fourth amendment only protects us from unreasonable search and seizure... if they are checking everyone or a pattern of persons on the road it is legal under the 4th amendment. They would need probable cause to pull you over or target one person.
I don't see any harm in this situation displaying your License registration proof of insurance and disclosing to the officer if you're carrying a weapon if you are licensed or are authorized by the laws of that state to have a weapon without a license to disclose it. That helps ensure the safety of anyone because cops do not like people who make sudden movements. If they start asking questions you have a right under the Fifth Amendment not to answer. That alone cannot establish probable cause nor is proof that you have committed a crime. Exercising your 5th Amendment rights by themselves in itself is not obstruction of justice. If they had smelled alcohol in your car that would have been a completely different issue and that clearly would have been probable cause. The Fourth Amendment says unreasonable searches and seizures you are protected from. It doesn't say no searches and seizures at all. Also, many police agencies have special flashlights that can detect alcohol vapor in a vehicle when the light changes color. Alcohol as soon as it's exposed to the outside air quickly evaporates. If they start doing something against your will it's very important that you do not resist them but you do make it clear that this is not consensual. Make it clear that you're going to cooperate to avoid a potential resisting arrest charge but anything they do after you stop talking is being done without your consent. If they have probable cause that you have committed a crime, you do not have the right to not obey their lawful orders. If they said we smell alcohol in the vehicle and you refuse to exit. They can forcibly remove you from the vehicle. At that point they are giving you a lawful order. Resisting can be an additional charge in itself and constitute a felony depending on the level of resistance. You want to protect your rights that's fine but make sure you're careful. I would like to add that driving a vehicle is not a right it is a privilege. Driving a vehicle a requires a certain set of knowledge, skills, and ability. You have the right to travel absolutely unmolested unless there is probable cause one has broken the law. They only need Reasonable Suspicion to pull you over. That means "behavior that potentially indicates a law may have been broken". That's enough to pull somebody over but it is not the same level as probable cause. Weaving in traffic can create Reasonable Suspicion one has been drinking and driving but it's not probable cause. The driver having slurred speech and open containers of alcohol in the vehicle and smelling like booze that's probable cause. I encourage people to stand up city of Rights but don't be a douchebag or idiot when doing it. It doesn't take much to establish reasonable suspicion and once that's established it doesn't take much to establish probable cause.

Just because by law you have the right not to answer questions doesn't mean its a good thing to. In this case this is wasting lots of peoples time, and the end result is either he wasn't drinking and just decided to screw with a cop just doing his job, or he was drinking and was trying everything to get away with it. Either way, you shouldn't need to 'exercise your rights' just for something like this, you'll only aggravate the police and a lot of them do a great job remaining calm, but they're only human. That cop you refuse to talk to could save your life or your son/daughters life one day.

I also don't agree with your laws, especially the right to bear arms. We're a bit stricter here, You need a reason to have a gun and I prefer it that way. It shouldn't be a right to have a gun because you want one, and have no reason for it. We let the police do stops and breath testing. No one says its illegal, we go along with it and they help us keep our roads safe. I can't think of anyone who was wronged by police just for doing a breath test, in fact I wish we had more booze bus stops.

What if you make a legal turn though? I approached a checkpoint and there was a stoplight right before it. I could have legally turned right, however I did not thinking they would follow me. Can they follow with suspicion of me if I had chose to turn?

They had no legal right to his driver's license. This was not a traffic stop, it was a DUI check stop. Unless they have a crime, you're under no obligation to give your license in a checkpoint.
Under current law, in Nevada, they can demand ID at a DUI checkpoint. It's a good idea to look up the DUI checkpoint and terry stop laws in each state you visit.

The production of a driver's license, by the driver, is only required when an officer has probable cause, or reasonable suspicion to believe that the driver has committed a driving violation. In the case of a checkpoint, such probable cause and/or reasonable suspicion does not exist. The buzzer just sounded Alex...you're wrong!

