In my situation there wasn't any case to pick up, same as with DJT's case over the loans. My lawyer didn't recognize it, he proceeded with witnesses testimony that would have put it into the jury's hands to decide and with the judge's jury instructions that can be a major deciding issue for jurys. I wasn't happy with chance and in jeopardy. I explained to my lawyer in trial nobody is accusing me of anything EXCEPT the state attorney, it's my right to put her on the stand. Back story, my GF got drunk and fell, hit her face on the night stand and knocked herself out. I hear it, came in and put her on the bed and then went and got ice for her face. She comes to, wants to see her face, looks in the mirror and freaks out. She became combative, I left the house. She continued to drink and call up people, eventually calling 911 and hanging up. 911 calls back and she says I either fell or someone hit me. Police arrived, police called EMS and took pictures, EMS transported to hospital, statement in ambulance "I might have fell" hospital discharged. 18 months later I'm picked up on arrest warrant issued by the state. Back to the trial, the jury convicted after 30 minutes. A month later at sentencing the judge threw it all away.....had to. It was totally baseless. Before trial the state prosecutor would not budge. She said it's her job to convict me for domestic violence. My record is completely clean, it's like it never happened. Erased. The facts supported the state was the accuser vs the "victim" changing their story.

Contrary to what the TV experts have said, I think Trump should testify. I have tried many dozens of felony trials and never have lost one where the client testified. Never, not once, including murder cases. Jurors want to hear the defendant. During voir dire (jury selection), lawyers often ask whether the jury will hold it against the defendant if he doesn't testify. Every time, the honest jurors will say, "Yes, because if charged with a crime they would want to tell their own story." Most defense lawyers kick those jurors with their peremptory challenges. Those jurors will believe the defendant who testifies. As to the claim that Trump would face withering cross-examination, I doubt that very much because in my extensive experience I have seen very few prosecutors with real trial skills. A few, but only a tiny few. The prosecutors never prepare for the defendant to testify. Good cross requires hours and hours of preparation. No one can do a good job if taken by surprise. Even moderately smart defendants make prosecutors look stupid. What do you think Trump would do to these chumps?
