      Drivers need to do the responsible thing. The moment they find out the company closed. Park the truck, especially if you can get a hold of anyone in office. If the insurance on that truck is gone... he will be screwed

      Yea in theory we all would do that. BUT in reality its not going to work out like that UNLESS you want to go to jail...If the next company you go to in the future finds out you "kept the truck" they may question you about it and it may not be a good look for you.       What’s happening is that lot of these companies are playing the shippers my old company did the same thing. They opened a sister company and would charge to bring the trailer to the yard and charge again to deliver it and lot of theses companies are going broke and to stay afloat they bidding under price to get the contract fucking it up for every other company who’s actually legit

    This is why I got my own authority. I’d rather hustle for loads and have to do a little extra paperwork than to be booted at anytime without pay. I’m my own boss. Through thriving times or my own failure, it’s my responsibility to learn the most I can for the success of my family.

    The drivers need to work together. Take any equipment that they still have in their possession to a secure lot, and contact an attorney. See if you can get a lien on the companies property until you are paid, in full.

      The problem is this drivers are not employees they are 1099.
      The building and equipments are all leased. The leasing company will take over the building and equipments. Technically that business is not exited so this drivers can’t go after nobody smh

    I know of a Company owner who filed bankruptcy and didn't pay anyone. Defaulted to contractors working on his house and cheated everyone he could. Two weeks after filing he was driving a new $115,000 Mercedes around town.

    Drivers abandon the truck and they are thrown under the bus. But if the company abandons the drivers the attitude is ‘oh well…’ even though drivers are left stranded, and that’s BS!

      Is not true they paid drivers every week but the problem is that you have to be on the road for 2 weeks and drivers notice that they missing 1 weeks of payment but they are in the road and can't do anything about that

    Went thru the same barely 1month ago. Homi declared bankrupcy to me when i got home from the expected current week's pay and$1500 owed in backpay. Had to negotiate for to get $700 and cut my losses. Figured it was better than $0 and sob story excuses.

    I worked for a company back in 2009 that suddenly closed down without any warning however some drivers including myself self were paid the week prior of the company shutdown and some drivers didn’t get paid. I really feel for these guys.

    That is shameful to say the least. Why would anyone keep working if they owe you more than a week??. Get together, contact the sstate attorney, file a police report then find an attorney and TAKE THEM TO THE CLEANER$$. Also many S Florida companies hire 1099 workers to avoid paying taxes or benefits. Remember 1099 is a contractor not an employee, the minute you use the company's equipment and do as you are told you are an employee. This should be sent to the State Attorneys office. These crooks need to be prosecuted. MIAMI CROOKS AT ITS BEST!

      It happened to us on the pipeline in West Virginia back in 2018 . We seen a helicopter hovering over our job site my coworker looked up the helicopter it’s from epa minutes later we all had to go the office we all got fired over another company that didn’t follow environmental rules . Guys still hadn’t bounced back from that .

    I got one of my first trucks by putting a mechanics lean on it for 1100 dollars owed to me. It’s easier than ever to file one. If you do it before they file bankruptcy, you have a great chance of getting your money, but if they already filed bankruptcy, they can seize the truck and after 3 or 4 years, you will get maybe 10 cents on the dollar they owe you.

    Unfortunately for the drivers they are going through this but the writing was on the wall January 20, 2020. Company drivers were warned but they felt safe under these mega carriers even some of the smaller carriers. They made jokes but who is laughing now 😢

    The people at the top of that company are cashing out . All the money those drivers earned in the past thirty days or so are going into the owners pockets. When the final deliveries are made they’ll shut down 100 % and let the creditors sue and fight over basically nothing in court. It’s a dirty game.

      Dont be soo sure ...rates have been soo low for soo long they may habe legit run out of money. When rates are below our operating costs its impossible to keep afloat unless you have huge savings. Not sure what happened in this particular case but dont be surprised if owners just ran out of money.

    I would only leave equipment at terminal bases or maybe approved drop yards. You don't need "abandoned equipment" on DAC report. Take video walk around showing tires and open the hood to show truck was complete. Inside cab too to show all there.

You can take a mechanic lien on a business matter not employers against employee. Don't need a law degree to know that. Most equipment is leased. So they aren't the people who owe you

    I know a guy when the company went broke they told him to bring the truck back he was done but he took it home and drained 200 gallon of diesel fuel out of it first because he figured he wasn't going to get paid kept him warm in the shop for a while at home😊😊

    Just went through a crooked company a month ago. I worked for them for 1 week because how fishy they were handling things. They STILL did not pay me my check and my buddy worked for them for a month. They only paid him 700 dollars 🤦🏾

    Reach out to your local labor board. They will help you get owed wages. If enough driver file, it can turn into a class action suit.

      I worked for a trucking company that close it's doors and didn't pay us, 2,500 drivers, our last paycheck. I filed a claim with the labor board and got paid. It doesn't hurt to try. Doing nothing isn't going to get you results either.

    when arrow trucking went out, drivers kept there truck, and legally sold parts off the trucks to get money back

      I remember that the flatbed driver's were selling all their equipment in order to get a bus or plane ticket home because Arrow just shut them down, canceled their insurance, and stranded all the drivers. I also remember some hitched a ride with other drivers back to their home state, and some rode with the drivers back to their terminal to start a new job with that company.

      That’s the best thing I’ve read so far. Great idea because the load board would only need the company’s name and other information that the drivers should already have. Just need to make sure the money is transferred to you. 😂

    Get yourself close enough to go home and then park it somewhere that is guaranteed to get towed. They will pay to get it out or the trucks will get sold to a more respectful company hopefully.

    I started to drive in 2010. We had loads from IL to CA and back. That was 1 trip. 1 trip was held as a deposit. My trainer told me from the start to never leave more than 2 trips in the company's account. To get a check we had to give trip report with logs during office business hours. Couple of times I had to pick loaded trailer from the terminal in the late evening or night. My boss knew he had to put BOL's for the next load with my check. I would not leave without it.

    The best you can do is to return the equipment to the yard, take pictures and video inside and out because if you keep that truck as a hostage you will get charged for stealing especially if the bank reports it as stolen, and instead been there wasting time you should jump into another company truck and start making money while you see what's going on if you you will get worse economic because 1 million dollar in payroll don't appear out the blue

    This shit happened to me with a company in Tampa.
    DBear Trucking.
    I was buying my truck from them via LP and had like 3 payments left.
    The Owner Dan just shut everything down and hauled ass to Atlanta without paying 10 of us Drivers anything.
    I found out that my truck was actually owned by the bank and he had no right to sell it and hadn't made payments on it in over 6 months.
    So I reported every little shady shit they did to FHP & DOT for all our Elog Violations where Dan was resetting our HOS to keep us in compliance while driving & working 18 hour days