In NC when they do checkpoints, they will pull you over with a quickness if you turn to avoid it. Hell, they normally set them up where there is nowhere to turn around at.
Why not just have HUI (Habitating Under the Influence) checkpoints in everyone's home? Do you know how many domestic violence and child abuse cases are caused by alcohol in the home? Why not just send the Gestapo through everyone's front door to make sure parents arent beating their spouses and kids senseless while drinking. If its truly about safety, why stop at DUI checkpoints? Wow, so drunk driving is the leading cause of crime-related death (since the first 17 items aren't criminal). We need more of these checkpoints; 32,000 killed from drunk driving every year is WAY unacceptable.
Andrew S. If you want drunk driving deaths reduced than you should be all for eliminating DUI checkpoints. They are only used for publicity and citizen compliance indoctrination (getting the people used to following government orders). Checkpoints only catch a very small percentage of impaired drivers compared to normal patrols by officers. Look it up, if you don't believe me.

I have no problem rolling my window down and telling the officer I had nothing to drink and sometimes engaging in short conversation so they can look for signs of impairment when I know it's saving HUMAN LIVES. Putting aside for a moment the fact that being stopped at a DUI checkpoint rarely involves more than answering a few questions, so can hardly be considered a search or a seizure, how can one possibly argue that it is "unreasonable" when TENS of thousands of people are killed each year by drunk driving (as provided by Ceadus34 )? The police aren't looking to search your car, or you (unless you are caught for being impaired, in which case you're subject to search incident to arrest). Peter Hunsader No .. the cop asked if he had a driving licence .. and he had to present it. If you drive a car, you are obligated to prove that you have the right to do so by having a valid driving licence. That goes for any countrys laws (that has trafic laws of any sensible sort).

I love the officer claims he could have lawfully evaded the checkpoint. This is sooo false. There are many times, and i know this because i have stupid friends who have fallen for it, that they put up indicators that there is a drug check or dui check ahead. But there actually is no checkpoint and 99% of the cars drive through and are say to themselves "wtf where is the checkpoint?" and continue on their ways without being confronted. They are sometimes referred to as decoy checkpoints. So there are multiple patrol cars set up around the signs that say dui or drug check ahead. And they only stop the cars who turn around or take a side road. Usually these people are guilty of possessing drugs or driving under the influence which is why they do it this way. My buddy was drinking one night and saw one of these signs on his way home and was pulled over due to suspicious activity because he had decided to not proceed through the decoy checkpoint. A common practice all over the U.S. I have even seen something similar on the Alaskan State Troopers show on National Geographic.
The towns down the road from me, operate DUI checkpoints certain weekend evenings. I have see the signs and turned off way before. Not because l am DUI, but because l am disabled and have a hard time getting out, if asked. However the one time l didn't already know, and drove into the checkpoint, they were nice, and let me drive off.

They want you to know cause most people will get their DL out. On an interstate it warns you of a delay or slowdown and why it is happening and to be careful, watchful braking etc. If you are drunk and avoid it and don't get caught I guess you are just lucky. That's hard to do on any controlled access highway though. They're probably just doing it cause the BRASS want more tickets...most cops don't live to write tickets I never did. If I wrote or made up 6 a month that was pretty good for m an a lot of others too. HUH? Fuck all that going to the magistrate when you are asleep in the daytime.....or anytime when you are of for minor BS that cops do everyday all day long driving around for 8 hours....seems a little disengenuous huh? For all of you that agree with the guy driving, he drove into the DUI Checkpoint. He had the option to turn around, no one forced him to go through it. If he was up to snuff on the laws, he would have known that if he enters the checkpoint, he's subject to the police determining if he's intoxicated or not. If you were a cop and someone was acting like this guy, wouldn't you suspect they have something to hide? Because that's generally what being defensive implies. They have cops watching the sign just for this reason. Once you see the signs you are committed. You will be dealing with a police officer whether you want to or not. So no, you have not made your point. We have the right to remain silent in this country. You can call it "being defensive" but refusing to answer questions can't be used as probable cause. That right does not disappear just because you've entered a police checkpoint.
OK. The laws may vary from state to state, but in Rhode Island, you can hook a U-turn before entering the checkpoint, legally. I've done it myself and I know my state's laws. It IS being defensive. You're defending your rights, aren't you? Defensive is the tone, not the words chosen. I understand that not answering questions isn't probable cause, but if you're not drunk, why not? I'm not sure I understand what the point is in refusing to answer the question "have you been drinking?" After all, you *did* answer the question "do you have any weapons?" If the question had been, for example, "can I search your car", *then* I would perfectly well understand a negative answer. That goes well over the line, and is often abused by the American police, and citizens have the right to refuse searches without a search warrant (and they really should.) However, "have you been drinking?" is not a question that makes sense to refuse to answer, even on principle.

