What a pile of shite when she mentions your home. The cop shop is not the coppers home it is a place of work.
Wrong name it’s the pigshack.!
It's a Hard Listen: It sounds like a child is talking to you. Glad you won your case and I'm glad you published the winnings as it gives others the confidence to sue for abuse of power !!, With regards to any questions outside of this alleged offence I would go No comment.

Fook me, ITS NOT ENCLOSED IF ITS OPEN!! Makes no ends that it a police station.
Why did you not just keep stumm. Just say absolutely nothing.

@@StickAroundBennett I am, but the joy of being in Wales, these backwards hill troggs will all vote Labour
She’s nowhere near competent enough to conduct an interview for an offence she has absolutely no knowledge about.
They use a woman like this to take men off guard and ooen up..He said way to much , so it worked
She keeps saying enclosed, yet admits several times the gates and barriers where open as they where broken. Therefore its not an enclosed space, as you can just walk in through the open gates. Whether he knows they are normally shut and it's normally an enclosed space doesn't matter. On this particular day it was an open space and open access for any member of the public to walk in. What she should have done is accepted liability as its their duty to make it enclosed, they failed in that duty with the broken gates. Therefore NO law was broken. Previous knowledge doesn't come into it, at all
@@joeexotic5831 her reasoning was pathetic… “it’s got fences around so it’s enclosed” ….. ok brains 😂
@gj5900 Screaming at the screen, but it's got an open entrance, the fences mean nothing. At one point, she says, "But you know you're not meant to come in" ?? She really didn't have a clue. Open access doesn't mean if there is any fencing it's enclosed, it means if the public can just walk in at any point. Id sack her. She just embarrassed the police force if truth be known. She would be better just admitting that usually it's all enclosed, but as our entrance points were open, you haven't broken any law, I'm really sorry for the inconvenience caused. That would be too much common sense, though. They would rather be pig headed and pay a civil claim from the taxpayers' money. Had she admitted it was their fault and apologised, she may have avoided a civil claim. You only have to hope that some one with a higher level of understanding of the law and intelligence interviews the real criminals, as If she interviews a nonce, rapist or terrorist, they will likely be let free after her interview
@@joeexotic5831 the custody Sergeant wouldn’t have booked him in if the constables told the truth. Easy civil claim as the arrest was filmed and was clearly malicious.
If the barriers are up it is not in closed the female is talking a load of rubbish.
*enclosed
@@Phil-Sandsyou are right but if you listen carefully she does pronounce it as “in closed” a couple of times 😂
She Totally Embarrasses Herself.

@@StickAroundBennett Effing Farage is UK tRump. Reform very dangerous ,like MAGA.
Name them they are not sausages they are tyrant's. The money should come out of the cops personal funds not the taxpayers.
Unfortunately, their misdeeds do not cost them personally.
Yes...agree 100%. My council tax is a crippling monthly payment and then I see these thousands of pounds handouts, makes me so mad. Like you said, compensation should come out from the salary from the offending officer(s).
💯
@@noelward8047that’s because people do not know or have the knowledge of how to hold the man or woman personally liable to trespass
Exactly
Police logic: it's an enclosed area where the PUBLIC is not allowed in which a PUBLIC order offence was committed.
Good point, well made.
That is an excellent point! Should be the top comment. Marti, if you read this please pin it.
Vote Reform. No more Immigration. Britain First
How she could say on tape, that this was enclosed, With a gate open, is beyond belief. The intention may be to have an enclosed area, but if that is the case, maybe close the gate at all times. A complete joke of an officer of the law, trying to defend the stupid unlawful actions of a butt hurt pc who made an illegal arrest
Also, there was no way this offence was going to be made out as you would have to be on an enclosed premises with unlawful intent. Making a youtube video is not unlawful intent. This was just a retaliatory arrest because Sgt Sausage got butthutt. Hope Marti enjoyed his holiday courtesy of GMP.
trying to trip him up into saying he shouldnt be there
Enclosed is a area you CANT get into.
@JustAlex848 you've contradicted yourself. You say 'jump' a gate. Nobody here jumped anything. The gate was open which means it is NOT an enclosed area. It really is very easy to grasp even with limited English
Both of you guys are partly correct. Enclosed means an area that's surrounded/closed off on all sides. So ultimately the officer is wrong, with a barrier/gate up or open. It's not enclosed.
@JustAlex848 WOW your get more stupid by the second. The police called it an enclosed area YET the gates were all wide open which means it is NO longer an ENCLOSED PLACE. The very term enclosed means without opening. If the gates were CLOSED then the officer would of been correct in calling it a enclosed area HOWEVER all the gates were OPEN so IT WAS NOT AN ENCLOSED SPACE. What the hell your going on about jumping over fences etc I have no clue. That has absolutely nothing to do with my comment. It seems your more retarded than the female officer doing the interview.
@@DaleSteel He's just saying that you could get into an enclosed area if you really wanted to. I don't know with a tank or whatever. :D
He's taking the CANT that you put in your first post literally. But I guess by CANT you mean by law you are not supposed to go in, if it is actually an enclosed area.
Never talk to the cops without a lawyer
Why not ?
Because they twist your words and make things up, in order to stitch you up.
@@TheReverendJones-lv5bz It was videoed.
@@brenda1378 it doesnt matter if you admit to being in the wrong
@BUSHCRAPPING, hence why he won 🤷♂️ so he wasn't in the wrong
I see promotion to sergeant in fact a lot of promotion nowadays is for diversity rather than ability. Hence standards will of course be lower. From untidy uniform or hair to lack of communication skills and worse. The head of the Royal Air Force wanted the same and a high ranking woman Officer in charge of recruitment resigned on principle!!!
It should be on ability to carry out your job. !!!!! RIP UK.
She was not interested in the truth. Trying to put words into your mouth to their agender
Exactly, zip it law student. Until u have it lawyer present, rule 101 dude 😍😎😘😗😙😚☺😆😅
Should only talk about stepp8ng onto the carpark to leaving it.

