I filed over 10 claims at once. VA approved 14 conditions in 6 months and 100% p&t. I had treatments and diagnosed in my records of 4 years active duty. I just wish i hadn't waited 30 years to file cause i was told i didn't qualify by the VA itself.
Filed ten but got approved for fourteen. Hmm ..... something not making sense here.
@@almoemason All depends on how it was claimed. I claimed rhinitis but the exam also showed sinusitis and was granted both. Maybe the claim was for "painful knees" and s/he got both knees granted separately?

Why did you believe you didn't qualify
I am a former VA claims examiner .... DO NOT file additional claims until you get a rating decision from the first claim(s). If you file and additional claim while you have one in processing those new claims get added to the original and your claim processing starts all over. Another thing not to do. Don't let the VSO go through your service medical record and file a claim for everything you went to sick call for. If you do that every single one of those will have to go through the rating process and a decision letter will have to be issued for each one. Not always, but we send out all the decisions from a single claims package at the same time. That usually means you are waiting eight or nine months to get your good claims decided while we waste time with bad claims. No One has 30 valid claims and even if you did VA math is not going to allow you to get paid for more than four or five.
@almoemason I just made that mistake. Had allergic rhinitis in for a while, but finally got my cpap after that. Was scared to hold onto sleep apnea too long. So I filed it while still waiting
What about filing a FOIA request while your claim is pending?

I received two continued, and one deferred. What does that mean?
Too late for me...I listened to a Claims shark who told me to do that. Can I ask for an immediate decision and try to expedite some of this. Have been in process since Feb and my intent to file OCT 2022. So far I only have rating for Tinitus. They are still process my PTSD claim and I have to appeal a lot because I didn't do the right things to win them.
One thing I do is I make sure that I very clearly name and date every file that I upload so that it is easy to tell what it is and the date I uploaded it. That way, the examiner can easily find it, and I can easily find it later 💁🏼♂️‼️

Should your medical records depict evidence, file it, PERIOD ! Evidence meaning injury/event/treatment received. DO THE BASICS FIRST, DONT ADD EXTRA UNNECCESSARY PAPERWORK AS IT WILL BOG DOWN YOUR CLAIM, additionally makes your C-FILE even bigger and just becomes another full file drawer the next time you have issues and/or more claims
So like my annual record reviews I shouldn't send them to the VA correct?
I have a lot of paperwork in my medical record that has very little information on it. Mostly qualified for worldwide duty that kind of stuff I was in the reserves 26 years.
In other words I should just send all the pertinent stuff correct?
The backlog is really big right now, so be prepared to wait

Hi hope everyone is doing well. I have a question regarding a claim that I filed for a neck condition. I file the claim an the current status is in evidence gathering and decision review. But here is where the question comes. In the updates it showed request for application ama review. Has anyone know what that means?

Yes. If your condition requires it get X-rays, MRI's ect... Sick call is enough.
Go to sick call multiple times for your conditions too. Build the evidence
Can you re - file like what I mean by that is say you didn't file correctly cause I filed before I started watching your videos if I don't get a 100 % VA Rating can I try again ?
Did 25 conditions for everything in my medical record. I filed in April of 2023 and only received 2 appointment so far
I did the same thing when I got out and was also only scheduled for 2 appointments. One was a mental health evaluation. The other appointment was for all other physical claims at once. It took almost 2 hours to complete.
Either of y’all ever receive a rating yet?

