So does a nehmer claim have priorities over any other claim such as the Pact act and standard claims?

So here's my timeline: October '22 ITF, filed April '23, decision was made (denied increase, granted service connection effective Aug 22) Nov '23, HLR filed and denied Dec '23, filed supplemental Jan '24. Supplemental approved (100 P&T), May '24. The effective date they gave me was April, the date of C&P exam. Currently have an HLR in and informal conference scheduled for next week. Do I have a shot at winning the HLR for the effective date of Aug '22?

Laterally on the same wave. Filed an HLR as well. Thought the VA would retroactively award the effective date from the initial denial if disputing within a year since its continuously pursued. Good Luck!

So my question is when I received my reason for decision letter and from my evidence section I notice that there wasn’t any mentioned about reviewed my STR or C-File or private medical records in detail. I’m still waiting on my foia to obtain my current C&P exam results bc I went to an exam for chronic vertigo but nothing was mentioned about it in the denial letter but only talked about tinnitus which I’m already SC for in 2022. So I’m curious does this sound like a DTA error bc the VA is required to make a reasonable effort to gather evidence for the vet like C-file or STR evidence?? Also was it an error to be denied for tinnitus by a nurse practitioner vs an audiologist about my chronic vertigo??

About 10% of HLR claims go in favor of the veteran.