Yes she really went down the “if it was your house scenario” 😂 proper ruined her
So silly. I didnt realise a police courtyard is their garden
looooool 😂 u should try doin stand up
I have no idea why people keep trying to use that analogy, oh yeah it's because they are stupid.
absolutely agree....she resorted to playground tactics 'my dads bigger than your dad'
Sargent should face a disciplinary panel & DEMOTED!
if gates are open its not an inclosed area as gates open
never say you understand, when talking to the police, its legal jargon for standing under their authority
i hear what you're saying but i don't stand under
They're quoting a 200 year old vagrancy act
@clementkirkpatrick4635
It doesn't matter how old the law is. The 1689 Bill of Rights is still on the statute book for our protection.
I use 1939 Ashby v Tolhurst to win private parking fines appeals.
@@tecnomagos.l.2684 you are correct, however the police were clearly looking for anything to pin on him and this was not the right one. It was clearly not an enclosed premise with the gates wide open also he was not carrying out unlawful activity. Police yet again ignorant of the legislation as well as the English language ie "enclosed"
@@clementkirkpatrick4635 Given she confirms that filming is not unlawful, exactly how they thought they could BS this to work is quite amazing
She tried so hard to make you self-incriminate. Unlucky lass
He did at times self incriminate. By saying "...Controversial videos"
He was really really stupid in this interview - given the context of him being a PINAC auditor. He should have remained silent, so that the interview would have been just her voice droning on and on.
He shouldn't have given them his name. And he should have gone in sterile, so they couldn't get it off his banking card.
@@lint8391controversial isn't illegal
Only give information pertaining to the arrest. Your whereabouts and how you got there prior is of no consequence.
@@agentsuperdave2191 ha ha yes!
All part of the game they play.
yeah i agree, gave far too much information. even speculating on others opinions and thoughts. talking about all sorts of nonsense that isnt relevant.
Give no information
How can she say “You know and I know….”, How can she speak to what ‘YOU KNOW’?
You handled that superbly especially to her leading questions.
4. The unlawful purpose found must amount to criminal activity.
5.If hiding in the backyard was to escape detection at the time that they were apprehended would not be an unlawful purpose because hiding from the police is not an unlawful purpose within the meaning of section 4.
Basically if they had gone through the law they would have realised it was an unlawful arrest a lot sooner but ignorance of the law is no excuse unless you're a police officer
That's a very diverse police station fair play.
Never say you understand to the cop's it actually means you "stand under" them.
Better to say I comprihend what you are saying 😊
I don't 'conprihend'.
Interviewed by a petulant teenager. Her mummy and daddy must be proud 😂
It's got nothing to do with standing under, that's a fmotl bull💩 argument...... 🙄🙄🤣
Tell me you get all your law advice from RUclips........🛎🔚
OMG how difficult is it for her to understand 'enclosed'.
Class yourself as an independent reporter.
FREEDOM OF PRESS.

