    Being a public defender is thankless and frustrating 99.9% of the time. I feel for her.

      Well, as a public defender with just half a brain, she should’ve known he was lying and knew better than to use that as a defense. It made both her and the defendant look stupid. Now he’s in jail,(rightly so) because he has a p.d. That didn’t give him the proper advise.

      ​@@jdmuckenfuss7082The PD can't give proper advice if the client lies to them. The PD also doesn't have leeway to divine what is probably true. They can suspect the defendant is lying and prod them. They can only work with what they're told and get. They have a hundred other clients this month and 0 time for a guy who wants to lie to them.

      I have never been to court except for jury duty, but if I was in trouble for my Robitussin habit i'd be shitting bricks if that man was standing behind me while I was lying to the judge and claiming it was orange juice....

      😂😂😂😂Best comment, now I picture him with his fingers in his ears😂😂 The lies these people come up with just amaze me that they think he will believe them-especially all the soberlink/other tests fails-it was my mouthwash/facecream/in the food and I didn't know or I was in a room where people were smoking weed but I didn't smoke any "I swear your honor, I didn't smoke any" (that was another case I saw) on here.

    Been sober for over 5 years now. It's easy to lie about a drinking problem. It's easy to excuse and be in denial about it. But when it starts affecting everything in your life, that's when you have to change and stop making excuses. Be honest with yourself and others. Acknowledge you're powerless, and ask for help.

      Congratulations! I lost both parents and three brothers to alcohol and prescription & illegal drug use. My entire family. It devastated me to have to cut them out of my life because of all their addictions. I was always afraid something they’d do would cause me to lose my nursing license. All of them died between 51 and 52 years of age. And I’ve seen from years in critical care the devastation addiction causes. Spent one New Year’s Eve with my entire ICU filled with people going through DTs. Awful!

      I’m a former heroin addict and I’ve been clean for 4 years May 2024. I now counsel addicts and I truly believe that getting clean from drinking is the hardest drug/intoxicant to get clean from. Number one bc the withdrawals can kill you and other than benzos I think it’s the only one that has that issue. Number two bc I’ve yet to see heroin when I walk into a grocery store, 7-11, etc and everywhere you go you see alcohol so it’s a lot easier to get your hands on. Congrats on your sobriety. I know how hard it is and truly applaud anyone who has put in the time/effort to change their lives for the best.

      I love Judge Simpson's Sheriff, the one who stands Just underthe bench in case the perp tries to leap at the judge. I'd be trembling if he walked into my view at court and I was the one in the dock! 😂

    Both the DA and the defense attorney were driving me nuts with the "Um" business.
    I'd say take a shot every time you hear "Um," but you'd be wasted 60 seconds in!

      Yeah I get what you’re saying 😂 but he lied to his public defender apparently. I’ve never needed a lawyer but I assume that’s not what you’re supposed to do. I wouldn’t blame a public defender one bit for his lie. She defended him for what information she had.

You gotta know your blow's, you've got your Robitussin blow, your NyQuil blow, and the infamous mouthwash blow's and failing to know your blow could result in incarceration. Anyone else sick of hearing the " i take full responsibility speech"? I guess as long as you say that you not supposed to be punished.     Whenever I hear Judge Simpson mention the name "Johnson" I flash back to 1 James Johnson. The 1 who was in this courtroom 4 days a week and also the one who threaten to kill then Prosecutor Caitlin Kirby.

    Just to be clear, Robitussin does NOT have alcohol in it. Even Nyquil's alcohol content is not an active ingredient and only used to dissolve other active ingredients. It's not the ingredient that causes sleepiness either.

      No, she isn't. Her job is to fight for her client, whether she believes him or not. He told her he did not drink those days, and her job is to relay that to the judge and try her best, regardless of how obvious it is, to get him the lightest repercussions possible. I'm sure she advised him against saying it in private, but it's his defense, not hers. She's not good or horrible here. She just "is".

      It’s not the first time Officer Allen is behind the defendant. I can say every time he takes that position, the defendant is remanded to custody.

      One of my dad's friends is an alcholic. A doctor can tell them that they will DIE from a drink and they will still drink.

    Back in 1970 we used to make road trips from the East Bay to The City to The Hub Pharmacy. They sold bottles of pure dextromethorpan hydro bromide. The govt. outlawed sales of it but the FDA allowed pharmacys to sell any they had in stock until they ran out! By the time we got to Oaktown we were all stooopid dumb!!! Except the driver. Thank the Lord they soon sold out of all they had !! Lol!!

    The ability to smile, laugh and continue with the next case is absolutely incredible. To keep cases separate and not drag that baggage with you to the next case or even home is just remarkable. Nobody is perfect and I'm sure a happy dog or crying baby wouldn't be the best way to arrive home, but overall, these judges are remarkable.

      Yes. But it would require several bottles to get as high as his levels were and the other ingredients like decongestant or cough suppressants would have killed him from toxicity. But he’s too dumb to know that.

      When did attorneys stop prepping their clients or at least intervene and call for a recess to reset their client? It probably wouldn't have kept him out of jail but simply relaying the lie to the judge sure didn't help.

    They play close attention. They seem to know judges so well that they know the “trigger” words that mean “close in.”

    Every trial attorney in that county knows the 'cough syrup' defense will not work with judge Simpson. I don't care if you're a public defender or a paid legal defense attorney the moment your client starts playing games it is your job to ADVISE him what to do and not to do. At a minimum should've asked for a brief recess to reset her client and she failed.
    And before anyone says the criminal messed-up, of course they do that's why they shouldn't represent themselves which is essentially what he ended up doing when his attorney didn't properly prepare, or step-in to stop the second everyone knew a remand was coming.

    So he got drunk. And then figured, "Fuck it. I might as well just keep drinking."
    Then when court time arrived he thought, "Oh, you know, now that I'm actually sober, I'm not so confident about my "act of civil disobedience", I'll just go with some old fashioned five year old's level of fibbing."
    Well, he's an addict. And he's addicted to something that every single person he spends time with, just LOVES and they all want him to keep drinking. It's also a legal substance, with thousands of ads on television, social media, print media telling him that drinking THIS will make you: Cool, attractive, sexually successful, popular at parties, wealthy.
    Though, the reality is, it makes you boring, fat, and a broke embarrassment.

    I don't know why ANYONE would want to be a public defender. You literally get lied to on a daily basis, and then you have to attempt to defend those lies in court.

    Alcoholism is such a terrible illness. He's doing whatever he can do protect his addiction. I know because I've been standing exactly where he is now. I feel sorry for him and hope that he is able to face down his demons and find peace.

    I worked with ex-cons for nearly half-a-century and this sort of distorted reasoning is commonplace. Most of us know that if we get caught doing something over and over, trying to deny one of the instances will only hurt us (as most people will just assume we are lying). And this is true even if we honestly believe we didn't do it on that occasion, even if the machine gave a false positive. However, this type of thinking with criminals is rampant. I'm also a Sociologist, and I am baffled where they get this from? Meaning, under what conditions did this work such that it became a tool in their mental/social toolbox ?