Jeeze what a waste of EVERYONE'S TIME! Your time, the VSO's time, the claims examiner's time, and the other Veteran's with valid claims that have to wait for the claims examiner to finish rating your bullshit claims, before they can get their claims decided..
@@Skritman after my initial appointments, I was rated at 60%, which is what most of my friends end up with too ironically. I’m at 100% now, since I’ve educated myself on the process.
I am still active duty and separate in 6 month. I was recently diagnosed with carpal tunnel on both hands. I have numbness and severe burning sensation in both hands. I am trying to submit my claim ASAP to get the ball rolling, but I was referred to occupational therapy my eligible date to submit my claim is the 12th but my OCT appt is on the 26th should I wait to file because the therapy isn't on my record? Submit everything but carpal tunnel? or submit it anyways?
Yes, there are folks on your base that can submit your claim prior to discharge. BTW Carpel tunnel is considered a CURABLE condition, usually with surgery. You would probably get rated zero percent, but you still want to do that in case it comes back.
Got a question, if I have a secondary that's linked to multiple primaries. Which primary would get the increase in rating, or would all of them get a bump. E.g. Sleep apnea with cpap. Secondary to PTSD (70%), rhinitis (10%) and tinnitus (10%).
If you file multiple claims at once will they assign one rater for all the claims? Regarding filing a secondary to a condition not service connected yet, can you just note in the personal statement that your not service connected yet and to please rate that secondary after the non service connected disability is rated so you can preserve that effective date instead of filing it later?
I believe it is the same tater for all your conditions per claim. Yes, you can, I just wouldn’t recommend spending thousands of dollars on nexus letters if the primary isn’t SC yet
@@vaclaimsacademy I filed eight conditions on one clam, and none of them were service connected. From this degenerative disease, disc bulge, osteoarthritis, radiculopathy, SI joint dysfunction, and I might be missing a couple. I got the results of my CNP exam and six of the eight said they were at least likely not related to my in-service injury. I did have a massive amount of evidence from a chronic diagnosis in the armyto continuous treatment for 30 years to several current diagnosis. So I am hoping is I will get rated for something on my back with other things as secondary. I’m just over three months so I imagine I have a long wait still.
Yes to the first question. Putting that other info in your personal waste of time statement is not gonna help. Put that in a "statement of the case" letter designating it as a secondary condition and leave it at that. Claims examiners know not to try and rate secondary conditions first. Telling them how to do their jobs is just gonna piss them off.
It depends. I filed for two conditions on the same application and they were granted on separate letters. It might have been that the exams were a couple weeks apart and they just did the one that was ready.
I am so confused on how you can file secondary to a non-service connected claim. I thought that was the reason why they call it secondary. Because it's second to a primary service connection claim. 😮
I have 3 low value claims that are taking forever. I want to file claims for sleep apnea, cervical strain and cervical radiculopathy asap before congress eliminates it. Would it be advisable to ask the VA to drop the 3 low value claims, then file the 3 higher value claims. I am 74 years old at am presently rated at 90%(86%).
Tuff one here... Bobber is in the water, may want to sit this out. Should current rating be weak could receive a decrease as no body is really protected 100%. If strong then good but are the three low value claims helpful ? I'm assuming secondary's for SA & cervical issues
Thanks Gene. The process can be overwhelming at times. It's good to get some outside input. My current status is 10% tinnitus, 30% R. Knee, 50% Depression/Anxiety, 20% Lumbar Strain, 10% X4 for upper and lower leg radiculopathy bilaterally and another 10% for the bilateral factor. I have 3 pending claims filed, one of which is a HLR for the opposite knee which was denied, a urinary urgency claim (deferred) that was a symptom during a back claim, and the last is a request for a temporary disability following lumbar fusion in June 2023. I don't think the 2 claims would get me up to 100%. I think that I will wait until the pending claims are settled then file the new ones. Thanks again. @@geneot4936
You’re already at 90%, if you qualify based on the 60% or 70/40 rule consider filing for TDIU to get to your 100%. There’s no age limit for filing TDIU. But all of your claims will be dated from your filing or intent to file date. So if they’re in you might as well keep them in.
@tamarraj Thanks Tamarra. I mistakenly indicated that I was retired. An award letter stated that I was ineligible for TDIU. I can only wait patiently until my present claims are settled, then I will submit new claims.