Can you actually show me a reference of how harsher penalties have reduced accidents involving drunk drivers somewhere? When people get drunk, their judgment and reasoning capabilities are reduced. Do you really think that they are thinking about fines? (The most typical thing that goes through their head is like "I'm not *that* drunk... it's just a short distance, I won't even get caught. Besides, I'm such an experienced driver...")

Cops usually take advantage of people that don't know them, and make up their own. So I strongly suggest anyone and everyone should at least brush up on some basic laws and rights. I'm all for keeping drunks off the road. The problem here is that the cops don't even seem to be familiar with the very laws they're enforcing. The guy in the video didn't do anything wrong; it's the cops trying to throw their weight around and violate his rights that's the issue here. He's not obligated to answer any questions or step out of the car, yet they try to force him to do so against his will. (Because they're letting their ego get in the way of doing their job professionally) Fact is, we're living in a police state, courtesy of the NDAA, The NSA, and The DHS. If we keep giving them an inch here and an inch there, we'll have no ground to stand on before long.
Yes but with that same logic you're making these checkpoints redundant. No one is obligated of course, this is America home of all that is free, but at the same time the questions asked are not imposing of your rights. If there's a threat on the road who goes through the checkpoint, refuses to answer or cooperate with something as simple as "You been drinkin?" and then that same person continues on and ends up hurting someone; a lot of questions are gonna be raised about why the cops didn't stop him and at the same time a family will be hurt. There are better ways to show up cops but this way (which isn't actually invasive, at least where I'm from) isn't gonna do it.

But as it it stands, these people are within their rights to not answer any questions and not step out of their car. It's the whole idea of being "guilty until proven innocent" that rubs people the wrong way. If he isn't obligated to step out of the car or answer any questions, then the officers shouldn't "bend the law" by coercing people into doing things that don't have to do and treating them like they've automatically done something wrong. Also, bringing over the canine to smell his car without a reason to suspect him of hiding anything is a little excessive. Just my 2 cents.
Well we all know the Fifth Amendment states that you are not required to incriminate yourself but there is no law that says a police officer or any law enforcement for that matter is required to tell you the truth. Not many people know that an undercover cop can lawfully ingest an illegal or controlled substance while in the performance of his/her duties. The whole DUI checkpoint is an illusion. Those check points are a violation of the private citizens rights to travel, 4th and 5th amendments etc. Today it's supposed to be for driving under the influence. What will it be tomorrow? If you don't wake up and smell the coffee you may find yourself going through a check point just to get in and out of your neighborhood or to go from one state to another....don't take it lightly..

If the police came to your door and started asking you personal questions, would you readily answer? Then, if they wanted to search your home, would you readily agree? And if you said no, would you have said no because you had something to hide or because there are certain things that you own and no one else, not even the police for a good cause, have the right to access? You own personal information just as much as you own your home or property. And in some cases, it is even more valuable. This man was protecting his own personal information - whether you felt it was important information or not - he does not have to hand over ANYTHING just because a representative of the government demands it. It was the drivers choice - and he chose not to share.
Nick H There's a difference between a cop asking you to do an alcohol breath check while driving, and a cop asking to enter and search your house, or get naked, or some other act that WILL violate your rights. You don't need to refuse to answer questions in this situation unless you're guilty and poor. Agreeing to it will speed the night up for everyone, and you can either go about your night without irritating anyone or you learn a lesson that will hopefully prevent you from driving under the influence again. If all drunk drivers could get away with this, more people will die on the road.

These cops were more than reasonable. You drove, on a public street, into a check point. If you were trying to prove some infringement of rights you failed. These guys were out there trying to take people off the road who otherwise account for several deaths of innocent people each year. There are plenty of ways cops might step over the line and abuse their power but this wasn't one of them. Kudos to the cops.

