    What makes sense if her story is true, she would’ve ran out through the garage!
    Remember, they were packing up a truck so I believe the garage door was open and the door from the house into the garage was open so they can go back-and-forth .
    When you’re carrying boxes, you struggle to open the front door so you go through the garage that’s what makes sense !
    What does it make sense you have a gun/on that hamper with a 3yrold running around the house … that doesn’t make sense.
    What doesn’t make sense is that your house is completely packed up yet your guns are not locked in a box on the truck . This doesn’t make sense.
    What doesn’t make sense is why when she ran into the bedroom she didn’t shut the door and lock him out .
    Running into the bedroom and grabbing a gun doesn’t make sense.
    What does make sense is a plan to shoot?
    She has him come over to her house .
    She has mom and baby out of the house at the park .
    What’s left in the house is a couple of last-minute items and two loose handguns ..
    Empty house
    Two guns
    Him
    Her
    She wanted to be free of him, and because of their daughter, they are attached for the rest of their lives 🤷‍♀️.
    If Something doesn’t make sense… you can pretty much bank on the fact that it’s not true.

    The stragest thing about closing arguments is that the prosecutor changed their motive 3 times by that time:
    Opening arguments they said she killed him to prevent the report from being disclosed 3 days later
    When it was proved there was no report being disclosed they said it was the custody injuction.
    And in closing arguments they said she killed him to keep the child for herself.
    So which is it? Which one did they prove?
    I really don't think the lesser charges should be admissible on trials, if the prosecution says they have proof of murder in the second degree and they can't prove it that should be it....

    • @Deepwld10
      @Deepwld10 2 месяца назад +3

      @@fernandaolivares7926 I got that too. But I believe that the true reason was because a judge in family court stated that she didn't believe Ashley. Three days after the killing they were supposed to be in court with that judge. Ashley was either going to loose custody or joint custody was to be made. But Judge Whyte wouldn't let the state to use the Judge ruling against her in criminal court. So I think the state had to pivote a bit on motive. I believe.

    • @darlingdeb7010
      @darlingdeb7010 2 месяца назад +3

      Hopefully the jury caught that. If the state can't figure out their own case, then they can't prove it. To me, they proved nothing.

    • @fernandaolivares7926
      @fernandaolivares7926 2 месяца назад +2

      @@Deepwld10 yeah, and that would further the motive of losing the child or wanting the child for herself...
      However she was already coparenting more or less in peace, why would she kill him if they continued with joint custody?
      Even if the judge didn't believe Emerson was being abused I don't think he had grounds to take the child away from her all together...
      I don't know, what I think is she wanted nothing to do with that man after what he did in South Carolina, it was hell knowing this guy was in her life FOREVER, she didn't want her daughter around someone who was still enfatuated after 3 years of being separated and who was no doubt starting to act out because of the new boyfriend.
      (Btw That is how most kids get killed or harmed by the exes)
      I think that night he did rough her up and she snapped and pointed the gun at him to get him to back down.
      I also believe he saw red when he saw her pointing that gun at him and that of he had gotten a hold of that gun she might have been seriously injured or worse.
      So it's kind of in the middle for me, she did want him gone but he would still be alive if he had not been violent in the past and on that night.
      So that would have to be a not guilty according to the law.

    • @drak0v
      @drak0v 2 месяца назад

      "I really don't think the lesser charges should be admissible on trials," - Totally agree. You see this all the time now and it seems so unfair. Bring the charges and prove them. Allowing a jury to pick from a list of charges without the defendant being charged with them is not right.

    • @cateellington6653
      @cateellington6653 2 месяца назад +2

      Are you new to watching criminal trials?
      Many murderers have multiple motives, for taking such an extreme action
      The Custody Injunction and wanting to have a child all to yourself can easily be considered same animal.
      I do think judges ruling hampered what they could argue, tho I agree with judge that the previous judges ruling & opinion was not admissible
      I believe Doug running out of money was a big part of why she wanted to leave him. But that’s hard to prove so hard to argue.

    Rebuttal attourney:
    "Don't be confused or distracted by emails and questions that showed you nothing"
    Mam, those emails and "questions"are evidence you misrepresented the evidence and showed your initial motive was BS so you had to change the motive mid trial!
    The way these posecutors take a NO and turn and say "well that was a clear yes, ladies and gentleman" is baffling and quite honestly insulting to the jurors intelligence.
    When you are sking the jury to basically ignore the evidence and focus and all the unproven theories and posibilities still sliding down the wall where they threw them, you have lost your case.
