- The Modesto Police Department in California released bodycam footage of Officers Sam Munsey and Sergio Valencia shooting Paul Chavez Jr., who was allegedly drunk and wielding a tow hitch on July 14. Chavez died at a local hospital. The footage was released after his family announced legal action.

It's interesting how the caller acted at first like it was just "some guy" at his door and not his son-in-law. I think there is more to this story than we are hearing.

I've seen probably hundreds of police shootings between this channel and police activity that were justifiable, and I can say in all honesty that this was an unjustified shooting. Not once did the guy brandish the object he was holding. Non compliance is not a justifiable reason to use deadly force. No attempt was made to de-escalate the situation. This cop needs to be charged.
dude, seriously. He was about to walk back into a house where he had previously threatened to kill people and he was armed with a deadly weapon. You don't let that happen... ever.

@@RobertPilla thats speculation at best. We don't shoot people on speculation. There was no indication of hostility, no provocation, no erratic behavior, nothing. A handful of steps to the right and he had bullet holes. That's not how police are supposed to handle things. IF he had made it into the home you'd have ground to stand on but he didn't and you don't.
He also was unfazed by tazers and ripped them out. Im guessing he was more than drunk.

call the police and tell them you are in fear of your life from a family member and then see how it ends up when your family member has a weapon and refuses to stop; what do people expect?
That moment you realize it's a Law and Crime video and not Police Activity where the entire scene is blurred out.
As a 20 yr veteran cop who was also a SWAT Operator and Defensive Tactics Instructor, all I can say is this was a very bad shoot. The guy was obviously drunk and could have been taken down easily, even with the tow hitch in his hand. He probably wouldnt have even noticed if one of the officers came up behind him. Not to mention they have pepper spray and batons which could have been utilized. I dont know if it is fear, lack of training, these days or even just looking for justification to shoot someone. But these kinds of incidents is what fosters a lack of trust of law enforcement and even hatred.
One of the biggest problems that happened in CA in the 90's was how police departments were so terrified of lawsuits that they started firing officers over the tiniest policy violations. They went overboard with the internal investigations following Rodney King in order to show the public that they weren't covering for their own. The problem was that when they did that it backfired. Basically when you immediately fire the officer for any violation, however slight, you are basically admitting that your employee did something wrong. This bites you in the a** when it goes to civil court in a lawsuit. So they learned the hard way (financially) that it was not the way to proceed. So what you have now is that no matter how egregious an officer involved shooting is (even when caught on video), they department will announce that they back the officer's actions and find that he did nothing wrong.

killed a father, brother, step dad, uncle, a person who probably could or was a leader of someone who looked up to them. All over a bad day and too much alcohol. How wonderful it is for cops to show up and shoot like its a shooting range. Don't be surprised when the same course of action is taken out on you guys and you end up in body bags.
I agree with bad shoot. But civil suit? LOL these cops rely on qualified immunity. And to be honest, why wouldn't they? You can shoot pesky citizens you're protecting and serving the f*ck out of all day long and not be held accountable for it.

California really should rewrite their laws and allow police more time to wait on a drunk who isn't actively attacking them instead of saying all calls must be resolved in under 3 minutes.
The long pause by the 911 dispatcher after the caller said: "no shirt" indicated that the she knew this was going to end very badly.

They would already be on the way even with the 911 operator on the phone with the caller. They would be updating police as they drive
It's all a part of the gathering of information. Police are dispatched immediately but 911 begins the process of gathering as much info as possible for them so that they are more informed when they arrive on scene.

Little quick on the trigger there for someone carrying a tow hitch. I've seen cops wait longer to shoot someone whom they suspected of carrying a gun. Crappy situation all around.

This is exactly why you should never call the police on your loved ones who are acting crazy or being aggressive. All you had to do is defend yourself and probably use a taser and pepper spray to subdue your loved ones.
One of the few videos on here where I say unjustified shooting.
It reminds me of the cop who shot the drunk guy in the hotel who couldn't waddle on his knees appropriately. That cop fled to The Philippines and has evaded all justice.

You forgot "How many facebook friends does he have?" While this is actually a pretty funny comment, I think they ask all those random questions to try and distract the caller a little since he said he was thinking about shooting the guy. She a very tiny window into the situation and since the caller sounds relatively safe, she is probably just trying to distract him from engaging the drunk guy until the cops show up (just a guess, I could be wrong). Unlucky this cop showed up. I generally err on the side of giving the cops the benefit of the doubt, but this one is pretty bad. I don't want that guy to show up if I call, yikies. At the very least his cop career should be over. Poor judgement.
Dispatchers are notorious for asking questions that were just answered by the caller! THERES A GUY WITH A GUN OUTSIDE MY HOUSE. Ok so youre saying theres a man outside sir? YES.. ok and does he have any weapons on him? YESSSS!!!! Jesus.