Is Insomnia its own rating or is it part of PTSD. I have a diagnosis for Insomnia but I’ve never claimed it because I thought it was grouped in with mental health and PTSD.
Its lumped into your MH claim. My MH explanation stated that.
Frankie is on fire, it’s a MH condition, so will be meshed into your existing PTSD claim. Maybe consider filing an increase on PTSD if you are rated less than 70%, and frame the insomnia as being a downstream symptom of your PTSD

How much do you charge for nexus letters if a vet has a doctor willing to sign it?
What about filing a FOIA request while a claim is pending? Will that slow down the process?
Good question bc they treat that like a claim when actually you're requesting records
@@NJGirl321 You are not getting usable records with a FOIA request ... It will take a long time and most of the info you need will be blacked out. Instead have an accredited VSO ask for your C-File or if you just want you medical records you can get them at a local VA or from you VA online MyHealthe Vet account

If I’m still in with 180-90 days left and want to use the BDD program should I file all at once?
I would definitely file while still active duty. At a minimum, submit an intent to file form.
You have up to one year after active to file and it still be considered service connected and presumptive. I recommend making appointments monthly to see your primary care to document your conditions.
Get buddy statements and copies of your medical records.
Definitely do the sleep study while you are in, if you have complaints about snoring - waking up choking and how tired you are after sleep. Honestly everything that has happened to you and you haven’t went to medical for start going weekly - I wish I could have done my last two years over again to document everything properly.
Should one letter address every condition or one letter per condition...
One letter for each condition.
5 paragraphs and no more than 1 page.
1) Background information and how you believe condition is related to your military service.
2) Talk about your symptoms on the worst day, frequency, and duration.
3) Tell about medications and any side effects of medication.
4) Talk about how conditions are affecting your home, work, and social life.
5) Summarize, tell them what you already told them in 1-4.

I believe in personal statements I always submitted one
I agree, I believe in personal statements. I break mine in 5 paragraphs and no more than 1 page.
1) Background info and how you believe your symptoms are related to military service.
2) symptoms, frequency, duration.
3) medications taken for issue and any side effects noted from taken medication.
4) Explain how issues impact your work, social, and home life.
5) Summarize, tell them what you told them from 1-4.
Keep it simple, chronological, and to point. These rater don't have time to read a book.

@almoemason I agree. But if most vets are like me, you walk out of the C&P exam, realizing I left important info out. In this case, if I forgot the info, there is a high likelihood that the examiner will read it in my statement.
@@sirbluv Nope. Personnel statements pretty much get ignored as the are not considered to be primary evidence.
@almoemason That depends on the rater. I am not gonna assume that they aren't getting read. I can only say that personal statements helped my case. If you don’t want to use them and you have been successful without them, that great. Personal statements are more helpful, then harmful, you decide.
You mentioned that you have Nexus letters/templates that our personal physicians could sign if they are willing. I just joined your highest membership level. How can I access those letters/templates?
I hope you know, that it is ILLEGAL to charge you for help filling and initial claim. It's very likely that what the VA claims academy is doing in their top level membership packages is illegal. Now it's legal to offer general advice and opinions and they certainly can charge for that. But the couching sessions they give are probably illegal. You may want to check out the VA's DBQs. VA DBQ into google.
My concentration and memory is bad.(tbi) I cant handle so many c&p and paperwork all at once. But if could dump everything, i woudo get 100% sooner (more money) but i been 19 years out, so whats another year missed?

$2400 for a DBQ/NEXUS. Wow! Our clients pay $300 or less for the Psych Eval + Nexus/DBQ. Then full body exrays are $135. Nexus/DBQ for each ortho issue is $200.

What the original poster was saying, is that it is usually not needed and one should not fork a large amount of money to get one [on the initial claim]. I agree. If you get denied then you pay to get one, if it will help. Then submit for a de novo review. BTW .... Having a different opinion or even being wrong, is not lying. DO NOT file secondary claims until your primary are awarded first. Because the rater will look at your secondary claim and try to deny you the primary in order to deny both claims. True story!
Exactly. It's like trying to buy a car without having a job...thats why it's called "secondary" it's secondary to a service connected primary. (Not to a hope and a prayer)
Bullshit ... This whole thing about raters trying to deny claims is a lie. There are two main reasons your claim gets denied. 1. You don't have proof a valid medical condition. 2. You don't have proof that it is the military's fault you have a valid medical condition. BAD CLAIMS = Denials, not bad claims examiners (well most of the time).
