not take them to court.
I used FedEx to send my German-made wristwatch back to Germany for repairs. FedEx refused to deliver the watch to the manufacturer (Sinn) for reasons unknown. After no less than 6 calls to FedEx, the watch just sat at a FedEx shipping location in Germany. Can I go to small claims court for breach of contract?

Well you said suggest specifics and I might have one in the future. Basically, I've been lending my sibling money with the intention of them paying me back. If they refuse... how to go about it. I have the text conversations and receipts to prove my claim. So I guess Ill look forward to the next video
Screen shot those text messages and take pictures of the receipt and save them in the cloud in case they delete them or your lose your phone or the receipt get damaged or lost. Also you should check what the maximum time in your state that you can go without filing a case from the last period you lend them money and the period you file the case(some have time periods that if you don't file a case within them you can't go to court) i spent years watching judged judy 😂🗿☕but this are genuine advices to help win the case