Unconstitutional is what they are. You can spot a true DUI a mile away, it is laziness to just sit in one spot and try to catch criminals, especially when drunks have the option to turn around and drive away.

I never agree with the titles of these types of vids. I didn't exactly feel the officer got OWNED, but to each their own. I still found this educational. I had always wondered what someone's rights were, in regard to DUI checkpoints. The police officers in this video, came across as very professional. The gentleman in the car was appropriately assertive as well. Good job.

Police are not allowed to violate your Fourth Amendment rights, and traffic stops are considered a "seizure" of everyone in the vehicle under the Fourth Amendment. Without probable cause, the police cannot do anything to you at a checkpoint. I would encourage anyone who isn't clear about what constitutes probable cause do their own research to determine for themselves what the limits of police actions during a traffic stop are.

People are missing the point. We have Rights for a reason, and people need to know what those Rights are. I see the point, but in *this* case the police officer was being polite and simply trying to get on with his night. Yes sometimes the police are hard to deal with and there are officers that are corrupt and sometimes themselves feel above the law. However, like us, they are humans and we cannot generalize them as assholes just because of the actions of a few. I think in this case instead of trying to prove that he knows his rights he should have gone on with his night and answered the few questions he was asked.

fourth amendment only protects us from unreasonable search and seizure... if they are checking everyone or a pattern of persons on the road it is legal under the 4th amendment. They would need probable cause to pull you over or target one person.

I don't see any harm in this situation displaying your License registration proof of insurance and disclosing to the officer if you're carrying a weapon if you are licensed or are authorized by the laws of that state to have a weapon without a license to disclose it. That helps ensure the safety of anyone because cops do not like people who make sudden movements. If they start asking questions you have a right under the Fifth Amendment not to answer. That alone cannot establish probable cause nor is proof that you have committed a crime. Exercising your 5th Amendment rights by themselves in itself is not obstruction of justice. If they had smelled alcohol in your car that would have been a completely different issue and that clearly would have been probable cause. The Fourth Amendment says unreasonable searches and seizures you are protected from. It doesn't say no searches and seizures at all. Also, many police agencies have special flashlights that can detect alcohol vapor in a vehicle when the light changes color. Alcohol as soon as it's exposed to the outside air quickly evaporates. If they start doing something against your will it's very important that you do not resist them but you do make it clear that this is not consensual. Make it clear that you're going to cooperate to avoid a potential resisting arrest charge but anything they do after you stop talking is being done without your consent. If they have probable cause that you have committed a crime, you do not have the right to not obey their lawful orders. If they said we smell alcohol in the vehicle and you refuse to exit. They can forcibly remove you from the vehicle. At that point they are giving you a lawful order. Resisting can be an additional charge in itself and constitute a felony depending on the level of resistance. You want to protect your rights that's fine but make sure you're careful. I would like to add that driving a vehicle is not a right it is a privilege. Driving a vehicle a requires a certain set of knowledge, skills, and ability. You have the right to travel absolutely unmolested unless there is probable cause one has broken the law. They only need Reasonable Suspicion to pull you over. That means "behavior that potentially indicates a law may have been broken". That's enough to pull somebody over but it is not the same level as probable cause. Weaving in traffic can create Reasonable Suspicion one has been drinking and driving but it's not probable cause. The driver having slurred speech and open containers of alcohol in the vehicle and smelling like booze that's probable cause. I encourage people to stand up city of Rights but don't be a douchebag or idiot when doing it. It doesn't take much to establish reasonable suspicion and once that's established it doesn't take much to establish probable cause.

Just because by law you have the right not to answer questions doesn't mean its a good thing to. In this case this is wasting lots of peoples time, and the end result is either he wasn't drinking and just decided to screw with a cop just doing his job, or he was drinking and was trying everything to get away with it. Either way, you shouldn't need to 'exercise your rights' just for something like this, you'll only aggravate the police and a lot of them do a great job remaining calm, but they're only human. That cop you refuse to talk to could save your life or your son/daughters life one day.

Andrew S. If you want drunk driving deaths reduced than you should be all for eliminating DUI checkpoints. They are only used for publicity and citizen compliance indoctrination (getting the people used to following government orders). Checkpoints only catch a very small percentage of impaired drivers compared to normal patrols by officers. Look it up, if you don't believe me.

