Sound advice. Most people who have the medical conditions that you referred to carry the proof with them (as do I). If it's a private car park, I show it to the shop/pub/whatever at the earliest opportunity. I take care not to abuse the privilege though, and check back with them before I leave. Then there is no palaver at all, and I have never been refused.
The contract is with the driver not the Keeper or owner . They need to prove who was driving . They paid they've paid the DVLA for the keepers details ... Charge them an admin fee if they want the driver details .
Daniel, I got a parking notice on my van in my own driveway, saying the van was over hanging onto the footpath. It overhangs a little, like splitting hairs, but doesn't cause any obstruction or hazard to pedestrians, and you can still walk on the footpath with no issues, I have appealed it, if I lose the appeal I won't be able to park on my own driveway because I will end up getting another parking ticket. The way my driveway is designed I cannot get the vehicle back any further, and I hit the wall of the driveway with my rear bumper, scuff all the bumper now. Been parking there for years, and now all of a sudden it's an issue, if I lose the appeal I won't be able to park in my driveway, and I carry expensive tools in my van for my job, when not working I can monitor the van on my driveway. This just makes me so angry, what with the cost of living crisis. It's all about making money, I personally feel it's stealing been made legalised.
@@aether-elephant it is, a short wheel base van, it had all 4 wheels on the driveway, it said on the violation ticket 62c my wheels weren't on the driveway, but they were, I took photos of it, then they said the front of my van overhang the footpath, but on the penalty charge 62c it said nothing about that, I emailed Havering council parking but they never emailed me back, in the end they said on this occasion they will overlook the matter. Then I emailed them about moving forward, and future tickets in my driveway, never emailed me back. It's all a scam, it basically is stealing been made legalised, to fill the council pot.
overhanging vehicles on footpaths is my pet peeve. i hate it. people often do this in supermarkets, reverse all the way back until the back wheel touches the kerb which is the pavement for pedestrians. you deserve a ticket, dont block pavements.
Dan , very surprised you referring to the action as a ‘fine’ Anyone else reading this just ask for the legislative requirement set out for a body requesting a payment , they do not like it up em 👍🙏
I don't have an excuse but I do have a reason. I was not parked at all, the two photos I have been sent as evidence against me shows the car moving and not in any designated parking bay. My Partner lives in a private block with it's own carpark in front, we had just done a big shop and as usual I stop in the carpark by the entrance to the building to unload then I wait in the car, turn it around and wait for my partner to come back down. I would have thought regardless of the carpark managements contract I would have some sort of easement right over that ground, my partner holds a leasehold in the building. Apparently there is a 10 minute allowance to be on the land but nothing in signage that supports it.
My son got a ticket, the app was not working and it took him 10 minutes to pay. He finally managed to pay for 3 hours but still got a fine. He appealed and it was rejected, he then appealed to POPLA and they said he must pay. He paid over 100£ plus he paid £6 for parking
All such fines are unLawful the English need to take the country back we are governed by insidious Foreigners from the City of London. Neither I nor family members pay them or council tax and there is absolutely nothing they can do. If you do get taken into their unlawful admin hearings you stand on the 1688 Bill of Rights which is our highest Law. To violate that holding public office is treason so they dismiss the case against you. Remember rules are not Laws and they can and will be broken when it's about robbing people of the fake debt notes.
Hi, Do I have grounds to have a Parking Charge Notice issued by a Private parking company if on the letter states the correct VRM but gets the vehicle make and colour incorrect?
I have a parking recipet, but entered incorrect registration detail in the keying machine, and eventhugh I provided the reciept , the parking company and independent appeal servive rejected my appeal. paying 100£ for making a keying error is unfair, although their T&C expect people to do this error. Keying errors are not intentional , do I stand a chance in court?
What if you didn't leave your car, but sat in a private business parking space when that business was closed for 1min 32 seconds while your passenger nipped into the shop in torrential rain?
Smart Parking have only sent a PCN to my boss as it's a work's vehicle. My grace period was 10 mins and 51 seconds! I have just received a copy of the PCN on the 20th day via email. I had already contacted them to ask them if they've penalised me or not as I was a little stressed as to whether I'd been fined or not! Maybe that was a mistake by me! My boss still hasn't contacted me! 🤔 Hope someone can help!
I had my permit at work fall off and got a fine in a spot I park in everyday. I explained that it fell off and sent them a photo of my permit yet they still insist I'm in the wrong. I would like to ask, do you think I have a strong enough case to appeal? Many thanks
I've got a question. I had a £120 carparking fine from Park With Eaze for not paying for a ticket at a local nature reserve. Now, the idea of parking fines is a punishment by financial loss, and also acts as a deterrent to never to do it again. So the company is technically employed partially as a punishment service to non payers. However, what if that fine isn't a punishment to me ? Two days after I paid it, my multi millionaire friend, stuck the money back in my account. So, technically, as a punishment service, its void. I lost nothing, it didn't punish me from that angle, and it wasn't a deterrent as I'm an honest guy and had always bought a carpark ticket before, and will always plan to afterwards. It was just this one time I didn't , so I don't the lesson in paying for my tickets. So on that front it failed as well. Which leaves the questions, who gained and who lost out ? The carpark company obviously gained £120, but for what ? The fine didn't serve its purpose , as it made no impact at all. The carpark company got £120 for absolutely nothing. Which technically kind of makes it theft. The only people who loose out are the nature reserve, because as a type of 'f£$k you' I'm no longer gonna use their carpark until I feel it again . I'll park in the village outside. So after all that, the carpark looses my custom, I've lost nothing because my friend stuck the money back in my account, and the carpark company gained £120 ...for providing a failed service.
Daniel, when you'll talk about ticket dispute you state that the motorist is at a mercy of issuing authority. Don't you consider a Civil Court an alternative for motorists ran over by the councils in their almost unlimited right to squeeze cash from motorists?
I would seriously think carefully about the stress and strain and time these issue's will cause you before taking them on.. Cause they do take a toll and a county court judgement effects your financial options for 10 years
@@IanMcFerran no I'm just saying be careful before you decide to do.. System is corrupt IMO.. Like casinos House always wins.. It wrong and system needs changing.. I was a taxi using a taxi lane and still got a ccj and fine increased 500% by going against it
Brilliant examples, providing the confidence I need when making an appeal. What about if the signage was too far away, too high up or unreadable?
so the bloke who owns the parking fine company also has a place on the board of the ipc , not that is corruption
Generating revenue that the public never sees