Smashed it lad 👌 fair play,
Peace and respect 🫡
First question from her was weird, 'How did you get here, whose car,' non of ya business tbh.
Well done Marti--!Good brave community journalist me thinks!!
Good for you young man!
Of course it was Oldham 😂
Not enclosed it was indeed an open area
Why dose that woman keep telling him what he knows ? What illegal activities took place ? 👮🤡
This is the UK different rules to India mate 🌭
IF the area is easily accessible with no physical obstacle or barrier then there is no offence committed, the fact that the gate is broken is in your favour.
NO COMMENT IS THE BEST WAY TO GO ALWAYS
Enclosed area of its fenced off all way round 🤔 technically that means any shop with its doors closed but unlocked would be an enclosed area by her logic
Great to see how dilligent the police are, the efficient use of valuable police time, ensuring the safety and rights of the public are protected.
An FOI as to the cost of this exercise would be interesting, how many officers X how many hours, plus compo etc.
The public dont pay for your garden. WE pay for the police station.
This interview highlights just how thick and stupid the Police are. Comical. As stated by many here this money should come out of their own pockets. Then maybe they will think twice before they act unlawfully. Of course nothing will happen to any of the feral involved in your arrest.
Absolutely
Inside an enclosed area when the gate was open, making it no longer enclosed 🙈🤣
It has to be 'for an unlawful purpose.' - You cannot split the legislation like the interviewer did. Quote 'You were found by a police office in an enclosed premises' 'I would say you fit that offence!'
Watching from New Zealand 🇳🇿. Stay safe my friend.
Well done Marti, have fun spending your money! I hope the tyrants learn from their stupid mistakes but I wont hold my breath.
Tell you what Marti, that's BRILLIANT. What a result , you told them CLOWN coppers off good and proper and got 2.3k for doing it , very well done can't fault that 😂😂😂😂 , that's a good day's graft keep up the good work !
Your a legend love it
Thanks to Oldham police station for Funding Martys Holiday with his Lovely family , God Bless yee 👍
She kept making assumptions on what you knew in relation to an enclosed space, stating that you knew you were in the wrong, Place was open, min would be tresspassing, Her questionig and assumptions would never have been accepted in court.
She's baiting constantly. Telling Marti what "he knows"..
They hate being filmed . And they will do anything to intimidate and incriminate a member of the public.
i see now why they say you should have a lawyer when going to a police interview
And why "Don't talk to the police" is the best advice ever in this context.
cop question 'what di yu have on you at time of arrest' I would have said ask custody Sargent they made a list
Seargent sausage 😂😂😂nice 1 m8,holiday on the police,mint 😂😂😂
Criminal justice act covered everything and so compensation was due
Marti, you must be laughing £2300 pay out plus the advertising income on the video. Well done to you
well done you keep up the good work love the vids
Well done Marty. Owned the interviewer as well. 👍
Desperate for a conviction rather than the truth , this is why we need policing by consent rather than policing by aggression.
Am genuinely surprised that went to court.
Marti you came across extremely articulately.
I think the take home message here for the police is that if you don’t want people wandering in your yard shut the gates and barriers 😆
Definition of *Enclosed* - surrounded by walls, objects, or structures.
Definition of *Surrounded* - to be everywhere around something.
Definition of *Everywhere* - to, at, or in all places or the whole of a place.
Summary - The car park was not *enclosed* as it didn't have walls, objects or structures *surrounding* the car park *everywhere.*
It amazes me that when cautioned people do not respond: by warning the police "you are interviewing me, and if you do not ask a question that may support my defence (exculpatory evidence) which you the police fail to consider, then it may harm your prosecution as the court may wonder why you failed to ask such question at the time."
Enclosed definition in Oxford definition is surrounded on all sides
Really well handled Marti. Personally I would have used no comment a lot more but then again you know what you are doing.
I thought he handled it terribly. Remain silent means remain silent.

From now own I want to see 100k paid by police forces for thise stupid arrest. Every time ego becomes bigger than actual law I want to see 100k fines!! Handled like a boss martie. Hats off! Let's just make it bigger and better now. Too meny time this happens all over the country. And until a big man stands up and asks for big money this will never end. So the next time stand up for everyone who encountered this ask for big money. Hopefully this will train officers across the land with such a high profile case to learn the law 1st before make stupid decisions. Sausages
£100k out of the public purse eh? Genius
No wonder our council tax is so extortionate 🙄
Which university are you studying law at? And do you really think, with your criminal records you'd ever get work at a Lawyer?
People with criminal records can become Lawyers. Sure it can be more difficult. The specific circumstances are key however. It's not an outright blanket no you cannot become a Lawyer.
Absolutely your criminal record does not stop you in any way from so unless you have specific convictions that does ban you.
However, having a record, you can be fully trained and accredited, but a firm is unlikely to take you on so you have to work solo.
The charge was obviously never going to be successful. There was no ‘unlawful intent’. The custody sergeant should have refused detention and possibly saved the force some money.
Like an ex copper told me 'you can always find a stupid one'

We shouldn't be 'surprised' that this officer doesn't know the definition of 'enclosed' and further doesn't know the law.
She was trying to lead you down an "enclosed" alley! When is enclosed not enclosed... when it's open. 🤜🤡🤛
@15.43 'You know & I know that IF THOSE GATES WERE DOWN, that's an enclosed area and you know it'...
-Should have read the Caution right back to her at the start...
So she admitted the gate was broken; in one can only assume in an open position.
So an inferred right of access is available.
Watching this again I bet SVR the solicitor who got struck off for fraud listed to this .
Got to 'love' the police, going for a subsection of a 200 year old vagrancy act...
money should come from there penshion pots
champion....
When she said that you fit the purpose of being in an enclosed space you should have put on record at that point that you do not agree with her or they could claim in court that you hadn't challenged that opinion when questioned.
Was the interview constable wearing a thin blue line? Twisting the situation and words.😎

The law only applies unless your police office, then they can make it up as they go along. Definition of a public place is unambiguous, unless your a police officer of course.