This sort of thing makes me really mad. I lost a friend to a drunk driver. I have no problem rolling my window down and telling the officer I had nothing to drink and sometimes engaging in short conversation so they can look for signs of impairment when I know it's saving HUMAN LIVES.
The fourth amendment, which you quoted in your comment, protects against UNREASONABLE search and seizure. Putting aside for a moment the fact that being stopped at a DUI checkpoint rarely involves more than answering a few questions, so can hardly be considered a search or a seizure, how can one possibly argue that it is "unreasonable" when TENS of thousands of people are killed each year by drunk driving (as provided by Ceadus34 )? The police aren't looking to search your car, or you (unless you are caught for being impaired, in which case you're subject to search incident to arrest). Such a minor intrusion into one's personal life can easily be justified by the number of drunks that are caught at these checkpoints and hence, the number of lives being saved. I can only wish that the idiot who killed my friend went through a DUI checkpoint; she'd still be here if he had.

No .. the cop asked if he had a driving licence .. and he had to present it. If you drive a car, you are obligated to prove that you have the right to do so by having a valid driving licence. That goes for any countrys laws (that has trafic laws of any sensible sort).

I love the officer claims he could have lawfully evaded the checkpoint. This is sooo false. There are many times, and i know this because i have stupid friends who have fallen for it, that they put up indicators that there is a drug check or dui check ahead. But there actually is no checkpoint and 99% of the cars drive through and are say to themselves "wtf where is the checkpoint?" and continue on their ways without being confronted. They are sometimes referred to as decoy checkpoints. So there are multiple patrol cars set up around the signs that say dui or drug check ahead. And they only stop the cars who turn around or take a side road. Usually these people are guilty of possessing drugs or driving under the influence which is why they do it this way. My buddy was drinking one night and saw one of these signs on his way home and was pulled over due to suspicious activity because he had decided to not proceed through the decoy checkpoint. A common practice all over the U.S. I have even seen something similar on the Alaskan State Troopers show on National Geographic.

On an interstate it warns you of a delay or slowdown and why it is happening and to be careful, watchful braking etc. If you are drunk and avoid it and don't get caught I guess you are just lucky. For all of you that agree with the guy driving, he drove into the DUI Checkpoint. He had the option to turn around, no one forced him to go through it. If he was up to snuff on the laws, he would have known that if he enters the checkpoint, he's subject to the police determining if he's intoxicated or not. I'm not sure I understand what the point is in refusing to answer the question "have you been drinking?" After all, you *did* answer the question "do you have any weapons?"
If the question had been, for example, "can I search your car", *then* I would perfectly well understand a negative answer. That goes well over the line, and is often abused by the American police, and citizens have the right to refuse searches without a search warrant (and they really should.)
However, "have you been drinking?" is not a question that makes sense to refuse to answer, even on principle.

I'm all for keeping drunks off the road. The problem here is that the cops don't even seem to be familiar with the very laws they're enforcing. The guy in the video didn't do anything wrong; it's the cops trying to throw their weight around and violate his rights that's the issue here. He's not obligated to answer any questions or step out of the car, yet they try to force him to do so against his will. (Because they're letting their ego get in the way of doing their job professionally) Fact is, we're living in a police state, courtesy of the NDAA, The NSA, and The DHS. If we keep giving them an inch here and an inch there, we'll have no ground to stand on before long.
Yes but with that same logic you're making these checkpoints redundant. No one is obligated of course, this is America home of all that is free, but at the same time the questions asked are not imposing of your rights. If there's a threat on the road who goes through the checkpoint, refuses to answer or cooperate with something as simple as "You been drinkin?" and then that same person continues on and ends up hurting someone; a lot of questions are gonna be raised about why the cops didn't stop him and at the same time a family will be hurt. There are better ways to show up cops but this way (which isn't actually invasive, at least where I'm from) isn't gonna do it.