To be fair, a tow hitch is a blunt object, and can be used as weapon the same way a bike lock can. But in this case, he didn't pose a threat, so I agree with you on the terms of unjustified shooting.
@@seancombs1188 he was uncooperative. Had an item he'd threaten someone with. He was dangerous. If they had waited a little longer and had he ran towards a home, neighbor, or an officer. It's totally justified. This was too quick but never assume someone is not a threat because of their appearance. Ever. Cops shouldn't operate that way in my opinion. They need to be vigilant and cool headed.
@@KhamTVinc While I agree with you that cops need to be ever-vigilant (ESPECIALLY nowadays), there was no need to shoot the man in my opinion. To be honest, this video is muddied with grey area, since they fired the taser to no effect, and only had live rounds left as their only means of defense. However the man wasn't near anyone else, and didn't seem to have any intent (or ability, based on his stumbling) to charge them effectively. My opinion doesn't really mean much though since I wasn't there, and don't know how I would've reacted in the same situation.
@@seancombs1188 he was high out of his wits and didn't comply with orders. the taser didn't faze him so the only way to put him on (in this case "in") the ground was bullets.. even then it took a while before he dropped.

This is exactly why I will never call the cops on family or someone I actually care about, having a crisis.

A police officer should never bring more aggression into the situation than the situation is. Paul was calm and showed no aggression. The shooting was groundless and unjustified!
So the officers should've waited for him to attack them? No way! He didn't listen to any verbal commands. Would you wait for a wolf to shred you to pieces before you shoot it? I don't think so. The officers gave him more than enough chances to drop the weapon, he didn't comply and got shot. Very good reaction from the Officers!

It is only your assumption, and theirs, was that he was going to attack them. Clearly the man was inebriated to the point where all the officers had to do was out-finesse him and quickly apprehend him. When the taser had no effect (as is often the case with drunk people) the cops' adrenaline level was the only thing that got out of control.
No violent crime was committed other than the senseless killing by cops, who don't wear bulletproof helmets because they don't want to intimidate the public with a military-like presence, but will shoot a man simply for being too drunk to immediately comply.

He was advancing at officers with a weapon. He may not have been running at them full force, but he was tased and when it didn't work he picked up speed and continued to advance at them. Should they wait until he's swinging a solid steel pipe with a 5-10lb metal ball on it at their heads? Cops (and normal civilians) shouldn't have to wait until they are in mortal danger to defend themselves. This guy made the decision to get drunk , go out and get a weapon and threaten people with it. The consequences of his actions are on him.

What weapon ? tow hitch is not classified as a weapon .. he's not doing any swinging action with that thing that can make the cops feel threaten.. the pepper spray and baton is more than enough to tackle a drunk men to the ground.

That cop murdered him man. I mean a warning shot was all it would’ve of took to probably rattle the guy enough to calm down. But that cop straight up point blank fired off 2 rounds into that guy’s chest or head perhaps it looked like. That was flat out murder if you ask me.
No one asked you. You weren't there. And two shots fired. Two hits, and he still didn't follow their commands to get on the ground until he collapsed a full 20 seconds later. With his behavior, he'd have eventually hurt or killed someone another day.

@@828enigma6 The point is a cop using there service weapon should always be a last resort thing. He didn't have a gun just a tow hitch which can be deadly but only at very close range. He was far enough away and moving slowly so they had plenty of time to use other non lethal methods to get him down. That cop was to trigger happy. The only way i would have agreed it was justfied to shoot that soon was if he had a gun or other longer rang weapon then then what he had.

If it was you on your own property its most likely self defense, and the only way someone was getting hit was if the officer missed, those rounds aren’t going to pierce through him🧐 and he will almost never miss at point blank against someone moving like a sloth, but in the end it was unjustified.
@@thiccnsaltytv998 In a lot of states unfortunately, if you assault or kill someone on your property; you go down because you were "supposed to retreat or avoid the individual as best you could" before lethal force is used. You actually have to wait for them to come into your house. It call all be argued if you have a good enough lawyer though.

