    Really great information. I need to make an update on my channel based on one piece of information you shared...appreciate that. Regarding the use of music that you do not have rights to. In most cases the copyright owner will just issue a copyright claim on your video and all ad revenue or partial will go directly to them. There are few that will demand RUclips to take down the video in which case RUclips will issue a copyright strike on that channel but it really all depends on the copyright owner. I would say that the use of music isn't always a bad idea, it's just best to know the copyright owner's rules and stipulations of use.

It looks more like they think the spam messages will contribute to making their comments look more "active" or something, and will often make a point of not removing anyone, almost ever. In my opinion I think RUclips should just leave content creators alone and let them have fun on their platform as long as it's legal content. Deleting someone's channel entirely is an over exaggeration, and these 4 issues you've pointed out can be dealt with in a more humane manner then to just unperson them. Although, since RUclips has become the grim reaper of free speech, I honestly don't expect anything less from them.

    • @danielels224
      @danielels224 2 года назад +8

      That solely depends on what the content of the video is. In most cases You Tube gives you strikes before they delete your channel. As for when it comes to creation of video's, Google are paying for the servers that are running You Tube and therefore we are obligated to follow their rules. We may not like it, it is just how it is. You Tube has a very difficult task of keeping the advertisers, the government and us creators happy at the same time. I do not envy You Tube CEO's job. You Tube is far from perfect but I believe that their are great people working at Google that will improve You Tube as time goes on and hopefully the guidelines and ways of making content will improve. To answer your comment You Tube does not just delete your channel they do however give you a strike depending on the violation. If you feel they unfairly gave you a strike you can always file a dispute. I would advise getting a lawyer's advise when doing that. I am not a lawyer. My point in all of this is that RUclips is not a perfect platform and that you channel do not just get deleted their are channels that need to go through before that happens and I do not think that RUclips will intervene if deem it necessary.

    Hi Nick, I've had some videos removed because of community guideline violations. Sadly there is no specific information explaining the exact violation. I assume based on limited explanations from youtube that they have been removed because in these videos some phone numbers and email addresses were visible. Most of the videos we make are private and can only be seem by our internal team. These videos are educational and help with the development of our software. What’s confusing is that I see many other creators post videos for their SAAS businesses and in their videos phone numbers and email addresses are clearly seen. Am I being targeted, or do I have the wrong type of account? Any ideas how can I resolve this situation? Thank you

    • @NickNimmin

      Private videos are counted as public videos when it comes to privacy, copyright and community guidelines. I think it's kind of silly that they do that but they do.

    I just found out recently that RUclips doesn't even like when you do a cover of a song, even if you created the music 100%. Their software actually recognizes the songs immediately. They have allowed my covers, and even the songs in which I downloaded the music & sang live. The "copyright claim" comes up immediately. Fortunately, all of the songs I've covered have been allowed by the copyright owners. On the bad side, if they ever change their mind & don't allow it, RUclips will give you a copyright strike, even though it was allowed when you posted the video.

    • @NickNimmin
      @NickNimmin  Год назад +3

      It would be super rare that once you get a claim that it would get upgraded to a strike in the future.

    • @JunkBondTrader
      @JunkBondTrader Год назад

      the claim comes from the owner of the song not youtube. All it usually does is send the revenue from the vidfeo to them, or, they can request removal of it which is rare. But if they do you you can remove it, all is ok. OR you can dispute it lol but if you lose the dispute you get a strike. I cover a lot of Elliott Smith songs, who passed in 2003. The owners of his music, whoever they are have been super chill. They claim some, and leave some alone completely, never ask for removal.

    I have always agreed with your advice .... I remember RUclips policy changes saying channels that were not commercially viable could be deleted...... I have intentionally used copyrighted music ... they do put a copyright content on the video taking away any monetization right of the video and usually place ads on the video making my channel commercially viable.

  • @chrisdunnettmusic

    Great tips as always Nick! As a professional musician that knows WAY more about Copyright than I wish I did at times (lol) YES...you are correct and it's a very common myth...the one I hear all the time is "you can use up to 8 seconds (or sometimes it's 8 notes)" of a song without infringing on the owner's Copyright and that is totally incorrect. There is no statute for the amount of length or the amount of notes.

    • @Enewerome_CQ

      Hi Chris. So I notice on some channels that they write something like
      Copyright Music
      Xyz by xyz (2020)
      Does this pass as copyright permission? If not, what can be done if you really need to use a particular non-copyrighted music?
      Thanks.

    • @chrisdunnettmusic
      @chrisdunnettmusic 2 года назад +8

      @@Enewerome_CQ Hi, no that does not pass for "permission" that is merely an acknowledgement of who owns the copyright. Some do that as their own "disclaimer" but that really doesn't protect you under law just gives you slightly better escape plan LOL
      The second part of your question I don't really understand? "Non-copyrighted music"? By definition that would pretty much only be music in the Public Domain such as a Mozart piece or some ( but NOT ALL) Christmas Carols etc... If it's Public Domain you don't need permission at all...you don't really even have to credit it but it's still the cool thing to do ;)
      The bottom line is if someone owns the copyright, get permission (which may involve paying a license or Sync fee - depending on the status of the song). The last thing you want to do is put a great deal of work into a project only to then get a Cease and Desist and lose that work.
      Fortunately though, and I can't speak for all, but many Copyright owners allow YT to monetize their music even if THEY are not the ones posting it. For example, (and this is JUST an "example" I can't say for sure) but let's say you use a Madonna song in your video. Can Madonna and/or her Record Label make you take it down? Absolutely! Will they? Probably not as they would rather leave your video up and hope it goes viral because they then will collect the money from their song playing in it. YOU wouldn't be able to monetize that video but they can. Again, I just chose "Madonna" as an example. Hope this helps, cheers,

    Seems like a lot of rules to make a tuff road harder than it already is, unless you're lucky enough to be one of the earlier content creators who are already where they need to be. It seems to become increasingly hard for new content creators to gain an audience, because these rules create a gate that separates people that are just starting from the ones who are already at the top. While they teach us to navigate a system, that's constantly trying to tighten the pipeline. Of course they're going to teach us ways to keep our failing channels, they have absolutely nothing to worry about. 🤷🏾‍♂️👑

    I have a question about the copyright section: I see tons of people posting pictures or film bits from movies all the time, each movie btw having that warning that no reproduction or redistribution cannot be made, and violators will be fined up to 250k and maximum of ten years in prison. So how is it they can be allowed to do this? I can't believe every single person has written permission to do so. One could argue that the legal owners of these films do not pursue these issues because they look at it as free marketing, but then again, many videos are showing why those movies suck. So how do these content creators get away with this stuff?

      You do not see the backend of their channel. They may have copyright claims on their videos and the copyright holders receive the ad revenue.
      Some channels, like movie review and commentary shows, may have a relationship with the studios and often are allowed to use trailer footage when discussing upcoming movies. The studios will often see that as a form of promotion/free advertising.

      Now that's not true. Fair Use does exists in UK and is called Fair Dealing. You can look more up on it on gov . uk, exception to copyright page (comments with links are sometimes held for review). Here is an excerpt:
      -------------------
      Factors that have been identified by the courts as relevant in determining whether a particular dealing with a work is fair include:
      1: does using the work affect the market for the original work? If a use of a work acts as a substitute for it, causing the owner to lose revenue, then it is not likely to be fair
      2: is the amount of the work taken reasonable and appropriate? Was it necessary to use the amount that was taken? Usually only part of a work may be used.
      The relative importance of any one factor will vary according to the case in hand and the type of dealing in question.