But as it it stands, these people are within their rights to not answer any questions and not step out of their car. It's the whole idea of being "guilty until proven innocent" that rubs people the wrong way. If he isn't obligated to step out of the car or answer any questions, then the officers shouldn't "bend the law" by coercing people into doing things that don't have to do and treating them like they've automatically done something wrong. Well we all know the Fifth Amendment states that you are not required to incriminate yourself but there is no law that says a police officer or any law enforcement for that matter is required to tell you the truth. Even if you have nothing to hide, when the police can violate your rights you always have something to fear.
If the police came to your door and started asking you personal questions, would you readily answer? Then, if they wanted to search your home, would you readily agree? And if you said no, would you have said no because you had something to hide or because there are certain things that you own and no one else, not even the police for a good cause, have the right to access? You own personal information just as much as you own your home or property. And in some cases, it is even more valuable. This man was protecting his own personal information - whether you felt it was important information or not - he does not have to hand over ANYTHING just because a representative of the government demands it. It was the drivers choice - and he chose not to share.
Nick H There's a difference between a cop asking you to do an alcohol breath check while driving, and a cop asking to enter and search your house, or get naked, or some other act that WILL violate your rights. You don't need to refuse to answer questions in this situation unless you're guilty and poor. Agreeing to it will speed the night up for everyone, and you can either go about your night without irritating anyone or you learn a lesson that will hopefully prevent you from driving under the influence again. If all drunk drivers could get away with this, more people will die on the road.

These cops were more than reasonable. You drove, on a public street, into a check point. If you were trying to prove some infringement of rights you failed. These guys were out there trying to take people off the road who otherwise account for several deaths of innocent people each year. There are plenty of ways cops might step over the line and abuse their power but this wasn't one of them. Kudos to the cops.

DUI checks are a good thing. Do you want to be killed by a drunk driver? If not then just tell him you are not drunk.
Unconstitutional is what they are. You can spot a true DUI a mile away, it is laziness to just sit in one spot and try to catch criminals, especially when drunks have the option to turn around and drive away.

I never agree with the titles of these types of vids. I didn't exactly feel the officer got OWNED, but to each their own. I still found this educational. I had always wondered what someone's rights were, in regard to DUI checkpoints. The police officers in this video, came across as very professional. The gentleman in the car was appropriately assertive as well. Good job.

OWNED, is a term that defines the officers "bully" attempts at unknowing citizens. And this citizen, knows the laws better than they do (which is sad, really, that a SGT wouldn't. He was polite, because he knew he was WRONG). Sorry, that you do not understand the terminology. They like to abuse our laws, when they can.

I certainly hope not. I also hope that if something like that does routinely happen where you live that you take action to fix it. Police are not allowed to violate your Fourth Amendment rights, and traffic stops are considered a "seizure" of everyone in the vehicle under the Fourth Amendment. Without probable cause, the police cannot do anything to you at a checkpoint. I would encourage anyone who isn't clear about what constitutes probable cause do their own research to determine for themselves what the limits of police actions during a traffic stop are.

I understand they are trying to keep the roads safe and do their jobs but it always makes me laugh when the cops in these videos ask if he's a lawyer.
Everyone THINKS they are a lawyer for simply understanding SOME of their rights.

Ironically, I trained various courses with FEMA. Really nice facility and some of the best training I've ever had through the Military. People are missing the point. We have Rights for a reason, and people need to know what those Rights are. Yes, had he just answered the questions he would have quickly passed through and avoided the whole situation. But, it is a very dangerous thing to surrender our Rights in the name of convenience. A lot of people have died to give you those Rights, don't be so quick to throw them away just to save some time.
So tonight the ID check, tomorrow dui check, the next night is name check with federal records, the night after could be police permission granting with your information of where and why you want to go. A slow process, but you will soon be conditioned to listen to orders and obey. Or just what this guy did, be THAT jackass and give a little hope to the country. Has anyone read their own State constitutions lately? I started reading mine and was so frustrated by the current abuse that I had to give up, and I hadn't even made it through the preamble yet!...
I see the point, but in *this* case the police officer was being polite and simply trying to get on with his night. Yes sometimes the police are hard to deal with and there are officers that are corrupt and sometimes themselves feel above the law. However, like us, they are humans and we cannot generalize them as assholes just because of the actions of a few. I think in this case instead of trying to prove that he knows his rights he should have gone on with his night and answered the few questions he was asked.
