I have a trip and fall lawsuit that have building code violations that was litigation 5 years earlier that they didnt repair all hazard on property i sustained quad tendon rupture in both legs torn mcl torn meniscus lateral and medial. Excellent video with great information quick question what is concurrent insurance and does it apply to construction accidents. Also, is excess and supplement policy are the same
Thanks. Its just a type of insurance the other side could have -- usually they have primary with excess like umbrella. But there are situations where you can find that another insurance policy is also in place. For example a tractor has a policy but the trailer may have a separate policy. Or if its a rental car, the driver has his own policy in addition to the rental car company. So that would be concurrent as two policies are in play at the same time. So when I draft the demands I am just trying to cover all bases and get ALL insurance :) Hope this helps

They have to disclose once a lawsuit is filed. In some states they don’t have to tell you before a lawsuit.

Can you ask for million dollar policy limit if medical expenses are lets say 100,000?
Yes if injuries are lifelong and permanent. I don’t like to use medical expenses to determine case value
What if I didn’t get surgery at but had spinal and chronic back pain ? They tried to give me and spinal injection but I denied out of fear of a needle going through my back.
That could still have serious value

Not sure what you are asking here. In Brooklyn you have the Supreme Court but there is no sheriff. Just a clerk.

Discovering policy limits can be a deep dive you say…Yes, but if you didn’t file the lawsuit and went through discovery, you never would’ve known that there was extra money out there. But that’s on the insurance company for not just settling for the 1 million, good job counselor.

How common is it that the defense attorney lies about not having the excess insurance? I’m in the middle of a lawsuit for a premise liability that caused me to have 3 separate surgeries for a type 4 tibia plateau fracture. My attorney is now telling me that the business has a policy limits of $1million with no umbrella or excess which I don’t understand with it being a popular bar/restaurant. So was told that even going to trial and getting rewarded way over the 1 million, they would still only pay that million. How common is that?
It does happen. It’s important to verify that there truly is no umbrella , excess , concurrent , or supplemental coverage. We ask for an affidavit of search as well as an affidavit from the broker. There are also outside companies who can do their own search to verify

Any idea what insurance coverage a major truck stop chain would carry for personal injury to a customer (trip and fall), caused by improper asphalt patch at truck fuel island?
It occurred 10 months ago, torn rotator cuff and bicep tendon surgery done, but both failed.
Now I need a total reverse shoulder replacement surgery.
I have been in almost constant pain. Awaken nightly, from pain, and lay awake for hours.
Owner operator losing $22,000 per month average revenue to truck.
Had to sell business.
Per doctor, permanent disability and can never drive a truck (front axle weight over 5000lbs) again.
You can just ask them in a request for production. They have to tell you the primary and excess. All companies have different limits but a major truck chain should have millions in coverage.

As I stated earlier, I had my injury almost 11 months ago. Had a surgery on 09 Jan 23 but it failed completely and I now must endure a complete shoulder replacement.

I got a settlement from walmart in 2019 on a workmans comp claim .i had to practically beg my lawyer to fight for me.After deciding to settle because it seemed my lawyer just wasnt willing to fight harder..im in pain for the rest of my life, the moneys gone..my case is still open for7 more years...can I sue again?...I just dont feel my lawyer was really in the battle for me.looking for an opinion, ty.

@@AttorneyArkady If I may ask a follow up question.. it has been three months since my accident and since I hired a lawyer. Last week we spoke and he told me that he doesn't even know if the other party had insurance at this point. Keep in mind, I have been back and forth to doctors already for my injuries. A letter of representation has already been sent to the other parties insurance co. And yet, he is telling me he doesn't know for sure if the kid had insurance or the limits. This of course is shady , right?
@@elainemo yea that’s a little odd. Which city is this ? In New York there are codes right on the police report so we can see the insurance. Then when you send a letter of representation & call the company they tell you right away. The only way it can take time is if it’s an out of state or temporary license plate then we have to order an insurance search.
How much is a mold injury worth ? I have 18 different health issues from it mentally and physical, the biggest being a rare immune system disorder called hypersensitivity pneumonitis, immune deficiency, headaches, multiple chemical sensitivities, and many others , my attorney isn't fighting much at all wanted me to take 8k and run with it , I turned it down , also if the rental lease say that the prevailing party is entitled to fees paid , do I need to come up with expert witness up front ? The attorneys I'm dealing with seems like they have been paid to not fight for me

They have more insurance two sets but they way they was talking the insurance company don’t want me to get it they are saying my tbi is mild not that serious. I told them my doctor said it’s post concussive syndrome and it progressive
They ever want to pay. You have to prep the case for trial to make them pay you the full policy limits.
Why would you prep for trial when you can just easily settle that would be way to much work so if you prep for trial do that scared them or something
@@Trolls584 prepping for trial and having a track record of jury verdicts is what gets the insurance company to pay the top dollar settlements. otherwise they will offer you peanuts bc they know many lawyers are either afraid or unable to get large jury verdicts.
