If flat-buyers get angry with builders like Sunteck, that's NOT DEFAMATION, it's normal & expected

  • NRI flat-buyer Ganesh Manjrekar is an angry man. After Sunteck has forfeited his amount and unilaterally cancelled his registered agreement, allegedly because of fatal breach of agreement. Sunteck has sent him a legal notice because Ganesh launched an angry social media campaign against them. Ganesh maintains that the cause of his delay in payment is because Sunteck's lines of communication with its customers is extremely restrictive and one sided.
    I am publishing this video in the teeth of a legal notice, fully aware that I may get dragged into the same defamation suit that Sunteck proposes to launch against Ganesh Manjrekar. My reasoning is very simple: Sunteck may or may not be legally entitled to forfeit a common man's hard-earned money because of their cunningly drafted one-sided agreement proforma, but Sunteck is not lawfully entitled to the silence of the common man after forfeiting such an amount. To say that the common man must lose his money to a big company, and must suffer that injury and insult in silence, without a public outcry, goes against every tenet of law known to me.
    I believe Ganesh has a claim against the flat that he booked or bought, and until Sunteck refunds him in full, he has a right to publicly state and agitate his claim. If Sunteck considers it defamatory for him to say so, and for me to publish a video with him saying so, then I am willing to let the matter be tested on every lawful forum.

    Totally agree with your thought on Fairness. If we draw an analogy with car purchase, to buy a car of any price, you only pay a booking amount say 25K and company has to manufacture as per your spec and deliver to showroom for your inspection only then buyer agrees to pay and take delivery of car or may walk away if needed. A Car is more customized to suit a particular buyer than a Flat, still no legal case, threat etc. Why would a Flat/Builder be treated so differently in our system.

    *Suntech had very cleverly put a small bed in a fully furnished sample flat* ... It looked like a double bed on first view... But on closer inspection it was small bed with small sized pillows which made the room looked much bigger than it actually was.
    *They also said I cannot take photos of the sample flat.* Then I decided that it was not a VERY trustworthy but *a VERY suspicious company.*

    Wrong happened with us too. We have invested in sunteck maxx world. CRM was changed 4 times in our flat, due to which we lost 1.5 lakh rupees.

    The best solution is send Registered letter with Index II and Registration Receipt to the Deputy Regitrar where the Agreement is registered not cancel my Registration without my consent eventhough such clause is mentioned by the builder (is adjudged as unfair trade practice by the SC). Even if the Registrar Cancel the Agreement then Complaint against the Registrar in Thane District Registrar Administrative Office which is controlling all Registrar Offices in Thane District

    Krishna sir can you guide us for safe buying Land or Plots in outer mumbai or panvel or any other area. Means guidence of paper work and other precautions to be taken for buying land

      Pl note buying land especially near big cities is complex thing . When you are putting your huge money in land buying it's advised to hire a lawyer who will do 30 year land title search . Also the piece of land identified should be in the same zone declared by ZP / local body as that of you intent to use it . Ie Residential / Agriculture/ Industrial. You will need to consult an advisor who will provide you details of land reservation . These two things are very important.Other wise your money will be wasted .

    It is human nature to lose temper in situations where you feel injustice is being done to you. But it's best not to use foul language to a woman. Feminism is in full swing and women are quick to play the woman card at the drop of a hat. Consequently, the real issue then goes for a toss.
    In the case of Mr Manjrekar, he mentioned the paper work was being handled by his wife. He should let her go forward and deal with the company. In India it is always men who have to do the heavy lifting. If his wife utters anything unsavoury, the other side would not be able to play woman card. Let she also do some heavy lifting.

    Sir, maine ek ready possession flat pasand kiya hai. Uska completion certificate nhi aaya hai abhi.
    Ye ek investor flat hai. Flat owner mujhe bol raha hai 12% GST pay karna padega with stamp duty.
    Kya ek resale flat k liye GST applicable hai?
    Jab owner ne under construction liya hoga tab GST bhara hi hoga, to mujhe dubara q pay krna padega?
    I have a feeling, vo mujhse apna pay kiya huya GST wasool raha hai.
    Also, project mein ek litigation hai. Building ka construction complete ho chuka hai. CC probably 15-20 days mein aa jayega.
    aap thoda bata sakte ho kya hona chahiye?

    CRM ne Ganesh ko uksaya to gussa hoyega aur gusse mein gaali nikal jaata hai ...be it male or female they represent the company when talking to customer and customer uses words then it is against company policy not any individual.

    Totally agree with you sir, even I am also a frustrated client who experienced a similar situation but controlled my anger and avoided giving bad words but in the end, I paid the fine with a minor reduction in the interest rate.
    (minor reduction because builder's RM agreed (off the record - verbally) that they were responsible for the delay, and RM asked me to think this way that they loaned me that amount temporarily like banks do and charged me interest on that like banks do, but when I asked them to give the same in writing they refused to do so.
    To avoid future complications like in manjrekar's case we were forced to settle for the time being at least till possession is received I believed, but listening to you I have lost all hopes I guess If I go to court for this fine amount of approx Rs 45,000 fine that is charged to me wrongly, then it will be a bad deal for me only, even if I win someone else might earn out of it and I will lose even more then Rs 45,000)
    good thing I will be receiving possession bad thing I will have to continue such affairs and dealings with the builder in future too (since this one-sided agreement has some clauses which allow the builder to get involved in future society affairs too I think, i.e. controlling things even after possession)
    Came to my notice that the agreement seems to have been standardized by the government/rera but for future buyers, dost this means that old buyers will be stuck with this one-sided agreement for their life ?

    To jab women ke paise builders forfeit kar dete he. Vo builder ke according fair hota he kya.? Builder ke office se jo baat karegi vo women he. As customer paisa bharegi. Builder uska paisa forfeit kar dega ye bhi to anyay he builder ki taraf se women pr. Jao grahak jago.

    I am planning to buy mhada resale flats from first owner. He is having only allotment letter from TMC in the year 13th oct 2014 & MSEB meter but Society is under proposed and TMC is not separated property TAX .
    Pl suggest and guide me on the same . Eagerly one video on the same.

    I am not buying any flat in bangalore. Better stay in rent and settle in our village after retirement. At max how much I pay rent 25k that is fine with most of the employees. At least stay in peace.

    What can you expect if leaders like modi or shah ,all they how to win next election?
    They do not care how common man is suffering to get justice for 20 years.
    How lawyers work with builder to find loopholes to forfeit. These lawyers and builders should be punished with criminal charges.

      Ministers don't have any thing to do with people like us, we should verify the authenticity of any real estate builders before even giving a single rupee.

      @@dennisboscodemello2123 point is it is loksabha and rajaya sabha passes rights and laws so it all depends on the ministers if they do not fill gaps in laws and do not include these cases in criminal purview, then these builders keep doing be cause for them 6 lakh is nothing they pay you if they loses in court. But you include these forfeit in criminal cases then do not dare to forfeit common man earnings.
      Point is it has to do with law ministry to make sure to find what comman man facing and fix those laws or make them strigent punishment