I've been tasered once when I was a kid while running from the cops. My muscles immediately lock up like I was frozen stiff and I couldn't breath. I fell face down with my arms and hands underneath my body. The cops then told me "Put your hands behind your back or I will shoot you!" while pressing and holding the button for 10 seconds at a time then releasing it. I tired to reply back but I had no air in my lungs to speak. After about 30 secs I was finally able to move my arms and put them behind my back. I was very close to being shot. They hit me right next to my heart. The next day I had a base ball size lump on my chest.

For the record, I HATE the police since they arrest people for "robbery" if they defend themselves against retail loss prevention and allow bounty hunters to break into our homes, but I'm sick of Police Academy dropouts like bounty hunters, loss prevention, bouncers, and armed guards being allowed to use lethal force when the real police aren't allowed to do the same.

Apparently people usually only fall after being shot because they've seen it in movies. Generally a bullet won't knock you down, but it also depends on the weapon used and the victims state of mind.

Wow...that went too far way too fast. One taser shot, no threatening actions, aside from non compliance, and he's shot in the torso two times? I think this defines excessive. It's absolutely wrong to no not comply with lawful orders, but was this worth executing him?
Here’s the deal. What he had in his hand could kill someone pretty quickly. Although some departments would have backed off and continued shouting the same thing at him I don’t really think that’s something they should be expected to do. When a situation like this is prolonged the danger to the public and officers present just grow. The guy had an adequate chance to determine that these officers saw him as a threat and to listen to commands.

There was a case here where I live, a family with a mentally I’ll son refused to call the cops when he acted up out of fear that the police would shoot him. The cops here are trigger happy too. The kid ended up beheading his own father in the kitchen one day.

He was in NO way acting as if he was going to hurt any of the cops. His last words before getting shot by them was "its okay". There were no sudden movements by him or anything. They literally shot him after telling him a few times to drop the hitch. That's murder. Just because you are a cop doesn't mean you can shoot someone after they fail to cooperate with your orders. That's NOT a license to kill. The cop who did this is just a pathetic murderer with a badge and a disgrace to humanity.

I watch these all the time and 99% of them are justified. This is definitely one where it seems like they went from 0 to lethal in no time at all. It’s gonna be hard to justify this by saying they felt in danger. They had distance, there wasn’t anyone else around to protect. He wasn’t moving towards them. He wasn’t complying, for sure, but he wasn’t a danger at the moment he was shot. They didn’t even warn him he would be shot if he didn’t drop the hitch.

I kind of agree with you that it’s stepped up pretty quick but you have to understand they taser it had no effect they gave him multiple commands he is the one at fault no one else. If you’ve got a gun pointed at you and you don’t comply it’s your fault if you’re shot. I told huge hitting someone in the head with that killed him instantly. Can you imagine if he hadn’t gotten one of the officers obviously he was feeling no pain the Tayser had no effect even being shot twice had no effect for several seconds. The bottom line is the cops are going to make sure they go home and they should. They’re just they’re trying to enforce the law this guy is not complying.
He was actually moving towards the cop who had tased him. Was that justification to shoot him? I don't think so. At the speed he was moving, the officer could have back pedaled at the same speed to keep his distance.

while i can agree with you on most of these points if you've watched enough of these like you said you have then you would know that allowing a subject who has threatened the lives of others to go into a house will lead to a hostage situation which is DEFINITELY not what you want, is it fully justified because of that? no but you fail to even take into account the potential hostage situation they resolved by not allowing him to go into that domicile (i dont even know if it was his house he was found laying down in the yard of the domicile next to the one he was attempting to enter when walking away from officers)

This was a case of horrible training, plus a guy who should never have been a cop.
The police shot him pretty quick. I understand that he was drunk but they didn't try to talk him down or anything. I know the taser didn't work, so they immediately went to shooting him. I normally support the police but not on this one.
I agree with you on this, but let's be realistic here . We are nothing but a bag of choices , he made a choice that day of drinking and causing commotion , and the cop made the choice to shoot .

I’m not a law officer and I’ve never been in that situation. That being said I’ve seen other videos where officers were confronted with even more aggressive individuals and they held off shooting and made the arrest. It’s all a judgment call but in this situation given what I saw from my layman’s perspective, I don’t think the shooting needed to occurr so quickly.
It wasn’t a gun and he wasn’t moving or making any threatening gestures towards the officers and his hands were in full view the whole time it’s not like it was done at night with uncertainty. They should’ve tried to use another taser Or perhaps a beanbag gun. That being said very unfortunate that it had to happen
